AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON
VACATING A PORTION OF THOMAS AVENUE S.W.
. WHEREAS a proper petition for vacating a portion
of Thomas Avenue S.W. , Renton, King County, Washington, was
duly filed with the City Clerk on or about May 19, 1977, and
said petition having been signed by owners representing more
than two-thirds of the property abutting upon such portion of
COsaid street sought to be vacated; and
WHEREAS the City Council by Resolution No. 2111,
•' passed and approved on June 6; 1977, and after due investigation,
did fix and determine the llth day of July, 1977; at the hour

to be the time and place for a public hearing thereon, and the
City Clerk having given due notice of such hearing in the manner
provided by law, and all persons having been heard appearing in
favor or in opposition thereto; and
WHEREAS the Department of Public Works and the Planning

Department of the City of Renton having duly considered said
petition for said vacation, and having found same to be in the
public interest and for the public benefit; and no injury or
damage to any person or properties will result from such vacation;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON,
WASHINGTON, DO ORDAIN AS FOLLOWS:
SECTION I: The following described'portion of Thomas
Ave. S.W. , to-wit: •
All that portion of Thomas Ave. S.W. (83rd Ave. , .
S.) having a width of 60 feet, lying northerly
of the northerly Right of Way.margin of S.W. •
16th Street extended and southerly of the southerly
Right of Way margin of Primary State Highway No. 1
(SR 405) and easterly of the easterly. line of
Block 36 and westerly of the westerly line of

As situated within the E 1/2 of Section 24,

Street, South of Freeway 405, West of Raymond
Avenue S.W. and E. of Powell Ave. S.W. (Earlington
area of the City)
BE AND THE SAME IS HEREBY VACATED, subject to payment unto the
City by Petitioner-owners of the amount of $9,000.00 which

Earlington Park Councilwoman Thorpe explained meeting with Park Board and Ron
Continued Heiret, Acting Park Director and residents of the community.
Letter from Heiret listed work planned, anticipating funds available
for building removal , cleaning, grading, planting, parking and
play equipment, etc. MOTION CARRIED.
Medic I at Moved by Stredicke, Second Thorpe, Council instruct the Administra-
Valley General tion to veto or vote against the charging of a user fee on Medic I
Hospital service at the Provider Group meeting. Following discussion, SUB-
STITUTE MOTION BY STREDICKE, SECOND THORPE, CITY COUNCIL INSTRUCT
THE ADMINISTRATION TO INFORM THE DELEGATE TO THE PROVIDER GROUP THAT
RENTON CITY COUNCIL IS OPPOSED TO USER FEE AND URGES THAT BODY TO
OBTAIN ADDITIONAL APPROPRIATION AND ALTERNATE FUNDING. King County
Councilman Lowry noted present. County funding of $1 . 50 per capita
and need for appropriation. of additional funds. CARRIED.
Recess MOVED BY STREDICKE, SECOND SHANE, COUNCIL RECESS. CARRIED. The

Planning and Planning and Development Committee Chairman Perry presented committee
Development report recommending that the Resolution setting policy for utilities
Committee Report within the City limits be referred to the Ways and Means Committee
Installation oc for consideration. MOVED BY PERRY, SECOND THORPE, COUNCIL CONCUR.
Utilities Lines CARRIED. (See later Resolution No. 2164)
McElroy Sewer The Planning and Development Committee report noted review of the
Connection App-al McElroy request for reconsideration of the Council ' s denial of sani-
Denied tary sewer connection to his premises just outside the City limits.
The report explained review with the Public Works Department staff;
that the proposed extension of utility lines does not conform to
the guidelines and standards concerning installation within the City.
The report recommended that the Council again deny Mr. McElroy' s
petition for connection to the City' s sanitary sewer until such
time as the area is annexed to the City so that the City can exercise
land use control on the parcel . MOVED BY PERRY, SECOND STREDICKE,
COUNCIL CONCUR IN THE RECOMMENDATION OF THE COMMITTEE AND DENY THE
McELROY REQUEST TO CONNECT TO THE SEWER. MOTION CARRIED.

