Format and Legal Description Review
Bob Mac Onie and I have reviewed the above referenced lot line adjustment submittal (dated August
7, 1998) and have the following comments:
Comments for the Applicant:
Is the 10 foot wide sewer easement over proposed Lots 5 and 6 private? If so,please note that fact on
the drawing.
The address for proposed Lot 5 has been changed due to the revision of the access for said lot. The
correct address is 308 Factory Ave.N. and that needs to be noted on the drawing.
The distance shown along N 4th St between Well Ave N and Factory Ave N is incorrect.
Correct the typo in the Owner's Certificate.
Questions or Comments to the Project Manager:
The comments above have been communicated to the surveyor but should still be passed to the
applicant.
Please note that the applicant needs to place a sign at the entrance to the alley off Factory Ave. N.
stating that this is a private drive and also noting the address for said Lot 5

Subject: Modification Request-Arcarius Homes Lot Line Adjustment

Dear Mr. Olschefski:
You have requested a modification of the access requirements for Lot 5 of your proposed Lot Line
Adjustment. The new Lot 5 would not have frontage on a street right-of-way, but is adjacent to an
existing 16' alley. The original proposed Lot Line Adjustment included a 20 foot access easement
across Lot 3, as permitted by City Code. Your request to use the alley for access by including an
additional four foot access easement is approved.
Modifications are allowed in the access and street improvement standards for development in the City of
Renton by the Street Improvement Ordinance, Section 4-34-11(B)which reads as follows:
'Modifications: Whenever there are practical difficulties involved in carrying out the provisions of
this Section, the administrator may grant modifications for individual cases provided she/he shall
first find that a special individual reason makes the strict letter of this Ordinance impractical, that the
modification is in conformity with the intent and purpose of this Ordinance, and that such
modification: (1) Will meet the objectives and safety, function, environmental protection and
maintainability intended by the requirements of this Ordinance, based upon sound engineering
judgment. (2) Will not be injurious to other property(s) in the vicinity."
The originally proposed access easement across Lot 3 would have restricted the developable portion of
Lot 3, and forced the siting of the house for this lot closer to the street. By utilizing the existing alley
right-of-way for access to Lot 5, Lot 3 could be developed with a somewhat larger house on a
reasonably sized lot. By adding an additional 4 feet to the alley with an access easement, the access to
Lot 5 will be the same width as required by Code, and can be paved to meet the twelve foot wide paving
standard required for access to a single lot. Additionally, secondary access would be available via the
alley right-of-way to the east of Lot 5.
The requested modification appears to meet the criteria for a modification, meets the objectives of the
Street Improvement Ordinance, and will not be injurious to other properties in the vicinity. The
modification is therefore granted.

but are not to be considered as primary access for emergency or Fire Department
concerns."
As you know lot 5 of the project is considered a land locked lot and would require an
easement through an adjoining lot to be buildable. Running an easement through either
lot 3 or 4 ( the only lots with enough room) would have the entrance and exit to lot 5 on
North 3rd Pl. and is believed by some ( including myself) to be a very difficult access.
I would like to propose that an easement of four feet be granted for lot 5 along the
Southern boundary of lot 6 so that with the existing 16 foot wide alley there would be a
20 foot access for emergency and Fire Department vehicles and uses. I would also
request that a modification to 4-34-5 be granted to allow the alley to be used as the
primary access to lot 5.

Dear Mr. Olschefski:
The City of Renton has reviewed your proposed lot line adjustment. Please make the following
changes so that we may approve your proposal:
1. Please make changes as requested by the Property Services Division (memo from Sonja Fesser
attached).
2. If a change of ownership is to occur prior to recording, a current title report reflecting the new
owner's name will be required before the City can approve the proposal.
3. The 20 foot easement shown across lot Lot 3 will not be approved due to safety and traffic
concerns. It has been suggested that the existing alley along the southern boundary of the
property be used as the primary access to Lot 5 instead of the proposed easement. The
elimination of the easement originally proposed will make Lot 3 more buildable as well as mitigate
the difficult access from North 3rd Street.
For fire and emergency purposes a 4 foot easement across Lot 6 is required in order to achieve a
total of 20 feet of access. The City will need to review the draft easement prior to the approval of
the lot line adjustment. The easement can be recorded consecutively with the lot line adjustment.
Also, a formal request for a modification to allow the use of the alley in combination with the
easement for primary access is required. The modification would be from the definitions section of
the Street Improvements Chapter of the Title IV Building Regulations (section 4-34-3).
Once the above changes have been made, please submit two copies of the lot line adjustment to me
for review. If you have any questions regarding your application, please contact me at (425)430-

Format and Legal Description Review
Bob Mac Onie and I have reviewed the above referenced lot line adjustment submittal and have the
following comments:
Note the City of Renton land use action number(LUA-98-112-LLA) and the city's land record
number(LND-30-0171)on the drawing. The type size used for the land record number should be
smaller than that used for the land use action number.
There appears to be a typo error in the bearing noted for the common north-south boundary line
between Lots 1 and 2.
The geometry will be checked when the above referenced bearings are provided.
Note that if there are restrictive covenants, agreements or easements (to the City of Renton or other
third party),they can be recorded concurrently with the lot line adjustment. For easements,indicate
on the drawing to whom the easement is granted. The lot line adjustment and the associated
document(s) are to be given to the City Clerk's office as a package. The lot line adjustment should
have the first recording number. The recording number(s)for the associated document(s)should be
referenced on the lot line adjustment drawings in the appropriate location(s).
Add the section,township and range to the new legal descriptions.
Ifnew easements are shown for the benefit of future owners of the proposed lots,then include the
following statement,juxtaposed to the subject easement(s): "Area for private easement for(water,
sewer stub,gas, access,etc.)." Since the new lots created via this lot line adjustment are under
common ownership at the time of recording,there can be no easement until such time as ownership of
one of the lots is conveyed to others,together with and/or subject to specific easement rights.
Also, add the following Declaration of Covenant language on the face of the subject drawing,if the
previous paragraph applies:

DECLARATION OF COVENANT
The owner of the land embraced within this lot line adjustment, in return for the
benefit to accrue from this subdivision, by signing hereon covenants and agrees to
convey the beneficial interest in the new easements shown on this lot line adjustment
to any and all future purchasers of the lots, or of any subdivisions thereof This
covenant shall run with the land as shown on this lot line adjustment.
Will there be a road maintenance agreement for the access easement over proposed Lot 3?
The addresses for the lots will be provided by the city as soon as possible. When available,note the
addresses on the drawing.
There is an incorrect call in the new legal description for proposed Lot 5.
Because the subject property is located within the Aquifer Protection Area,the Aquifer Protection
Notice needs to be noted on the drawing. See the attachment.

Regarding the Property addressed as 314 Factory Ave N.
Lots 1 through 7, inclusive , Block 11, Car Works Addition to Renton volume 15 of plats
page 47 King County Washington. Except those portions conveyed to the state of
Washington for Highway# 1 .
The purpose of the lot line adjustment is fully utilize the above property while making
convenient shaped lots for easy construction and resident use. The present lots are long
and narrow and not conducive to current popular building designs . This adjustment
will widen the lots to current City of Renton standards and meet all applicable codes .
