AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON
CHANGING THE ZONING CLASSIFICATION OF CERTAIN
PROPERTIES•WITHIN THE CITY OF RENTON FROM GENERAL
CLASSIFICATION DISTRICT (G) TO LIGHT INDUSTRIAL
DISTRICT (L-1) (R-143-78)
WHEREAS under Chapter 7, Title IV (Building Regulations) of Ordinance
No. 1628 known as the "Code of 'General Ordinances of the City of Renton", as
amended, and the maps and reports •adopted in conjunction therewith, the property
hereinbelow described has heretofore been zoned as General Classification District (G);
and
WHEREAS a proper petition for change of zone classification of said property
has been filed with the Planning Department on or about March,T4, 1978, which petition
was duly referred to the Hearing Examiner for investigation, study and public hearing,
and a public hearing having been held thereon on or about April 11, 1978, and said •
matter having been duly considered by the Hearing Examiner and said zoning request
being in conformity with the City's Comprehensive Plan, as amended, and the City
Council having duly considered all matters relevant thereto, and.all parties having been
heard appearing in support'thereof or in opposition thereto, NOW THEREFORE
THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO
ORDAIN AS FOLLOWS:
SECTION I: The following described property in the City of Renton is
hereby rezoned to Light Industrial District (L-1) as hereinbelow specified; subject to
the findings, conclusions and decision dated April 14, 1978; the Planning Director is
hereby authorized and directed to change the maps of the Zoning Ordinance, as amended,
to evidence said rezoning, to-wit:
See Exhibit "A" attached hereto and made a part hereof
as if fully set forth herein.
(Said property being located at vicinity of 620 S.W. 12th
Street)
AND SUBJECT FURTHER to that certain Declaration of Restrictive Covenants executed
by Petitioner-owners on or about April 16, 1979 and recorded in the office
of the Director of Records and Elections, Receiving. No. 7904160606 and
which said Covenants hereby incorporated and made a part hereof as if fully set forth.
SECTION II: This Ordinance shall be effective upon its passage, approval
and five days after its publication.

DECLARATION OF RESTRICTIVE COVENANTS
WHEREAS, James W. Dalpay and his wife Diane G. Dalpay are the owners of the
following real property in the City of Renton, County of King, State of Washington,
described as follows:
Lots 21 through 28 inclusive in Block 28 of C.D. Hillman's Earlington
Garden Addition to the City of Seattle, Division No. 1, as per plat

WHEREAS, the owners of said described property, hereinafter "the property,"

desire to impose the following restrictive covenants running with the land as

to use, present and future, of the property;
NOW, THEREFORE, the aforesaid owners hereby establish, grant and impose
restrictions and covenants running with the land as to the use of the land
hereinabove described with' respect to the use by the undersigned, their successors,
heirs and assigns, as follows:
SETBACKS
A minimum 20-foot setback shall be retained along S.W. 12th Street; a minimum
107foot setback shall be retained along the east property line; and a minimum
10-foot setback shall be retained along the north property line.
• LANDSCAPING
A minimum 20-foot landscape strip shall be provided adjacent to S.W. 12th Street;
a minimum 10-foot landscape strip shall be provided adjacent to the east property
line; and a minimum 10-foot landscape strip shall be provided adjacent to the
north property line. A detailed landscape plan shall be submitted to, and approved
• by the Renton Planning Department as part of the building permit application.
OUTSIDE STORAGE AREAS
outside storage of materials, equipment, and containers may be permitted within
the'-buildable portion of the property when said.storage is properly screened by a
sight-obscuring fence not less than six feet in height nor more than 10 feet in
height, together with a minimum five-foot landscape strip subject to review and
approval of the Renton Planning Department.
DURATION
These covenants shall run with the land and expire on December 31,' 2025. If at
any time improvements are installed pursuant to these covenants, the portion of the
covenants pertaining to the specific installed improvements as required by the
Ordinances of the City of Renton shall terminate without necessity of further
documentation.
Any violation or breach of these restrictive covenants may be enforced by proper
legal procedures in the Superior Court of King County by either the City of Renton
or any property owners adjoining subject property who are adversely affected by