Ways and Means
Committee Repot Ways and Means Committee Chairman Stredicke presented resolution for
reading which establishes definite guidelines and standards concerning
Resolution #2162 the furnishing of sanitary sewer services to property owners residing
Guidelines tor outside the present or future City Limits. The resolution stated
Sanitary Sewer hookups may be permitted upon payment of fees. when certain conditions
Hookup Outside the are met: Threat to public health exists; No alternative such as
City Limits formation of LID; Hookups permitedonly for*existing structures with
septic tanks; Modification by City Council may be made in event of
threat to public health. MOVED BY PERRY, SECOND STREDICKE, RESOLU-
TION BE ADOPTED AS READ. MOVED BY PERRY, SECOND THORPE, AMEND THE
RESOLUTION AND ADD*"STRUCTURE. EXISTING PRIOR TO DECEMBER 1976."

Kennydale Ave. N. and Park Ave. N. extended. MOVED BY STREDICKE, SECOND
CLYMER, COUNCIL ADOPT. THE RESOLUTION AS READ. CARRIED.
Resolution #2164 A resolution was read establishing guidelines and standards for

Resolution #2166 A resolution was read authorizing transfer of $19,072. 13 for the
Fund Transfer purpose of purchasing five trucks for the Park Dept. MOVED BY

Resolution #2167 A resolution was read transferring $802 to provide for installation
Fund Transfer of a fire and smoke detection system for the city jail to comply

NEW BUSINESS
Vouchers for The Ways and Means Committee report recommended Council approval
Payment for payment of Vouchers No. 16863 through No. 17018 in the amount
of $415,284. 54; plus LID.#306 Revenue Warrant R-3 $4,756.17 and
Cash Warrant C-3 $4,756.17, having received departmental certifica-
tion that merchandise and/or services have been rendered. Vouchers
No. 16858 - 16862 were machine voided during processing. MOVED
BY STREDICKE, SECOND CLYMER, COUNCIL APPROVE VOUCHERS. CARRIED.
CONSENT AGENDA These items are distributed to all members of the Council and are
enacted by one motion without separate consideration unless so
requested by the Council .

11/7/77 referral of the Comprehensive Park Plan. Perry noted the

Light property being top priority.
Street Banners Mayor Delaurenti explained for previous Council inquiry, that cloth
signs over public right-of-way require Council permission, plus

Housing Rehab Letter from Planning Director Ericksen reported that pursuant to the
Loan Program Housing and Community Development Act of 1974, King County has
#312 established a housing rehabilitation loan program, which is available
to residents of King County, including incorporated areas ; that the
City would be eligible for the program upon concurrence of the City
Council and signing of an interlocal agreement authorizing King
County to work within the incorporated limits of the City for resi-
dential inspections and administrative duties. The letter explained
the proposed loan program would enable low and moderate income home-
owners to obtain low cost loans for rehabilitation of older housing.
Refer to the Community Services Committee for review and recommenda-
tion. Council concurrence.

Fire Station Bids Letter from Mayor Delaurenti recommended Council acceptance of
the low bid for the Main Fire Station of John Maples (see attached
Architect Present tabulation) . The letter explained total cost of the project as
Cichanski & Assoc. $906,701 which is $94,555 over budget. The letter recommended
the additional money be borrowed from the Street Forward Thrust Fund
and a percentage of the Utility Tax be set aside in 1979 to repay loan.
The letter noted meeting with the architect and Fire Station
Advisory Committee. MOVED BY CLYMER, SECOND THORPE, COUNCIL REFER
THE MATTER TO THE WAYS AND MEANS COMMITTEE. MOVED BY THORPE, SECOND

Renton Hill and Letter from Kathy Keolker, President of the Renton Hill Community
Transamerica Association, notified Council of the unanimous decision of the
Court Case Renton Hill Community Association and Board of Directors to author-
ized and encouraged their attorney, Bob McBeth, to petition the court
for permission to intervene in the pending lawsuit which the Trans-
america Corporation has filed against the City. The letter ex-
plained the association and Mr. McBeth would assist the City and
defend the City's actions in changing the City' s Comprehensive
Plan to single-family-use designation on Cedar Ave. S. MOVED BY

