Ordinance #3637 An ordinance was read relating to land use and zoning for adult entertainment theaters, amending Ordinances 3526 and 3629 by deleting emergency clause and re-enacting the remainder. MOVED BY STREDICKE, SECOND BY ROCKHILL, ADOPT THE ORDINANCE AS READ. ROLL CALL: ALL AYES. CARRIED. Voucher Payment Ways and Means Committee Chairman Stredicke recommended approval of Vouchers 40062 through 40374 in the amount of $1 ,499,422.62. CORRESPONDENCE Devil ' s Elbow Letter from Pete and Diana Caple, 9628 - 123rd Avenue SE, Renton, Clean-up - thanked Ed Hayduk for his efforts in cleaning out Devil ' s Elbow, Signing Proposed wooded area east of Kennydale. Ed' s crew and approximately 15 community volunteers spent many hours in beautifying this area used by many for hiking, fishing and nature walks. "Run for the Letter from Dennis Robertson, Chairman, Southcenter Kiwanis Race Roses" Committee, Tukwila, thanked Council for its assistance in making the annual 10 kilometer "Run for the Roses" foot race a success. The race, held June 13, had more than 700 registered entrants. Profits from the race will be used for local charity work by the Kiwanis Club. Eastside Water- Letter from David R. Clemens, Policy Development Director, requested a Shed Project public meeting be held June 21 , 1982, to obtain public comment on recommendations to the Basin Executive Committee for the Eastside Watershed Project as concerns possible City withdrawal from the SCS/P-1 project and development of City' s potential flood storage regulations. Councilman Rockhill recommended inviting representatives of the Drainage District to attend this meeting. Newcastle Policy Development Director Clemens submitted a letter to King County Community Plan Executive Revelle and Members of the King County Council for Renton City Council President Clymer' s signature making the following recom- mendations regarding the Newcastle Community Plan: The King County Council reject the recommendation of the designation of one-half acre single family residential as a reserve on the East Renton Plateau and the use of on-site sanitary sewage disposal as a permanent solution in the East Renton Plateau; the May Creek Basin Plan specifically require the extension of sanitary sewers; the King County Council provide for additional convenience retail uses on the East Renton Plateau; and the King County Council not only designate but provide methods of funding active recreational space in the Newcastle Community Plan. Ferguson, Mayor, City of Bellevue, requested City' s Services cooperation in securing an agreement for marine patrol services for 1982. Although no facts or figures were given, Mayor Ferguson stated a solution had been obtained that, he believed, would place a minimal financial burden on each agency involved. Mayor Shinpoch noted she would have more information next week regarding other cities' actions on the marine patrol proposal . In order to foreclose any argument over ' the validity of the amendments , we propose that this Ordinance be re-enacted with the deletion of the emergency clause so that it will become law 30 days after its re- enactment . We are drawing legislation to implement this and we propose that the Ways and Means Committee recommend to the Council that this matter be placed on first , second and final reading at the first available Council meeting on June 7 , 1982 . Council Picture Theaters President Clymer called attention to the Council ' s rule of limiting remarks to five minutes and matters not already com- mented upon, if possible. Clymer explained that on 4/13/81 , Council adopted Ordinance No. 3526 defined and prohibited loca- tion of an adult motion picture theater within an area circum- scribed by a circle with radius of 1 ,000 ft. of a residential zone or use; one mile of public or private school ; 1 ,000 ft. of church or religious facility or institutions and 1 ,000 ft. of public park or P-1 zone. Clymer further noted the City and members of the Council , Mayor, City Clerk and Police Chief have been sued in US District Court by two corporations apparently owned by Roger Forbes, purchaser of Renton and Roxy Theaters 1/2(,/81 . The Mayor Pro tem further explained the Renton and Roxy Theaters fall within the distances set forth by Ordinance No. 3526 and are not a lawful location for an adult motion pic- ture theater; that Forbes ' suit contends the ordinance is un- constitutional and should be stricken. Clymer reported the City Council and Mayor Shinpoch have instructed the City Attorneys to defend the litigation imposed by Forbes and have authorized association with expert in First Amendment