Public safety and adequate staffing levels to best serve the public have been considered in the re-opening decision. To ensure safety for both patrons and staff, the following procedures will be followed:  When entering a City of Renton Recreation facility:  Wear a mask at all times regardless of vaccination status.  Complete a COVID-19 Health Screening questionnaire.  Inform the facility’s Safety Supervisor immediately upon receipt of a positive COVID-19 test, if in the facility within the last few days.  During this time, facilities will require pre-registration or reservations for amenities and programs. Schedules can be viewed at rentonwa.gov/recreation. A City of Renton PerfectMind Account is needed to complete the process for all registrations or reservations. If you don’t already have an account, sign up at rentonwa.gov/register or contact Recreation staff at (425) 430-6700. • Due to declining daylight, Renton Farmers Market will shift back one hour, opening at 2:00pm and closing at 6:00pm on Tuesdays, September 21 and September 28. ADMINISTRATIVE REPORT CAO Ed VanValey reviewed a written administrative report summarizing the City’s recent progress towards goals and work programs adopted as part of its business plan for 2021 and beyond. Items noted were: • Solid Waste Utility Division is hosting the last of three mini -recycle events on Saturday, September 18 from 10 a.m. to 2 p.m. at Renton Technical College. This event will include document shredding and collection of Styrofoam®. Food donations for the Renton Salvation Army Food Bank will also be accepted during this event. More information can be found at rentonwa.gov/solid_waste_utility/recycle_event. • King County Library System will display a Pop-up Story Walk along the walking path at Liberty Park through September. Enjoy each page of Cat’s Colors as you walk around the park. • Come view Renton History Museum’s new temporary exhibit When You Can’t Go Home: Portraits of Refugees in the Pacific Northwest. This exhibit is the life work of Karisa Keasey, local artist, author, and advocate. Keasey spent hours with each refugee featured in this exhibit with the help of World Relief, a globally celebrated refugee resettlement organization. These moving watercolor portraits demonstrate a passion for enabling some of the most marginalized people in the world to be seen and heard. On exhibit through November 6. • Preventative street maintenance will continue to impact traffic and result in occasional street closures. AGENDA ITEM #7. a) September 13, 2021 REGULAR COUNCIL MEETING MINUTES AUDIENCE COMMENTS • Tim Hayner, Bonney Lake, of Cascade Civil Construction, noted that his company is the contractor for the Williams and Wells Conversion project and requested support to get the project’s related change orders processed more quickly. He also noted that there are several utility conflicts in the area which has caused most of the change orders. • Carl Nelson, Beaverton (OR), stated that he is the Vice President of Cascade Civil Construction and echoed Mr. Hayner’s concerns about the timeliness of processing change orders. Mayor Pavone noted that he will review the issue with staff and have someone follow-up with Mr. Nelson. • Paulette Makela, Renton, expressed concerns about derelict buildings in downtown. She urged the administration to act, especially in regard to the building located at 220 S 3rd Pl which is across the street from the St. Anthony’s. Mayor Pavone noted that the owner had been issued code violations and recently signed an agreement allowing the City to trespass people from the property. • Renton Tinderer, unknown, jokingly asked that the Mayor name him Mayor of Renton because he has the same first name as the City. • Ashley Dale, unknown, Director of Bailing Out Benji, expressed concerns about Puppyland, a retail pet store in Renton, and urged Council to pass a humane pet store ordinance that bans the sale of dogs and cats. • Jill Servais, Renton, expressed concerns about Puppyland, alleging the company gets its puppies from dog mills in the Midwest and uses predatory loan practices. She urged Council to support a humane pet store ordinance that bans the sale of dogs and cats in retail stores. • Cathleen Powell, Renton, remarked that she is a long-time volunteer and advocate for dogs and urged Council to support a humane pet store ordinance. • Trenise Williams, Renton, stated that although she is excited about the Black Lives Matter mural being completed, she is disappointed in the way the City credited most of the work to the Renton Municipal Arts Commission and not the Black leaders and advocates, including herself, who made this vision a reality. She urged Council to be more considerate in the future. Councilmember Pérez thanked Ms. Williams for her hard work and dedication to this