The violation(s) listed below are deemed a Class 1 Civil Infraction pursuant to Chapter 7.80 RCW, and any such person shall be assessed a monetary penalty of up to two hundred fifty dollars ($250.00) per violation. VIOLATION 1: Fence Height Limits for Corner Lots Investigation Date 11/25/2020 Violation Note: Code Cited:RMC 4-4-040.D.3 Fences, Hedges, and Retaining Walls: Standards for Residential Uses: Height Limitations for Corner Lots Code Text:RMC 4-4-040.D.3 Height Limitations for Corner Lots: a. Front Yard Setbacks: Fences, retaining walls or hedges shall not exceed forty two inches (42") in height in any part of the clear vision area as defined by RMC 4-11-030, Definitions C. Fences, retaining walls, or hedges shall not exceed forty eight inches (48") in height within any part of the front yard setback when located outside of any clear vision area on said lot. b. Interior Side Yard Setbacks: Fences, retaining walls or hedges shall not exceed seventy two inches (72") in height within any part of the interior side yard setback to the point where they intersect the front yard setback, in which case they shall be governed by subsection D2a of this Section, Front Yard Setbacks. c. Side Yard along a Street Setbacks: Fences, retaining walls or hedges shall not exceed forty two inches (42") in height within any clear vision area, as defined by RMC 4-11-030, Definitions C, and forty eight inches (48") in height elsewhere in the side yard along a street setback. d. Rear Yard Setbacks: Fences, retaining walls, or hedges shall not exceed seventy two inches (72") in height within the rear yard setback except the fence, retaining wall or hedge shall not exceed forty eight inches (48") in height where they intersect the width of the side yard along a street setback or if the rear yard of the lot abuts a public or private street. Corrective Action:An approved special fence permit is required for a fence exceeding forty-eight inches in the front yard setback. Fencing in the clear vision area has a maximum height of forty-two inches. The vegetation and bark in front of the seventy-two inch fence along SE 5th St should comply with RMC 4-4-040.D.3.e, included with this notice.
