1. 7he Grantor(s)ar his/her(their)successors in interest and assigns("Owners"a shall at their awn
cast,aperate, maintain, and keep in good repair,the Property's drainage facilities constructed
as required in the approv�d construction plans and specificatians (Praject
F�an tr) on file with the City of �tenton �nd subm+tted to the City of Rer�ton for the review and
approvat af permit(sj f�pnstruction/Buitding/UtilityPermit#).The
Property's drainage faci4ities are shtawn and/or listed on Exhibit A—Site Plan. The Property°s
drainage facilities shall be maintained in compliance with the operation and maintenance
schedu4e included and attached herein as Exh'sbit B—Operations and Mainter�ance. Drainage
facilities include pipes, channels, flow eontral facilities, water quality facilities, on-site b�st
manag�ment practices (BMPs) and cather engineered structures desi�,ned ta manage and/ar

treat stormwater on the Praperty. t3n-site �MPs include dispersion and infiitration devices,
biore#ention, permeakale pavements, rainwater harwesting systems, tree retention cr�dit,
reduced imperviaus surface faotprint, vegetated roofs and ather rrteasures designed to mimic
pre-developed hydrology and minirr�ize stormwater runoff on the Property�
2. City of Renton shall hav,e the right ta ingress arrod egress aver thase portions of�he Property
necessary to perform inspectians of the stormwater facilities and BMPs and conduct
maintenance activities specified in this l7eclaration af Covenant and in accordance with the
Renton Municipal Cade. City af Renton sha10 provide at least thirty {30� days' written natice to
the Owners that entry on the Praperty is planned far the inspection of drainage facilities.After
the thirty (30) days, the Owners shall allow the City of Rentan to enter for the sale purpose af
inspe�ting drainage facilities. In lieu of inspection by the City, the Owners may elect to engage
a licensed civi3 engineer register�d in the state af Wash�ngtan who has expertise in drainage to
inspect the drair�age �acilities and provide a written report describing their candition. If the
en�ineer option is chcrser�,the Owners shall prvvide written notice to the City of Renton within
fifteen(15) ciays of receiving the City's notice af inspection. Within thirty(30)cfays of giving this
notice,the(7wners,or engineer on behalf of the Qwners, shall prouide the engineer's report to
the City of Rentcrn. If the report is not provided in a timely manner as specif'red abr�ve, the City
af Rer�tan may inspect the drainage facilities withaut further natice.
3. If City of Ftenton deterrr�ines frarn its inspection, or from an engineer's report provided in
accordance with Raragraph 2,tha�mainter�ance, repair, restoration, and/or mitigat'ron wark €s
required to be done to any af the drainage facilities, City af Rentan shall natify the CJ�wners of
the sp�cifBc maintenanee, repair, restora�ian, ar�d/or mit'tgation work ("Work") requir�d
pursuant to the Rer►ton Municipal Cade. The City shall also �et a reasonable deadfine for the
Owners to earv�p6ete the Work, ar to provide an engineer's r�port that verifies completion of
the Work. After the deadline has passed, tt�e Ovvners shall allaw the City access to re-inspect
the drainage facilities unless an engineer`s repart has been provided verifying completion of
the Work. Of the Work is nat compieted within th� time frame set by the City, the City may
initea�e an enforcement actian and�ar perfarm the Wc,rk and hereby is given access to ihe
Property for suchr purposes. Written notice will be sent ta the f�wners stating the City''s
intention ta perfarrn su�h Work.7his Wark will not cammence until at least seven (7)days after
such notice is mailed. t#, within the sole discretian af the City, there exists an irnminent ar
present cfan�er, the seven �7� day notice period wilf be wa6ved and Work will begin
immediately.
4. The C�wners shall assume all respansibility far the cost of any Work, ar any measures taken by
the City to address conditions as describ�cf ir� Paragraph 3, Such responsibility shaU include
reimbursement to the City within thirty(30)days of the receipt af the invoice far any such Work
performed. (�v�rdue payments will require payment of interest at the maxirnum legal rate
allowed by RCW 19.52.Q20(currently twelve percent (12�o)y. If the City initiat�s legal action ta
enfiorce this agreement, the prevailing party in such action is entitled to recover reasonable
lit'sgatir�n casts and attorney's fees.
5. The Owners are reqr�ired to abtain written approval from City caf Rent�n prior to filling, piping,
cutting, ar remaving vegetation (except in routine landscape maintenance) in open vegetated
storrr�water facilities (such as swales, channels, ditches, ponds, etc.�, or perforr�ning any
alteratians or modificatians tc�the drainage facilities refere�ced in this Declaratior�ofi C4venant.