litigation involv- ing pornography by name of James J. Clancy of Los Angeles. Clymer assured City's intent to support the legislation to preserve the character of community and prevent deterioration of neigh- borhoods. Mayor Pro tem further explained that because of the litigation , members of the Council are not at liberty to make public comment; invited public testimony concerning acceptable locations within the City for adult entertainment land use. Mrs. Picture Theaters Keolker expressed the group's support of the City in defense of Ordinance 3526, land use zoning for adult entertainment ; noting zoning enforcement for other businesses and residences. Keolker Favoring Ordinance explained objections to pornograph. Robert Brownlow, 17702 160th Ave. SE, discussed history of rights; freedom of speech vs freedom of license or expression; right of community to defend itself against destruction of liberty by pornography. Charlotte Kegley, 1032 Redmond Ave. NE, President of Renton PTSA spoke out against pornography, noting 75% ends with children. Chuck Slothower, 517 S 17th St. , expressed concerns over X-rated movies on 3rd Ave. 5, about outside detrimental influence on children and families; and proud of reaction of community to fight. Francis Smith, 1724 Jones Dr. SE, questioned rights to bring pornography and called for rights of his and other families and spoke against pollution of young. Marilee Hoffman, Highlands Elementary School PTA President and Boy Scout leader, 845 Index Court NE, explained negative aspects of pornography and detri - mental affect upon children and called for rights of citizens. Brad Allen , Senior from Kentridge High School , 17801 142nd NE, spoke out against pornography and the portrayal of theater owner as a good businessman. Don Jacobson, 2919 NE 5th Pl . , Renton School Board Member, noted support of ordinance at original Planning and Development Com- mittee meeting, objecting to close proximity of theaters to the Renton High School . Craig Brewer, MD, 315 Morris S, surveyed patients and reported 90% of older children and adults opposed the location of pornographic theaters on S 3rd St . and noted had additional petitions; also feared empty buildings downtown Don Holm, Attorney, 1015 Tacoma NE, Office 1002 S 3rd , opposed x-rated theaters on S 3rd (objecting to unhuman/degrading quality) noting clients must pass those theaters to reach his office due to one-way street system. Mel Prue, 15222 SE Maple Valley Hwy, foresaw trouble from pornographic theater attendees. John Quinn, 88 Lincoln St. , noted jewlery business on 3rd affected. Lew Yahoudy, 1018 Pierce Ct. NE, told of incident that happened while carrying sign at theater. Nadine Rood , 12696 SE 169th St. , reported sexual assault prisoners object to the pornographic theaters as have contributed to their crimes. Mike Paxton , 17045 125th SE, explained the universal concept of sowing seed, noting seed of pornography sows corruption. Joe Riedi , 13635 SE 135th, noted heavy imprinting by pornography on the mind which causes trouble at home and in marriages , causing need of counseling. LeAnne Johnson, 1739 NE 6th St. , children's program leader, objected to pornographic theaters in downtown Renton. Rev. Wayne C. Anderson, Lake Boren Christian Center, 1801 Union Ave. NE, noting self indulgence may destroy rights of others that x-rated movie theaters do not have the right to lure and degrade our community causing problems in families and commended citizens for fight. Victor Proulx, 1519 Jefferson NE, does not want pornographic theaters downtown and supports ordinance which leaves area for theaters. William Heiser, 921 Monroe NE, St. Anthony Catholic Church and members support ordinance. Farley Kessler, Empire Estates , opposes pornographic theaters in down- town; represents First Baptist Church and members; also objected to reference to "adult" when referring to pornographic. Adult motion picture theaters are prohibited within the area circumscribed by a circle which has a radius consisting of the following distances from the following specified uses or zones : 1 . Within or within one thousand (1000 ' ) feet of any residential zone (SR- 1 , SR-2 , R-1 , S-1 , R-2 , R-3 , R-4 or T) or any single family or multiple family residential use . 