�O said breach. Reasonable attorneys' fees incurred during an enforcement proceeding
will be borne by the parties whom the court determines are in error and shall be

ORDINANCES AND RESOLUTIONS - Continued
Ordinance #3307 Councilman Perry declared possible conflict of interest and left the
Deak Rezone 1 Chambers taking no part in any discussion or action of this matter.
R-286-79 An ordinance was read rezoning property from R-2 to P-1 located at
the west side of Talbot Rd. south of SE 43rd St. , known as the
Deak Rezone. MOVED BY CLYMER, SECOND PERRY, ADOPT THE ORDINANCE
1 AS READ. Councilman Stredicke explained withdrawal of his objection.

approval of the Renton Planning Department.
DURATION
These covenants shall run with the land and expire on December 31, 2025. If at
any time improvements are installed pursuant to these covenants, the portion of the
covenants pertaining to the specific installed improvements as required by the •
' Ordinances of the City of Renton shall terminate without necessity of further

Any violation or breach of these restrictive covenants may be enforced by proper
legal procedures in the Superior Court of King County by either the City of Renton
or any property owners adjoining subject property who are adversely affected by
said breach. Reasonable attorneys' fees incurred during an enforcement proceeding
will be borne by the parties whom the court determines are in error and shall be
entered as a judgment in such action.

PUBLIC HEARING ' This being the date set and proper notices having been posted,

of N. Riverside hearing to consider closure of North Riverside Drive adjacent
Drive to the new Cedar River Trail . Persons present and making comments
regarding proposed closure of Riverside Dr. N. included: For
closure - Dan Warren 830 Riverside Dr. N. , Int' 1 . Operating Engi-
neers, to protect against damage to premises as has been previously
hit by cars . Gary Dime, 927 No. 1st St. feels closure would provide
higher and better use; better insurance rates and safety, that
people would not be walking in street with the traffic, would
appreciate property value with direct river access. Larry Good,
908 Riverside N. , feels street is now a safety hazard as it is a
through street to Bronson, which handles heavy traffic. Opposing
closure of Riverside Dr. N. - Frank Beanblossom, 810 Riverside Dr. N.
Robert E. McBeth,Attorney, 1906 Rolling Hills Ave. SE, on behalf of
Pauline Kirkman, 1002 N. 35th, Renton, property owner one house from
proposed blockade objects because of access restriction, Riverside N.
to 1st, no access for garbage disposal , no police patrol , and no
turn around for fire department use, depreciation of property value,
as they see it there is no beneficial purpose of a planter area. Also,
as they have the last driveway on Riverside Dr. N. and foresee it
being used as a turn around, with no other turn around being on the
proposed layout; Wyman Dobson, 821 No. 1st St. representing client
Lewis Peretti , questioned location of blockade. Riverside Dr. N.
has provided business access, blockade would depreciate value of
property. Problem noted if fire department were to go though barrier.
During ensuing discussion it was suggested that the city wait to
that point of construction of the trail system to determine if
closure is necessary, because more problems would be created than
solved. MOVED BY THORPE, SECOND TRIMM TO CLOSE HEARING. CARRIED.
Thorpe commented that proposed blockade should be moved as to
allow fire department access to apartments, but continue the
closure of Riverside N. *MOVED BY SHANE, SECOND SHINPOCH,THE STREET
BE KEPT AS IT IS NOW. In ensuing discussion, Councilwoman Thorpe
noted her committee, in public meeting, heard from all affected
parties and had considered those aspects now questioned regarding
giving up river front property to property owners and whether the
trail was to be people or vehicle oriented, access for refuse, etc.