project and the community. • Gina Cari, Renton, expressed concern about Puppyland and urged Council to adopt a humane pet store ordinance that bans the sale of dogs and cats in retail stores. • Carmen Rivera, Renton, expressed outrage towards the City’s social media posts commending the Renton Municipal Arts Commission and not the local Black leaders who worked on the Black Lives Matter mural. She demanded that Council have the posts edited to reflect credit to those community members involved in the project. Ms. Rivera also demanded that community members be allowed to appoint members to the proposed Renton Equity and Empowerment Commission. • Nancy Quinn, Renton, asked for a staff contact regarding the condominium project proposed for the old Stoneway site off of the Maple Valley Highway. She also noted that she would follow-up with Mayor Pavone regarding public safety issues in her neighborhood. AGENDA ITEM #7. a) September 13, 2021 REGULAR COUNCIL MEETING MINUTES • Rev. Dr. Linda Smith, Renton, echoed the previous speakers’ concerns regarding crediting the Black community leaders who worked on the Black Lives Matter mural. She also echoed Ms. Rivera’s demand to allow community members to appoint individuals to the proposed Renton Equity and Empowerment Commission. • Ali Cohen, Renton, expressed support for the previous speakers’ comments regarding the Black Lives Matter mural, and support for the adoption of a humane pet store ordinance. City Clerk Seth read the following announcement: “Mr. Mayor, I would like to make an announcement for the benefit of the public regarding a change in administrative process for accepting Audience Comment. Beginning at the next Council meeting, September 20, 2021, residents, and others who wish to speak during the Audience Comment period will be required to register in advance. A link to the registration form will be included on future agendas, as well as being posted to the City Council webpage, the Council agenda portal webpage, and various City social media sites. The form requires the following information from speakers: Meeting Date (the meeting you would like to speak at); Full name (of speaker); City of Residence, email address and/or phone number, and the topic of the speaker’s comments. Registration will be open at all times, but speakers must register by 5 p.m. on the day of a Council meeting in order to be called upon. Anyone who registers after 5 p.m. on the day of the Council meeting will not be called upon to speak, and will be required to re-register for the next Council meeting if they wish to speak at that next meeting. Council Concur. b) AB - 2936 City Clerk reported bid opening on August 23, 2021 for the 2021 Runway PCC Panel Repair Project, CAG-21-184, and submitted the staff recommendation to award the contract to the lowest responsive and responsible bidder, Road Construction Northwest, Inc., in the amount of $448,393.26. Council Concur. c) AB - 2937 City Clerk reported receipt of an appraisal for the Solera Street Vacation Petition, VAC-20-002, and submitted the staff recommendation to accept the appraisal and set compensation for the street vacation at $0.00 due to the developer dedicating future right-of- way estimated at $3,165,000. Refer to Planning Commission and Planning & Development Committee. e) AB - 2942 Community & Economic Development Department requested authorization to hire a Civil Engineer III at Step D of salary grade a29, effective September 27, 2021. Refer to Finance Committee. f) AB - 2943 Community & Economic Development Department requested adoption of a resolution authorizing a temporary full street closure for an 850-foot-long portion of Sunset Lane NE between NE 10th St and Harrington Pl NE for a period not to exceed two (2) years from October 4, 2021 to October 4, 2023. Refer to Transportation (Aviation) Committee. g) AB - 2939 Community & Economic Development Department requested authorization to hire an Associate Planner at Step E of salary grade a21, effective September 27, 2021. Refer to Finance Committee. h) AB - 2944 Equity, Housing, and Human Services Department recommended setting a public hearing on September 20, 2021 to consider approving a grant agreement (subject to approval as to form by the City Attorney Department) with King County, to accept an additional $186,591 in Community Development Block Grant - Coronavirus Round 2 (CDBG-CV2) funds which will be allocated to the Renton Housing Authority ($91,430) and Centro Rendu ($91,429). King County will retain two percent of the amount to administer the program. Refer to Finance Committee; Set Public Hearing on 9/20/2021. i) AB - 2928 Equity, Housing, and Human Services Department requested approval to execute the termination of the Multi-Family Housing Property Tax Exemption (MFHPTE) Agreement for the Sunset Terrace