Council recessed at 9:10 p.m. and reconvened at 9:18 p.m. Roll Call.: CLYMER, PERRY, THORPE, STREDICKE, SHINPOCH,SHANE. PUBLIC HEARING This being the date set and proper notices having been published and Federal Shared posted as required by law, Mayor Delaurenti opened the public hearing Revenue to consider the City's Planned Use of Federal Sharing Revenue Money in amount of $567,315 as presented by the Mayor for inclusion in Comments Invited the 1979 budget. Report was presented explaining .the Mayor's recom- mended use of the funds for salaries and benefits for Public Safety Physical Environment and Library Services. The funds were derived as follows: $21 ,478 from unappropriated Entitlement Funds held in Revenue Sharing Trust Fund, $5,500 interest, and Federal Entitlements $540,337. Councilwoman Thorpe noted the revenue sharing would end in 1980 anticipating problems for future salaries and supported use of funds for projects. Following discussion, Councilman Stredicke asked for assurance from Mayor Delaurenti , that the Libraries would be staffed and remain open; assurance given. Councilwoman Shinpoch noted for informational purposes that the League of Women Voters plan monitor regarding the Federal .Shared Revenue and will be meet- ing with the City; also that membership is open. MOVED BY STREDICKE, SECOND SHINPOCH, REFER MATTER OF THE FEDERAL SHARED REVENUE TO THE WAYS AND MEANS COMMITTEE FOR PROPER LEGISLATION IF NEEDED. CARRIED. AUDIENCE COMMENT Mr. Byron Johnson, 2138 SW 317th P1 , Federal Way, purchaser of property south of Cedar River being condemned by the City for park Cedar, River purposes, Cedar River Trail marshland, proposed to deed the 25 acre - Marshland property in condemnation to the City without monetary consideration in exchange for zoning remaining land as planned unit development, probably multiple. City Attorney Warren advised any zoning depends upon limits as established by the comprehensive plan and application would be made through the Planning Department and heard by the Hearing Examiner. Mr. Warren advised the condemnation proceedings will be completed soon except for compensation and that the city was willing to accept dedication without monetary compensation. Community Services Committee Chairwoman Seymour-Thorpe invited Mr. Johnson to attend meeting (see schedule attached) 'regarding Cedar River trail and acquisition. Upon inquiries by Councilman Shane, Councilwoman Thorpe explained the trail system planning through the Block Grant Program. (Time 9:55 p.m. )'. OLD BUSINESS Transportation Committee Chairwoman Shinpoch presented (Aviation Aviation Committee) report explaining problem of near accidents involving Committee Report joggers and vehicles on the Airport's Perimeter Road, that upon Joggers on advice of City Attorney Warren, signs were posted prohibiting Perimeter Road joggers. The report recommended that these signs be removed and that the Administration be directed to resolve this issue with consideration being given to accomodate joggers. MOVED BY THORPE, SECOND STREDICKE; Council concur in the committee recommendation. Following discussion, City Attorney Warren noted pedestrians in roadway as illegal . SUBSTITUTE MOTION BY THORPE, SECOND SHINPOCH, amend committee report by replacing signs with warning that joggers are present and remind joggers to stay to right of roadway. ROLL CALL: 3-AYE: THORPE, STREDICKE SHINPOCH; 3-NO: CLYMER, PERRY, SHANE. MAYOR DELAURENTI VOTED NO AND MOTION FAILED. MOVED BY PERRY, SECOND THORPE, Council concur in the committee report. Airport The (Aviation) Transportation Committee report recommended that the Restaurant Sunbird Restaurant completion date be extended to December 15, 1978 and noted the restaurant is 70% complete and anticipate opening date of December 1 , 1978. PUBLIC MEETING This being the date set and proper notices having been posted and Cascadia published, Mayor Delaurenti opened the public meeting to consider Annexation the 10% petition for annexation of area located south of 'Honeydew 10% Petition Elementary School and north of SE 128th St. (NE 4th St. extended) Located South of between Union Ave. NE and 140th Ave. SE. ; approximately 107.3 acres Honeydew School with assessed valuation of $1 ,029,700. Data sheets were :distributed East of Union NE. which listed area: undeveloped land, single family dwellings, North o,f SE 128th a day care center and commercial uses near corner of 138th Ave. SE and SE 128th St. (NE 4th St. ); Comprehensive Plan: single-family residential together with commercial and multi-family residential near intersection of SE 128th St. and 138th SE. Letter from City Clerk Mead noted that the City's Planning Department had certi- fied the signatures on the petition represented 56.6% of assessed valuation, only 10% needed by law. Planning Director Ericksen used wall maps and slides for presentation, noting Cascadia Properties as initiator. Councilwoman Thorpe noted possible