2 . One (1) mile of any public or private school 3 . One thousand (1000 ' ) feet of any church or other religious facility or institution 4. One thousand (1000 ' ) feet of any public park or P-1 zone . B . The distances provided in this section shall be measured by following a straight line , without regard to intervening buildings , from the nearest point of the property parcel upon which the proposed use is to be located , to the nearest point of the parcel of property or the land use district boundary line from which the proposed land use is to be separated. At that meeting, the Commission referred the matter to its Special Studies Committee for investigation and report back. The Special Studies Committee initially met with Dan Kellogg, Assistant City Attorney, who explained the Council's referred item. The Committee members considered various options open to the committee and to the Commission. After looking at said options, it was unanimously decided by the Committee to refer the matter back to the full Commission with the recommendation that the Commission, in turn send the question of adult entertainment back to the Council for further action as it deems necessary. The Commission met at its regular meeting of November 12, and concurred in the Committee's recommendation. The Commission, at this time, has before it many matters which it feels are of great importance and urgency. The Commission, therefore, respect- fully suggests that the referred subject matter could best be handled by a Council committee and a citizen's committee appointed by the Council and reporting directly to the Council for the specific purpose at hand. The Commission also feels that most of the facets involving adult enter- tainment are not within the purview of the Commission, except perhaps in some later review of the zoning ordinance. The overriding consensus is that the Commission is overburdened with priorities which the Commission feels are in need of immediate action. Review of the comprehensive plan relating to mobile home parks. 6. Review of the parking and loading ordinance. 7. Review of the PUD ordinance. RENTON CITY COUNCIL "FROM: RENTON PLANNING COMMISSION The Renton Planning Commission received and first considered your referral on adult entertainment "land uses" at its regular meeting on September 20, 1980. At that meeting, the Commission voted to refer the matter to its Special Studies Committee for investigation and report back. The Special Studies Committee met first with Attorney Don Kellogg who explained the Council's referred item, The Committee members have met, and in their lost meeting on November 6, 1980, considered several options open to the committee and to the Commission. After looking at various options, it was unanimously decided by the Committee that the matter should be referred bock to the full Commission with the recommendation that the Commission, in turn, send the question of adult entertain- ment back to the Council for the Council's further action as it deems necessary. APPROVAL OF MINUTES: The Chairman called for corrections or additions to the minutes of October 15, 1980. Commissioner Walker, referring to Section 6 of the October 15, 1980 minutes regarding the Newcastle Area Plan, requested that the minutes reflect that Commissioner Schellert represents the City of Renton and not just the Renton Planning Commission in that plan. Commissioner Walker noted that perhaps this would also eliminate some question as to Commissioner Schellert' s position on that committee as well. NORTHEAST QUADRANT STUDY COMMITTEE Chairman Walker advised that a fieldtrip was held October 18th and the committee also met once during the last month. A committee meeting is scheduled for November 19th at 7: 00 p.m. Gary Norris , Traffic Engineer, has been invited to attend and the agenda is to include his comments. The Planning Director commented that Mr. Norris has agreed to come before the committee and state his position. He also advised that the Director of Public Works will be invited to address the important areas of utilities and sewer services. t Renton Planning Commission Public Meeting, November 12, 1980 Page Three The Commission during this period of time has before it many matters to be studied which are of great importance and urgency, and the Commission respectfully suggests that the referred subject matter might best be handled by a Council committee and a citizens' committee to be appointed by the Council which would report directly to the Council. The Commission feels that some of the facets involving adult entertainment ore not necessarily within the purview of the Commission, except perhaps in some later review of the zoning ordinances at on appropriate and more convenient time. However, the overriding consensus is that the Commission is overburdened with priorities which the Commission feels ore in need of immediate action. The Commission feels that the following are some of the most pressing physical land use issues which must be studied with the most expeditious speed possible (some of which obviously require lengthy time and study) : 1. The Northeast Quadrant review of the comprehensive plan now under way and which will continue for eight more months. 