Withdrawal from Letter from the Renton Police Officers Guild, John Pavone, Presi-
Social Securijty ent requested consideration of steps necessary to remove the
Renton Police Department and Police Officers' Guild from the
` United States Social Security System. Letter from Renton Manage-
ment Association, W. Gonnason, President, stated that in view of
the proposed rate increases for Social Security and the financial
impact it will have on. the City budget, consideration of withdrawal
from the Social Security System is requested. The letter noted
an annuity insurance program to provide coverage for those employ-
ees now covered by Social Security and at the end of required
two-year time limit for withdrawal , the City's cost would be
about 75% of cost of Social Security. Moved by Stredicke, Second

Dear Council Members:
On April 28, 1978, we filed our appeal from the recommenda-
tion made by the Hearing Examiner in the above referenced
matter. The appeal was filed at that time to meet your
time deadline and was made before I had had a sufficient
opportunity to review this matter and formulate a written
statement in support of that appeal. I have now had an
opportunity to review the matter more thoroughly and sub- .
mit that the Hearing Examiner' s recommendation should be
rejected for the reasons set forth in this letter.
TheIproperty involved in this rezone request is situated
at the corner of Union Avenue Northeast and Northeast
12thi Street, Renton, Washington. It is our understanding
and position that this area has been designated as a
"retail-commercial" use according to the Comprehensive
Plan. The City Planning Department apparently disputes
that contention, and the Hearing Examiner has accepted the
Planning Department's position in that regard. (Findings
6 and 7) . Unfortunately, the record relating to the
adoption of the Comprehensive Plan, and amendments thereto,,
is not terribly clear, but we believe these findings to
be incorrect and to constitute grounds for rejection on
the IHearing Examiner' s recommendation.
I am attaching herewith a copy of City Ordinance Nos. 2142
and 2439. As we understand the record of prior Council
action in this regard, the original Comprehensive Plan was
adopted by approval of a Comprehensive Land Use Map,
rather than adoption of an ordinance setting forth speci-
fic legal descriptions of the property effected. There-

after, the City Council has adopted several amendments to the
Comprehensive Plan, each time setting forth the legal descrip-
tions of the properties involved. The two cited Ordinances
enclosed herein modify the .Comprehensive Plan as it effects
this property. Under Ordinance No. 2142, this area was designated
"retail-commercial" (Finding >Nb. • 7) . The Hearing Examiner then
states that this designation was revised to "medium-density
multi-family'!. under City Ordinance No. 2439 (Finding No. '7) .
As I read Ordinance No. 2439, that. Finding is in error.
Ordinance No. 2439 does not effect this property at all. It
effects only property lying easterly of and southerly of our'
site® This Ordinance did not change the Comprehensive Plan
designation for our property, and it should therefore remain
"retail-commercial" . •We believe that this is a proper land
use ! designation for this property and that the rezone requested
should be approved as: being in conformance with the Comprehen-
sive Plan.
Additionally, we feel that our proposal -is . consis.tent with
the development which has occurred in the surrounding area
and 'creates little conflict with the residential areas ' .
lying to the south and west of the subject site. The property
lying to the north and east of the subject site has been::..
developed into a rather intense- retail-commercial use. Our
proposal for a low-profile business use is compatible with
adjacent uses, blends in well with the adjacent residential
uses, and should be approved.
Lastly, we do not agree that our proposal is in any way in-
consistent with or incompatible with the goals and policies
of the Comprehensive Plan. We dispute.. the inference that
approval of our request would in any way contribute to a
reduction in property values or contribute to a decay or
obsolescence in adjacent residential areas. We _feel. that
.
this, proposal would encourage the development 'and utiliza-
tioniof the land to, its highest and best use and would promote
the best interest of the community and contribute to its
over;-all attractiveness and desirability as a place in which
to work, shop, live and play. ,
We see no reason presented for denial of this rezone. request
and would ask that the same now be approved.

