I have included your comments in the official project file for consideration by the decision maker. We have discussed your comments regarding the joint-use driveway access onto Nile Ave NE and the off-site improvements you recommend on Pasco Ave NE. Regarding the access off of Nile Ave NE, as Lots 11 and 12 do not have frontage on the proposed extension of Orcas Ave NE it would not be code compliant to require that access to these lots be provided off of the new Orcas Ave NE extension. The proposed joint-use driveway off of Nile Ave NE is the preferred access for Lots 11 and 12 as these lots directly front on Nile Ave NE. The off-site improvements you recommend on Pasco Ave NE to facilitate a through connection to NE 6th cannot be required under this development application, as those improvements would extend beyond the boundaries of the project site. The new public hearing is scheduled online for January 18th at 9:00 am, you are welcome to attend and testify during the public comment period. DeLange Address 530 Nile Ave NE Renton WA 98059 Email jldelange@outlook.com Telephone 650 303 8872 COMMENTS Myself, Joel DeLange, and owner Ron Bielka 524 Nile Ave NE – ronbielka@gmail.com oppose any shared driveway access easement to Lots 11 and 12 off of NE Nile Ave. Access to Lots 11 and 12 should be accessed via the proposed new public street extension from Orcas Ave NE to the North and via NE 4th PL to the South. City of Renton acknowledges that Nile Ave NE is a collector arterial Nile Ave NE traffic is non-stop and congested during morning and evening commutes as well as used moderately throughout the day and night. It is so busy that you need to back your car into the residence driveway so as to alleviate the RISK of being in or causing an accident on Nile Ave NE if one were to try and reverse out of their driveway onto Nile Ave NE. There is already significant noise pollution and environmental pollution of the use of Nile Ave NE as it is a collector arterial which will only see increased traffic use with the continued development of the Renton Highlands area and this land use as well. The allowance of a shared driveway access easement to Lots 11 and 12 off of NE Nile Ave will only increase the RISK of rear end or t-bone accidents of this heavily used collector arterial road. It will also increase environmental and noise pollution from backed up traffic during heavy use as Lots 11 and 12 attempt to access. DENIAL of the shared driveway access easement to Lots 11 and 12 off of NE Nile Ave will mitigate the RISK of accidents as well as the environmental and noise pollution vs. allowing same. Myself and the Bielka household as well as other owners of residences on Nile Ave NE have only seen increased traffic, increased speeding, and increased environmental and noise pollution as the Renton Highlands area is built out and will continue to have to bear the brunt of such development. Therefore, relief is being requested and the City of Renton is being asked to deny this shared driveway access. As stated, the development can be modified to allow access to Lots 11 and 12 through the new extension of Orcas Ave NE to the North and via NE 4th PL to the South. As for the new public alley extension proposed I, Joel DeLange am opposed to a partial extension of the alley. Since this is a public access road (partial/Alley), the City of Renton is obligated to fully extend Pasco Ave NE from NE 4th St from the South all the way through to NE 6th ST from the North for the greater good of the public at large. Applicant has a conflict of interest (as an owner) and simply is trying to delay public access which will ultimately have to be completed. There should be no delay as ultimately, this land use will be approved and the City of Renton should side on the publics interests. I thank you for allowing me to make public comment on LUA21-000287. Therefore, I respectfully request along with the Bielka and Manjit households that the City of Renton provide the following: · Disclose a total count and list of ALL property owners who reside within 300 feet of the project site · Disclose a total count and list of ALL property owners who reside within 300 feet of the project site and were properly notice · Disclose the total count and list of ALL property owners who reside within 300 feet of the project site who should have been provided notice that were not provided such notice · Disclose what “computer system error” (sic) prevented proper NOTICE of ALL property owners who reside within 300 feet of the project site who should have been provided notice that were not provided such notice · Disclose in detail as to what action "The City is taking steps to ensure such an error will not be repeated" CAUTION: This email originated from outside the City of Renton. The City has re-examined its files and records of notice and admits that there were, in fact, property owners who reside within 300 feet of the project site who should have been provided notice that were not provided such notice due to a computer system error. The City is taking steps to ensure such an error will not be repeated. The City therefore recommends the following resolution: · that the City issue notice of proposed action to those property owners who did not previously receive action; and · that those property owners be provided a 14-day opportunity to provide written comments to the City as were otherwise provided to other property owners; and, · that a Hearing on the action be convened, and allowing public comment from those property owners. The City defers to the Hearing Examiner regarding whether the Hearing proposed above be a re- opened first Hearing or a Hearing on Reconsideration given the notice discrepancies noted by Mr. DeLange. To All Parties Herein Myself (DeLange) and the Bielka and Manjit households challenge that the Notice of Application was mailed to our respective households as “the notice” was never received by said parties. Nor were we added as party of record as requested through email and as instructed to alert City of Renton Jill Ding to request during “Notice of Neighborhood Meeting for Cypress Lane” (see attached pdf) CAUTION: This email originated from outside the City of Renton. Based on the above and the need to hold 2 virtual neighborhood meetings given reason “that all the required persons were not notified/noticed before.” It is my belief that AGAIN not all required persons were mailed the “Notice of Application” once on file with the City of Renton. We attempted in good faith to attend the neighborhood meetings, request to be party of record and be informed of public input dates so what we could participate and have our voices heard. They have not been heard and, therefore the request for reconsideration was put in motion. It is not that we are opposed to the land/build use project proposed but that we wanted to be active participants in having are concerns heard and changes implemented if deemed appropriate. Of importance and reason for 2nd mtg was “that all the required persons were not notified/noticed before.” July 15, 2021 – Email initiated by Joel DeLange on behalf of DeLange (530 Nile Ave NE), Bielka (524 Nile Ave NE) and Manjit (535 Orcas Ave NE) households to City of Renton (Jill Ding) requesting to be added as party of record for said Cypress proposal. A public hearing was held November 23rd and the Hearing Examiner issued his decision December 2nd. We are currently in a 14-day appeal period for the Hearing Examiner’s decision. I am respectfully requesting the hearing examiner set a reconsideration hearing in this matter as I do not believe proper notice was sent out to all parties involved.
