covenants (covenant)with the City of Renton ("City of Renton" or"City'), a municipal corporation
of the state of Washington,that he/she(they)will observe, consent to,and abide by the conditions
and obligations set forth and described in Paragraphs 1 through 9 below with regard to the
Property, and hereby grants (grant) an easement as described in Paragraphs 2 and 3. Grantor(s)
hereby grants (grant), covenants (covenant), and agrees (agree) as follows:
1. The Grantor(s)or his/her(their)successors in interest and assigns("Owners")shall at their own
cost, operate, maintain, and keep in good repair, the Property's drainage facilities constructed
as required in the approved construction plans and specifications R4072 (Project
P�an#) on file with the City of Renton and submitted to the City of Renton for the review and
approval of permit(s) C19003341 _(Construction/euilding/utilityPermit#).The
Property's drainage facilities are shown and/or listed on Exhibit A—Site Plan. The Property's
drainage facilities shall be maintained in compliance with the operation and maintenance
schedule included and attached herein as Exhibit B—Operations and Maintenance. Drainage
facilities include pipes, channels, flow control facilities, water quality facilities, on-site best
management practices (BMPs) and other engineered structures designed to manage and/or

treat starmwater can the Praperty. Qr�-site BMPs ir�clude dispersian and infiltratian devices,
biaretentiorr, permeable pavements, rainwat�r harvesting systems, tree r�tention credit,
reduced impervious surface faatprint,vegetatied rao�s and ather measures designed to mimic
pre-developed hydroiogy and rninimize starrnwater runoff on the f�roperty.
2� City a� Renton shall have thre right taa ingress and egress aver those portions of the. Property
necessary to perform inspectians of the stormwater facilities and C3NiPs and cc�nduct
maintenance aetivities specified in this [7eclaratir�n of Covenant �r�d i� accardanc� with the
Renton Muni�ipal Code. City of Renton shall provide at least thirty(30) days' written notice to
the Owners tha�entry on the Property is planned for the inspectian of drainag�facilities, A�ker
the thi�#y(�0) days,the C2v�r�ers shall allow the City of Renton ta enter far the sole purpose of
inspecting drainage facilities. Irr li�u af inspection by the City,the C)wners may elect tc�engage
a licensed civil engineer registered in khe state of Washingtan who has expertise in drainage to
inspect the drainage facilities and provide � written report describin� their conditic�n. If the
ei�gineer optian is chosen,�he C�wroers sl�all pravide writter� natice to the City of Renton wathin
fifteen(15)days of receiving the City's notice af inspection.Within thirty(30)days of giving this
notice,the awr�ers,or engineer can �eh�lf r�f th�Clwners,shall pra�vid�the engineer`s report to
th�City of Renton. If the report is nat pravided in a tirr�ely manner as specified above,the City
af Renton rnay inspect the drainage faciliti�s without further notice.
3. If Cify af Rentan determines fram its inspection, ar from an engineer's report prc�videc3 in
accordance with Paragraph 2,that maintenanee, r�pair, restoratian, arrd/ar mitigation wc�rk is
required to be dorre fio any af 4he drainage facilities, City of R�nton shall natify the CJwners of
the specific rnainkenance, repair, restoratiaro, arrd/or rnitigatian work ("Work") required
pursuant to the Rentr�n Municipal Code. The City shall also set a reasanable de�dline for the
(Jwners to comptete the Work, ar�o pravide ar� �ngineer's report�hat verifies compietian o�
the Wark. After the deadline has passed, the Owners shall allow�he City access fio r�-inspect
the drain��e facilities �anless an er�gin��r's report has kaeen provided verifying completir�n of
th� Work. qf the VJa�rk is na� comple�ed within the time frame set by the City, the City may
initiate an enfarcement action and/or perform Che Wark and hereby is given access to the
Property for such purposes. Vifritt�n natice will be sent to the Owners stating the City's
int�nticrn to perfc�rrt�such Work.This�/ork will not ccrrnrnence untip at least seven(7)days after
such notice is mailed. If, wi�hin the sole discretian of the City, khere exists an imminent crr
present danger, the seven (?) day notice pericrd vrrilf be waiv�d arrd Work will be�i�
immediately,
A�. 1"he C7wn�rs shall assurne�96 respc,nsibility for the casfi caf any Work,ar any measures taker� by
the City to addr�ss condi�ians as described in f�aragraph 3. Such respc�nsibiVity shall include
reimbursem�nt to the City withir�thirty(30�days of the receipt of the inwoice fcar any such Work
per�c�rrried, t�verdue paymen�s will require payment af interest at the maximum legal rate
aHowed by RCW 19.52.020(currently twefve percent (12%j). If the City inifiates legal actiar�to
enfarc� this agre�ment, the prevailin� par�y in such action is entitled to recover reascrnalal�
litigatian costs and attorney's fees.
5. The Qwners are required to c�btain written apprc�val from City af Rentan prior to filling, piping,
cutting, ar removing vegetatian (except in routine landscape maintenanee} in open vegetated
stormwater facilities (such as swales, channefs, ditches, ponds, etc.), or performing any
alterations or modificatior�s to the drainage facilitees refereneed in this Declaration of�crver�ant.

6. Any notic�ar cansent required to be given or otherwise prouid�d for by the provisions af this
Agreement sha01 be effective upon personal deliuery,or three(3)days after mailing by Certified
Mail, return receipt requested.
