7. Chapter 7: Subdivision Regulations
F. APPLICABLE SECTIONS OF THE COMPREHENSIVE PLAN:
1. Land Use Element- Residential Single Family
2. Housing Element
3. Environmental Element
G. DEPARTMENT ANALYSIS:
1. Project Description/Background
The neighborhood of the proposed project consists of flats in moderate to poor condition. The site of the
proposed project has a vacant flat that has been salvaged for building materials by the previous owner and is
in a high state of disrepair. It is our understanding that the applicant has obtained a demolition perm t. If one
has not been obtained it will be required prior to removal of the existing building from the property.
The applicant has proposed subdividing the 19,509 s.f. (0.45 acre) parcel into four (4) lots. Future
construction would be detached single family residential. The proposed lot sizes are Lot 1 at 5,689 sf, Lot 2 at
6,130 sf, Lot 3 at 3,512 sf, and Lot 4 at 4,178 sf. The minimum lot size in the Residential-10 Zone, for a
detached single family residence, is 3,000 sf.
The Residential-10 (R-10) Zone requires a minimum of 7.0 units per net acre, unless the parcel is less than
an acre, as is the case with this proposed project. Therefore, the minimum density requirement is not
applicable. The maximum density in the R-10 Zone is 10.0 dwelling units per net acre. The proposed project
has a net density of 8.93 du/a, which is within the required range for the R-10 Zone.
Access will be from Harrington Pivenue NE by means of a private access easement. Harrington is a two lane,
paved road connecting to NE 16 hStreet, an arterial. Harrington Avenue NE has an existing 3'wide sidewalk
abutting the property. The applicant will be required to replace this sidewalk with a new sidewalk, curb and
gutter.
Utilities will be placed underground in an easement adjacent to the private road that serves the 4 lot .
The existing grades will be maintained and no cut or fill will be required, other than resulting from minor
grading for utilities and building foundations.
One existing tree, an 11" diameter apple tree, will be removed from the property. Other vegetation ind an
existing fence may be retained and incorporated into new residential landscaping.

HARRINGTON SQUARE DECISION DATED NOVEMBER8 ,1999 I Page 4
2. Environmental Review
The property is located within Aquifer Protection Area 2, but is otherwise not located in environmental)
sensitive areas, nor are there known issues of environmental concern associated with the property or 'roject.
3. Compliance with Environmental Review Committee Conditions
This short plat is not subject to review by the Environmental Review Committee.
4. Staff Review Comments
Representatives from various city departments have reviewed the application materials to ide tify and
address issues raised by the proposed development. These comments are contained in the official file, and
the essence of the comments has been incorporated into the appropriate sections of this report and the
Departmental Recommendation at the end of the report.
5. Consistency with Short Plat Criteria
Approval of a plat is based upon several factors. The following short plat criteria have been established to
assist decisionmakers in the review of the plat:
a) Compliance with the Comprehensive Plan Designation
The project, as proposed, would comply with the policies of the Comprehensive Plan Design tion of
Residential Options.
b) Compliance with the Underlying Zoning Designation
The proposed project would comply with the development standards of the underlying zoning
designation of Residential-10. The subdivision will create 4 lots and allow for the future cons ruction
of 4 detached, single family residential houses. Four dwelling units on this 19,509 s.f. (0.45 cre)
property would equal a net density of 8.93 du/a. The allowed density range in the R-10 Zone is
between 7.0 and 10.0 du/a (although no minimum density is required for this project due to it size of
less than 0.5 acre).
c) Compliance with Subdivision Regulations
Streets: No new public streets will be created with this short plat. The private driveway will eet
City of Renton standards. All frontage improvements made to Harrington Avenue NE shall •e
constructed or shown to meet City standards, including, but not limited to paving, curb, gutte ,
sidewalk, signing, channelization, and street lighting.
Blocks: No new blocks will be created with this short plat.
Lots: The proposed project would create 4 lots, Lot 1 at 5,689 sf, Lot 2 at 6,130 sf, Lot 3 at ',512 sf,
and Lot 4 at 4,178 sf. The minimum lot size in the Residential-10 Zone, for a detached sing family
residence, is 3000 sf. The R-10 requires a minimum lot width of 30 feet for interior lots and 0 feet
for corner lots. The minimum lot depth is 55 feet.
The setback requirements are 20 feet for front yards on streets existing as of September 1, 995,
such as Harrington Avenue NE. Back yard setbacks are 15' and side yard setbacks, for inte for lots,
are 5'. An interpretation of the Development Standards for Residential Zoning Designation -10 was
made by the Zoning Administrator on July 26, 1999, however, that applies to the project as roposed.
This interpretation applies to setbacks for front and side yards abutting private streets. On rivate
streets, the front yard setback shall be 10'for the primary structure, and 20' for attached gar ges
accessed from the front or side street. These setbacks shall be measured from the edge of he
required pavement width or back of the sidewalk, if there is one, and in no case shall be les than the
required setback distance as measured from the property line.

