Comcast proposes to OVERLASH (1) 12CT FIBER ON EXISTING AERIAL STRAND Comcast is requesting that the City of Renton approve this variance request based on the fact that the requirements for undergrounding this proposed over-lash on existing plant will cause undue hardship. 1. Installation of undergrounding facilities will increase the total cost of construction roughly 15-25 times the amount of an aerial over-lash on the existing Comcast strand. 2. Risk of potential damage to underground facilities will be increased. 3. Over-lash will not cause substantial adverse impact to other persons or entities in the immediate area. Over-lashing the cable will be accomplished in a few days, and the residents will not notice any impact. Comcast will clean up the over-lashed spans as necessary and identify and remove any existing dead cables along this route. 4. The variance is necessary to prevent any undue hardship due to the increased construction costs if forced to install the proposed extension underground. 5. The granting of the variance will not be materially detrimental to the public welfare. Comcast does agree to participate in future underground improvements for its proportionate share of the undergrounding costs, waiving the obligation into the future when all other utilities are undergrounded to prevent an undue hardship against Comcast currently. Comcast proposes to have Cannon Construction LLC overlash 12CT fiber for a total of approximately 374 lineal feet to existing Puget Sound Energy (PSE) poles along the alley between S 3rd St and S 4th St within the City. See the enclosed Site Plan showing the proposed overlashing limits. ANALYSIS: The City has considered the request for an exemption from RMC 4-6-090. Ordinance 5720 grants Comcast, the right to install fiber optic cable and related appurtenances under, along, over, below, through and across the streets, avenues and alleys of City of Renton within the right-of-way of Renton. Section 3.4 of the franchise ordinance states that if all of the distribution lines all the wireline service providers, such as telecommunications service providers, as defined in RCW 35.99.010, a utility service provider or a Cable Operator (collectively “Service Providers”) in any portion of the Franchise Area are underground, Grantee shall place its Cable System’s distribution cables underground within that area; provided that such underground locations are actually capable of accommodating Grantee’s cable and other equipment without technical degradation of the Cable Systems’ signal quality. The proposal would utilize existing poles with other attached franchisee communication facilities and overlash to the existing Comcast aerial path. As minimum vertical height clearance of 15’-6” would need to be provided for, any existing obsolete cable will need to be removed; staff recommends these as conditions of approval. Therefore, the City is granting an exemption with conditions, per the Comcast franchise agreement which allows new overhead facilities to be placed overhead provided there are other similar providers overhead as well. Comcast is required to obtain all necessary private utility easements for work on private property. DECISION: The requested exemption from underground utility installation requirements RMC4-6-090 (C) as requested by the applicant is approved with conditions subject to the conditions below as the request complies with the Comcast Franchise Agreement.
