That Daman Awla {hereinafter, "Grantor"},for and in consideration of mutual benefits,do by these presents,grants,
ba�gains, sells, conveys, and warrants unto the City of Renton, a Washington municipal corporation (hereinafter,
"Grantee"},its successors and assigns,a perpetual easement and right-of-way over,under,thraugh,across and upon
the property in King County,Washington,described on page 1.This easement shall be for the purpose of canstructin�,
reconstructing,installing,repairing,replacing,enlarging,operating and maintalning a Public Street as deflned by Renton
Municipal Code sedion 4-6-060 St�eet Standards,together with the right of ingress and egress thereto without prior
institution of any suit or proceedings of law and without incurring any legal oblfgation or liability therefor.
G�antor will protect,save and hold ha'rmless,and defend,Grantee and its successors,assigns,customers,and invitees,
from all claims,actions,filed or threatiened,costs,damages,or expenses of any nature whatsoever arising out of or in
connection with negligent atts or omissions of Grantor in connection with Grantor's exercise of its rights u�der this
easement_The obligation to protect,save and hold harmless,and defend shall not inciude such claims,actions,costs,
damages,or expenses which may be caused by the sole negligence of Grantee or iu successors or assigns;provided that
if the claims,actions,costs,damages,or expenses are caused by or a result from concurrent negligence of(a)Grantee
or its successors or assigns and(b)Grantor,its agents,contractors or assigns,and involves those actlons covered by RC1N
4.24.115,this lndemnity provision shall be valid and enforceable only to the extent of the negligence of G�antor, its
age�ts,contractars or assigns.Grantor;shall promptly notify Grantee of any loss,damage,injury or death arising out of
or in connection with any acts or omissions of Grantor in connection with Grantor's exercise of its rights under thls
Easement. '
This easement is granted subject to th�following terms and conditions:
1. Grantor shall retain the right to use the surface of she easeme�t as long as such use does not interfere
with the easement rights granted to the Grantee.
2. Grantor shall retain the right to maintain,replace or instatl a driveway and private utilitfes(such as sewer,
water,sto�mwater,power,gas,telecommunications,etc.)within the easement area.Upon i�stallation of
the Public Street 6y the G�antee,Grantor shall restore the surface of the easement as nearly as practicable
to the condition it was in immedlately before commencement of the work.For any such work within the
easement area, Grantor 'shall notify the Grantee and tt�e Grantor shall receive written approval from
Grantee prior to commericement of any such work,unless such work constitutes an emergency in which
case the Grantee shall notify Grantor wiihin seventy-two (72) hours of performing work. At the sole
discretion of the Grantee;and as part of providing prior written aparoval,Grantee may elect to require
payment for and inspect the Grantors work.
3. Grantor shall not have the right to:
a. Erect or maintain any buildings or structures within the easement;or
b. Plant trees,shrubs or vegetation within the easement;or
,
d. Uig,tunnel or perform other forms of construction activities on the property which would disturb the
Grantee's Public Street;or;
e. Erect fences in the easement area.
This easement shall run with the land described herein,and shall be binding upon the pafties,their heirs,successors in
interest and assigns.Grantor covenants that it is the lawful owner of the above property(ies}and that it has a good and
lawful right to execute this agreement.
By this conveyance,Grantor will warrant and defend the conveyance hereby made unto the Grantee against all and
every person or persons,whomsoever,lawfuliy,claiming or to clairn the same.This conveyance shall bind the heirs,
executors,administrators and assigns forever.