City of Renton P/B/PW Department Administrative Land Use Action
HARRINGTON SQUARE REPORT DATED NOVEMBER 8,1999 PROJECT LUA-99-131 SHPL-A
HARRINGTON SQUARE DECISION DATED NOVEMBER$,1999 Page 5
The lots in the proposed project appear to comply with the minimum lot areas, lot dimensions, and
setback requirements in the R-10 Zone Development Standards, as interpreted by the Zoning
Administrator on July 26, 1999.
d) Reasonableness of Proposed Boundaries
Access: All 4 lots would be accessed from a new, private street via Harrington Ave NE.
Topography: The property is level and minimum grading (for building foundations and the p vate
driveway) will be required.
Relationship to Existing Uses: The proposed use, detached, single family residential, is a I•ss
intense use than is primarily existing in the vicinity of the project site. It is compatible with the
elementary school located 1 block to the east of the property. The area of the property is zon -d
Residential-10 (R-10) and consists primarily of residential uses. There are no commercial, re ail, or
industrial uses in the vicinity.
e) Availability and Impact on Public Services(Timeliness)
Police and Fire: Police and Fire Prevention Department staff indicate they have sufficient r: ources
to serve the proposed project, subject to the condition that the applicant provide for code-req ired
improvements and mitigation fees.
A fire hydrant with minimum 1000 gpm fire flow shall be located within 300 feet of all new sin!le
family structures. In addition, as a condition of short plat approval, a Fire Mitigation fee of$, ;8.00 is
required for all new single family structures for development of fire prevention facilities. A credit of
$488.00 for one single family home or flat will be given for the existing flat. Payment of thes:,fees will
be required prior to recording the short plat.
Recreation: Although there is a school nearby with a play area, it is limited in its availability o the
public. There are no nearby public parks or recreation facilities, nor does the applicant prop•-e to
provide on-site recreation areas for the future residents of the development, other than what ill be
available on each lot. Payment of the City of Renton Parks and Recreation Mitigation Fee o•$530.76
will be required, as a condition of short plat approval, for each new residence (credit equalin• the fee
for two multi-family units, $354.51 each, will be given for the existing flat). The Parks and R: reation
Mitigation Fee shall be paid prior to the recording of the short plat.
Schools: For facility planning purposes, the City of Renton estimates that each new residen e
generates 0.76 school-age children. It is anticipated that the proposed project would result i 1.52
new children to local schools (excludes the existing flat).
Storm Water: Stormwater facilities are not located in Harrington Avenue NE at the present time.
Storm conveyance systems may be required if deemed necessary at the time of plat review. System
development charges required for each lot are calculated at the rate of$385 for each single amily
lot. This fee is payable with the construction permit.
Water and Sanitary Sewer Utilities: There is an existing 8"diameter water meter in Harrin!ton
Avenue NE and an existing fire hydrant in the vicinity. Verification that the hydrant is within c 00 of
the farthest residence will be required prior to plan approval. There is an 8" diameter sanita , sewer
in Harrington Avenue NE. System development charges for sanitary sewer, at the rate of$ :5 per
single family lot, and for water at the rate of$850 per lot is a code requirement and will be r-suired at
the time construction permits are obtained.
Transportation: Streets in the area will be impacted by additional daily car trips. Current e:timates
used for the purposes of traffic mitigation are 9.55 average weekday trips per household. A raffic
Mitigation Fee of$75 per average weekday trip, or$716.25 per lot is recommended as a co dition of