Comprehensive Councilman Perry reported meeting of the Planning and Development
Park Plan Committee with the members of the Park Board and Consultants re
11/7/77 referral of the Comprehensive Park Plan. Perry noted the
Park Board and Consultants will revise plan to include requested
items :Cedar Center Park and Cedar River Trails, noting Seattle City
Light property being top priority.
Street Banner. Mayor Delaurenti explained for previous Council inquiry, that cloth
signs over public right-of-way require Council permission, plus
$25 fee unless waived by Council, noting one Christmas banner O.K. ' d,
one placed without Council approval and therefore removed.
ORDINANCES AND RESOLUTIONS
Ways and Means Ways and Means Committee Chairman Stredicke presented committee report
Committee Peport recommending second and final reading of an ordinance rezoning
Ordinance 3194! property located on the east side of Kennewick Pl . NE near NE 30th
Werstiuk Rezone from General Classification G to SR-2, R-1 and R-2. First reading
of the ordinance 1/16/78. Following readings , MOVED BY STREDICKE,
SECOND CLYMER, COUNCIL ADOPT THE ORDINANCE AS READ. ROLL CALL : ALL
AYES. CARRIED.
Street Vautioi The report recommended first reading of an ordinance vacating a
Thomas Ave. SW portion of Thomas Ave. SW near FAI-405, noting $9,000 vacation fee
has been received. Following reading, MOVED BY CLYMER, SECOND
PERRY, COUNCIL REFER ORDINANCE BACK TO THE WAYS AND MEANS COMMITTEE.

Resolution #21 0 The committee report recommended reading and adoption of the following
Fund Transler resolutions: A resolution was read borrowing $900,000 from Street
_ • Forward Thrust Fund pending receipt of tax monies due the City.

CONSENT AGENDA The following consent agenda items are studied by each Council
Member, are considered routine and are enacted by one motion without
discussion unless requested:
Housing Rehab Letter from Planning Director Ericksen reported that pursuant to the
Loan Program Housing and Community Development Act of 1974, King County has
#312 established a housing rehabilitation loan program, which is available
to residents of King County, including incorporated areas; that the
City would be eligible for the program upon concurrence of the City
Council and signing of an interlocal agreement authorizing King
County to work within the incorporated limits of the City for resi-
dential inspections and administrative duties. The letter explained
the proposed loan program would enable low and moderate income home-
owners to obtain low cost loans for rehabilitation of older housing.
Refer to the Community Services Committee for review and recommenda-
tion. Council concurrence.
Fire Station Bias The 1/17/78 re-bid opening for the Main Fire Station construction
received three bids; known as EDA-LPW Project #07-51-23907 Phase II .
See attached tabulation. Refer to the Public Safety Committee.
Appointment Letter from Mayor Delaurenti appointed Sanford E. Webb, 264 Chelan
Ave. SE to the Planning Commission effective through June 30, 1980,
replacing Logan Garrison who does not wish to be reappointed. Refer
to the Ways and Means Committee.
(Damages Claim Claim for Damages was filed by Vitali Chonin, 10204 SE 8th , Bellevue,
for damage to property located at 3322 NE 6th, alleging sewer back
up causing damage in amount of $56.25. Refer to City Attorney and
Insurance Carrier.

Fire Station Bids Letter from Mayor Delaurenti recommended Council acceptance of
the low bid for the Main Fire Station of John Maples (see attached
Architect Present tabulation) . The letter explained total cost of the project as
Cichanski & Assoc. $906,701 which is $94,555 over budget. The letter recommended
the additional money be borrowed from the Street Forward Thrust Fund
and a percentage of the Utility Tax be set aside in 1979 to repay loan.
The letter noted meeting with the architect and Fire Station
Advisory Committee. MOVED BY CLYMER, SECOND THORPE, COUNCIL REFER
THE MATTER TO THE WAYS AND MEANS COMMITTEE. MOVED BY THORPE, SECOND
CLYMER, AMEND MOTION TO INCLUDE PUBLIC SAFETY COMMITTEE REFERRAL.

Renton Hill and Letter from Kathy Keolker, President of the Renton Hill Community
Transamerica . Association, notified Council of the unanimous decision of the
Court Case Renton Hill Community Association and Board of Directors to author-
ized and encouraged their attorney, Bob McBeth, to petition the court
for permission to intervene in the pending lawsuit which the Trans-
america Corporation has filed against the City. The letter ex-
plained the association and Mr. McBeth would assist the City and
defend the City' s actions in changing the City's Comprehensive ,
Plan to single-family-use designation on Cedar Ave. S. MOVED BY
PERRY, SECOND THORPE, COUNCIL REFER THE MATTER TO THE CITY ATTORNEY
FOR ADVICE TO COUNCIL. CARRIED.

