AN ORDINANCE OF THE CITY OF RENTON, W.\SHINGTON., VACATING PORTION OF A
CERTAIN ALLEY IN BLOCK 1, CAR WORKS ADDITION TO THE CITY OF RENTON.
WHEREAS a proper petition for vacating a portion of a certain alley as herein-
after more particularly described was duly filed with the City Cleric of the City of Renton
on or about November 19, 1964, said petition being signed by the owners of more than two-
thirds of the property abutting upon said portion of the alley sought to be vacated; and
WHEREAS the City Council adopted Resolution No. 1278 therein fixing and deter-
mining the 11th day of January, 1965, at the hour of f:00 P..M, , in the Council Chambers
of the City of Renton to be the time and place for public hearing thereon, and the Clerk
having given due notice of such hearing in the manner provided by law, and all perbons
having been heard appearing in favor or in opposition thereto, and
WHEREAS the Planning Commission having heretofore recommended the vacation of
said portion of alley, and said vacation to be found in the public interest and for the
public benefit and no injury or damage to any person or properties resulting therefrom,
NOW THEREFORE
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENTON AS
FOLLOWS;
SECTION I: The following described portion of alley, to-wit:
That portion of alley in Blocic Car Works Addition to
the City of Renton, abutting upon tots 56 4, '7, 12, 13 * d 14
(according to plat recorded in Volume 15 of Plats, Page 47,
Records of King County, ?tashington) all situate in Renton,
King County, Washington
BE AND THE SAME IS HEREBY VACATED
SECTION II: This Ordinance shall be in full force and effect from and after
its passage, approval and legal publication as provided by law.

Gentlemen:
The Texaco Company has agreed in writing to construct a man-
hole on our Sanitary Sewer north of the portion to be vacated, thus
releiving the necessity of retaining an easement. Therefore, it
is the recommendation of the Engineering Department that the portion
of Alley be vacated without reserving an easement for Utility
purposes.

4. Continued :
,Director' s report :
Recommend approval of the plat with the exception that a tem-
porary easement should be provided over Lots 8 and 16 for a turn-
around. The turning easement should have a diameter of not less than
80 ' .
Mr. Jensen stated that the City Engineer has signed the Plat ,
indicating that it has met Ordinance requirements. The members in-
spected the Plat. It was moved by Peretti9 seconded by Busch, to
concur in the Director' s report and recommend to the City Council
the acceptance of the Plat provided that the condition as stated in •
the Director' s report is met. Motion carried.
5 . COUNCIL REFERRALS:

Director' s report : Recommend approval of the request , pro-
vided that adequate provision for a turning movement of not less
than 25 ' radius be provided.
Z After inspection of the area in question, it was moved by Den-
zer, seconded b Racanello that we recommend to the Cit Council

the Director' s report be met. Motion carried. Mr. Peretti abstained
from voting.
b. Protest by Milton Cable on behalf of Vic Diambri to con-

ducts , Inc.
Director' s report:
Recommend that the Commission study this matter.
The letter from Milton Cable was read protesting construction
of the mixing and batching plant for which a permit was issued by
the City Building Department. It was stated that this is in violation
of the zoning in that it is a heavy industrial use in a light indus-
trial zone. The letter further stated that Mr. Diambri, whose pro-
perty is adjacent to the subject property, and whose property would
be damaged by this usq has protested to the City. Subsequently, an
order to desist construction was issued by the Superintendent of
Building. However, the order was recinded and construction began
again.
Mr. Diambri,who was in the audience , stated that he felt this
construction and operation of this plant would be damaging to his
and the surrounding property and is a violation of the zoning ordin-
ance.
Mr. Busch commented that the concrete plant has been in this
area for about ten years and he felt that they had a right to con-
tinue operation, since the City has issued them a permit.
Mr. Felker asked if this was a function of the Planning Com-
mission rather than the legal department .
Mr. Jensen stated that the Commission had been requested by the
Council to study this matter and make a recommendation, and he
felt that it was a matter of concern to the Planning Commission since
it involved zoning.
Mr. Ewing Stringfellow protested the construction of the plant ,

10 foot easement for utility and other purposes. Inasmuch
as the reservation of such an easement would have a serious
effect upon the construction of our service station, we
respecfully suggest the purpose for which the easement is
reserved be confined to that area described in the Deed
from Texaco Inc. to the City of Renton, dated February 17,
1965.

on the matter the Clerk read the previous communication from the Commission
recommending approval upon the basis of plans submitted. Councilman Schellert
advised of Street and Alley Committee investigation and concern as to whether the
dedication would be adequate for a through street and that the City Engineer had
given assurrance that it meets all requirements. Moved by Garrett, seconded by
Hulse, that the Hearing be closed. Carried. The Hearing was declared closed and
Council action requested. Moved by Poli, seconded by Delaurenti, to concur in the
Planning Commission recommendation with referral of the matter to the Law and
Ordinance Committee. Carried.
COMMUNICATIONS:
A letter from City Engineer Wilson submitted and recommended for payment final
construction cost for work completed to 12-11-64 by M. A. Segale, Inc. on the
Puget Drive Contract, Section I, as follows:
Construction Cost $ 50,686.46 less 10%, $ 5,068.65, less previous payment,
$37,481.54. Amount due Contractor, $ 8,136.27.
The project has been accepted by the Engineering Department as of the completion
date and acceptance by the City Council was recommended as of this date, 1-11-65.

alley as hereinafter more particularly described and said petition being signed
by the owners of more than two-thirds of the property abutting upon said portion of
the alley sought to be vacated, same being described as follows, to-wit:
That portion of the alley in Block ?, Car Works Addition to the
City of Renton abutting upon the following lots, to-wit:

Renton according to the plat recorded in Volume 15 of Plats,

BE IT RESOLVED BY THE MAYOR AND TEE CITY COUNCIL OF THE CITY OF RENTON
AS FOLLOWS:
SECTION I: That the llth day of January, 1965 at the hour of 1 :00 P.M.
at the City Council Chambers in the City Hall of Renton, Washington, be and is
hereby fixed as the time and place when the aforesaid petition for vacating portion
of the aforesaid alley shall be heard and determined.

Attached is a petition for the relocation of an alley in the
southern portion of Block 8, Car Works Addition to Renton. It
is signed by the property owners of record for lots 5, 6, 7,
12, 13 and 14.
Also, a preliminary plot plan byh Texaco, Inc., showing the
alley in its present location and proposed location. Texaco
is exercising their option on this property and it is import-
ant that this alley be relocated to fit in with their planning.
