without prior institution of any suit or proceedings of law and without incurri,ng any legal obligarion or liabiiity
therefor. Foliowing the initial construction of its faciiities,Ga'antee�y from.time to tixne construct such
additional faciliries as it may requize. 'This.easeznent is grauted subject to the followiug terms and conditions:
1. 'Ihe Gran;ee sball;upon comgIetion.of any work within the property covered by the easement,r+estore the surface of
the easement;and any.private unprovements disttisbed or destroyed during execariozt of the work,as nearty as
practicable to the condition they were in immediately before coamiencernent of the work or entry by the Grautee.
2. Grantor shall retain tl�e rigbt to use the surface of the easement as long as such use does nat interfere with the easement
rights granted to the Graiitee.
Grantor sttalt not,however,,have the right to:
a Erect or maintain any buifdings or struc�a�es within the easement;or
b. Plant trees,shrubs oi vegetatian having deep root patterns which may caase damage to or interfere with the
urilities to be gtaced'within t6e easement by the Grantee;or
c. Develop,lanciccape,or beautify the easement area in amy way w�ich would unreasonably increase the costs to
ttie Grantee of restoiittg the easement area and any private'rmprovements therein.
d. Dig,tunnel or perforrn other foims of canstruction activities.on the progerty which would disturb the
compaction or.unearth Crantee`s facilities on the right-of-way,or endanger ihe laferal support facilities.
e. Blast witliin fifteen(15)feet of the right of-way.
This easement shail niu with the 2and described herein,and shalt be binding upon ths parkies,their heias,
successors in ittterest and assigns. Grantors covenant that.they are the iawhit awners of the above properties and
that they have a good and lawfeil rigtit m execnte this agreement.