Speed Limit Councilman Shane asked that the speed limit be raised from 35 mph

Second Shane, council refer the matter to the Administration to
check speed limit on these streets and report back. ROLL CALL:

Intersection main subject of concern being reduction of the existing grade.
Aberdeen Ave NE The report listed alternative cuts of 3, 4 and 5 feet; the existing
and NE 24th St L sight distance 220 ft. ; safe stopping distance at 30 MPH with wet
pavement conditions - 217 ft. The report listed cost of $45,694 for
3-ft cut increasing sight distance to 250 ft. and safe stopping
distance to 307 ft. at 30 MPH; also giving similar facts for other
grade changes and noting possible damage to driveways of abutting
properties; installing larger sized watermain as proposed in the
Comprehensive Water Improvements Plan to reduce cost; instituting a
local improvement district for street improvement if property owners
so inclined. The report concluded that present sight distance of
220 ft. provides sufficient sight distance to provide the safe stop-
ping distance, that increase in sight distance by lowering the grade
of Aberdeen Ave. is not justified and recommended that the speed
limit be reduced from 30 to 25 MPH to increase sight distance at
relatively no cost. Following the showing of slides of the area,
Deputy Public Works Director Bennett discussed number of vehicles
per day using streets under discussion: 307 per day on NE 24th,
770 cars per day on Aberdeen Ave. NE. Bennett explained high accident
locations of last year, five of which are scheduled for improvement:
Benson Road and S. Puget Drive, 17 accidents 1976, 15 in 1975;
Rainier Ave. S. and S. Grady Way; NE Sunset Blvd and Duvall (SE 138th)
with high pedestrian traffic from Hazen High, 12 accidents in 1976.
Bennett noted that upon Council direction, priorities could be
changed and the funds diverted. Public Works Director Gonnason
explained possibility of installing 16-inch watermain in combination
with reduction of grade on Aberdeen NE, however, problem of damage
to abutting property still existed and ability to enter and exit

Comprehensive Council President Perry discussed notification of persons in the
Plan Review southern portion of the City as concerns public hearing scheduled
10/3/77 10/3/77 for review of the Planning Commission recommendation on
Valley General the South Renton planning area, and opposed individual mailings to
Area those persons outside the city limits not interested in annexing
to the City. Councilman Stredicke requested five additional post-
ings in that area, explaining King County takes, the City' s Compre-
hensive Plan into consideration for such areas.

The Public Services Committee has carefully reviewed
Mr. Brown's request and the matter of the City' s
policy of charging half the appraised value as a
vlcation fee. The Committee met for one hour with
ttie petitioner to receive his comments .
The Committee feels that the established policy is valid
and should not be modified merely because the petitioner
is not as yet ready to fully .utilize, the property. The
Ciimmittee found no hardship existed and ruled that the
best interests of the City taxpayers would not be served
by a fee reduction.

the area would result. The letter objected to the $9,000 vacation
fee, noting the object of the street vacation was to landscape the
land and that it would bring the property onto the City's tax roles .
The letter further noted anticipated expenditures for landscaping,
sewer assessment and widening of 16th; therefore extended offer
of $1 , 500. MOVED BY PERRY, SECOND SHINPOCH, REFER COMMUNICATION TO
THE PUBLIC SERVICES COMMITTEE FOR RECOMMENDATION. Upon inquiry of
'Councilman Stredicke, City Attorney Shellan noted state law allows
charge of not more than 1/2 the appraised value, noting Council ' s
policy of charging 1/2. Upon inquiry, Gonnason noted appraisal was
in-house, noting Mr. Brown ' s objection was not to the amount of the
appraised value but the charge as it affects him and his intended
use of street to be vacated. Discussion ensued wherein the committee
was asked to study any case where extenuating circumstances might
have altered Council ' s policy of charging full 1/2 appraised value.

