Dear Ms. Allen:
This office has reviewed your request dated November 22, 2021 (attached) to extend an approved
Temporary Use Permit (File No. LUA21-000102) for a period of one hundred and eighty (180) days. The
Temporary Use Permit (TUP) expired on November 26, 2021.
In your request, you state the carrier’s (Verizon) original plan to integrate a new, permanent facility into a
proposed development on the adjacent site at 1300 Bronson Way N is no longer viable and therefore an
alternative site needs to be pursued. Staff is aware of the challenges facing the approved project on the
adjacent site and concurs that the site may no longer be viable for the installation of a permanent wireless
communications facility. Per you request, the carrier anticipates the pursuit of an alternative site and
construction of a new, permanent facility will take approximately twelve (12) months.
A specific type of extension request is available to temporary use permits issued for temporary wireless
communications facilities. Pursuant to RMC 4-4-140K, the municipal code allows issuance of up to two (2)
extensions of up to 180 days each to an applicant who files a written request with the Administrator upon
showing that the proposed installation or repairs are actively progressing. The applicant is requesting the
first of two (2) possible extensions for the subsequent Temporary Use Permit.
According to the applicant’s request (attached), the wireless provider is actively searching for new sites to
locate a permanent wireless communications facility. Due to the length of time, the temporary facility has
been located on the site, staff recommends the applicant be required to submit a monthly update with
regards to the wireless carriers progress in leasing a site for a permanent facility. The updates shall be
submitted to the Current Planning Project Manager by the tenth (10th) day of each month beginning in
January of 2022. The 180-day extension request is approved, subject to one condition*.
*Condition: The applicant shall submit a monthly progress report to the Current Planning Project Manager
on or before the tenth (10th) day of each month starting in January of 2022 until expiration of the
Temporary Use Permit. The progress report shall include information on potential sites identified, lease
negotiations, and any other information related to the installation of the subsequent permanent facility.
If the report is not submitted on or before the tenth (10th) day of each month, the permit shall be void and
equipment shall be removed.
The 180-day extension shall be measured from the expiration date of the original approval, November 26,
2021. Therefore, the permit extension shall expire on May 25, 2022.