Apartments dated June 7, 2019; which is necessary in order to execute the new MFHPTE agreement approved by Council on August 9, 2021, with Colpitts Sunset LLC, for the Sunset Terrace project. Refer to Planning & Development Committee. j) AB - 2940 Executive Services Department recommended approval of the 21EMPG/21EMPG- ARPA Award Obligation Letter, with the Washington State Military Department - Emergency Management Division, and approval of the related grant agreement when it is issued (subject to approval as to form by the City Attorney Department) necessary to receive grant funds in the amount of $77,021. Refer to Finance Committee. l) AB - 2933 Public Works Airport requested authorization to execute Amendment No. 1-21 to LAG-19-001, lease with Rainier Flight Service, LLC, which includes construction milestones for the 820 and 800 Airport parcels, lease back an office space area, amend the rental rates, and make other housekeeping corrections. This amendment increases the annual lease revenue by $22,577.40 above the current lease structure. Refer to Transportation (Aviation) Committee. m) AB - 2920 Public Works Transportation Systems Division requested authorization to purchase signal equipment from Mobile Electrical Distributors, estimated at $192,114.60, for signals and streetlight poles, as part of the agreement, CAG-20-156, with King County Metro Transit Department. Refer to Finance Committee. o) AB - 2941 Public Works Transportation Systems Division submitted the 2022-2027 Six-Year Transportation Improvement Program, and requested a public hearing be set on October 4, 2021 to consider approving the related annual updates to the program. Accounts Payable – total payment of $9,307,082.05 for vouchers, 10344, 394110- 394122, 394124-394126, 394136-394504; payroll benefit withholding vouchers 6645, 6647, 6649, 6652 6654-6655, 394127-394135 and two wire transfers. 2. Payroll – total payment of $1,577,679.56 for payroll vouchers that include 651 direct deposits and 20 checks. (08/01/21-08/15/21 pay period). 3. Kidder Mathews vouchers 6379-6393 totaling $26,735.72. CARRIED. b) Finance Committee Chair O'Halloran presented a report concurring in the staff recommendation to accept the Washington State Department of Commerce Grant – 2019 Local and Community Project Grant in the amount of $1,455,000 to reimburse construction costs of the Family First Community Center. The total 2021 budget for the two projects is $3,763,103. There is sufficient unencumbered funding in the budget to cover this amendment. SUMMARY OF ACTION: In 2017, Public Works initiated a project to upgrade and rehabilitate 19 of the 20 lift stations and related force mains that move sewage through the city to the King County Wastewater Treatment Facility. While all these facilities are less than 25 years old, there is a list of needs that should be addressed to keep these facilities operating 24 hours per day for 365 days per year. The following is a representative list of work that would occur: • Pump replacements. • Structural repairs. • Installation of force main clean-outs. • Adding backup generators. • Upgraded telemetry systems in an effort to modernize the facilities and increase efficiency and reliability of these facilities. Design and construction work was originally separated into two groups based on the priority of the lift station. Due to funding and the need for easement acquisition, the groups have been divided into four phases. The phases represent design/bid/construct packages. The following is a list of the stations, respective phase of work, and reference to the original grouping. AGENDA ITEM #7. d) The proposed amendment with RH2 Engineering will allow for the completion of 100% design for the three Phase 2 projects with anticipated bidding for construction of this work by the end of 2021. It will also fund the design work (concept to 100% design) for the Phase 3 and 4 projects in 2022 -2023, with Phase 4 being the final group constructed (tentatively 2023) due to the need for acquisitions of easements. The contract scope of work includes the following tasks: 1. Project management. 2. Desktop review and field inspection of the Phase 3 and 4 lift stations. 3. Preparation of conceptual 30% design plans for each Phase 3 and 4 lift stations for identified improvements. 