conflict of interest and left the Chambers and took no part in any discussion or action on this matter. Continued Persons present making inquiries: Raymond LaBlanc, 11621 SE 47th Place, Bellevue, property owner of 12 acres inquired re impact on taxes, being advised by the City that taxes are equal or slightly less than King County upon annexation to the City. Mr. LaBlanc inquired re proposed zoning, being advised all property annexed at G, owners apply for reclassification in accordance with comprehensive . plan; hearings conducted prior to any change. Mr. LaBlanc inquired_ re sewers and was advised by the Public Works Director of pump sta- tions with limited capacity and general gravity drainage_ from_basin extends southerly across SE 128th, east of Heather Downs into back of Maplewood Golf Course. Mr. LaBlanc withdrew his name from the annexation petition. Mrs. Grayson, 90 -years resident, was introduced an'd later inquired about street right-of-way at 6th. P1r. Paul Benton, 10692 NE 8th, Bellevue, one of owners of property at corner of 138th Ave. SE and NE 4th St. extended, acted as spokesman for the annexation and explained reason for annexation to obtain benefit of Circulation of sewers in order to build neighborhood shopping center, noting severe 75% Petiton water problems in area. Upon inquiry of Councilman Stredicke, Mr. Authorized Benton agreed to acceptance of the comprehensive plan, zoning and any pre-existing bonded indebtedness for the annexation area. All but approximately $15,000 of this has been earmarked for salaries . Guidelines for use of these funds caution against using these monies in such a way. "Highest priority should be given to tax reductions fol- lowed by capital construction and other nonrecurring costs . Use of revenue sharing for continuing operation projects should be discouraged. . . " (1977 Citizens ' Guide to City Budgeting, Washington Research Council, pg. 9 ) . What will be used to meet these salary expenses when revenue sharing expires in 1980? 2. $710 ,404 of General Revenue is allocated to the Street Fund. This figure is double that of the 1976 budget. Many projects in this department could utilize l/2 gas tax monies. But gas tax monies are used primarily for new construction instead. This will increase the strain on future budgets to pay even more for street maintenance, presumably drawing more and more from general revenues , or worse, resulting in even less ability to adequately maintain streets , particularly in residential areas . Both of these areas require closer scrutiny by the Adminis- tration and Council. They are questionable policies at best and could force a future Council to make a choice between drastic reduction in services or severe tax increases . Patricia M. Report (H.R. 13367) was presented explaining the Mayor' s recommended use of the Federal Revenue Funds for the year 1978 totalling $641 ,724 with expenditures for Puget Sound Conference of Governments; CATV Cable Television services with City of Seattle; Public Safety, Police Patrol and Fire Suppression Salaries; Seattle-King County Public Health Services; Puget Sound Air Pollution Control Agency; Parks and Recreational salaries; Library salaries. Upon inquiry Finance Director Marshall explained guidelines for use of the funds , noting the City has chosen to use the revenue sharing money in similar manner' in most years, that use of funds for salaries is easiest for auditing purposes. Upon further inquiry, Finance Director Marshall explained formula for determining the amount of funds , being determined by unemploy- ment rate and City's tax effort; that City's increase in utility tax was taken into consideration i'n arriving at $641 ,724 figure. Upon further inquiry, Mayor Delaurenti explained legal requirements for hearing and opportunity for public participation; that Council will make final determination on use of the funds at time of budget hearing and adoption. City Attorney Shellan explained procedure if Council determined to vacate portion of right-of-way with payment of 1/2 appraised value; ordinance not being effective until payment received, explaining if street right-of-way vacated to 23 feet, rockery would not have to be moved. Upon discussion of effect on Rutherford property (B-1 zone) would be landlocked if entire street vacated, Fire Chief Geissler noted restrictions on property if right-of-way reduced to 23 ft. , such as no parking on street. Mr. Farrell noted King County Assessor valuation of area property at $1 . 50 to $2.25 per' sq.ft. City Attor- ney' Shellan advised need to consider easements; also need for written consent with indemnity clause from abutting property owners if street vacated to 23 ft. Councilwoman Shinpoch inquired as to continuance of matter even with vacation, being advised by the City Attorney that Farrell would withdraw his complaint if he doesn' t have to move rockery; that centerline is in location described by Public Works Director.