2. The Central Area study encompassing the downtown business district, South Renton, North Renton, Earlington, West Hill, and Skyway, which likewise is under way and will continue for eight to ten months. 3. The Shoreline Master Plan which, by law, requires periodic review and update. 4. Review of the Green River Valley comprehensive plan. 5. Review •of the comprehensive plan relating to mobile home parks. 6. Review of the parking and loading ordinance. 7. Review of the PUD ordinance. As you can see, our schedule is very full. There was considerable discussion on the moratorium as declared by the City Council under Resolution #2368, its appropriateness as an item before the Planning Commission and the Special Studies Committee. Mrs. Scott was particularly concerned because, since the closure of Austin Rexall Drugs , Bartell 's is the only drugstore in the downtown core area, thus eliminating any choice for patrons who would prefer not to shop at an establishment selling smut. OLD BUSINESS Community Community Services Committee Chairman Reed submitted committee Services report recommending that the 10/6/30 referral of potentially Committee hazardous trees on Sunset Blvd. SW be referred to the Planning Trees Adjacent Department with the directions to contact the developer on the to Sunset Blvd SW site adjacent to Sunset and identify potentially hazardous trees for removal . Land Fill The Community Services Committee recommended extension of the Moratorium existing land fill moratorium for a period of 60 days and (Referred included three other referrals affecting the need for moratorium: 12/10/79) Green River Flood Basin Project (referred 12/10/79) , Federal 60-Day Extention Flood Insurance (referred 5/5/80) and Flood Hazard Ordinance Requested (referred 11/6/78) . The report stated the resumption of land fill in this area without complete understanding of the impact could result in a threat to public health, safety and welfare; could result in displacement of valuable wetlands and wildlife habitat; and could result in precluding alternatives such as a natural drainage system when the Comprehensive Plan does not include the Green River Flood Basin Project. The report further stated the 60-day extension would allow the Planning Department and Planning Commission additional time for ordinance preparation. MOVED BY REED, SECOND STREDICKE, COUNCIL CONCUR IN REPORT. Upon inquiry Councilman Reed noted existing land fill permits are being used, the moratorium prohibits issuance of new permits. Transportation Councilman Stredicke, Chairman of the Transportation Committee, Committee noted meeting with Diaro Ledbury concerning potentially dangerous Progress Reports streets in the northwest section of the City and noted progress, and Inquiries report following meeting with school district. Councilman Stredicke also reported progress on the Jon Troxel matter and requested information from the Administration (alley near new Taco store) ; reported Police response re light at Honeydew School on Union Ave. NE as very efficient; and noted good State response to installation of traffic light at 131st on Maple Valley Hwy. with signal approved and funding being sought. Councilman Stredicke inquired regarding the Hearing Examiner' s denial of the City' s request for rezone of surplus Park Department property and was advised by Mayor Shinpoch that the City Administration would be discussing the matter and processing any appeal , as the Legislative body would be making the final decision on any land use appeal . RESOLUTION NO. 2368 A RESOLUTION OF THE CITY OF RENTON, WASHINGTON, DECLARING A MORATORIUM ON THE LICENSING OF BUSINESSES SELLING OR SHOWING SEXUALLY EXPLICIT MATERIALS WHEREAS the City of Renton is a residential city with a discreet business area; and WHEREAS the residential areas and the business areas, in all instances, are located in close proximity to one another; and WHEREAS sexually explicit material , including books, magazines, pictures , and movies, whether sold, rented, or showed on premises, may legitimately be controlled by a municipality, either through gathering in one location, or separating from other uses which will be inordinately impacted by the sale, rental, or showing of sexually explicit materials; and WHEREAS the City of Renton does not, at the present time, have any business whose primary purpose is the sale, rental , or showing of sexually explicit materials; and WHEREAS the subject matter has been referred to the Planning Commission of the City of Renton for study and report back; and WHEREAS the establishment of a business which, as its primary purpose, sells, rents, or exhibits sexually explicit material would have a severe impact upon surrounding businesses and residences: NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON DO RESOLVE AS FOLLOWS: 1. The above findings are found to be true and correct in all respects. 