("Property") described above, the Grantor(s), the owner(s) in fee of that Property, hereby
covenants (covenant)with the City of Renton ("City of Renton" or"City'), a municipal corporation
of the state of Washington,that he/she(they)will observe, consent to,and abide by the conditions
and obligations set forth and described in Paragraphs 1 through 9 below with regard to the
Property, and hereby grants (grant) an easement as described in Paragraphs 2 and 3. Grantor(s)
hereby grants (grant), covenants (covenant), and agrees (agree) as follows:
1. The Grantor(s)or his/her(their)successors in interest and assigns("Owners")shall at their own
cost, operate, maintain, and keep in good repair, the Property's drainage facilities constructed
as required in the approved construction plans and specifications R4072 (Project
P�an#) on file with the City of Renton and submitted to the City of Renton for the review and
approval of permit(s) C19003341 _(Construction/euilding/utilityPermit#).The
Property's drainage facilities are shown and/or listed on Exhibit A—Site Plan. The Property's
drainage facilities shall be maintained in compliance with the operation and maintenance
schedule included and attached herein as Exhibit B—Operations and Maintenance. Drainage
facilities include pipes, channels, flow control facilities, water quality facilities, on-site best
management practices (BMPs) and other engineered structures designed to manage and/or

treat starrr7water on the Prcap�r�y. C7n-site BMPs include ciispersioo� and infiltra�ican devices,
bioretentian, perrrreable pav�ments, rairmwater harvesting systems, tre� retentian credit,
reduced imperuious surface footprint, ve�etated roafs and oth�r m�asures designed�o mirr�ec
pre-develcaped hydrology and minimize storrnwater runoff an the Praperty.
2. City c�f Renton shall have the ri�ht to ingress ancf e�ress aver thc�se portions of the Prcaperty
nec�ssary ta perform inspections of the stormwater facllities ar�d E�MPs and conduct
roaaintenance activities sp�cifi�d ir� �his Declaratian of Cavenant arrd ir� accUrdance wi�h th�
Renton Municipal Ccade. City of Renton shall pravide at least thirty(30) days' written r�otiee fa
the dwners that entry on the Property"ss plarrned for tfroe inspection of drainage faci{ities.After
the thirty(30}days,the C7wners shall �Ifow the City of Renton to enter for the sale purpose af
inspeetin�draina�e facilities. In fieu caf inspection by the Ci�y,the C►wners may eleet to enga�e
� licensed civil engineer r�gistered in the state of Washington who has expertise in drainage ta
inspect the drainag� facilities and provide a written report describing their canditian. If the
engineer caption is chc�sen,the Owners shall provide written notice to the City c�f Renton within
fifte�n(15}days of receiv0ng the City's ncrtcce af inspection.Within thirty(s0}days of giving this
notice,the Owners,a�r engineer an behalf of th�Ctwners,shall prc�vide the engiraeer's r�part tca
the City of Renton. 9f th� report is raot pravided in a tirriefy mar7ner as specified above,th�City
of Renton may enspect the drainage faci6ities without further notice.
3. {f City a€ Rentan determines fram its inspectican, or fram an engineer's reparC provided in
accardance with Para�raph 2, that maintenance, repair, r�stora�ian, and/c�r mitigatian work es
required ta be dane�o any of the drainage faeilities, City of Rentan shall natify the C3wners af
the specific mairrtenance, repair, restoration, anc!/or mitigatian work (`•Wark'"j required
pursuant ta the Rer�ton iViunicipal Code. �i"he City sha61 also set a a�easonable deadline fcar the
awners ta camplete the Work, or tc� prov�de ar� engine�r's report�h�t verifies cc�mpBetior� of
the Wc�rk. After the deadlin� has passed, the Own�rs shal{ allcrw the City access tca re-iraspe�t
the drainage facilities �nfess ara �n�ineer's repart has been provided verifying completian af
the Work. If the W\lork is not completed withiro the tirne frarn� set by th� City, the Ci�y ra�ay
initiate an enforcement action and/ar perForm the Wark �nd hereby is given aecess ta the
Praperty fcar such pt�rpcases. Written notice will be sent tc� th� (JwnErs stating the City's
intenticrn ta p�rform sueh Work.This Work w6il nat camrnence until at least seven(7�days after
such notice is rnailed. Pf, within the sole discretion af the City, �here exists an imminent or
present dan�er, the seven (7j day nc�tice period wi6l b� waived and Wc�rk will begin
immediately.
4, Th� Ctwners shalP assume all respansibili�y for the ccsst of an�r Work, or any r�aeasures taken by
the Ci�y ta address canditions as described in Paragraph 3. Such responsibility shall inclucte
reimbursement to the City�ithin thirty(30)days of the r�c�ip�of the invoice for any such Wark
performed. Overclue payments will require payment of interest at the maxirrrum {��aB rate
allowed by RCW 19.52.02�(currently twelve p�rcent (12°!)). If the City initiates lega{actir�n ta
en�Force this agreemen�, th� prevailing party in such actior� is �ntitled to recover reasorrabl�
f�tigation cos�s and attorney's fees.

cratting, or removing vegetation (except in rautine landscape maintenance) in open ve�etated
