DECLARATION UF EASEMENT AND
ROAU MAINTENANCE AGREEMENT
T`lais Declaration o€Easer�ent and Road Maintenance Agreement is made by and
between Stephen U. and Jennifcr L. RyIan.d("Granwrs") and Lxo A. and dudy A. Pre�iwitz
("Grantees").
RECITALS
A. Graniors own the real property and improvemeats thereon lega�ly described in
Lxhibit A{"Burdetted Property").
B. Gra.-ttees�wn the rea!prope�an�improvernents thsreon legaIly des�ribed i:�
Exhibit B ("Benefited Pragerty").
C. Grantees(or tiieir successors or assigns}intend to subdivide t�e Senefitect �
Property inia chree lots, and construct a paved road alosig ihe Southern edge of the Beuefited

constructed for this road.

D. The Grantors and Grantees wish to create an easernent for a fir.e deparanent
turnaronnd{"Tumaround")and pravide for the maintenance of the Turnaround by the current
and future owners af the Burdened Property and the Benefited Property.
DECLARATI4N
NOW THEREFORE, for good and valuable consideration, the Granwrs and Grantees
hereby declare and agree as follows:
1. Grant of Easement. Grantors hereby declare, grant, and convey to Grantees,
their successors and assigns, a permanent, mu.tual, and non-exclusive easement("Easement")
on, over, and under Ehat certain area of the Burdened Property legally described in Exhtbit C
("F.asement Area"). This Easement shall be for pedestrian and vebicular aceess, including
access by er�ergency vehicles, to and from the residen�ces tocated now and in the future on the
Benefited Property. The Easennent shall benefit the Benefited Property and barden tt�
Burder�Praperty.
2. Interference with Easemern. Grantors shali not materially interfere with, nor
impede, the intended use of tt�e Easement.
3. Construction. Crantees shall be responsible for all costs and expenses associated
with constructing the Turnaround.
4. Mainten�nce and Repair. Grantors shall be responsible for maintenance and
repair of the Turnaround. Grantors shall not be responsib€e for maintenance or repair of any
road ar�a on the Benefited Properry.
5. DestnEction. If the Turnaround is substantiaily destroyed by the Grantors, or
anyone acting on their behalf, imritarion, or license, tl� Grantors shall promptty restore the
Turn�around at their awn cost. If the Turnaround is substandally destroyed by the Grantees, or
anyone acting on their behalf, invitarion, or license, the Grante�s shall prompdy restore the
Turnaronnd at their own cost. If the Turnaround is substantiatly de.stroyed by neithcr the
Grantars nor tl�Grantees, or anyone acting on tlteir behalf, invitation, or iicense, the Grantvrs
and Grantees shall pro�nptly restore the Turnaround at their cost.
6. Covenant Runnin�with tt�e Laad. The Easement shall run with the land and
shall be binding on the parties. their successors and assigns; provided, however, that if the
roadway and other impmvemenEs within the Easement Area are dedicated to the local
municipality, this agreem�ent and declaration, tt�Easement, and the Grantors' maintenance and
repair obligations shall automatically terminate. If such a dedicatian takes place, Grantees shall
have a continucd riglit to use t�e improvements in the Easemeni Area for egress and ingress as
a matter of public right.

7. Autho ' . Each person signu�g this declaration and agreement covenants,
represents, and warrants that he or she has authority ta fully bind the eniity for v�rhom that
signatory purports to sign or which f�e or she purports to bind.
8. Independent Connsel. Each party regresents rhat he or she has reviewed this

9. Integration Clause. This is a fuIty integrated agreement. It contains the full and
fuial expression of t�parties regarding its subject matter.

Re: Declaration of Easement and Road Maintenance Agreement
As part of the construction on the Prellwitz site,the builder,Magnus Andersson of
Hanson Baker Ludlow Dnunheller P.S., has agreed to move the existing hedge over from
the Prellwitz side of the properly line to the Ryland side of the property line.
In addition, either the builder or Leo A. Prellwitz will replace the existing cyclone fence
at the southem edge of the benefited property with a 6 ft cedar fence. The fence will
extend the full length of the existing cyclone fence,and be extended to the start of the
hedge.