Dear Mayor Delaurenti and Members
of the Renton City Council:
I have been retained to represent Mr. James W. Dalpay,
applicant in the above referenced matter, and have been
asked to assist him in seeking review of the decision
rendered by the City of Renton Hearing Examiner in the
above referenced matter. The Hearing Examiner submitted
his formal report and recommendation to the City Council,
dated April 14, 1978, recommending that the City Council
approve the requested reclassification of the property to
an L71 zone subject to certain conditions relating to set-
backs and landscaping requirement's. On April 28 , 1978 ,
we filed our "Request for Reconsideration" with the Office
of the Hearing Examiner requesting that the restrictive
covenants relating to setback and landscaping be modified
to allow greater use of the property. Our Request for
Reconsideration was denied by letter from the Hearing
Examiner on May 5, 1978. Having no other recourse, we
hereby file this appeal from the recommendation and decision
now rendered by the Hearing Examiner in this matter and
submit herewith our check in the sum of $25.00 in payment
of the filing fee required pursuant to Title IV, Chapter 30,
City ,Code, as amended.
Specifically, we ask that the City Council reconsider
and alter that portion of the Hearing Examiner's recom-
mendation that effects setback and landscaping requirements.
As we, understand the Hearing Examiner's decision, he is
requiring a minimum setback/landscaping area of 20 feet

along Southwest 12th Street; 10 feet along the east property
line;. and 10 feet along the north property line. By themselves,
these requirements would pose very little problem for us and
would,, in general, be acceptable. However, when this require-
ment is combined with the City's requirement for offstreet
parking, the combination creates an undue hardship for the appli-
cant. The City of Renton presently requires 'a minimum area of
18 feet in width to accommodate the necessary offstreet parking
necessary for this building. That results in a total land area
of approximately 5,000 square feet being committed to offstreet
parking. The City's requirement for landscape/setback areas
results in 7,920 square feet committed for this purpose. The
total of these two, requirements, results in a substantial portion
of the available land area being committed to offstreet parking,
landscape/setback requirements. We do not feel that this
leaves a sufficient area remaining to make the proposed build-
ing development economically feasible. We sincerely ask that
these requirementsbe altered as the present decision would
require 67% of the available land area being committed to
landscaping/offstreet parking. We feel that this is excessive.
As we understand the conditions that have been imposed upon
us by the Hearing Examiner, it appears to us that the Hearing
Examiner is attempting to i?nco:rp:orat.e requirements of a'
Manufacturing Park, zone .into the L-1 zone we have requested. '
It seems to me that 'we are entitled to an L-1 zone without
the additional requirements for landscaping/setback being
imposed upon us. We have previously. proposed that the Hearing
Examiner' s recommendation be modified to permit a combination
20 foot setback/landscaping/parking area along Southwest 12th
Street, and a combination 10 foot setback/landscaping/parking
area ',along both the, east and north ;property lines. In effect,
we are asking that the' applicant be allowed to intermingle
landscaping areas with parking areas within the allotted 20
foot setback area. ' Obviously, .. if such a. proposal were accepted,
al detailed landscape :plan would have to be' .submitted to and
be:-..approved by the Renton Planning Department as part of the
building permit, application. We feel that this proposal
complies with the requirements of an L-l. zone and is fully
compatible with the development which has occurred on adjacent
properties.
Our proposal would permit an area of approximately 3 to 5 .
feet along Southwest 12th Street with additional areas set'
aside !within the adjacent 18 feet for landscaping. A possible

site plan is enclosed with this letter to provide an example
of our proposal. Obviously, this is a very rough sketch,. but
I believe it shows the general concept of what we have in
mind. We' ask that ' this request be given your serious considera-
tion and hope that the recommendation of the Hearing Examiner
can be modified, accordingly.
'As 'stated 'in the Hearing Examiner's report and findings,
our original ,request conforms to the goals and. objectives of
the Comprehensive Plan and is totally consistent with other
development which has occurred in the area. The physical
characteristics of this land make the setback requirements
which the Hearing Examiner. has imposed very onerous. We feel
that these requirements impose a substantial hardship on the
applicant and fail to accomplish any real purpose as far as
theiCity of Renton is . concerned. Our proposal takes nothing
away from the City, but still allows our development to occur
within reasonable limits.
We, sincerely hope 'that you will review the Hearing Examiner' s
decision in this matter and that you will modify his recom-
mendation in 'light of this request. '