4. Geotechnical investigations of each project site. 5. The project started with the City breaking down these facilities into Phase 1 and Phase 2 based on rehabilitation priority. However, a few of the Phase 1 LS projects required property acquisition and other permitting requirements. In an effort to prevent delaying the improvements to the remaining lift stations, the City decided to divide the Phase 1 lift stations into Groups 1A and 1B. It is anticipated that the Phase 2 lift stations will be divided into different groups as well. The following provides a detailed breakdown of the lift stations by phases and groups: PHASE 1 (COMPLETED) • Group 1A: Misty Cove, Piper’s Bluff, Shy Creek, Stonegate, Airport, Lind, and part of East Valley. The rehabilitation improvements for these facilities have been designed, bid, and constructed as part of Amendments Nos. 2 and 4. PHASE 2 • Group 1B: Cottonwood, Devil’s Elbow, Baxter, and the remaining portion of East Valley. The preliminary 60-percent design has been completed for these four lift stations. Continuing property acquisition efforts likely will result in addressing further design for the Cottonwood Lift Station separately from the other three Group 1B facilities. Completion of the final design and advertisement for bidding is slated to occur by the end of 2021. o Group 1C: At the time this Scope of Work was prepared, the required easement for the Cottonwood LS was still being negotiated to accommodate the proposed electrical building and generator. The timeline of when the City will be able to obtain an easement from the property owner is uncertain. Therefore, this lift station will be improved later, under a separate group number, as part of Phase 4. Due to Kensington Crest likely requiring acquisition of an easement, it will be deferred to Group 2B at the 60-percent milestone, along with any other facility that is determined to require an easement. o Group 2A: Liberty, Wedgewood, Lake Washington Beach, Lake Washington No. 2, Lake Washington Flushing Station, Talbot Crest, Long, and Westview. Plans for rehabilitation of these lift stations will be developed from the 60-percent preliminary design level to 90-percent final design, and finally proceed to bidding and construction. o Group 2B: This amendment will determine the easement requirements for the Kensington Crest improvements for the City to begin the acquisition process. The timeline for securing an easement is unknown; therefore, this lift station and any other Group 2A facilities that necessitate easement acquisition will be improved under a separate group number and as part of Phase 4. PHASE 4 • Group 1C: Once easement negotiations are finalized for the Cottonwood LS, improvement plans will be developed from 60-percent to 90-percent design, and subsequently proceed to bidding and construction. • Group 2B: Once easement negotiations are finalized for the Kensington Crest LS and any other facilities that need easements, improvement plans will be developed from 60 -percent to 90-percent design, and subsequently proceed to bidding and construction. Currently, RH2 is under contract to complete the design for the Group 1B and 1C lift stations: Baxter, Cottonwood, Devil’s Elbow, and the remaining portion of East Valley. RH2 also is under contract to provide one (1) round of services during bidding (SDB). As part of Phase 2, RH2 will complete the design for improvements to the three Group 1B facilities, to be advertised for bidding by the end of 2021. Phase 4 will be completed on an independent schedule and design track, depending upon time needed to resolve any property acquisition and permitting needs. Table 1 identifies the Groups 1B, 1C, 2A, and 2B projects included in this amendment and the anticipated types of improvements involved. Assumptions: • No further easement or property acquisition is anticipated for any of the Group 1B facilities. • No major changes in approach or scope of improvements are expected for any of the Group 1B facilities. Task 21 – Project Management Objective: Manage the RH2 project team and maintain files and records. Monitor the project scope, budget, and schedule. Task 24 – Predesign Project Analysis (Group 2) Objective: Prepare conceptual 30-percent design plans for all nine (9) Group 2 LS and FM projects. The primary purpose of preparing conceptual plans is to quantify the design development effort. Many of the plans and details developed as part of this Task will be further developed during the design phase of the project. Some details will be common to several LS or FM sites. Approach: Evaluate the characteristics of the site geology and topography for accommodating retaining walls and emergency generators in the slopes for the Talbot Crest and Long Lift Stations. Prepare preliminary recommendations regarding level of effort and whether it will be more feasible to construct improvements during Phase 3 (Group 2A) or Phase 4 (Groups 1C and 2B). Review available soil, geologic, and groundwater information for each site, observe sites for current slope conditions, evaluate requirements for slope stabilization needed to accommodate construction and operation of emergency generators, and provide a summary with initial recommendations to the design team. Prepare a cover sheet and general construction notes for the project. Prepare a vicinity