HomeMy WebLinkAboutPermitFebruary 28, 2022 SHELBY PETRO, Practicum Coordinator Samantha Stuefen Wetland Science and Management Certificate Program University of Washington Email: sami.stuefen@hotmail.com PERMISSION FOR RIGHT-OF-ENTRY TO BLACK RIVER RIPARIAN FOREST AND SPRINGBROOK CREEK WETLAND Ms. Petro: The City of Renton Parks and Recreation Department (Licensor/City) hereby permits the student Samantha Stuefen and an assistant of the University of Washington (Permittee) a nonexclusive revocable license to enter Black River Riparian Forest (BRRF) and Springbrook Creek Trail Wetland as designated in Exhibit “A” (excluding the Springbrook Wetland Mitigation Bank area), (collectively ‘Parks’), for the purpose taking water quality measurements and soil samples to establish a current wetland rating for these sites as part of the certificate program for wetland and science management through the University of Washington, at the sole cost to the Permittee and for no other purpose, and all subject to the terms and conditions and locations identified in Exhibit “A” set forth herein. CONDITIONS OF RIGHT-OF-ENTRY ARE AS FOLLOWS: 1.Purpose of Permittee’s surveys in the Parks: The purpose of the surveys is to establish a current wetland rating for Black River Riparian Forest and Springbrook Wetland as part of a practicum for the Wetland Science and Management Certificate Program. 2.Permittee will perform surveys as follows in the Parks: Dig a total of three (3) soil pits by hand, each approximately eighteen inches (18”) deep and eight inches (8”) wide; Each hole will be filled immediately after different measurements are taken; Two people per visit (recommended); Where possible, vegetation types around each hole will viewed and recorded from an overlook of the land to minimize ground disturbance. 3.Permittee will adhere to the following: PAG-22-002 Stuefen – University of Washington  Page 2 of 4  February 28, 2022  Permittee will not perform survey activities in the wetland mitigation area next to the Lake to Sound Trail at BRRF, as shown in Exhibit “B;” Permittee will not perform survey activities in the Springbrook Wetland Bank area; Survey work will only occur during parks hours of operation, between sunrise and sunset. Permittee may go off-trail to find a suitable pit location and to survey vegetation; any off-trail access should minimize impacts to flora and fauna to the maximum extent possible; Collection of plants or animals is not permitted; Survey team must wear identifiable, bright-colored vests; Survey teams will enter the Parks sites on foot. 4.A copy of this Permit must be in Permittee’s possession when on-site in the Parks. 5.It is understood and agreed by the Permittee that the performance of any work under this Permit shall constitute an acceptance of all provisions and an agreement to adhere to all of Permittee’s Representations stated above. 6.The term of this Permit shall begin February 28, 2022 and shall terminate March 31, 2022. The City retains the right to terminate this Permit at any time, and for any reasons it desires. 7.Prior to entering the Parks (approximately two days prior), the Permittee shall communicate and coordinate survey schedules and locations with Parks Maintenance Supervisor Dana Appel at (425) 766-6202. 8.At no time shall Permittee in any way represent themselves as an employee, officer, or agent of the City. 9.There shall be no entry onto the subject properties, nor onto any private property, except via public roads, without the permission of the affected owner. 10.Vehicles shall be kept on maintained roads. 11.Each vehicle shall carry one round-end pointed shovel and fire extinguisher. 12.Overnight use of the subject properties is not allowed unless approved by the City. 13.Permittee shall notify City Park staff of any unusual or unauthorized activities noted while in the Parks. 14.Any negative physical impact to preserve property will be restored and/or corrected to the satisfaction of the Director of the Parks and Trails Division. 15. Permittee shall in no way obstruct or impede access to the subject properties. In addition, Permittee shall take action to ensure that all work in relation to this Permit is conducted in a safe and prudent manner. 16.Permittee must be insured for damage resulting from liability of Permittee or any of Permittee’s agents or employees with General Liability insurance with minimum policy limits of $1,000,000 for each occurrence/$2,000,000 aggregate for the Term of this Agreement. Permittee may be requested to furnish to City proof of insurance in the forms and amounts satisfactory to City. The City understands that the Permittee is insured Stuefen – University of Washington  Page 3 of 4  February 28, 2022  through the University of Washington Self Insurance Program for the Permittees program. Permittee agrees that indemnification provisions in Section 17 will apply to self-insurance and excess layers as with Additional Insured status, as appropriate. 17.Permittee shall defend, indemnify, and save harmless the City, its officers, agents, and employees from and against any and all claims (whether valid or alleged), demands, actions, suits, damages, losses, judgments, liabilities, expenses and costs, including but not limited to, court costs and reasonable attorney’s fees incurred by City on account of any such claims, demands, or liabilities, and from loss of any kind or nature or nature arising out of, resulting from, or in connection with this Permit. Permittee’s obligation shall apply whether or not there is concurrent, active, or passive negligence on the part of the City, its agents, officers, or employees, except where the City is solely negligent. It is further specifically and expressly understood that the indemnification provided constitutes Permittee’s waiver of immunity under the Industrial Insurance Act, RCW Title 51, solely for the purposes of this indemnification. The parties have mutually negotiated and agreed to this waiver. The provisions of this section shall survive the expiration or termination of this license. 18.Nothing in this Permit shall be construed to grant Permittee an easement by implication, prescription, or any other operation of law, or to extend the term of the Permit past its expiration date as stated herein. 19.Permittee must make all necessary precautions and coordinate all efforts with City Parks and Trails Division staff to ensure the safety and security of the Parks at all times. 20.Permittee must provide City with reports summarizing the work completed in electronic and/or hardcopy form. 21.If soil and/or water sampling is done in support of the environmental site assessment or any other purpose authorized under this PERMIT then Permittee: A.Must take and preserve split samples – preserving one for the CITY, and B.Must provide a copy of all raw data and environmental analyses, and C.Must advise the CITY prior to any reporting to the Washington Department of Ecology. D.Agrees to fully release, waive any contribution rights, and hold harmless, defend, and indemnify the City from any liability (including but not limited to any responsibility for costs, fees, charges, or penalties) associated with any environmental cleanup work (including but not limited to any removal or remediation activities) required or voluntarily undertaken on the PROPERTY if such work was caused to any extent by the results of Permittee sampling.
