Tuesday, November 7, 1978 in the office of the Commissioner of Public Lands at Olympia, Washington. /IR It is our understanding that the agenda for this meeting is large and we cannot be certain the Board of Natural Resources will act on this proposal . ":f 2--9/w A RESOLUTION relating to the vacation of certain Slip and Wharf Sites as shown on Plates 28 an 29, Lake Washington Shore Lands, the official maps of which were filed in the office of the Commissioner of Public Lands at Olympia, Washington Septembe 19, 1921 . Section 1 . The City of Renton, Washington by Resolution No. 2178. passed by the City Council March 13, 1978 recommends requests and urges the Commissioner of Public Lands, State of Washington and Department of Natural Resources to initiate proper action to vacate certain areas between the ,inner and outer harbor lines in Lake Washington in front of Government Lot 1., Section 32 and Government Lots 3 and 4, Section 31 , Township 24 North, Range 5 East W.M. designated as "Slip" and "Wharf" on Plates 28 an 29, Lake Washington Shore Lands filed in the office of the Commissioner of Public Lands at Olympia, Washington September 19, 1921 . Section 2. This request is made because the City Council of the City of Renton, Washington concluded that the special areas designated for "Slip" and "Wharf" on these maps are in conflict with the City of Renton's Comprehensive Plan, the Shoreline Master Program, the Lake Washington Regional Shoreline Master Program and residential and recreational uses of the Lake Washington shore line. Sec=ion. 3. It appears from examination of the records and other information obtained that these special areas designated as "Wharf and Slip Sites" on these maps within the harbor area established have not and are not being used for the purposes designated, that apparently no such use is now contemplated or antici- pated in the future, that the best interest of the State would be served by removing these areas from within the harbor area at these locations.; therefore Section 4. Be it resolved by the Board of Natural Resources acting in its capacity as the Harbor Line Commission that those certain areas between the inner and outer harbor lines in Lake Washington in front of Government Lot 1 , Section 32 and Government Lots 3 and 4, Section 31 , Township 24 North, Range 5 East W.M. I, II II designated as "Slip" and "Wharf" on Plates 28 an 29, Lake Washington Shore Lands l+ filed in the office of the Commissioner of Public Lands at Olympia, Washington Septe'Imber 19, 1921 are:hereby vacated. He has assured the City that the request for ' vacation of slips and wharf sites is proceeding as •requested. Concelrning the log storage, he has assured us that DNR under- stands and concurs with the City' s position that this use should be phased out and will keep the City advised of any changes as they occur. RE: !WATER QUALITY MANAGEMENT STUDY - REFERRED 3/16/78 The above referred report has been requested by METRO by the end of May. The Committee has set meetings to review the status of this item. Unfortunately, City staff has not yet been' able to produce any written information. At our last meeting on May 16 , we met to review a proposed draft which was still not ready. A representative of METRO was present and rassured us that even though METRO had hoped to receive `the City° s report by the end of May, such reports would be accepted after that date. Mr. Gonnason, Public Works Director, has agreed to submit material for the Committee to review by May 30. The Utilities Committee report noted review of sewer needs for the Northeast Section of the City and program for Kennydale Sewers the May Creek Interceptor and connecting Kennydale and Honey Creek interceptors to serve that area; the committee instructed the staff to continue efforts to get funding assistance. The report noted several property owners in the Kennydale area are desirous of pro- ceeding with land development projects which had previously protested. The report recalled LID #296 hearing with 70% protest and project terminated. Concurrent with this application was another filed for a special grading permit under Chapter 7 section 4-732 of the City ' s ordinances . The proposed work for which the applications were filed relates to maintenance dredging at the mouth of May Creek to maintain navigability. This is a permitted use under section 7 . 06 . 02 ,. E of the Shore- line Master Program of the City of Renton. The planning staff reco mended that a permit be issued - but the application was denied by the hearing examiner after obtaining an opinion from the City Attorney . Based upon the literal construction of the Master Program the City Attorney could make no other recommendation. The enclosed correspondence provides addi- tional details of the procedural steps taken to date on this matter . I think the evidence is clear that an error was made in the editing of the Master Program which was overlooked by everyone involved in the drafting process (I was involved and I certainly overlooked it) . The effect of the error is to either prohibit dredging which may be necessary for the welfare of the community (and is specifically provided for in the Master Program) or to "'unnecessarily burden both the applicant and City Staff with the S .M.A. variance procedure for each dredging application . It should be added that variances require prior approval of the Department of Ecology , while the state is limited to the right of appeal on substantial development permits when issued by the City an accord with the criteria contained in the Master Program. To correct this error I would propose striking the words "a-_.wet- ai .d;" . and substituting(" in their place "water or marsh" . You will note this is consistant with the language contained in the stand- ard conditions of dredging permits issued by the State Department - of Fisheries and the E .P .A. Inasmuch