drainage �acilities shall be mairatained in complianee wi�h the c�peration and maintenance
schedule includec# and attach�d herein as Exhibit E�—Oper�tio�ts at�d tVl�in�ert�nce. Drainage
facilities inc(�ade p[pes, channels, flow control facilities, water c�uafity facilities, an-site best
managemen�t practices (BMPs) and other engineered structcaa�es designed to �raanage and/or

treat starrt�water on the Property. Qn-site BMPs include dispersion and infiltration devices,
bioretentican, permeabfe pavements, rainwater haruestir�g syst�ms, tree retention credit,
reduced impervio�us surFace footprint, vegetated roofs and ather measures desrgned to mirnic
pre-develaped hyc�rce�o�;y and mi�irrrize storrrawater runoff on the Prc�perty.
2. City of Renton shafl have the right to ingress and egress over those perrtia�s a€the Property
necessary to perFc�rm inspectiar►s of the stormwater facilit�es ared BMPs and conduct
maintenance ackivities specified in this Declaration of Govenant and in aecardance with the
Rentcan Nlunicipal Code. Cityr of Re�tan shall provide at least thirty (30} c{ays'written natice to
the Owners tha�entry an the Pcaperty is planned for the inspec�ion of drairoage facilities. After
the thirty(30) days,the Ov�rners shall allow the City of Rentor�to enter for the sole purpose of
inspeeting drainage facifities. lra 6ieu of dnspection by the City,th�C>wners may elect to engage
a licensed civil engineer regis�ered in the state of Washington wha has expertise in drainage�o
inspect the drais�age facikities anci provide a written report describing their condition. If the
engineer optian is chosen,the C7wners shafl provide wrwttedry nc�tice to the City of Renton within
fifteen �15j days af receiving the City's notice af inspeetion.Within thirCy(30}days of giving this
natiee,th�Owners, ar en,�ineer on behalf of the Owners, shall provide the engineer's report�ta
the City of Renton. &f the report is not provided in a timely manner as specified alaove,the City
of Rentan may ins�rect the drainage facilities wathaut further natice.
3. If City of Renton determ'rraes fram its inspection, or frorrt an engineer's r�port provicfed in
accordance with Paragraph 2, that mairotenance, repair, restorafi¢c�n, andfor mitigation work is
req�ir�d to be done ta any of the drainage fiacilities, City o�Renton shall na�sfiy the �wners of
the specif�c mairtterrar�ce, repair, restoration, and/or mitigatic�n work ("Wark") reqe�ired
pursuant tc�the Renta�n Mur�icipal Code. The City shall aCsQ s�t a reasonable deadline for the
Owners to comp{et�the Work, or to provide an engiraeer's repor-t that verifies eompletion of
the Work. After the de�dlir�e has passed, the Owners shalt allow the Caty aceess to re-inspect
the drainage faci(ities unless an er�gineer's report has been provided verifying completian of
the Work. Cf the Work is n€�t campleted within the time frame set by the City, the City may
initiate an enfarc�rrtent actia�n and/ar perform the Wcark and hereby is �;iven access to the
Property for such purposes. Written natice wi[I be sent to the C7wr�ers stating the City's
intentian ta perform such Work.This Work will nnt commence until at least seven(7)c�ays after
such notice is mai[ed. lf, with'tn fihe sale discretior� of the City, there exists an imminent or
present dangc�r, the seven {7) day natice perir�d wil! be wa�ved and Work wili begin
immediately.
4. The Owners shal9 assum�a!l responsibility far the cast of any Work, or any measures taken by
the City ta address canditions as described in Paragraph 3. Such responsibi(i�y shall include
reimbu�semer�tto the City within thirty(3Q)days afthe receipt of the invoicefor any such Work
performed. CDverdue payments will require payment r�f tnterest at the maximum legal rate
alfawed by RCW 19.52_020 (currently twe�ve pereent(�2%�}. If the City initiates legal actian ta
enforce this agreement, the prevailing party in such actian is erttitled to recover reasonab(e
I�tigation ccasts and attorney�s fees.
5. The (7v�ners are required ter obtain written approvat frorn City of Renton prior to fifling, piping,
cutting, or remaving vegetation {except in routine landscape maintee�ance} in open vegetated
stormwater fa�ilities (such as swales, channels, ditches, ponds, etc,}, or perfQrming any
alteratic�ns ar mc�dificatians�o the draina�e facilities s-eferenced in thas Declaratioc�of Covenant.

6. Any notice or ccansent reqtaired ta be given or otherwise provided for by the p�r4visions of th�s
Agreement shall be�ffective upon personal dePiveey,arthree{3}days aftec mailing by Certified
[VEaiI, return receipt requested.
7. With regart�to the matters addressed herein,this agreement canstitutes the entire agreernent
between the parties, and se�persedes all prior dise€�ssions, negcrteations, and all agreements
whatsoever whether crraf c�r wr�tten.
8. This Dedaration of Cavenant is intended to protect the ualue and desirability and promote
efficier�t and effective management of surface water c�rainage of the real pra�erty described
above, and shail inure ta the benefct of aEl the citizens of the City of Renton and its successors
and assigr�s. 1"his Dec{aratior� c�f Covenant shalf run with the land and be binding upon
Grantor(s), and Grantor's(s'�s�ccessors in interest,and assigns.
9. This Declaratian af Covenant may be terminated by execution af a written a�reement by the