short plat approval. Credit equaling the fee for a two-unit townhouse (5.86 average weekday ips per
unit, or$879.00 total) will be given for the existing flat. Payment of the Traffic Mitigation Fee
required prior to recording the short plat.
H. DECISION:
The Short Plat, File No. LUA-99-132, SHPL-A, is approved subject to the following conditions:
1. Temporary Erosion Control shall be installed and maintained to the satisfaction of the
representative of the Development Services Division prior to issuance of the construction
permit and for the duration of the project.
2. The applicant/owner shall draft and record either a maintenance agreement or establish a
Homeowners' Association for the maintenance of all common improvements (access ard utility
easements, private streets, stormwater facilities, landscaping). A draft of the document shall
be submitted to the City of Renton for review and approval by the City Attorney and
Development Services Division prior to the recording of the short plat.
3. The applicant shall pay a Park and Recreation Mitigation Fee equivalent to $530.76 for each
new residence. A credit will be available for the two multi-family units existing prior to the
subdivision. The Parks and Recreation Mitigation Fee shall be paid prior to the recording of
the short plat.
4. The applicant shall pay a Fire Mitigation fee of$488.00 for all each single family structure
(excluding the existing flat) for development of fire prevention facilities. Payment of those fees
will be required prior to recording the short plat.
5. The applicant shall pay a Traffic Mitigation Fee equivalent to $75 per each new average
weekday trip attributed to the project. Trips are estimated to average 9.55 per household, per
weekday. Credit will be given for the existing flat. Payment of the Traffic Mitigation Fee is
required prior to recording the short plat.

each of the two units (flat) that will be demolished on the property ($709.02).
Therefore the total Parks Mitigation fee that will be assessed on this project will be:

$1414.02
If this is not your understanding, please let me know as soon as possible. Thank you.

MEMORANDUM
DATE: October 12, 1999
TO: Elizabeth Higgins
FROM: Sonja J. Fesser ',
SUBJECT: Harrington Square Short Plat,LUA-99-132-SHPL
Format and Legal Description Review
Bob Mac Onie and I have reviewed the above referenced short plat submittal and have the following
comments:
Comments for the Applicant:
There is an eight feet wide walkway(per the Corrected Plat of Renton Highlands No. 2)adjoining
the subject property on the north. Said walkway is south of Huselands 1st Addition. Note this
walkway on the drawing.
The following comments apply to the final short plat submittal:
Note the City of Renton land use action number(LUA-99-132-SHPL)and the city's land record
number(LND-20-0255) on the drawing. The type size used for the land record number should be
smaller than that used for the land use action number.
Tie to the City of Renton Survey Control Network. See the attachment.
The geometry will be checked when the ties have been made.
Provide lot closure calculations.
Note the bearing to center at the most southerly corner of proposed Lot 1.
All owners of record need to sign the short plat drawing and include proper notarization of
signatures. Change the first word of the"Owner's Certificate"block to"We" instead of"i."
Note what is set at each of the new lot corners.
\\TS SERVER\SYS2\COMMON\H:\FILE.SYS\LND\20\HARRNGTN.DOC

