That said DCT MONSTER ROAD LLC,a Delaware limited liability company(hereinafter,"Grantor"),for and in
consideration of satisfying condition 7 of LUA 18-000237 and to avail Grantor of the benefits of such land '
use application,and other good and valuable consideration,receipt of which is hereby acknowledged,do by '�i
these presents, grants and conveys unto the City of Renton, a Washington municipal corporation
(hereinafter,'°Grante2"),its successors and assigns,a non-exclusive easement for the purpose of preserving
native vegetation for the control of surface water and erosion, maintenance of slope stability,visual and
aural buffering, and protection of plant and animal habitat, within the Native Vegetation Protection
, Easement Area described on Exhibit B and depicted on Exhibit C, each attached hereto and incorporated ,
' herein by this reference (hereinafter, the "Nateve Vegetation Protection Area" or "Easement Area"). The '
I foregoing grant of easement shall also permit Grantee with the right to install,repair, replace and maintain
the native vegetation and to remove invasive vegetation and species within the Native Growth Protection
Area,together with the right of ingress and egress thereto over the Grantor Property. l he foregoing grant
of easement is conditioned on Grantee's covenant that it shall, upon completion of any work within the
property covered by the easement, restore the surface of the easement, and any private improvements
disturbed or destroyed during execution of the work, as nearly as practicable to the condition they were '�
in immediately before commencement of the work or entry by the Grantee or its vendors or contractors.
The Easement Area includes the protected slope area. MAINTENANCE RESPONSIBILITY: Afl owners of lots
abutting or which include this Native Vegetation Protection Area are responsible for maintenance and
protection of the Easement Area. Maintenance includes ensuring that na alteration by such Grantor occurs ,
within the easement and that all vegetation remains undisturbed by Grantor without the express, prior ',
written authorization of the City.
This easement shall run with the land described herein and shall be binding upon the Grantor as the owner
� of the Grantor Property,its heirs,and all successor owners of the Grantor Property. Grantor covenants that
it is the lawful owner of the Grantor Property described on Exhibit A and that it has a good and lawful
right to execute this easement.
Any lawsuit or legal action brought by any party to enforce or interpret this easement or any
of its terms or
covenants shall be brought in the King County Superior Court for the State of Washington at the Maleng
Regional Justice Center in Kent, King County,Washington,or its replacement or successor.Grantor hereby
expressly consents to the personal and exclusive jurisdiction and venue of such court even if Grantor is a
foreign entity registered,or not registered in the State of Washington.
