HomeMy WebLinkAboutAddendum - 3AMENDMENT NO. _3_ TO AGREEMENT FOR PHILIP ARNOLD PARK SITE IMPROVEMENTS THIS AMENDMENT, dated for reference purposes only as _____________, 2022, is by and between the City of Renton (the “City”), a Washington municipal corporation, andHBB Landscape Architecture, Inc. (“Consultant”), a Washington corporation. The City and the Consultant are referred to collectively in this Amendment as the “Parties.” Once fully executed by the Parties, this Amendment is effective as of the last date signed by both parties. Whereas, the City engaged the services of the Consultant under Agreement CAG-19-360, dated December 12, 2019, to provide necessary services for the Philip Arnold Site Improvements (referred to herein as the “Agreement”); Whereas, the Parties wish to amend the Agreement to change the scope of work and change the compensation in order to provide additional professional design services for the Philip Arnold Park site improvements. NOW THEREFORE, It is mutually agreed upon that CAG-19-360 is amended as follows: 1. Scope of Work: Section 1, Scope of Work, is amended to add work as specified in Exhibit A-3, which is attached and incorporated herein. 2. Compensation: Section 4, Compensation, is amended so that the maximum amount of compensation payable to Consultant is increased by $_26,682.70_ from $_445,180.88_ to $_471,863.58_, plus any applicable state and local sales taxes. The additional compensation shall be paid based upon Work actuallyperformed accordingto the rate(s) or amounts specified in Exhibit A-3, which is attached and incorporated herein. 3.All terms of the Agreement not explicitly modified herein shall remain in full force and effect and such terms shall apply to Work performed according to this Amendment as if fully set forth herein. Grady Way Renton, Washington 98057 RE: Philip Arnold Park: Scope & Fee Amendment #3 Dear Betsy: Per our previous correspondence and meetings discussing the addition of 2 Alternates to the draft 100% set (permit resubmittal set), I have prepared this request for additional services to Task 5 100% Design Phase. This amendment request adds the scope for the design effort to revise the 100% design to develop alternates and redesign the two base bid areas, and includes the associated fee for this level-of-effort. Alternate 1 involves removing the scramble from the base bid and redesign of the scramble area for one (1) base bid condition. Alternate 1 results in revisions to grading, drainage, planting, irrigation, and hardscape plans, schedules, and details. New details will be developed for the cheek walls adjacent to the stairs and flatwork at the “scramble area” staircase. Since this area is divided between two watersheds, modeling will also need to be performed on the revised grading and drainage, to ensure that water from one watershed is not being captured or diverted to the other watershed. Alternate 2 involves removing the small shelter from the base bid. Alternate 2 results in changes to hardscape and electrical, plans and schedules. Both alternates will need a few edits in the specifications and a revision to the cost estimate. The cost estimate will need to account for base bid conditions, and then either deductions and/or additions for the alternates. A. Two (2) Alternates Additional Level-of-Effort: 1. Two (2) internal Team Coordination meetings of up to 2-hrs each, to discuss and coordinate the revisions needed to develop Base Bid Design, develop Alternate 1 plans (new sheets will be needed) and Alternate 2 plans. 2. Revise plans, details, schedules, calculations (pipe sizes, watershed modeling due to revised grading and drainage etc.) and specifications to incorporate the Base Bid Design, the Alternate 1, and the Alternate 2, including: a. Revise Grading Plan and Notes. 1 Additional sheet to be developed. b. Revise Drainage Plan, Profile Details, and Notes. 1 Additional sheet to be developed. c. Revise Electrical Plan, Notes, and Schedule. d. Revise Hardscape Plan, Details, and Notes. 2 Additional sheets to be developed including cheek wall details. e. Planting Plan, Notes, and Schedule. Additional Plant Schedule for Alternate 1 and additional Planting Plan design for Base Bid Area to be developed. f. Irrigation Plan and Notes. The irrigation design for revised lawn and planting in the base plan to be developed. The irrigation plan for Alternate 1 will be pulled out and provided as a separate plan detail. 3. The original agreement to provide an updated 100% cost estimate and this amendment adds reformatting that cost estimate for the base bid condition, and the deductions and additions to update quantities per the base bid condition, Alternate 1, and Alternate 2. 4. Perform internal Project Manager QC review of the drawing changes, new details, revised details, specification updates, and cost estimate quantity revisions for the creation of Alternate 1 and Alternate 2 in the set. Quality control review will be by a senior licensed staff member for each discipline. 5. All revisions (including for alternates) will be included in the Permit Resubmittal Set which will also serve as the City’s Review Set. Exhibit A-3 Philip Arnold Park 8 March 2022 Page 2 AMENDMENT #3 FEE In consideration of the above services, we are proposing the following estimated fee (see Exhibit A enclosed for spreadsheet breakdown). New Total Contract Amount $ 471,863.58 Assumptions: 1. The Base Bid Design of the scramble area will consist of a combination of sod, cheek walls, and buffers of planting area with concrete mow strips. 2. Should Alternate 1 for the scramble be deleted based on further cost analysis, it is assumed that the Base Bid Design level-of-effort would not change and would still need to occur. This amendment would cover that Base Bid design effort. 3. One Base Bid design will be developed in this process. Multiple options of the Base Bid Designs are not included. Redesign of the Base Bid design and Alternates due to subsequent comments outside of the existing contract is not included. 4. Production of additional review sets during the 100% phase is not included. 5. The TIR stormwater report will not need to be updated to reflect the alternates. 6. Additional Permit Resubmittals as a result of the addition of alternates are not included. 7. Additional City & Team meetings or charrettes to review new base bid design and alternate plans outside of the existing contract are not included. 8. Items that are not explicitly stated as part of the scope above are not included, and would be additional services. The above contract amendment request is beyond the existing scope of work tasks as described in our agreement dated 12 December 2019 and would be billed at the rates established in the contract.