Housing Authority For information only, Certificate of Appointment to Housing Authority
Appointment by Mayor Delaurenti was read, appointing George Boode, 2128 NE 6th
Court, as a Commissioner of the Housing Authority until 9/10/82,
to fill vacancy left by the expiration of term of Harold J. Austin.
The certificate explained Section 25 of Housing Authorities Law of
State established duty as Mayor to appoint Commissioner. Councilman
Stredicke requested minutes of Housing Authority meetings be forwarded
to the City Council members and/or Mayor.
Preliminary Plat Letter from Land Use Hearing Examiner forwarded files for Tiffany
Tiffany Park #3 Park No. 3 Preliminary Plat and exception to subdivision ordinance,
& Exception PP-059-77 and E-60-77, noting appeal period expired 9/19 and asking
Council review prior to acceptance of a final plat request. MOVED

Resurfacing Paving Co. , Inc. in the amount of $27,366.78 for asphalt resurfacing
project as recommended by the Public Works Department. (See earlier

COMMITTEE REPORT AND AWARD BID. Upon inquiry by Councilwoman Thorpe,
Public Works Director Gonnason explained difference between engineer' s

Aviation Committee Committee report presented by Councilman Stredicke recommended that

specified interim improvements which will improve the appearance of
the building. The report explained that Renton Aviation' s prime
lease, LAG 10-75, provides for the removal 'of the building this month,

Revolving Bins We are purchasing the property to the east of Thomas Avenue Southwest
Wire Partitions from the Austin Company. We are planning to build a small warehouse
and office complex on this site and during our zoning discussions
Work Benches with the City, it was suggested that Thomas Avenue Southwest be

Austin Company to apply for the street vacation since they legally

Southwest, so the request for vacation was done at my request since

Drum Handling Equip. On July 26, 1977, a letter addressed to the Austin Company, from

Councils' approval and a fee of $9000.00. Since the Austin Company

possible.
Since most of the land will eventually have to be landscaped per
the Citys' requirements, it means an expenditure by this company,
over a period of time, of .75 to $1.00 per square foot. A sewer
assessment for the 60' of frontage will have to be paid by us at
$11.00 per lineal foot. Also, plans to widen 16th street could
further levy an assessment of approximately $100.00 per lineal foot.
With these kinds of costs facing us we feel it is not economically
feasible to pay $9000.00 plus improvements down the road, plus
taxes, just to plantgrass on a piece of property that is not
essential to our building plans.
Therefore, we feel that a more realistic price for'Thomas Avenue,
given the above circumstances would be a price of $1500.00.
We would like our offer to be submitted to the City Council as
soon as possible as construction on our project is imminent.

STREET VACATION PROCEDURE
R.C.W. 35.79 et seq

PETITION OR RESOLUTION METHOD OF STREET (OR ALLEY) VACATION
1 . Owners of property abutting a street (or alley) may petition the Legis-
laltive Authority for the vacation of such street or alley or any portion
thereof, by filing a petition with the City (or Town) Clerk. Signatures
mast represent owners of more than two-thirds of the abutting property
to validate the petition. ($100 processing fee must be filed with the
petition. ) Public Works Department will prepare initial 'petition.
2. Petition is placed on the City Council Meeting Agenda following certi-
fication of validation.
•
3. If initiated by petition of property owner, the City Council refers the
maltter to the Legislation Committee for a Resolution setting a date for
hearing., (not more than sixty days, nor less than twenty days after pass-
age of the Resolution) and to the Board of Public Works for___ __._ a-
7't`o7 (Council may also refer the subject to the' Public Works and •
Transportation Committee, etc. for information as desired. )
4. The legislative authority May itself initiate such vacation procedure
by Resolution. If vacation is city-initiated, all abutting property
ow ers must be notified by mail at least fifteen days before the hear-
ing. ) Clerk prepares, mails and posts written notices of pendency of
the petition, as required by law. If 50% of abutting property owners
file written protest with the City Clerk prior to the time. of the hear-
ing, the City is prohibited from proceeding with the vacation.
5. The Board of Public Works shall determine whether public utility easement
shall be retained. The. Public Works Department shall recommend whether
City's interest is great enough to warrant appraisal and the Council
accordingly determines compensation to be paid the City by acquiring
r� ert owners (notto
p p y exceed one-half of the appraised value of the
area proposed to be vacated) , as provided by law.
6. If the legislative authority, upon hearing, determines to grant the
vacation, or any part thereof, the matter is referred to the Legislation
Committee for Ordinance which shall authorize the vacation and specify
the fee to be paid; unless waived. (City Attorney prepares ordinance. )
7. Ordinance becomes effective .five days after publication, however, if
fees are charged, publication is withheld until all money has been paid
to the City and all legal instruments are properly executed and filed.
(Owners, among themselves, determine acquisition and payment arrange-
ments, conveying to each other any quit claim deed necessary. )
8. Seien (7) certified copies of the Ordinance are filed for record with
the King County Council and one (1 ) copy with the Auditor's Office
upon return from recording. A copy of the ordinance is forwarded to
each acquiring owner.