2. There is hereby established a moratorium against the granting of any business license to any business to be established within the City Limits of the City of Renton, which business has as its primary purpose the selling, renting or showing of sexually explicit materials. Such moratorium shall be in effect for the period of one hundred twenty (120) days, but shall be automatically extended for a period of further ninety (90) days, should a report and recommenda- tion from the Renton Planning Commission not be received by the Renton City Council , and acted upon by the Council , within such time period. -1- 3. For the purpose of this Resolution sexually explicit materials shall be those materials which show, portray, describe or otherwise primarily relate to sexual intercourse, or excretory functions , or which portray or show male or female genitalia, the breasts, anus , buttocks, and which are primarily intended to appeal to the erotic interest, whether or not the same could be defined as obscene or not. He indicated his concern regarding the definition of "local government . " He noted his feeling, however , that local governments should cooperate and that is the intent of the document . Discussion among the Commissioners followed in which it was suggested that the document should be returned to committee for further overall review or that another point of view might be appropriate . The depth of the Special Studies Committee review and its attempt to impart the essence of cooperation was again noted. Commissioner Jacobs expressed his support , noting that it would be a working document which can be amended . COUNCIL REFERRAL: 7* REGULATION OF ADULT ENTERTAINMENT LAND USES The Chairman referred the membership to a Council referral requesting that the Commission hold public hearings at the earliest possible date on the subject of possible amendments to the Comprehensive Plan and amendments to the Zoning Code as may be desirable to regulate adult entertainment land uses within the City of Renton . The Chairman suggested that the Commission consider holding a public hearing at the October meeting with referral to a committee for review following the hearing . The Planning Director noted that background information should be available from the City Attorney . Discussion among the Commissioners followed concerning the appropriateness of the Commission ' s considering this issue, the matter of priorities as they relate to current Commission studies , and the need for a defini- tion of "adult entertainment . " It was suggested that it might be a matter for committee review and recommendation . The Planning Director discussed the reasons for the referral coming before the Commission , noting that it is the City Attorney ' s feeling that sending the matter to the Commission would place it on a more objective level , inasmuch as the issues could be viewed in relation to the Comprehensive Plan as well as the Goals and Policies of the City . Renton Planning Commission Public Meeting - September 10 , 1980 Page Five ACTION : MOVED BY WALKER , SECONDED BY JACOBS , THAT THE PLANNING COMMISSION ADOPT THE FOLLOWING FORMAL RECOMMENDATION TO THE CITY COUNCIL : A RECOMMENDATION OF THE RENTON PLANNING COMMISSION REQUESTING THE RENTON CITY COUNCIL TO INITIATE A TRANSPORTATION/TRAFFIC STUDY AND TO IMPLEMENT MITIGATING MEASURES IDENTIFIED BY SUCH STUDY WHEREAS , transportation/traffic problems are of City-wide concern , and WHEREAS , problems of increasing traffic/transportation congestion have been compounded in the past three years , and WHEREAS , the continued deterioration of the trans- portation system adversely affects the quality of life within the City of Renton , and WHEREAS , traffic/transportation problems directly affect land use decisions and thus directly affect the Planning Commission ' s ability to effectively maintain a viable Comprehensive Plan , and WHEREAS , solutions to traffic/transportation problems will become more difficult to implement and to finance , if not acted upon promptly , and THEREFORE , the Renton Planning Commission recommends to the Renton City Council that the 1981 budget include funding for a Comprehensive Transportation/Traffic Study to ( 1 ) identify problem areas , ( 2 ) evaluate solutions to these problems , and ( 3 ) to prioritize phasing of improvement , and THEREFORE , the Renton Planning Commission is willing to assist in the identification of traffic problem areas , consideration of solutions to these problems , and ultimately to recommend priorities for improvements resolving these traffic problems . MOTION CARRIED . 