pre-developed hydrology and mindmize stormwater runoff an the Property,
2. City of Renton shall have �he right to ingress and egress aver those portions of the Prcrperty
neceasary to perform 'snspections of the stormwater facilities and BfV1Ps and canduct
maintenance activities specifPed in this Declaration of Covenant and in accordance with the
Rer�tcan Municipal Cc�de. City of Rentan shal! prc�vide at least thirty(30) days' written notiee ta
the Owners that entry on the Property is planned far the inspectinn n#drainage facilities. Aft�r
the thirty (3Q) days, the Owners shall al6owr the City of R�nton to enter for the so6e purpase af
ir�specting drainage facifities. In lieu of inspectian by the City,the Owners may elect ta engage
a licensed civi(engir�eer registered in the state of Washin�#a�n who has�xpertise in drainage ga
inspect the draina�e faciliti�s and pravide a v�rritter� repor[ describing tf�eir condition� If the
en�ineer optian is chosen,the Owners sha11 provide written notice to the City of Renton within
fi�teen (15)days o�rec��ving the City's notice of inspection.Within thirty(30)days of givin�this
notice,the Owners,or engineer or� behalf af the Qwners,shall pravide the engineer's repart to
the City of Rentan. If the repart is not provided in a timely rnanner as specified above,the City
of Renton may inspect the drainage facilities without further notice.
3. If City of Renton deterrnir�es from its inspection, or frorn an engineer's report provided in
accorcfar�ce with Paragraph 2,that maintenance, repair, restoration,and/or mitigation vvark is
reqa�ired tc� be done to any of the drainage�acilities, City of Renton shalf no�ify the tJwners of
the specific maintenance, repair, restoration, and/ar mitigation work ("Work"} required
pursuant to the Renton Municipal Code. The City shafl alsa set a reasonable deadPin� frsr the
Owners to camplete the Work, or to pravide an �ngin�er's report that verifies carnpletian af
the Wark. After the deadlin� has passed, the Owners shall allaw the City access �o re-inspect
the drainage �acilities unless an engineer's rep�ort has been pravided v�rifying compCetian of
th� Work. If the Wark is not campleted within the time frame set by the City, the City may
ir�itiate an enforcement aetian and/or perform �he Work and hereby is given access to �he
Propert� for such purpc�ses. Written r�otice will lae sen� to the Owners stating the City's
infiention to perform such Work.�'his Work will r�at carrrmence until at least seven(7�days after
such notice is rnailed. i�, within �he sc�le discretian of khe City, there exists an irnmirr�nt or
present danger, the sever� (7) day notice period will be waived and Work wi9! begin
immediately.
4. `fhe Owners shall assurrre a6P responsibifity for the cast of ar�y Work, or any measures taken by
the City to address conditions as described in Paragraph 3. Such responsibi9'sty shal! include
reirnbursement ta the City within thirty(30}days e�f the receipt of the inv4ice for any such Work
perfcarm�d. C7v�rdue payrraents w�ll require payrn�nt of interest at the maxii�urr► le�al rate
allowed by RCW 19.52.02C1 (currently twelve percent (9.2%a)}. If the City initiates legal action to
enforce this agreernent, the prevailing party in such actian is entitled ta recc�ver reasonable
litigation caasts and attorney's fees.
S. The Owners are required to abtain written approval fram City of Renton prior to filling, piping,
cutting, or remaving vegetation (except in routine lar�dscape maintenance) in open vegetated
starmwater facilities (such as swa4es, channels, ditches, pands, etc.), ar performing �ny
alterations ar mndifications ta the drainage facilities referenced in this Declaration of Covenant.

6. Any notice ar cnr�sent r�equired to be given or otherwise provided for by the prauisions af this
A�reement shall be effective upon p�rsonal delivery,ar three(3)days after mailin�by Certified
Mail, refiurn receipt requested.

between the parties, and supersedes all priar discussions, negatiations, arrd all agreemerrts
whatsoever whether oral ar written.

abave, and shall inure ta the benefit of ali the citizens of the City of Renton and its successors
