HomeMy WebLinkAboutC_Extension Request Response Ltr_Michael Residence Variance_211222 December 22, 2021 Ryan Michael 3500 Factoria Blvd Bellevue, WA 98006 Subject: Variance Extension Granted Michael Residence Variance, LUA19-000057, V-A Dear Mr. Michael: This office has reviewed your request (dated October 29, 2021; attached) to extend an administratively approved variance (File No. LUA19-000057) for a period of one (1) year. The variance was set to expire on May 9, 2021. On April 20, 2020 the Renton City Council adopted an Emergency Ordinance (Ordinance No. 5968) that temporarily extended the validity of certain permits by a period of six (6) month due to on-going construction challenges created by the COVID-19 outbreak. Therefore, the Emergency Ordinance extended the expiration date of the variance until November 9, 2021. Since the first extension was granted in response to the current public health emergency, the project remains eligible for the standard single-extension of up to one (1) year as authorized in RMC 4-9-250B.20. In your request, you identify continuing challenges created by the COVID-19 pandemic as the reason for the request, which staff concurs with. Pursuant to RMC 4-9-250B.19, the Municipal Code allows the applicant to petition for a single extension of up to one (1) year if the request is filed prior to expiration of the variance approval. Due to email security protocols, your request was incorrectly categorized and filed to a spam inbox. However, your request meets requirements of Renton Municipal Code and qualifies for a one-time extension of one year, as the extension request was submitted on October 29, 2021 prior to the expiration of the variance approval. Therefore, your one (1) year-variance extension request is approved. The one (1)-year extension shall be measured using the expiration date of the variance after issuance of the temporary six (6)-month extension (November 9, 2021) in order to ensure consistency with the extensions granted to other projects under the emergency ordinance. Please note that per RMC 4-9-250B.19, construction must commence prior to the last day of the new extension period (November 9, 2022).