8 . KING 5UBREGIt AL PLAN: Comments were invited from Committee Chairman Mola by Chairman Porter . Commissioner Mola referred the Commission to the Committee ' s final draft which is presented for Commission concurrence and submission to the City Council for consideration . In response to the Commission ' s inquiries as to the intentions of the Committee ' s proposed revisions , it was explained by Commissioner Vaupel that they were trying to provide for local autonomy although encouraging cooperation and using the Subregional Plan to advantage . The goal was to try to make sure that the Committee , the Commission and the City Council know exactly what is being said in the document . General comments were maLe by the Planning Director concerning the difficulty in evaluating some of the intent of these policies and their impact , and it was noted that there had been 18 committee meetings to accom- plish this review . Mr . Ericksen indicated that this document represents policies for a 25-30 year period . It was agreed that the Planning Director would arrange for the Committee to meet with the City Attorney in order to obtain some background for its review . 10 . ADMINISTRATIVE : A . COMMITTEE REPORTS The Chairman called for committee reports . 1 . GOALS AND POLICIES COMMITTEE NORTHEAST QUADRANT STUDY COMMITTEE It was noted that the Goals and Policies Com- mittee has completed its assignment . Therefore, Chairman Walker announced the dissolution of the Committee and the reactivation of the Northeast Quadrant Study Committee . She scheduled a meeting of that Committee for 7 : 30 p.m . , October 1st . 2 . CENTRAL STUDY AREA COMMITTEE Chairman Warren reported that the Committee had met once since the August meeting . Items of discussion included the Committee ' s annual report and zoning and the downtown area . 3 . SPECIAL STUDIES COMMITTEE The Chairman noted the conclusion of the study of the King Subregional Plan. Commissioner Mola requested that a new Chairman be assigned in view of his possible departure from the Commission . 4 . NEWCASTLE PLANNING AREA COMMITTEE Commissioner Schellert noted that the Committee had made three hikes on Cougar Mountain and had resumed thcir weekly meetings the previous evening. The working draft of the proposed draft is currently being reviewed . They are trying to incorporate the Cougar Mountain areas into the Plan . It was agreed that a presentation of the working draft be made to the Commission in October in order to offer the Commission an opportunity for comment . b . PLANNING COMMISSION ANNUAL REPORT The final draft of the Planning Commission ' s Annual Report for 1979-80 was presented for Commission approval . The following revisions were requested : that the latest Council referral be included and that the referral from the Kennydale Community be deleted. At Commissioner Walker ' s request , --Ythe Planning Director agreed to review the schedule —for review of the Shorelines Master Program . MOTION CARRIED . C . COMMITTEE STRUCTURE The Chairman reviewed the existing committee structure wind made the following decisions : 1 . The Northeast Quadrant Study Committee is to retain its present membership of Walker , Schellert , and Porter with Commissioner Walker as Chairman. 2 . The Central Area Study Committee is to include Commissioners Warren , Vaupel , and Maxin with Commissioner Warren as Chairman. 3 . The Special Studies Committee is to include Commissioners Mole , Vaupel , and Jacobs and, pending Council confirmation , newly appointed Commissioner Houser . Commissioner Vaupel was appointed Chairman . D . 1980 FALL PLANNING ASSOCIATION OF WASHINGTON CONFERENCE It was noted that the Fall Conference of the Planning Association of Washington is scheduled for October 8 , 9 and 10 in Richland . It was noted that detailed information concerning the program has yet to be received but that it involved energy and lifestyle and authorization has to be made this evening for any members wishing to attend. The Commission ' s attention was directed to a six-part documentary , " The Landy," which will be aired on KRAB/Seattle , 107 . 7FM , from 9 :00 - 11 :00 p.m . on September 16 , 19 , 23 , 24 , 25 , and 30 . 3 .