Dear Mr. McBeth:
Your letter of April 28, 1978, contained information very similar to Mr.
Dalpay's testimony in the public hearing. No new information was presented
nor was substantiation received for the consideration request apparently
based upon Section 4-3015 (Hearing Examiner Ordinance) .
My recommendation to the City Council was essentially a continuation of the
precedent established in the O'Brien (R-885-76) and Divelbiss (R-016-77)
rezones. The specified landscape strips were required in order to accomplish
as much of the Manufacturing Park character, in the midst of several single
family residences, as possible per the Comprehensive Plan for the area.
Another look at Exhibit #3 (Conceptual Plot Plan) revealed that apparently
sufficient property exists to accommodate parking requirements while complying
with the conditions of the rezone. It is a normal requirement that landscape
areas be devoted exclusively to landscaping. These landscaping areas were
deemed necessary to accomplish the general objectives of the Comprehensive
Plan (M-P) and transitional buffering of existing single family residences.
In the 'public hearing the existing alley was discussed in terms of access
but I would suggest exploring parking alternatives as well for near the
alley with the Planning Department. Perhaps a solution could be found there.
The circumstances surrounding the property (e.g. Comprehensive Plan and
existing single family residences) seem to require the conditions specified
. in my recommendation to the City Council. Justification in these terms has
not been presented to warrant changing this recommendation.

Mr. Smith advised that the setbacks on the Dive lbiss property average nine feet to 36
feet from east to west on S.W. 12th Street. Mr. Dalpay questioned the accuracy of the •
setback measurement on the eastern corner of the site and advised that he had recently
surveyed and measured the property. He also felt that conformance to a 30-foot average
setback would not allow best use of his property because of the unusual configuration of
the lot.
The Examiner asked for testimony in support or opposition to the application. There
was no response. He then asked Mr. Smith for additional comments. Mr. Smith revised
the Planning Department recommendation for average setback requirements on the southerly
property line adjacent to S.W. 12th Street from 30 to 25 feet to allow parking space at
the rear of the structure and provide compatibility with the parallelogram-shape of the
site. He noted that because improvement of the existing alley on the northern boundary
of the property would not occur until a future date, access to the site would probably
be provided from S.W. 12th Street:
The Examiner asked the applicant for additional comments. Mr. Dalpay stated his opinion
that setback requirements would interfere with provisions for parking space on the north
and landscaping on the south side of the property, and advised that construction of
additional structures on the eastern portion of the site is anticipated. For this
reason, he felt that the setback requirements would decrease aesthetic value of the
proposed development. In response to the Examiner's inquiry regarding 'the possibility
of orienting the building parallel to S.W. 12th Street, Mr. Dalpay indicated that
extension to the east would be necessary and would result in interference with future
plans for that location on the site.
The Examiner asked Mr. Smith for additional comments, modifications or revisions to
Exhibit #1. Mr. Smith indicated that the report would remain as submitted with the
exception of the revision of setback requirement on the southerly property line from -
30 to 25 feet with a minimum setback at the southwest corner of no less than five feet.
He recommended that parking areas be located at the rear of the structure concurrent
with development of the alley and that landscaping be located at the front of the
building. He suggested that the alley be eventually utilized for access to the subject
site, and noted that details of the plan will be reviewed during the building permit
process. Mr. Smith emphasized that consideration of the unusual configuration of the
property be given in review to maintain a balance to allow reasonable development of
the site and also retain compatibility with the Comprehensive Plan designation of
Manufacturing Park zoning.
In response to the Examiner's inquiry regarding conformance of the Divelbiss property
development to established restrictive covenants, Mr. Smith reported that although
measurements taken from the approved Building Division plans indicated conformance,
final inspection of the property had not yet occurred.
The Examiner asked the applicant if the revised Planning Department recommendation for
a 25-foot setback on the southerly property line was acceptable. Mr. Dalpay expressed
a preference for a 15-foot setback and advised that a 10-foot setback currently exists
on the site.
In response to the Examiner's statement regarding the flexibility of the proposed
building configuration in width and length, Mr. Dalpay advised that a limit of 50 feet
had been established as maximum width to provide necessary parking space on the
northern portion of the site.
The Examiner asked for further comments. Since there were none, the hearing on
File No. R-143-78 was closed by the Examiner at 9:45 a.m.
FINDINGS, CONCLUSIONS AND RECOMMENDATIONS: Having reviewed the record in this matter,
the Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of a rezone of approximately 24,000 square feet from
G-6000 to L-1.
2. The Planning Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter
and is hereby attached as Exhibit #1 and incorporated in this report by reference
as set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance •
has been issued for the subject proposal by Gordon Y. Ericksen, responsible official.

PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the,application, and
• field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as
follows:
The hearing was opened on April 11, 1978 at 9:00 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were sworn.

It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following

Referencing Section P.1, of Exhibit #1, Mr. Smith advised that averages had been computed
to establish, setback requirements because of the parallelogram configuration of the site.
He noted that the subject site is larger than two parcels of property previously
rezoned in the immediate area and that averages had also been computed to arrive at
setback requirements for these sites. •

Mr. Dalpay indicated his concurrence in the report with the exception of setback
requirements. He submitted photographs of the Divelbiss 'property referenced by, Mr.
Smith located adjacent to the subject site in order to illustrate possible nonconformance
to setback requirements established by restrictive covenants during recent rezone of the
property. The photographs were labeled by the Examiner as follows:

4. The recommendation by the Planning Department that the _front yard setback (along
S.W. 12th Street) be computed on the basis of the average dimension is not provided
for in the zoning regulations or in Ordinance No. 3125 (Divelbiss rezone) . Setbacks
are measured parallel to the property lines per the minimum specified distances
(20 feet per Sections 4-712. (C) and 4-711.D for the L-1 zone and Ordinance No. 3125.
Deviation from this requirement can occur through only the variance process and
lies outside the purview of the Examiner.
RECOMMENDATION:
Based upon the record, testimony, findings and conclusions, it is the recommendation
of the Examiner that the City Council approve reclassification of the property to L-1
subject to the following conditions being attested to in the form of restrictive
covenants:
1. A minimum 20-foot setback along S.W. 12th Street; a minimum 10-foot setback along
the east property line; and a minimum 10-foot setback along the north property line.
2. A minimum 20-foot landscape strip adjacent to S.W. 12th Street; a minimum 10-foot
landscape strip adjacent to the east property line; and minimum 10-foot landscape
strip adjacent to the north property line. A detailed landscape plan shall be
submitted to and approved by the Renton Planning Department as part of the building
permit application.
3. Outside storage of materials, equipment, and containers may be permitted within
the buildable area of the property, when said storage is properly screened by a
sight-obscuring fence not less than six feet in height nor more than 10 feet in
height, together with a minimum five-foot landscape strip subject to review and
approval of the Planning Department.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must
be filed in writing on or before April 28, 1978. Any aggrieved person feeling that the
decision of the Examiner is based on erroneous procedure, errors of law or fact, error
in judgment, or the discovery of new evidence which could not be reasonably available
at the prior hearing may make a written request for review by the Examiner within
fourteen (14) days from the date of the Examiner's decision. This request shall set
forth the specific errors relied upon by such appellant, and the Examiner may, after
review of the record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires
that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and
meeting other specified requirements. Copies of this ordinance are available for
inspection in the City Clerk's office, first floor of City Hall, or same may be
purchased at cost in said office.