Page 2
Addresses will be provided by the city as soon as possible. When available, note said addresses on
the drawing.
If the city is requiring a road maintenance agreement, then the attached statement can be used, if a
separate recorded document is not required. Please note that this statement may need to be changed
to fit the subdivision under review.
Note that if there are restrictive covenants, agreements or easements to others(City of Renton, etc.)
as part of this subdivision, they can be recorded concurrently with the short plat. The short plat and
the associated document(s)are to be given to the Project Manager as a package. The short plat shall
have the first recording number. The recording number(s)of the associated document(s)need to be
referenced on the short plat drawing in the appropriate location(s).
The sewer maintenance easement, as noted in the legal description submittal(Exhibit A), and in a
related note on the drawing, should be recorded, preferably, as a city-held utilities easement. The
legal description should include the appropriate section, township and range. In addition, the
applicant's surveyor should stamp, sign and date said legal. The previous paragraph is applicable to
this easement document. Use a City of Renton Utilities Easement form.
The new private 26'easement for ingress, egress and utilities should include"Area for private"
preceding the easement note already shown on the drawing. Since the new lots created via this short
plat are under common ownership at the time of recording, there can be no easement until such time
as ownership of one of the lots is conveyed to others, together with and/or subject to specific
easement rights. Therefore, the legal description attached to the submittal for the access easement is
not needed at this time.
Add the following Declaration of Covenant language on the face of the subject drawing, if the
previous paragraph applies:
DECLARATION OF COVENANT:
The owner of the land embraced within this short plat, in return for the benefit to
accrue from this subdivision, by signing hereon covenants and agrees to convey the
beneficial interest in the new easement shown on this short plat to any and all future
purchasers of the lots, or of any subdivisions thereof This covenant shall run with
the land as shown on this short plat.
On the final short plat submittal, remove all references to topog lines, plants, utility facilities and
other items not directly impacting the subdivision. These referenced items are only required for
preliminary short plat approval.
See the Aquifer Protection Notice attachment for a revision to said notice.

Comments for the Project Manager:
Is the city requiring a road maintenance agreement? If so, it can be noted on the short plat drawing.
Unless specified by the city, said agreement does not require a separate recorded document.
Fee Review Comments:
The Fee Review Sheet for the preliminary short plat review is provided for your use and
information.

CITY OF.RENTON
DEVELOPMENT:•SERVICES DIVISION
INTERPRETATION/POLICY DECISION .
MUNICIPAL
CODE SECTIONS: Section 4-2-120.F, Development Standards for Residential Zoning
Designations, of the City of Renton Municipal Code RMC)
REFERENCE: N/A
SUBJECT: Minimum Side Yard Along a Private Street in the R-10 Residential 10
dwelling units per acre zone.
BACKGROUND: The City has received a preliminary project review submittal for a four-lot
short plat in the R-10 zone, The required setbacks were not indicated on the
conceptual site plan. The need for interpreting the minimum side yard along
a street became necessary.
i-
JUSTIFICATION: Section 4-2-110.F of the Renton Municipal Code states: "Along Private
Streets/Access: The side yard along a street shall not be less than 10 ft. in
depth for a primary structure, and a minimum depth of 20 ft.for attached
garages which access from the side yard street. If a sidewalk is provided
along a private street/accessway, the setback shall be measured from the
back of the sidewalk for private streets/accessways. Otherwise setbacks
shall be measured from the lot line". Since private streets typically have no
sidewalks, measurements cannot be taken from the "back of sidewalk". And,
the standard private street width is 26 feet, it makes no sense to measure
from "the lot line", since residential front yard setbacks range in size only
from 10 to 20 feet, putting the setback within the private street easement
which makes no sense,
DECISION: The setback for construction on the easterly portion of the lot fronting on both
a public street and a private street shall be 10 feet from the edge of the
private street pavement for the homes themselves or 20 from the edge of the
pavement for attached garages which access from the private street.