. 6. Any notice or consent required ta be given car otherwise provided for by the provisions af this
Agreement shail be effective cappn persanai delivery,ar three(3)days after mailing by Certified
Mail, return receipt requested.
7. With regard to the matters addressed herein,this agreement cc�nstitutes the entire agreement
between the parties, and supersedes all priar discussions, negotiations, and all agreements
whatsoever whether crral ar written.
8, This Decbarafiion o� Covenant is intended Co pratect the value and desiraSaility and promate
efficient and effective mar�agerr�e�t of surface water drainage af the real praperty described
abave, and shall inure to the �enefit of a!I the citizens of the City of Renton and its succ�ssars

MAINTENANCE INSTRUCTIONS FOR FULL INFILTRATION
Your�ro�erty coiitaiiis aii ou-site BMP (best i��auagei��eiit�ractice) called `full infiltration,"which
was installed to mitigate the stortnwater quantity and quality impacts of some or all of the imperviou
surfaces on your property.
Full infiltration is a method of soaking runoff from impervious area (such as paved areas and roofs)
iiito the grouud. If pioperly iiistalled aiid ivaiiitaiued per Appeiidix A of the City of Reutoii's Suifacf
Water Design Manual, full infiltration can manage runoff so that a majority of precipitation events a�
absorbed. Infiltration devices, such as gravel filled trenches, drywells, and ground surFace depressiox
facilitate this process by putting runoff in direct conta.ct with the soil and holding the runoff long
enough to soak most of it into the ground. To be successful, the soil condition around the infiltration
device must be reliably able to soak water into the ground for a reasonable number of years.
Infiltration Devices
The infiltration devices used on your property include the following as indicated on the sit�
plan(CHECK THE BOX(ES) THAT APPL�:

MAINTENANCE RESTRICTIONS
The size, placement, and composition of these devices as depicted by the site plan and design details
must be maintained and may not be changed without written approval from the City of Renton or
through a future development pernut from the City of Renton.
INSPECTION FREQUENCY AND MAINTENANCE GUIDELINES
• Infiltration devices must be inspected annually and after major storm events to identify and
repair any physical defects.
• Maintenance and operation of the system should focus on ensuring the system's viability by
preventing sediment-laden flows from entering the device. Excessive sedimentation will res�
in a plugged or non-functioning facility.
• If the infiltration device has a catch basin, sediment accumulation must be removed on a yea
basis or more frequently if necessary.
• Prolonged ponding around or atop a device may indicate a plugged facility. If the device
becomes plugged, it must be replaced.
• Keeping the areas that drain to infiltration devices well swept and clean will enhance the
longevity of these devices.
• For roofs, frequent cleaning of gutters will reduce sediment loads to these devices.

RECORDING REQUIREMENT
These full infiltration on-site BMP maintenance and operation instructions must be recorded as an
attachment to the required declaration of covenant and grant of easement per Requirement 3 of
Section C.1.3.4 of the City of Renton Surface Water Design Manual. The intent of these instructions
to explain to future property owners, the purpose of the BMP and how it must be maintained and
operated. These i��structio��s are inte��ded to be a iruui��iui��; the City of Re��to�����ay require additio���
instructions based on site-specific conditions. See the Gity of Renton's Surface Water Design Manu�
