original condition, including but not limited to its size, shape, configuration,
location and external appearance, within a reasonable period after decay or
partial destruction, except where repair causes substantial adverse effects to
the shoreline resource or environment.
3. Replacement of a structure or development may be authorized as repair
where such replacement is the common method of repair for the type of
structure or development and the replacement structure or development is
comparable to the original structure or development including, but not limited
to, its size, shape, configuration, location and external appearance and the
replacement does not cause substantial adverse effects to shoreline resources
or environment.

PROJECT NARRATIVE
Fire Hydrant Repair.
This project proposes to repair a leaking fire hydrant fire main located on
the Boeing Lake Washington shoreline, adjacent to the City of Renton Boat
House. The shoreline is classified as Urban and consists of a concrete
bulkhead. There will be no views blocked as a result of this project. The
repair of the fire hydrant 6 inch fire main, will be able to allow continued
fire protection. Erosion control will be implemented during the repair of the
fire hydrant repair. Less than one cubic yard of soil will be disturbed. The
estimated total cost of the repair will be approximately $2,000 dollars. The
construction will begin upon the receipt of all permits necessary to complete
the project.
A Shoreline Development Permit Exemption is being sought because it is
"normal maintenance or repair of an existing structure" and the construction
value of the improvement does not exceed $2,500 and the project does not
interfere materially with the shoreline or water of the State.
The project is above the mean high water mark of Lake Washington.

FIRE HYDRANT AND FIRE WATER USE AGREEMENT
THIS FIRE HYDRANT AND FIRE WATER USE AGREEMENT ("Agreement")dated this
ter terg u , 1993, is entered into by and between The City of Renton
("Renton") and THE BOEING COMPANY, acting by and through its division BOEING
COMMERCIAL AIRPLANE GROUP ("Boeing").
Recitalg
A.'. Renton has requested permission to use that certain fire hydrant ("Hydrant") located
adjacent to the Renton boat house at the south end of Lake Washington, as depicted in •
Attachment A hereto, and the associated fire water. The hydrant and the fire water are the
property of Boeing. Renton desires to have access to the Hydrant and fire water for the sole
purpose of fire protection for the boat house.
B. Boeing hereby agrees to allow Renton use the Hydrant and'associated fire water for
such purpose, subject to the following terms and conditions:
Agreements
NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency of
which are hereby acknowledged, the parties agree as follows:
1. No Obligation by Boeing. Use of the Hydrant and associated fire water shall be
provided to Renton at no charge. Boeing is under and assumes no obligation to provide fire
water to Renton through the Hydrant, or otherwise. Boeing is under and assumes no
obligation to keep, maintain or otherwise provide the fire water or any alternative•source of
water. Renton's receipt of fire water and use of the Hydrant•shall give rise to no right, express
or implied, to the fire water. Boeing shall have no obligation to preserve, maintain or
otherwise affect the Hydrant in any way whatsoever. The receipt of the fire water through the
Hydrant shall be at Boeing's convenience and shall be at Renton's sole risk.
2. Unpredictability of Service. Renton acknowledges that availability of such fire water, is
inherently unpredictable and subject to interruption, suspension, curtailment and fluctuation.
Boeing will not be liable to Renton or any third party for any interruption, suspension,
curtailment or fluctuation in any fire water, or for any loss, injury, or damage caused by or
arising therefrom, whether or not caused by Boeing or others.
4. Indemnification by Renton. Renton agrees to release, indemnify, defend, and hold.
harmless Boeing, its agents, officers, directors, employees and assigns from and against all
losses, claims (including any claims by any government or governmental agency), penalties, iING
fines,judgments, damages, liens and liabilities (including, but not limited to a Zit!

connection with Renton's use or attempt to use the Hydrant or fire water, or any nhw-efooy98

whether or not due in whole or in part to the fault or negligence
. of Boeing whether active,
passive or imputed, and whether or not such claims be false,fraudulent or
respect to all or anygroundless. With
portion of the foregoing obligation which i iay be held to be within the
purview of RCW 4.24.115, such obligation shall apply only to the maximum extent permitted
by RCW 4.24.115.. As between the parties and for purposes only of the obligations herein
assumed, Renton waives any immunity, defense, or other protection that may be afforded by
any worker's compensation, industrial insurance, or similar laws (including, but not limited to,
the Washington Industrial Insurance Act, Title 51 of the Revised Code of Washington). The
foregoing obligation will survive termination of this Agreement or the cessation or termination
of the fire water or the modification, replacement, destruction or abandonment of the Hydrant.
3. T i ati n. This Agreement may be terminated by either party upon thirty(30) days'
advance written notice.

first written above.