map that identifies the location of the LS and FM sites included in this phase. Prepare conceptual site and utility plans showing FM improvements and details. Coordinate with City Planning Department staff regarding local permitting requirements as pertaining to the proposed improvements. Prepare an anticipated permit list for each project site to be incorporated into the technical memorandum prepared in subtask 24.13 and provide input on schedule and cost impacts associated with permitting. As of this Amendment, no permitting requirements are expected. Prepare a preliminary construction cost estimate of each individual LS for the City’s review. Prepare a technical memorandum summarizing the improvements scheduled for each LS and FM and submit to the City for review. Approach: Evaluate the progress of property acquisition at the Cottonwood LS and FM and estimate the time remaining to complete real estate actions. Provide a flow chart and schedule for next steps and a timeline once property and easement negotiations are finalized. Re-evaluate the proposed project design at the East Valley and Baxter LS facilities, as well as proposed solutions for slope stabilization at Devil’s Elbow. Confirm that the approach previously developed remains applicable. Update the Groups 1B and 1C preliminary construction cost estimates for the City’s review to reflect current labor and material prices, as well as any revisions in approach to the four (4) Groups 1B and 1C projects. Assumptions: • It is assumed that the initial scope of improvements for Groups 1B and 1C have not changed. This Task is meant to ensure a smooth design process as Groups 1B and 1C progress to final design. RH2 Deliverables: • One (1) electronic PDF of the updated flow chart and schedule for the Cottonwood LS. • One (1) electronic PDF of the updated preliminary construction cost estimates for the four (4) Groups 1B and 1C LS sites. Task 26 – Bidding and Construction Sequencing Plan (Groups 1B and 2) Objective: Task 24 developed the conceptual 30-percent design plan sets for the nine (9) Group 2 project sites (Liberty, Wedgewood, Lake Washington Beach, Talbot Crest, Long, Westview, Kensington Crest, Lake Washington No. 2, and Lake Washington Flushing Station). Otherwise, they will be part of Phase 3 (Group 2A) to be designed and advertised for bid sometime during 2022. Refer to Table 1 in the Background for anticipated project phasing. Property acquisition for the Cottonwood LS and FM project likely will require a later completion of final design for that facility, postponing this work into a separate Group 1C set of projects, as described in the Background portion of this Scope of Work. Due to the expected property and easement acquisition for the Kensington Crest site and the unknown schedule that will be incurred, it is anticipated this facility will be included in Group 2B and scheduled to be bid later in a separate Phase 4 set of projects that can be completed concurrently with Group 1C. Upon finalization of this site and group organization, the remainder of th e design work will progress in the following phases. Phase 3 includes tasks associated with advancing the Group 2A facilities from their current design level to bid-ready design, as well as providing SDB. Phase 4 includes tasks associated with advancing the Groups 1C and 2B facilities from their current design level to bid-ready design, as well as providing SDB. Approach: Discuss with City staff which Group 2 projects can advance to preliminary and final design (Group 2A) and which can be addressed later (Group 2B) with Group 1C facilities. Assumptions: • Geotechnical investigations are anticipated for the Group 2 lift station and force main improvements, but this assumption will be validated during Phase 3 or 4 design work. Provided by City: • Attendance at one (1) meeting to discuss project phasing. RH2 Deliverables: • Attendance at one (1) meeting to discuss project phasing. PHASE 3 – PRELIMINARY/FINAL DESIGN AND SDB FOR GROUP 2A At the start of Phase 3, the sites assigned to Group 2A (Liberty, Wedgewood, Lake Washington Beach, Talbot Crest, Long, Westview, Lake Washington No. 2, and Lake Washington Flushing Station) will be at 30-percent design and ready for updating to the 60-percent design milestone. The proposed final design and advertisement for bids for Group 2A sites is scheduled to be completed sometime during 2022. Task 27 – Geologic Exploration and Surveying (Groups 2A and 2B) Objective: Perform engineering geology site investigations and reporting as needed for final design of the Group 2 facilities that warrant this effort, as well as property boundary surveying. Approach: Perform a limited geological investigation to observe, characterize, and document earth and groundwater conditions of the sites. Identify potential