PERMANENT EASEMENT
D & C INVESTMENTS, L.L.C., a Washington limited liability company, ("Grantor") under the
imminent threat of the City of Renton's exercise of its rights of eminent domain, for and in
consideration of$10.00 and other valuable consideration, does by these presents, grant, unto the
CITY OF RENTON, a municipal corporation, ("Grantee"), and its successors and assigns a
nonexclusive, perpetual easement for slopes and utilities, together with a nonexclusive, perpetual
easement for utilities to PUGET SOUND ENERGY, INC., a Washington corporation, whose

Colorado corporation, a/k/a CenturyLink, whose address is 1801 Calfornia St�wQ����ra��

1801 W. Ba� Dr. NW �o�fnc��A), e purposes set forth herein, over, under, through,
across and upon the real estate, situated in the County of King, State of Washington, which is
depicted on Exhibit "A" attached hereto (the "Easement Area"). The City of Renton, PSE, Qwest
(CenturyLink), and Comcast are each a "Grantee" hereunder and together, "Grantees."
Each Grantee shall have the right to cut, remove and dispose of any and all brush, trees or other
vegetation in the Easement Area. Each Grantee shall also have the right to control, on a continuing

basis and by any prudent and reasonable means, the establishment and growth of brush, trees or
other vegetation in the Easement Area.
Grantor reserves the right to use the Easement Area far any purpose not inconsistent with the rights
herein granted, provided, however, Grantor shall not construct or maintain any buildings,
structures or other objects within the Easement Area, and Grantor shall do no blasting within 300
feet of the Easement Area without Grantees' prior written consent.
Any notice, request, approval, consent or other communication required or permitted to be given by
any party to any other hereunder shall be in writing and shall be deemed to have been duly given
when delivered personally or by overnight courier; or received following deposit as prepaid
certified mail (return receipt requested) with the United States Postal Service; and addressed to the
appropriate party at its address set forth above, or at such other address as such party shall have last
designated by notice to the other.
Each Grantee agrees to indemnify Grantor from and against liability incurred by Grantor as a result
of such Grantee's negligence in the exercise of the rights herein granted to such Grantee, but
nothing herein shall require either Grantee to indemnify Grantor for that portion of any such
liability attributable to the negligence of Grantor or the negligence of others.
This easement shall run with the land described herein, and shall be binding upon the parties, their
heirs, successors in interest and assigns. Grantor covenants that it is the current lawful owner of the
Easement Area and that they have a good and lawful right to execute this agreement.