4. Plans for the proposal have been reviewed by all city departments affected byithe
impact of 'this development.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.

7. The proposed conceptual plot plan (Exhibit #3) is not compatible with the required
front and sideyard setbacks of Section 4-730 (M-P) ,but is compatible with the
setback requirements of Section 4-712 (L-1) of Title IV, Ordinance No. 1628, Code
of General Ordinances.
8. Within the vicinity, two rezone applications have been approved for L-1 subject to
conditions very similar to those recommended by the Planning Department (O'Brien,
R-885-76, and Divelbiss, R-016-77) . The latter application immediately abuts the
westerly boundary of Mr. Dalpay's property. The conditions imposed upon the
Divelbiss property were:
a. A minimum 20-foot setback along S.W. 12th Street; a minimum 10-foot setback
along the east property line; and a minimum 10-foot setback along the north
property line.
•
b. A minimum 20-foot landscape strip adjacent to S.W. 12th Street; a minimum
10-foot landscape strip adjacent to the east property line; and a minimum
10-foot landscape strip adjacent to the north property line. A detailed
landscape plan shall be submitted to and approved by the Renton Planning
Department as part of the building permit application.
c. Outside storage of materials, equipment, and containers may be permitted•,
within the buildable area'of the property, when ,said storage is properly
screened by a sight-obscuring fence not less than six feet in height nor
more than 10 feet in height, together with a minimum five-foot .landscape
strip subject to review and approval of the Planning Department.
9. The area encompassed by FAI-405, S.W. Grady Way, and State Highway 167 was
originally platted into small single family lots under G-6000 zoning. Some
single family development occurred over the years; however, for the past several
years commercial and industrial uses have,been located in this area (Section
4-3014. (C) ) . The Comprehensive Plan Land Use Map indicates this transitional
trend in the designation of Manufacturing Park for the area (Section 4-3014. (B) ) .
Due to the configuration of the platted lots (100-foot depth) , it is difficult
to meet the setback requirements of the M-P zone. The setback requirements of
the L-1 zone can be met.
10. The last area land use analysis was apparently completed for this area in 1970
during review of the Green River Valley element of the Comprehensive Plan. •
Testimony was not provided regarding whether specific rezone classification .
was considered at that time relative to the subject site (Section 4-3014. (A) ) .
✓CONCLUSIONS:
1. The proposal conforms to the goals and objectives of the Comprehensive Plan
(Section 4-3014. (B) ) .
2. Development in the area and adjacent to the subject site have impacted the
property significantly since the previous land use and zoning analysis of the .
area (Section 4-3014. (C) ) .
3. The City Council has established clear precedent for this request in the O'Brien
and Divelbiss rezones. It seems appropriate to require the same conditions of
Mr. Dalpay as was required of the Divelbiss application and continue the type of
development that responds to the unusual conditions surrounding properties in
this area.
Essentially, the required setbacks would represent in Mr. Dalpay's property the
minimum requirements of the L-1 zone except for an additional five feet of side •
yard setback.
The other conditions incorporate portions of the M-P zone requirements, thereby'
increasing conformity with the Manufacturing Park designation of the Comprehensive
Plan.