as the aforementioned wharf sites are located in this portion of harbor area, we will incorporate the City of Renton 's vacation request int_9/the outer harbor line relocation proposal for presentation to the Harbor Line Commission. At the moment this matter has not scheduled for review by the Board of Natural Resources and/or Harbor Line Commission; however, when this v' k6 s. request is placed on the board agenda, your office will be so notified. In regard to the log storage activities, it should be noted that this office has an existing Use and Occupancy Agreement for that portion of the storage activity located outside of the harbor area. QUENDALL TERMINALS REQUEST REGARDING VACATION OF SPECIAL AREAS .DESIGNATED` SLIP AND "WHARF" 'ON THE LAKE WASHINGTON' SHORELINE PLAT The Community Services Committee has reviewed a request from Mr. Nor- man of Quendail Terminals requesting the City to initiate vacation- of areas designated " slip” and "wharf" on the . Lake Washington Shore lines Plat adjacent to .the. Barbee Mill site . In addition , the Com- mittee undertook a review of similarly designated areas on the •: remainder of the Renton , shorel i ne . (see attached map) . It is the Committee ' s conclusion that the special area. designations for " slip" and "wharf" are in conflict with the City of Renton ' s Comprehensive Plan , the Shoreline Master Program, the Lake Washington Regional Shoreline Master Program, and residential and recreational uses of the Lake Washington shoreline . The Committee , therefore , recommends that the Council concur in the request and initiate proper resolution to be forwarded to the Commissioner. of Public Lands , State. of Washington , and the Department of Natural Resources . ' The Committee further recommends that the City Council go on record, ' concurrently to the Commission of Public Lands and the., Department of Natural Resources , requesting that bed lease log storage be discon- tinued at the earliest feasible date. ' The Committee feels that, such storage is also in conflict with the recreational use of the Lake , particularly as it relates to boating and the boat launching ramps at Lake Washington' Beach Park .and on the Cedar River.' Dear Mayor DeLaurenti : For some time and at some effort , we have been preparing the data needed for a master plan proposal under the City ' s Planned Unit Development ordinance . It would be the intent of this pro- posal to specify uses contemplated for the Port Quendall proper- ties from the array of uses permitted under the present zoning and land use ordinances . There are two outside agencies , however , with direct land use authority along the Lake Washington edge of the properties : The Washington State Department of Natural Resources (DNR) and the Port of Seattle (POS) . DNR is owner in fee of the Harbor Area and beds lying lakeward of the inner harbor line . POS acts as management agent for the harbor area. DNR claims certain police powers over land use matters on these submerged lands . During the sixty years since these Lake Washington shorelands were platted , there have been numerous changes and additions to statutes and regulations as well as the actual uses of the Lake and its shorelands . It is our intent to reconcile the uses permitted by the State with those of the City . At present it is not clear whether there are conflicts between permitted uses of the State and City but there are State statutes and administrative actions still in effect that are obsolete in view of present land use doctrines governing Lake Washington . These are acknowledged by DNR and were addressed in the RCW Title 7Q review and SHB 122 which passed the House but not the Senate in the last regular session of the legislature . We can ignore these anachronisms and attempt to struc- ture a master plan around them. 1 • 12 . We can address the "house cleaning" pirocess of State shoreland and harbor area regulation ',by including the DNR within P .U.D. master plan approval process . I i 13 . We can proceed to make specific changes to provisions which are most likely to cause inadv4rtant future con- j i flict and complete the master plan based upon a signi- ficantly simplified set of state land use conditions . We would prefer the third alternative and theispecific changes we would propose to DNR deal with the following : 1 1 . Easement provisions which have been granted to Puget Power and Metro over property in whi'ch we have a leasee ' s interest but were conveyed without our knowledge or approval . 2 . Sideline lease boundaries in the harbor area (i . e . inter- secting the two harbor lines) which 'are ill defined , reflect obsolete shoreland property lines or are incon- sistent with state law governing such sidelines . 3 . Harborline adjustments to reflect conditions and natural events having occurred since the lines were first estab- lished in 1914 . These conditions are primarily the effect 1 of chronic accretion at the mouth of May Creek altering 1 navigability . 4 . Vacation of special areas within the harbor area as described in the 1921 shorelands plat and having to do with facilities then proposed for commercial navigation. I Such facilities, if they were built ,'today; would be incon- sistent with both the City ' s and th'e regional master 11 programs under the Shoreline Management Act . Changes pertaining to harbor area easements and lease sidelines 11 are largely administrative matters between the POS , DNR, and the lessees . Harbor line adjustments and vacations of special platted areas between the harbor lines require the quasi-judicial action of ; the State Harbor Line Commission. For a 'vacation to be acted upon, a petition would be required from the pity. A draft of an appropriate petition is attached. 1 We; have discussed each of these proposed changes with DNR and have requested a hearing date to be scheduled in; front of the Harbor Line Commission.