BACKGROUND
The project site is located in the Highlands area of Renton at 1819 Harrington Ave. N.E..
The parcel size is 19,509 square feet. The site is presently developed. A duplex that is to
be demolished is presently on the site. The short plat will create a total of four lots on the
parcel.
The subject site is in the City of Renton Aquifer Protection Area#2. Domestic water and
sanitary sewer are available to the lot.
EXISTING CONDITIONS
The existing soil type is classified as an Indianola(Ic) series by the U.S. Dept. of
Agriculture, Soil Conservation Service in the"King County Soil Survey" This soil type is
characterized as a fine sandy loam with rapid permeability. Indianola soils are classified
into Hydrologic Group "A", having a high rate of water transmission.
The topography of the site slopes gradually from the east to the west. There is an
elevation difference of approximately 7 feet across the site with general slopes of 1
1/2%.
STORM DRAINAGE EVALUATION
During a field inspection of the site there were no indications of water courses, standing
water, or flooding. Existing runoff patterns are dispersed and there are no signs of
significant drainage patterns or scouring of channels, ruts, or surface erosion on site. The
permeability of the soils is capable of absorbing the surface runoff.
After approval of the short plat, it is anticipated that a single family residence will be
constructed on each of the new lots. Lot improvements will consist of the structures and
driveways. The permeability of the soils and the low amount of impervious lot coverage
from the residences and driveways will allow lot infiltration systems on each parcel. It is
anticipated that the infiltration capability of the soils will allow the site improvements to
be installed without exceeding the 0.5 cfs threshold for the 100 year/24 hour design
storm. Water quality treatment of runoff or biofiltration is not anticipated because the
project will create less than 5,000 square feet of impervious surface used by vehicles.
/-C
Temporary erosion and sedimentation controls will be designed and implemented during
the construction phase of the project.

DEVELOPMENT PLANNING SEC N COMMENTS
4-LOT SHORT PLAT AT 1819/1821 HARRI
The applicant has proposed a 4-lot short plat to accommodate the construction
of 4 new single family residences. Access to the lots would be via a new private
access easement. An existing duplex currently located on the site is proposed
to be demolished.
Land Use Permits Required: The proposal will require an administrative short
plat approval and will not require environmental review, unless a site visits
identifies the presence of sensitive areas. Processing time for an administrative
short plat is approximately 8 to 10 weeks, assuming no appeals are filed. A
complete short plat application package is attached.
Uses and Density: The subject site is zoned R-10, Residential 10-Units Per
Acre. This zoning permits detached single family dwellings provided the density
limitations of the zone are met. This zone permits residential development at
densities between 7 and 10 units per net acre. Based upon the lot size provided
by the applicant (19,400 sq. ft.) and assuming the site contains no sensitive
areas, the 4-unit proposal results in a net density of 8.98 units per acre.
Dwelling Unit Mix: The zone allows the development to be 100% single family
detached units, so the proposal is in compliance with this provision as well.
Minimum Lot Size: The applicant is proposing the following lot sizes: 3,587
sq. ft., 3989 sq. ft., 4,330 sq. ft., and 4609 sq. ft. The site contains less than 1/2
acre, so there is no minimum lot size required by the zoning.
Minimum Lot Width and Depth: The minimum lot width required for creation of
a lot for a future single family residence is 30 feet. The minimum lot depth for
creation of a lot for a future single family residence is 50 feet. Although the
applicant's conceptual plat plan is not dimensioned, it appears to comply with
these r • ements.
Setbacks: Although setbacks were not indicated on the conceptual plat plan,
the app ' ant may wish to ensure that the lot abutting Harrington will be buildable
hat the 20-front yard setback will be off of Harrington resulting in the 15-
foot rear yard being required along the northerly lot line.
Section 4-2-110F relative to minimum side yard requirements along a street is
somewhat ambiguous. The Zoning Administrator has made an interpretation of
this R-10 Zone "Side Yard along a Street" setback requirement: The setback for
construction on the easterly portion of the lot fronting on Harrington Avenue NEtvr P\
shall be 10 feet from the edge of the private street pavement for the homes Rc-‘`.
S ny
2..
themselves or 20 from the edge of the pavement for attached garages which
access from the private street.
Access Requirements: The City's street standards permit a minimum 26-foot
wide private street to access up to four lots. While the street is not dimensioned,
it appears to meet this requirement. If the private street exceeds 150 feet in
length a turnaround meeting the requirements of the Fire Prevention Bureau will
be required. It looks as if the proposed private access road is proposed as a
separate tract. This road should actually be a private access easement across
the 3 lots closest to the public street.
Mitigation Fees: For the purposes of calculating mitigation fees for this
development, fees will be based on a total of two dwelling units (rather than 4)
as the applicant will be given credit for the existing duplex now located on the
site. She attached fee schedule for mitigation fees.
Sensitive Areas: Although no site visit was conducted, the site is not indicated
as sensitive on the City's Greenbelt, Flood or Wetlands maps. The site is
located within Zone 2 of the City's Aquifer Protection Area. This should not have
an impact on the proposed development as the lots are proposed to be sewered.
Other Subdivision related Issues: A Demolition permit will be required to
issued and finaled prior to actual recording of the short plat.

