Motor, City Clerk Re: Request for information, Staff meeting of 12/30/85 Regard- ing Vacation of Mountainview Ave. N. , Lots 38 and 39 as Petitioned by Ted LaValley and Harry Patterson. Public hearing for above-captioned street vacation was held May 17, 1976. The property was obtained from.King County during annexation of Kennydale area with restrictions for street and roadway purposes. At the hearing it was determined that State law prohibits vacation when on fresh or salt water unless for moorage, park or educational purposes. It was determined the topography was too steep for such purposes and issuance of a revokable permit was suggested by City Attorney Shellan. The Legislation Committee prepared such permit and authorized Mayor and Clerk to sigi. On June 20, 1976 the subject of the Kennydale lots (LaValley) was referred to the Community Services Committee. The subject does not readily appear to have been reported out of the committee. Hillman's Addition to Seattle • Dear Dick: Thank you for the original plat map together with the deed quit claiming the property to King County. The o iginal plat shows that the Lots in question do not borde an open street, but rather border a railroad right-of- way. Later the property was quit claimed to King County on a form deed, the printed portion of which grants the property for laying out and establishing a public road. This deed was apparently signed in 1907 while the original plat was in 1904 . The dedication for a dock and as a road are contradictory. There is no other road to which this road could connect. Therefore, the handwritten language dedicating the property for a dock would appear to be controlling. Additionally, there is a rule of law that if the language is ambiguous that handwritten terms would rule over preprinted terms . If the City wishes to dispose of this property I think several things must be done. Initially, the City Council must review the mutter and declare that the property is not within the City'ls inventory of right-of-way and that the City has no intention of developing the property as right-of-way and that it has always been held from the time of vacation forward as a dock or whlrf site. Next, the City Council should declare the property as su plus. Then we should contact a title insurance company and see i we can get clear title. If the title insurance company will of give us clear title, then the City must determine wheth r or not it is economically advantageous to file a declaratory judgment action to see if we can obtain clear title. Hillman Plat Per our conversation last week, Barbara has asked that we resolve the questions surrounding the status of the referenced lots which are currently in City owrrership. The primary question is what flexibility does the City have in disposing of these lots if they are determined to be excess? There seems to be some disagreement within the staff as to applicability of the RCW provisions which caused us problems on N. 52nd (Sailing Club). Please let me know if the City can dispose of these lots and, if not, whether the current use of these properties by adjoining property owners creates any concern. Finance Director, Gwen Marshall , explained to inquiries of Councilman Stredicke, that Shephard Ambulance Co. bills the city for unpaid calls, approxi- mately $300 to $400 per month, and credits the city for any bills col- lected at a later date. Utilities Public Works Director Gonnason and Deputy Finance Director Bennett Rate Increase used wall chart to explain proposed utility rate increase, presentation having been planned for Committee of the Whole meeting of June 8, which was cancelled due to lack of quorum. Gonnason noted the rate increase of two years ago when city determined two-year review for rate adjust- ments, noting increase in operating costs of 30% in the past two years. Gonnason explained proposed 11% reduction in sewer rates for laundries due to evaporation (sewer rates based &n water consumption); explained rate increase to be effective 7/1/76. Sewer rates for single family residence would increase from the present rate of $1 . 50 to $1 .65; water rates for 3/i4" meter would increase from the present $1 .55 to $2.00 per month. Councilman Stredicke and Councilman Clymer inquired as to Mater of the cost of producing water, and were advised of the various prices Rate Increase the city pays for water. Councilman Clymer inquired as to whether. Tabled industrial users were paying actual costs as compared to home owners. Janitorial protesting bids for building maintenance at the Highlands Administration Bids Protest Building, the contractors bidding all being non-union employers and employing "scab laborers". The letter strongly urged the work be done by the city employees under the contract with the Washington State Council of County and City Employes, AFL-CIO, as it has been done in the past. Proposed Raise Letter from Mayor Delaurenti reported after meeting with Public Works in City Utility Director Gonnason on May 18th, Mr. Gonnason recommended certain rate Rates increases for sewer and water service rates based on projections of city utility costs through 1979, which must be implemented to avoid annual utility deficits. The Mayor's letter recommended that Council refer this matter and the recommendation from Mr. Gonnason to the Committee of the Whole and/or appropriate Council committee for priority consideration as the recommended rate increases should be implemented by July 1st. Offer of EAA Grant Letter from Public Works Director Gonnason reported the City accepted ($87,000) the offer of a loan in the amount of $87,000 from the State Economic S.W. 43rd St. Assistance Authority (EAA) on October 8, 1975; however, the city has (S. 180th St. ) , received a new offer from EAA which will change the original loan to East to West a Grant of $87,000. to help fund the joint project of Renton - Kent Valley Roads for improvements to S.W. 43rd St./S. 180th St. , from East to West Valley Roads. Mr. Gonnason recommended the Council authorize acceptance of the grant asiloffered (subject to Kent's acceptance and also approval by both City Attorneys) ; Kent to include this in their Council Meeting of June 7, 1976. Upon • deter4nation that such use is not feasible, and no injury would occur to the public, vacation of the roadway could take place either by initiating such process by City Council Resolution, or by the abutting owners. Upon v cation, one-half of the roadway would then revert to the abutti g owners, respectively. We do not' believe the City is, in a positi n to sell this property to parties other than thove indicated.
