The original application included a requested proposal for a Preliminary Short Plat approval, Environmental (SEPA) Review, and a street Modification for the subdivision of an existing 62,781 square foot project site zoned R-8, into eight (8) lots and two (2) tracts (shared driveway/alley and native growth protection area). An existing single-family residence is proposed for removal. The proposed lots would range in size from 5,000 square feet to 6,522 square feet. Access to the proposed lots would be provided via a shared driveway/alley off of NE 38th Street. Half street improvements, including paving, curb and gutter, landscaping with street trees, and sidewalk would be provided along the site's Lincoln Ave NE and NE 38th Street frontages. The site is mapped with erosion hazard areas, landslide hazard areas, sensitive slopes, and protected slopes. The applicant is proposing to retain 17 of the existing 102 significant trees located on the project site. The applicant is requesting to waive the frontage improvements along the steep slopes and to limit the frontage improvements to a sidewalk, parking area, and landscaped courtyard over the proposed stormwater vault. The 38th Street Preliminary Short Plat approval expired on December 21, 2021 prior to the completion of the construction of the short plat improvements approved under the issued Civil Construction Permit (C19004544) and the recording of the short plat. Gill Homes, LLC has filed a new application for a Preliminary Short Plat (LUA22-000022) for the KP Development Short Plat, which would extend the approval of the original 38th Street Short Plat and allow the applicant to complete the required civil improvements and record the short plat. The KP Development Short Plat is an extension of the original 38th Street Short Plat, with no changes in scope for which the DNS-M SEPA threshold determination was issued. As the proposal would not change the scope of the original DNS-M, staff has determined that the existing DNS-M would be appropriate to mitigate the impacts of the KP Development Short Plat proposal. The original SEPA determination included the following mitigation measures all of which should apply to the KP Development Short Plat project (LUA22-000022): 1. Project construction shall comply with the recommendations outlined in the Geotechnical Engineering Report, prepared by ZipperGeo, dated October 12, 2018. 2. A 25-foot buffer and additional 15-foot building setback shall be required from the top edge of the protected slope area. The City’s Environmental Review Committee issued a Determination of Non -Significance - Mitigated (DNS-M) for the 38th Street Short Plat and Street Modification. The DNS-M included two (2) mitigation measures. A 14-day appeal period commenced on June 21, 2019 and ended on July 5, 2019. Analysis: It has been determined that the environmental impacts of the proposal were adequately addressed under the analysis of significant impacts contained within the previously adopted DNS-M. Based on WAC 197-11-600(4)(c), the addendum process may be used if analysis or information is added that does not substantially change the analysis of significant impacts and alternatives in the existing environmental document. The proposal for the DNS-M issued for the 38th Street Short Plat to be utilized for the KP Development Short Plat would not change the analysis or impacts in the State Environmental Policy Act (SEPA) Review. The City of Renton is hereby issuing a SEPA Addendum pursuant to WAC 197-11-600. This Addendum is appropriate because it contains only minor information not included in the original Determination, specifically the amended timeframe for the completion of the project, and there are no additional environmental impacts related to inclusion of the new information. DECISION: The City of Renton is hereby issuing a SEPA Addendum pursuant to WAC 197 -11- 600 to allow the DNS-M for the 38th Street Short Plat to apply to the KP Development Short Plat application, LUA22-000022.