0. PLANNING DEPARTMENT ANALYSIS':
1 . The proposed L-1 zoning is inconsistent with the Manufacturing
Park designation of the Comprehensive Plan . However, because
of the small lot sizes peculiar to this area of the Valley
(The area was formerly a residential plat. ) , which create
difficulties in meeting the M-P District setback standards ,
it has been the policy of the City Council to approve L- 1
zoning in lieu of Manufacturing Park subject to certain
conditions . Such conditions have been in the form of restric-
tive covenants and establish development standards which are
Compatible with the M-P .zone and Valley Comprehensive Plan
goals and objectives , June 1976 (Section 4-3014( B) ) .
2 . The proposed plot plan is not acceptable and, therefore , has
not been specifically reviewed and approved. The proposed
u,se appears to be an acceptable L- 1 use. Detailed site and
development plans will be necessary as part of any building
permit application .
3 . Water and sewer mains are in the area . A water main extension
firom Raymond will be necessary at the time of site development.
4. Fre • access , water flow, and hydrant location will be subject
to Fire Department requirements at the time of, site develop-
ment.
5 . Any development of the site should include removal of the
existing structure located on the site, together with provision
of suitable setbacks , landscaping, and screening requirements
consistent with other similar rezone approvals in the area
( i . e . , Rich O ' Brien Rezone , No . R-885-76 , Charles Divelbiss
Rezone, No . R-016-77 , etc. ) and the Valley Comprehensive Plan .
6. Siince the land zone classification (G-6000) was placed on the
' site , the area has experienced a transition from single family
residential uses toward more commercial and industrial uses
(Section 4-3014(c ) ) .
P. PLANNI'NG DEPARTMENT RECOMMENDATION:
Recommend approval of L-1 zone based on the above analysis with
restrictive covenants which will provide compatibility with the
Comprehensive Plan and M-P zone classification as follows :
1 . SETBACKS
Noibuildings or structures shall be permitted a located:

a. 1 Within 30 feet of the southerly property line adjacent
to S . W. 12th Street.
b . Within 10 feet of all other property lines .
2 . LANDSCAPED AREAS
The first 10 feet adjacent to all property lines shall be
appropriately landscaped and maintained continuously in a ,
neat and clean manner, except for designated pedestrian and
vehicular accessways . The remainder of the setback areas
exclusive of the 10 foot landscape area may be utilized for
off-street parking purposes as provided by the laws and
ordinances of the City of Renton . Any areas not utilized

COMMENTS:
Introduction The State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals . The Act also requires that an EIS be
prepared for all major actions significantly affecting the quality of the environment.
The purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.

0. PLANNING DEPARTMENT ANALYSIS':
1 . The proposed L-1 zoning is inconsistent with the Manufacturing
Park designation of the Comprehensive Plan. However, because
iof the small lot sizes peculiar to this area of the Valley
'(The area was formerly a residential plat. ) , which create
difficulties in meeting the M-P District setback standards ,
it has been the policy of the City Council to approve L- 1
zoning in lieu of Manufacturing Park subject to certain
Conditions . Such conditions have been in the form of restric-
tive covenants and establish development standards whichrare
'compatible with the M-P zone and Valley Comprehensive Plan
goals and objectives , June 1976 (Section 4-3014( B) ) .
2 . The proposed plot plan is not acceptable and, therefore , has
. not been specifically reviewed and approved. The proposed
use appears to be an acceptable L-1 use. Detailed site and
development plans will be necessary as part of any building
permit application .
3 . Water and sewer mains are in the area . A water main extension
• from Raymond will be necessary at the time of site development.
4. Fire access , water flow, and hydrant location will be subject
t'o Fire Department requirements at the time of, site develop-
ment.
5 . Any development of the site should include removal of tpe
existing structure located on the site, together with provision
of suitable setbacks , landscaping, and screening requirements
consistent with other similar rezone approvals in the area
( i . e . , Rich O' Brien Rezone , No . R-885-76, Charles Divelbiss
Rezone , No. R-016-77 , etc. ) and the Valley Comprehensive Plan .
6. Since the land zone classification (G-6000) was placed on the
site , the area has experienced a transition from single family
re4sidential uses toward more commercial and industrial uses
(Section 4-3014(c) ) .
P. PLANNING DEPARTMENT RECOMMENDATION :
Recommend approval of L-1 zone based on the above analysis with
restrictive covenants Which will provide compatibility with the
Comprehensive Plan and M-P zone classification as follows :
