The parcel is split zoned with the eastern side of the lot zoned Commercial Downtown (CD) and the remaining area zoned Commercial Arterial (CA). The applicant has proposed the fence to be installed one foot (1’) inside the property line surrounding the perimeter of the 16,000 square foot site, including within the front yard setback of the CA zoned portion of the property, with a single twenty-four foot (24’) wide double gate on the south edge of the parcel leading to S Tillicum St (Attachment A). The applicant is proposing to have the fence erected for up to one (1) year in order to maintain privacy and safety while they apply for land use entitlements related to development of the subject lot. The site is mapped with Wellhead Protection Zone 1 (Downtown Wellfield) and High Seismic Hazards and is overlayed with Urban Design Districts ‘A’ and ‘D’. Approximately four (4) City owned street trees exist on the north property line and the applicant is proposing to retain all 4 trees. ANALYSIS: The subject lot is split-zoned CA and CD and is therefore subject to Urban Design District ‘D’ and ‘A’ standards, respectively. The lot is also located adjacent to parcels in the Residential-8 (R-8) zone and the Medium Industrial (IM) zone and has frontage on Airport Way S, a Principal Arterial roadway. Pursuant to Renton Municipal Code (RMC) 4-4-040 Fences, Hedges, and Retaining Walls, fences are allowed anywhere on the commercially zoned lot provided the fence does not stand in or in front of any required landscaping or pose a traffic vision hazard. According to RMC4-4-070 F.1 Landscaping, ten feet (10’) of on-site landscaping is required along all public street frontages and per the City’s street tree inventory, there are four existing street trees present in the ten foot (10’) landscaping area. Based on the required landscaping setback as well as to maintain a pedestrian oriented environment as intended by urban design district standards, staff recommends as a condition of approval that the applicant set the fence back a minimum of ten feet (10’) from the north property line. Approval of the temporary use permit would provide short term relief from the intent and guidelines related to the pedestrian environment as set forth in the Urban Design Regulations. To mitigate the impacts of the fence along the street frontage of Airport Way, staff recommends as a condition of approval that the applicant use green or black vinyl coated fencing materials without slats in lieu of the proposed green screened fence along Airport Way. The applicant is currently in the process of applying for additional land use entitlements for a future project at the subject site, however, construction of the project is not foreseen to begin before expiration of this permit. An Abatement Agreement (Attachment C) has been submitted with the Temporary Use Permit application to acknowledge the terms of the fence removal at the time of permit expiration. Therefore, staff recommends as a condition of approval that if the applicant has not submitted a complete land use application and is in active pursuit of an entitlement for the proposed development project, the fencing shall be removed no later than October 7th, 2022. Any consideration for an extension request to this Temporary Use Permit while actively pursuing the entitlement and eventual construction will require the submittal of a landscape plan detailing landscaping and planters within the 10’ setback to provide a vegetative buffer. The landscape plan shall be reviewed and approved by the Current Planning Project Manager prior to permit extension and the landscaping shall be installed within 30-days of any extension unless otherwise amended by the Current Planning Manager. GENERAL REVIEW CRITERIA 4-9-240J: YES 1. The temporary use will not be materially detrimental to the public health, safety, or welfare, nor injurious to property or improvements in the vicinity of the temporary use. Comments: The temporary fence will not cause a visual disturbance or become a public detriment to the area and will increase safety by reducing the ability for trespassing on the subject site. There are parking stalls on the northeast edge of the lot that will be enclosed within the fence (Attachment A) and the new fence will not affect the abutting property that was informally using the stalls (Attachment B). YES 2. Adequate parking facilities and vehicle ingress and egress are provided to serve the temporary use and any existing uses on the site. Comments: There is no proposed parking associated with the fence. If needed, access to the site would be provided via a 24’ wide double gate off of S Tillicum St. YES 3. Hours of operation of the temporary use are specified and would not adversely impact surrounding uses. Comments: Not applicable. Compliant if conditions of approval are met 4. The temporary use will not cause nuisance factors such as noise, light, or glare which adversely impact surrounding uses. YES 5. If applicable, the applicant has obtained the required right-of-way use permit. Comments: Not applicable. The Temporary Use Permit is hereby Approved with Conditions* and subject to the following conditions:: *CONDITIONS OF APPROVAL: 1. The applicant shall set the fence back a minimum of ten feet (10’) from the north property line. An updated site plan showing the new placement of the fence shall be submitted to the Current Planning Project Manager for review and approval prior to the installation of any fencing. 2. The applicant shall use green or black vinyl coated fencing materials without slats in lieu of the proposed green screened fence along Airport Way. The updated material choice must be sent to the Current Planning Project Manager for review and approval prior to installation. 3. The fencing shall be removed no later than October 7th, 2022 if the applicant has not submitted a complete land use application while also actively pursuing an entitlement for a development project on the subject site by that same date. Any consideration for an extension request to this Temporary Use Permit will require evidence that the applicant is pursuing an entitlement and eventual construction for a development project on the subject site as well as the submittal of a landscape plan detailing landscaping and planters within the 10’ setback to provide a vegetative buffer. The landscape plan shall be reviewed and approved by the Current Planning Project Manager prior to permit extension and the landscaping shall be installed within 30-days of any extension unless otherwise amended by the Current Planning Manager. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation or fact. After review of the Reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame. Due to the ongoing state of emergency enacted by Governor’s Proclamation 20-05, the City Clerk’s Office is working remotely. For that reason, appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov or delivered to City Hall 1st floor Lobby Hub only on Tuesdays and/or Wednesdays. The appeal fee, normally due at the time an appeal is submitted, will be collected at a future date if your appeal is submitted electronically. Appeals to the Hearing Examiner are governed by RMC 4-8-110 and additional information regarding the appeal process may be obtained from the City Clerk’s Office, cityclerk@rentonwa.gov. EXPIRATION: This Temporary Use Permit is valid for up to one (1) year from the effective date of the permit. EXTENSIONS: Extension requests do not require additional fees and shall be requested in writing prior to permit expiration to the Department of Community & Economic Development Administrator based upon the conditions and limitation noted in the analysis above.