geologic hazards and alternatives to mitigate the identified geologic risks and evaluate potential constructability issues for the EG foundations and associated retaining walls. RH2 will coordinate with City staff to perform test pits for geologic investigation as warranted. Prepare an engineering geologic report for the two (2) sites that follow, which will include a summary of geological and groundwater conditions and provide recommendations to design and mitigate construction geologic hazards, the EG foundation, and associated retaining wall. The engineering geology report will include a figure showing exploration locations, photographs, and logs from each test pit performed. • Talbot Crest • Long Describe survey work to be completed, including the survey limits and requirements. Coordinate with a surveyor as a subconsultant to RH2 to perform topographic survey for the LS facilities that follow. particularly described was filed with the City Clerk on November 12, 2020, and that petition  was signed by the owners representing more than two‐thirds (2/3) of the property abutting  upon the portion of street to be vacated; and  WHEREAS, the City Council, by Resolution No. 4428, passed on March 22, 2021, set  April 19, 2021, at 7:00 p.m., by means of the Zoom video conferencing web application as the  time and place for a public hearing on this matter; and the City Clerk gave proper notice of  this public hearing as provided by law, and all persons were heard who appeared to testify in  favor or in opposition on this matter, and the City Council considered all information and  arguments presented to it to determine whether the vacation is in the public interest, whether  the property is not required for overall circulation of traffic within the City, and that the  requested vacation is not detrimental to the public health, safety and general welfare; and  WHEREAS, the Administrator of the Community and Economic Development EXPAND THE NUMBER OF ZONES IN WHICH HOMELESS SERVICES MAY LOCATE  AND OTHERWISE ALIGN WITH REQUIREMENTS OF ESSHB 1220, PROVIDING FOR  SEVERABILITY, AND ESTABLISHING AN EFFECTIVE DATE.     WHEREAS, the City of Renton is required as a result of Engrossed Second Substitute House  Bill 1220 adopted in the 2021 legislative session (ESSHB 1220) to update zoning requirements  related to Emergency Shelter, Emergency Housing, Transitional Housing, and Permanent  Supportive Housing; and  WHEREAS, in Ordinance Nos. 5996 and 6019, the City adopted interim zoning controls to  provide a path for permitting of homeless services with conditions based, in part, upon  documented safety, public health, and welfare considerations relevant to the siting of shelters  and housing covered by Engrossed Substitute House Bill 1220; and  WHEREAS, those safety, public health, and welfare considerations remain relevant; and  WHEREAS, pursuant to RCW 36.70A.106, on July 30, 2021, the City notified the State of  Washington of its intent to adopt amendments to its development regulations; and   WHEREAS, the Planning Commission held a public hearing on August 25, 2021 and on  September 1, 2021 voted to recommend to the City Council to make the previously adopted  interim zoning controls final with limited changes to comply with ESSHB 1220 and adopt  definitions and use classifications that better align with ESSHB 1220;   NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO  ORDAIN AS FOLLOWS:  AGENDA ITEM # 9. c) ORDINANCE NO. ________  2  SECTION I. The  above recitals as well as the recitals and findings of fact in Ordinance  Nos. 5996 and 6019 are adopted as findings of fact in support of this final zoning control SECTION V. Subsection 4‐4‐045.I.3 of the Renton Municipal Code, as adopted by  Ordinance No. 5996 and amended by Ordinance No. 6019, is amended as follows:    3. Occupancy Limits and Size‐Related Development Standards:  a. All homeless services uses shall comply with occupancy limitations  contained in applicable building and fire codes and ordinances adopted or  amended by the City.  b. In commercial and industrial zones where homeless services are  permitted, Overnight shelter such facilities shall not provide sleeping  accommodations for more than one hundred (100) occupants residents, or up to  one hundred and fifteen (115) residents if there is an written agreement with the  City to designate at least fifteen percent (15%) of the sleeping units to those  currently experiencing homelessness in the City.   c. Within the R‐1 Zone, homeless services uses shall not provide  sleeping accommodations for more than ten (10) occupants including staff. Within  the R‐10 and R‐14 Zones, homeless services uses shall not provide sleeping  accommodations for more than fourteen (14) occupants including staff.  