NOTE ON PRELIMINARY REVIEW COMMENTS CONTAINED IN THIS REPORT:
The following comments on development and permitting issues are based on the pre-application
submittals made to the City of Renton by the applicant. The applicant is cautioned that information
contained in this summary may be subject to modification and/or concurrence by official decision
makers (e.g. Hearing Examiner,Boards of Adjustment, Board of Public Works and City Council).
Review comments may also need to be revised based on site planning and other design changes
required by the City or made by the applicant.
WATER
1. There is an existing 8-inch diameter water line in Harrington Avenue NE. The derated fire
flow in the vicinity is modeled at 2000 gpm with a static pressure of 75 psi.
2. There is one fire hydrant in the vicinity that may be counted towards the fire protection of
this project, but is subject to verification for being within 300 feet of the nearest corner of
the furthest building. Additional hydrants may be required. Upgrade of the existing hydrant
with a 5-inch Storz quick connect fitting may be required.
3. The proposed project is located in the 565 water pressure zone and in Aquifer Protection
Zone 2.
4. The Water System Development Charge (SDC) will be triggered at the rate of $810 per
additional single family home.
SANITARY SEWER
1. There is an existing 8-inch diameter sanitary sewer in Harrington Avenue NE.
2. The Sanitary Sewer SDC is triggered and will be assessed at the rate of$585 per additional
single family home.
SU ACE WATER
1. A limited level one drainage study is required. No retention/detention calculations are
required for this project. Water quality treatment sized for the new impervious surfaces
subject to vehicular access is required.
2. The Surface Water SDC is triggered and will be assessed at the rate of $385 per additional
t)(14 1 , single family home.
1 TRANSPORTATION
1. The traffic mitigation fee of$75 per additional generated trip shall be assessed per single
family home at a rate of 9.55 trips. ($75 x 9.55 x4 = $2,865 ) If there is an existing house,
credit will be given for 9.55 trips.
Harrington Square
PreApplication Review 07/01/99 Page 2
2. Full street improvements including, but not limited to paving, sidewalks, curb & gutter,
street signs and street lights are required if not already existing. Any substandard or
damaged paving, streetlighting, sidwalk, curb or gutter will be required to be replaced.
3. All wire utilities shall be installed underground per the City of Renton Undergrounding
Ordinance. If three or more poles are required to be moved by the development design, all
existing overhead utilities shall be placed underground.
PLAN REVIEW
1. All plans shall conform to the Renton Drafting Standards which are attached for reference.
Also attached for general information are a fee reference sheet and the King County Storm
Water standards as adopted by the City of Renton.
2. A construction permit is required. When plans are complete three copies of the drawings,
two copies of the drainage report, a construction estimate and application fee shall be
submitted at the sixth floor counter. A fee worksheet is attached for your use, but prior to
preparing a check it is recommended to call 425-430-7266 for a fee estimate as generated by
the permit system.
