This easement is far the purpose of constructing, improving, maintaining, and repairing slope stabilization facilities over, under, and upon the easement area, as described in Exhibit A and graphically depicted on Exhibits B and C, together with all necessary or convenient appurtenances thereto within said easement area, without prior institution of any suit or proceedings of law and without incurring any legal obligation or liability therefor. Following the initial construction of its facilities, Grantee may from time to time construct such additional slope-related facilities as it may require. This easement is granted subject to the following terms and conditions: 1. The Grantee shall, upon completion of any work within the property covered by the easement,restore the surface of the easement, and any private improvements disturbed or destroyed during execution of the work, as nearly as practicable to the condition they were in immediately before commencement of the work or entry by the Grantee. 2. Grantor shall retain the right to use the surface and subsurface of the easement as long as such use does not unreasonably interfere with the easement rights granted to the Grantee. Grantor covenants that it is the lawful owner of the property legally described on Exhibit A and graphically depicted on Exhibits B and C and that it has a good and lawful right to execute this agreement. If site development brings all ar any portion(s) of the said easement area, as described in Exhibit A and graphically depicted on Exhibits B and C,to near right-of-way grade or otherwise eliminates the need for this slope easement, then the easement shall be deemed automatically terminated over all or said portion(s) as the case may be. In that event, within 60 days following written demand of the Grantor(or Grantor's heirs, successors in interest or assigns), the Administrator of the City of Renton Department of Planning/Building/Public Works or his/her designee shall execute and deliver to Grantor in recordable form a written confirmation of such termination as to all or said portions of the easement as the case may be.