AGENDA ITEM # 9. c) ORDINANCE NO. ________  4  c. Overnight shelter uses shall comply with the following additional  requirements:  id. Shelters Homeless services uses shall locate greater than one‐half  (0.5) mile from any other homeless services use, unless they do not serve more  than a combined one hundred fifteen (115) residents.  iie. Shelters Facilities with more than fifty (50) beds should shall locate  within one (1) mile of a public transit stop.  SECTION VI. The definition of “Homeless Services Use” in section 4‐11‐080 of the  Renton Municipal Code, as adopted by Ordinance No. 5996 and extended by Ordinance No. 6019,  is amended as shown below. All other definitions in 4‐11‐080 remain in effect and unchanged.  HOMELESS SERVICES USE:  A day sShelters or overnight shelter housing as defined  below:  1. Day Shelter: A facility that offers a haven to people experiencing homelessness  by providing a safe place to rest during the day or evening, but with no overnight  stays. Support services for homeless populations is an integral part of a day shelter  use and may includes but is not limited to access to food, seating, showers,  laundry, restrooms, storage, a computer lab, phones, fax, and a critical mailing  address. Spaces for meetings and examinations are generally provided to  accommodate counseling and access to medical/dental and legal assistance.  2. Emergency Shelter: Consistent with RCW 36.70A.030, a facility that provides a  temporary shelter for individuals or families who are currently homeless.  Emergency shelter may not require occupants to enter into a lease or an  AGENDA ITEM # 9. c) ORDINANCE NO. ________  5  occupancy agreement. Emergency shelter facilities may include day and warming  centers that do not provide overnight accommodations. Overnight Shelter: Any  facility that is operated for a long‐term and indefinite period (and not in response  to a single sudden event such as a natural disaster) for the primary purpose of  providing temporary shelter for people experiencing homelessness in general or  for specific populations of people experiencing homelessness. Supportive services  may or may not be provided in addition to the provision of shelter. A COVID‐19  deintensification shelter meeting this definition is a Homeless Services Use –  Overnight Shelter.  3. Emergency Housing: Consistent with RCW 36.70A.030, temporary indoor  accommodations for individuals or families who are homeless or at imminent risk  of becoming homeless that is intended to address the basic health, food, clothing,  and personal hygiene needs of individuals or families. Emergency housing may or  may not require occupants to enter into a lease or an occupancy agreement. A  COVID‐19 deintensification shelter meeting this definition is a Homeless Services  Use.  SECTION VII. Section 4‐11‐160 of the Renton Municipal Code is amended to add a new  definition of “Permanent Supportive Housing,” in alphabetical order, to read as shown below. All  other definitions in 4‐11‐160 remain in effect and unchanged.  PERMANENT SUPPORTIVE HOUSING: Consistent with RCW 36.70A.030,  subsidized, leased dwelling units with no limit on length of stay that prioritizes  people who need comprehensive support services to retain tenancy and utilizes  AGENDA ITEM # 9. c) ORDINANCE NO. ________  6  admissions practices designed to use lower barriers to entry than would be typical  for other subsidized or unsubsidized rental housing, especially related to rental  history, criminal history, and personal behaviors. Permanent supportive housing  is paired with on‐site or off‐site voluntary services designed to support a person  living with a complex and disabling behavioral health or physical health condition  who was experiencing homelessness or was at imminent risk of homelessness  prior to moving into housing to retain their housing and be a successful tenant in  a housing arrangement, improve the resident's health status, and connect the  resident of the housing with community‐based health care, treatment, or  employment services. Permanent supportive housing is subject to all of the rights  and responsibilities defined in chapter 59.18 RCW.  SECTION VIII. Section 4‐11‐200 of the Renton Municipal Code is amended to add a new  definition of “Transitional Housing,” in alphabetical order, to read as shown below. All other  definitions in 4‐11‐200 remain in effect and unchanged.  TRANSITIONAL HOUSING: Consistent with RCW 84.36.043, a project that provides  one (1) or more dwelling units and supportive services to homeless persons or  families for up to two (2) years and that has as its purpose facilitating the transition  of homeless persons and families into independent living.  SECTION IX. If any section, subsection, sentence, clause, phrase or work of this  ordinance should be held to be invalid or unconstitutional by a court or competent jurisdiction,