AUD ENCE COMMENT Frank Cenkovich, 2625 Benson Road So., inquired as to what was going
to be done about completing the Senior Center now that the project
Senior Citizen was being excluded from any EDA funds. Council President Perry explained
Center that Councilman Stredicke and he had tried to convince the Renton School
Board to change their priorities, but they insisted on keeping their.
priorities. Perry moved, seconded by Bruce, that two items be placed
on the November ballot and that they be referred to the Ways and Means
Committee and Bond Counsel for preparation of proper legislation:
(1) A General Obligation Bond for $800,000 for the purpose of
construction and furnishing of a Senior Citizen's Center (with funds
also to be eligible for use to purchase any land that may be required)
(2) An Advisory Ballot to the City Council if Proposition #1 is not
acceptable should the City Council raise the Utility Tax by 1% for
the purpose of repayment of Councilmanic Bonds .for the purpose of
land acquisition, construction and furnishing the Senior Citizen's
Center. After some discussion, a. SUBSTITUTE MOTION BY STREDICKE,
SECONDED BY PERRY, THE CITY OF RENTON ISSUE COUNCILMANIC BONDS FUND-
ING CONSTRUCTION OF. A SENIOR CITIZEN CENTER TO THE AMOUNT OF $800,000,
REDUCED ;BY THE AMOUNT RECEIVED FROM OUTSIDE FUNDING, AND THE BONDS BE
PAID BY LEVYING A 1% UTILITY TAX, THE CITY ATTORNEY AND CITY CLERK TO
DRAW UP PAPERS FOR COUNCILMANIC BONDS. Moved by Clymer, seconded by
Bruce, to refer the matter to the Community Services Committee.. Roll

Summer Festival and all the senior citizens to the Sidewalk Sale and Summer Festival
to be held July 14, 15, and 16. (See action later under Correspondence.)

PUBLIC HEARING This being the date set and proper notices having been posted and pub-
lished, Mayor Delaurenti opened the public hearing on the vacation of

AND THE CITY ACCEPT 1/2 OF THE APPRAISED VALUATION OF THE VACATION.
Upon inquiry by Councilman Bruce as to input from the Fire Department,
Mr. Gonnason said street is unimproved and not used. SUBSTITUTE MOTION
CARRIED. MOVED BY STREDICKE, SECONDED BY BRUCE, THE PUBLIC HEARING BE CLOSED.

Les Brown, 7746 Overlake Drive, Bellevue, representative of the Austin
Co. inquired whether it would have to come back to the Council if the
Austin Co. objected to the appraisal price or if it could be settled
with the Public Works Department; City Attorney Shellan replying that
the ordinance vacating the street would contain the price and the
Council would have to approve it.

Western Fire Letter from Fire Chief Geissler requested authorization to attend the

Stree. Vacation Letter from Deputy City Clerk Motor reported receipt of a petition for

Buckingham ppeal Letter from Thomas C. Buckingham, 5025 Ripley Lane N„ registered
of Hearing appeal of Land Use Hearing Examiner's determination concerning
Examiner Decision R-022-77, rezone from single family residence district (G-6000) to
R-022-77 R-3, medium density multiple family residence district for property
Denying Rezone located between Lake Washington and Ripley Lane N. adjacent to and
north of Misty Cove Apartments. Mr.. Buckingham's letter enclosed
appeal fee of $25.00 and copies of the Hearing Examiner's determina-
tion dated 4/13/77, Examiner's response of 5/6/77, as well as
Buckingham's appeal of 4/19/77 covering the main issues of contention.
Appeal based on error in judgement by Examiner, due to change in'
Examiners at crucial time; contending outgoing Examiner's conclusion
based on recent Council action to change the Comprehensive Plan
did not permit a fair determination regarding request for rezone,
MOVED BY STREDICKE, SECONDED BY SHINPOCH, COUNCIL REFER APPEAL TO THE
PLANNING AND DEVELOPMENT COMMITTEE. Committee Chairman Perry estab-
lished date of June, 20, 1977 to bring the recommendation back to
the Council . The City Clerk was requested to 'so notify Appellant.
MOTION CARRIED. Council President Perry reminded Council members to

