CITYOFRENTON,WASHINGTONORDINANCENO.6057ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,DECLARINGAMORATORIUMONLANDUSE,BUILDINGPERMIT,ANDBUSINESSLICENSEAPPLICATIONSFORWAREHOUSINGANDDISTRIBUTION;SETTiNGFORTHFINDINGSOFFACTINSUPPORTOFSAIDMORATORIUM;PROVIDINGFORSEVERABILITY;DECLARINGANEMERGENCY;ANDESTABLISHINGANIMMEDIATEEFFECTIVEDATE.WHEREAS,theCity’sCommunityandEconomicDevelopmentDepartment(CED)regularlyundertakesworkprogramstoproposeamendmentstoTitleIVoftheRentonMunicipalCode(RMC);andWHEREAS,onesuchworkprogramisanevaluationoflandusesinthecity’sindustrialzones,namelyconsiderationoftheWarehousingandDistributionlanduseandtheimpactfeeamountforthatlanduse;andWHEREAS,warehousinganddistributionfacilitiesareallowedonlyinthecity’sindustrialzones,whichareintendedtoimplementtheEmploymentAreaLandUseDesignationoftheCity’sComprehensivePlan;andWHEREAS,PolicyL-18oftheCity’sComprehensivePlanstates,inpart,“EmploymentAreasprovideasignificanteconomicdevelopmentandemploymentbasefortheCity.Maintainavarietyandbalanceofusesthroughzoningthatpromotesthegradualtransitionofusesonsiteswithgoodaccessandvisibilitytomoreintensivecommercialandofficeuses;”andWHEREAS,truckingassociatedwithwarehousinganddistributionfacilitiescreatesignificantimpactsonlocalroadwaysandproducehighlevelsofparticulatepollution;andWHEREAS,warehousinganddistributionfacilitiesareland-intensiveuseswithrelativelylownumbersofemployees;and1 ORDINANCENO.6057WHEREAS,taxescollectedforwarehousinganddistributionfacilitiesareinefficienttomitigateimpactscausedbysuchfacilities;andWHEREAS,theCityseeksadequatetimetocompletesaidworkprogram;andWHEREAS,theCityCouncilhasdeterminedthatthereisaneedforamoratoriumonacceptinganylanduseapplication,buildingpermitapplication,orbusinesslicenseapplicationforWarehousingandDistribution;andWHEREAS,theCityCouncilwillholdapublichearingwithinsixty(60)daysofthepassageofthisordinance;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.TheaboverecitalsareadoptedasfindingsoffactinsupportofthemoratoriumsadoptedhereinpursuanttoRCW35A.63.220andRCW36.70A.390,andarefoundtobetrueandcorrectinallrespects.SECTIONII.TheCityCouncilherebydeclaresamoratoriumuponthesubmissionoracceptanceofanylanduseapplication,buildingpermitapplication,orbusinesslicenseapplicationforWarehousingandDistribution;andSECTIONIII.Thismoratoriumshallnotapplytoanycompleteandacceptedlanduseapplications,buildingpermitapplications,orbusinesslicenseapplicationsforWarehousingandDistribution;andSECTIONIV.ThemoratoriumimposedhereinshallbeineffectuntilAugust14,2022,unlessendedearlierbysubsequentCityCouncilaction,orunlesssubsequentlyextendedbytheCityCouncilpursuanttostatelaw.2 ORDINANCENO.6057SECTIONV.Apublichearingshallbescheduledandheldwithinsixty(60)daysofthepassageofthisordinance.SECTIONVI.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phraseorwordofthisordinance.SECTIONVII.TheCityCouncildeclaresanemergencyfortheprotectionofthepublicwelfareandtoenablethepurposeandintentofthisordinancetobeaccomplished.ThisordinanceshalltakeeffectimmediatelywhenpassedbytheCityCouncil.TheCityClerkshallcausetobepublishedasummaryofthisordinanceintheCity’sofficialnewspaper.Thesummaryshallconsistofthisordinance’stitle.PASSEDBYTHECITYCOUNCILthis14thdayofFebruary,2022.ia7nA.Seth,/ityClerkAPPROVEDBYTHEMAYORthis14thdayofFeruary,2022.ApproyedasShaneMoloney,CityAttorneyDateofPublication:2/17/2022SummaryORD—CED:2208:2/11/2022Mayor3
