To Whom it May Concern:
Midnight Mountain Communications has been contracted to design, engineer and construct
this project on behalf of ExteNet Systems, Inc. (“ExteNet”). ExteNet is applying for an aerial
variance request in order to install new aerial fiber along Snake Hill. The specific exemption
ExteNet is seeking to utilize is under RMC 4-6-090 Utility Lines - Underground Installation,
Section D. Exemptions: 1. I, (i), and (ii). See attached submittal documents for further details.
ExteNet proposes to – Place new permanent aerial ¼” strand and 1728ct fiber on existing PSE
poles on SE 192nd St from HWY 167 to 108th Ave SE.
‐ Place Strand and complete Make Ready per PSE standards and approval.
‐ Place new 1728ct fiber on new proposed strand.
‐ Support and tag each pole with EXTENET labels (fiber tags).
ExteNet is requesting that the City of Renton approve this variance request based on the fact
that the requirements for undergrounding this proposed aerial fiber on existing infrastructure
will cause undue hardship. This section of fiber has been previously discussed with the city and
ExteNet and the City are in agreement that we should keep this section aerial for the
following reasons:
1.Safety is a top concern. Snake Hill is a windy sloped road and installation of
underground plant would be dangerous.
2.Installation of undergrounding facilities will increase the total cost of construction by
a factor of approximately 25 times, when compared to aerial installation.
3.Risk of potential damage to underground facilities will be increased.
4.There are sensitive areas along Snake Hill and utilizing an aerial installation will prevent
any impact on the sensitive lands in and around Snake Hill.
5.There are existing utility poles along Snake Hill that can be utilized for aerial attachment.
6.The variance is necessary to prevent any undue hardship due to the
increased construction costs if forced to install the proposed extension
underground, and avoid significant safety concerns.
7.The granting of the variance will not be materially detrimental to the public welfare.
ExteNet does agree to participate in future underground improvements for its
proportionate share of the undergrounding costs, waiving the obligation into the
future when all other utilities are undergrounded to prevent an undue hardship
against ExteNet currently.
Upon the granting of the variance, ExteNet will coordinate construction and traffic control
as per the requirements. ExteNet and their contractors want to cooperate at the highest
level and agree to adhere to all provisions and requirements set forth by the City of Renton
to insure safe installation and maintenance of the proposed facilities.

SUBJECT: Request for Undergrounding Exemption (JB#2020-1119, MFP21004567, 19201 108th Ave SE)
Dear Ms. Fenton:
The City of Renton has reviewed your request to grant ExteNet Systems Inc. an exemption from Renton
Municipal Code (RMC) 4-6-090(C) which states that all new electrical or communication facilities shall be
required to be installed underground, pursuant to the standards of the section of RMC.
Midnight Mountain Communications on behalf of ExteNet proposes to overlash 5,535 lineal feet of new
1728CT fiber on existing Puget Sound Energy poles along SE 192nd St within the City. See the enclosed Site
Plan showing the proposed overlashing limits.
ANALYSIS: The City has considered the request for a temporary exemption from RMC 4-6-090. The
proposal would utilize existing poles and attach to the existing aerial path. Ordinance 6013 grants ExteNet
Systems Inc., the right to construct, remove, replace, repair, and/or restore any Facility, and may include,
but are not limited to, digging and/or excavating to construct, remove, replace, repair, and restore
pipeline(s) and/or Facilities with the Franchise area.
The proposal would utilize existing poles and attach to the existing communication aerial paths. As
minimum vertical height clearance of 15’-6” would need to be provided for, and any existing obsolete
cable would need to be removed. Staff recommends these as conditions of approval. Therefore, the city
is granting an exemption with conditions, Per RMC 4-6-090(D)(i)(i) which states there is a technological
difficulty associated with the particular facility, or the particular real property involved.
DECISION: The requested exemption from underground utility installation requirements RMC4-6-090 (C)
in accordance with RMC 4-6-090(D)(i)(i), exemption due to a technological difficulty associated with the
particular facility, or the particular real property involved, as requested by the applicant is approved with
conditions subject to the conditions below.

Conditions of Approval:
1. Any existing height violations within the Project Reach must be resolved at the time of
construction. New aerial lines within the Project Reach must have a minimum vertical
clearance of 15’-6”.
2. Any abandoned or unused lines within the Project Reach must be removed at the time that
construction is taking place.
3. A traffic control plan must be separately submitted to the City, and no construction may take
place until the City has approved a traffic control plan.
4. The new aerial fiber lines within the Project Reach must be converted to underground
facilities in the future, at the Applicant’s cost, when any one of the following events occurs:
(1) any other utilities are undergrounded within the Project Reach, (2) a joint use trench is
proposed by a franchisee within the Project Reach, in which case the Applicant shall
participate in the joint use trench installation for the purpose of undergrounding its aerial
lines, or (3) a conduit is made available within the Project Reach that will accommodate the
aerial lines. The new aerial lines must be undergrounded within one year, or approved
otherwise by the City of Renton Community and Economic Development Administrator or
designee, from the first event triggering the requirement to underground the aerial lines.
This decision to approve the exemption with conditions is subject to a fourteen (14) day appeal period
from the date of this letter per RMC 4-8-110. Any appeals of the administrative decision must be filed
with the City Clerk, along with the required appeal fee, by 5:00 pm, October 21, 2021. Due to the ongoing
state of emergency enacted by Governor’s Proclamation 20-05, the City Clerk’s Office is working remotely.
For that reason, appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov or
delivered to City Hall 1st floor Lobby Hub only on Tuesdays and/or Wednesdays. The appeal fee, normally
due at the time an appeal is submitted, will be collected at a future date if your appeal is submitted
electronically. Appeals to the Hearing Examiner are governed by RMC 4-8-110 and additional information
regarding the appeal process may be obtained from the City Clerk’s Office, cityclerk@rentonwa.gov.

Engineering
1 Any abandoned or unused lines within the Project Reach must be removed at the time that construction is taking
place.
2 Any existing height violations within the Project Reach must be resolved at the time of construction. New aerial
lines within the Project Reach must have a minimum vertical clearance of 15'-6".
3 A traffic control plan must be separately submitted to the City, and no construction may take place until the City
has approved a traffic control plan.
4 The new aerial fiber lines within the Project Reach must be converted to underground facilities in the future, at the
Applicant’s cost, when any one of the following events occurs: (1) any other utilities are undergrounded within the
Project Reach, (2) a joint use trench is proposed by a franchisee within the Project Reach, in which case the
Applicant shall participate in the joint use trench installation for the purpose of undergrounding its aerial lines, or
(3) a conduit is made available within the Project Reach that will accommodate the aerial lines. The new aerial
lines must be undergrounded within one year, or approved otherwise by the City of Renton Community and
Economic Development Administrator or designee, from the first event triggering the requirement to underground
the aerial lines.