EDA Funding Letter from Mayor Delaurenti explained extension of Title I .portion
Priorities of Public Works Act of 1976 to reduce unemployment by funding local
public works projects in high unemployment areas nationwide, and
that regulations as previously submitted may be updated or withdrawn.
The letter restated priorities established and submitted (highest
to lowest): new main fire station, building 'of new pump station and
installation of new waterlines on Talbot Hill and construct portions
of Cedar River Trail System. The Administration proposed to update
cost estimates for the original applications and if so desired by Coun-
cil, requested Council review and report back 6/6/77, applications
to be certified before 6/1.5/77. MOVED BY STREDICKE, SECONDED BY
GRANT, COUNCIL STAY ON RECORD MAINTAINING PRIORITY AS PREVIOUSLY
ESTABLISHED AND AUTHORIZE SUBMITTAL OF EDA FORMS. Councilwoman Thorpe

Public Services Public Services Committee Chairman Bruce submitted committee report
Committee Report re meeting with property owners 5/17/77 to discuss deficiencies in
Cedar Ave. So. concrete work on Cedar Ave. So. (LID 293) and recommended: (1.). The'
LID 293 contractor, Moss Construction' Co. , proceed with correction of the
Street . deficiencies in the water meter boxes and refinishing of weepholes
Improvement in the curbs throughout the project; detailed list to be supplied
to the contractor. (2) The cracked curbs and gutters at the several
driveway approaches are still substantially in their constructed posi-
tion; no settlement, displacement or spalling of concrete and are
generally sound structurally. The City will provide letters to the
abutting property owners indicating property owners will not be
responsible or liable for replacement of these cracked curbs and
gutters should they become dangerous and defective as result of work
performed under this contract; City assuming responsibility for the
replacement as here indicated; Contractor warranting to the City he
will replace cracked curbs and gutters within two year period of this
date if becoming dangerous and defective, (3) The City staff will
• investigate and work with abutting property owners regarding drainage

STREET VACATION PROCEDURE
R.C.W. 35.79 et seq
PETITION OR RESOLUTION METHOD OF STREET (pR ALLEY) VACATION
1 . Owners of property abutting a street (or alley) may petition the Legis-
lative Authority for the vacation of such street or alley or any portion
thereof, by filing a petition with the City (or Town) Clerk. Signatures
must represent owners of more than two-thirds of the abutting property
to validate the petition. ($100 processing fee must be filed with the
petition. ) Public Works Department will prepare initial petition.
2. Pettition is placed on the City Council Meeting Agenda following certi-
fication of validation.
3. If initiated by petition of property owner, the City Council refers the
matter to the Legislation Committee for a Resolution setting a date for
herring, (not more than sixty days, nor less than twenty days after pass-
age of the Resolution) and to the Board of Public Works for recomenda-
ti ns. (Council may also refer the subject to the Public Works and
Transportation Committee, etc. for information as desired. )
4. The legislative authority may itself initiate such vacation procedure
by Resolution. If vacation is city-initiated, all abutting property
owners must be notified by mail at least fifteen days before the hear-
ing. ) Clerk prepares, mails and posts written notices of pendency of
the petition, as required by law. If 50% of abutting property owners
file written protest with the City Clerk prior to the time of the hear-
ing, the City is prohibited from proceeding with the vacation.
5. ThF Board of Public Works shall determine whether public utility easement
shall be retained. The Public Works Department shall recommend whether
City's interest is great enough to warrant appraisal and the Council
accordingly determines compensation to be paid the City by acquiring
property owners (not to exceed one-half of the appraised value of the
area proposed to be vacated) , as provided by law.
6. If the legislative authority, upon hearing, determines to grant the
vacation, or any part thereof, the matter is referred to the Legislation
Committee for Ordinance which shall authorize the vacation and specify
the fee to be paid, unless waived. (City Attorney prepares ordinance. )
7. Ordinance becomes effective five days after publication, however, if
fees are charged, publication is withheld until all money has been paid
tolthe City and all legal instruments are properly executed and filed.

ments, conveying to each other any quit claim deed necessary. )
8. Seven (7) certified copies of the Ordinance are filed for record with
the King County Council and one (1 ) copy with the Auditor's Office
upon return from recording. A copy of the ordinance is forwarded to .
each acquiring owner.
