AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON,
CHANGING THE ZONING CLASSIFICATION OF CERTAIN
PROPERTIES WITHIN THE CITY OF RENTON FROM
RESIDENCE DISTRICT (R-2) TO RESIDENCE DISTRICT
(R-3)
WHEREAS under Chapter 7, Title IV (Building Regulations)
of Ordinance No. 1628 known as the "Code of General Ordinances
of the City of Renton", as amended, and the maps and reports adopted
in conjunction therewith, the property hereinbelow described has
heretofore been zoned as Residence District (R-2) ; and
WHEREAS a proper petition for change of zone classification
of said property has been filed with the Planning Department on
or about April 7, 1978 which petition was duly referred to the
Hearing Examiner for investigation, study and public hearing, and
a public hearing having been held thereon on or about May 2, 1978,
and said matter having been duly considered by the Hearing Examiner
and said zoning request being in conformity with the City's Comprehensive
Plan, as amended, and the City Council having duly considered all
matters relevant thereto, and all parties having been heard appearing
in support thereof or in opposition thereto, NOW THEREFORE
THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO
ORDAIN AS FOLLOWS:
SECTION I: The following described property in the
City of Renton is hereby rezoned to Residence District (R-3) as
hereinbelow specified; SUBJECT to the findings, conclusions and
decisions dated May 4, 1978 of the City's Hearing Examiner; the
Planning Director is hereby authorized and directed to change
the maps of the Zoning Ordinance, as amended, to evidence said

Old Business - Continued
Resolution #2185 Councilman Perry noted attendance of the Mayor and three Council
County Health Care Members at the 5/30/78 meeting in Kent with Senator Bagnariol re
Financing common problems for cities and noted presentation of health services
problem as worked out by our City. Councilman Perry presented a
resolution for reading as prepared by the City Attorney at Perry's
request, placing burden of cost for the health services onto the
County without direct contribution by the cities, with copies to
State Legislators and Association of Washington Cities. Follow-
ing reading, it was MOVED BY PERRY, SECOND CLYMER, COUNCIL ADOPT
THE RESOLUTION AS READ. Councilman Stredicke noted other items
of interest to cities were advanced at the meeting by the Renton
Mayor and Council Members. MOTION CARRIED. Discussion ensued re
City representation at the forthcoming Association of Washington
Cities conference; Councilman Perry noted importance of presenta-
tion of the resolution and value to all cities of the state.
Councilman Stredicke noted importance of meeting with Senator
Bagnariol; of advancing problems and ideas of smaller cities to
their legislators.

of the following real property in the City of Renton, County of King, State of
Washington, described as follows:

Unit Development concept, Mr. Smith indicated that because of the minimum size of the
undeveloped lot, the request would not qualify for review through the P.U.D. ordinance
process which requires a minimum size of 5 acres for an undeveloped parcel.
The Examiner asked for further comments. Since there were none, the hearing on File
No. R-153-78 was closed at 9:40 a.m.
FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter,
the Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of a reclassification of 8,000 square feet of
undeveloped property from R-2 to R-3.
2. The Planning Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter,
is uncontested, and is hereby attached as Exhibit #1 and incorporated in this
report by reference as set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance
has been issued for the subject proposal by Gordon Y. Ericksen, responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development and no adverse comment was expressed.
5. There was no opposition to the proposal expressed..
6. All existing utilities are, available and in close proximity.
7. The conceptual site plan, Exhibit #3, was inadequate to determine if the proposal
is compatible with the required setbacks, lot coverage and height requirements of
Section 4-709A (R-3) of Title IV, Ordinance No. 1628, Code of General Ordinances.
8. Existing R-2 zoning allows a total of four dwelling units in two separate duplex
structures on the two 4,000 square foot lots owned by the applicant separately prior
to adoption of the Subdivision Ordinance. The applicant desires to maintain this
density but in a four-plex configuration. The site does not meet the site area
criteria of Section 4-2708 of the P.U,D. Ordinance in order to apply this ordinance
in the existing R-2 zone. A special permit per the criteria of Section 4-708. (B)
(R-2) would permit only one duplex unit. If the applicant's intent is to be
realized a rezone is necessary.
9. The neighborhood is a mixture of single family residences on small lots, some
duplexes, a few apartments and some commercial uses. High density single family
residences dominate the area despite the existing R-2 and R-4 zoning.. These
single family homes are predominantly older structures.
10. The Comprehensive Plan Land Use Map indicates the site to potentially be High
Density Multifamily (Section 4-3014. (B) ) .
11. No testimony was given to substantiate that the property was or was not considered
for R-3 or R-4 zoning in any previous area land use analysis (Section 4-3014. (A) ) .
12. No testimony was submitted to substantiate that any improvements have or have not
been made in the area and do or do not affect the site (Section 4-3014, (C) ) .
CONCLUSIONS:
1. The proposal conforms to the Comprehensive Plan (Section 4-3014.. (B) ) .

REPORT AND RECOMMENDATION TO THE RENTON CITY COUNCIL.

LOCATION: Property located at northwest corner of Factory Avenue
North and North 3rd Street.
SUMMARY OF REQUEST: Applicant requests approval of a proposed rezone from
R-2 to R-3 to allow construction of a four-plex on two
lots.

RECOMMENDATION:

PLANNING DEPARTMENT The Planning Department staff report was received by the
REPORT: Examiner on April 26, 1978.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and
field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as
follows:
The hearing was opened on May 2, 1978 at 9:25 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner had received and reviewed the Planning( •
Department report, and the report was entered into the record as Exhibit #1. There was no
response to the Examiner's inquiry regarding representation for the applicant at the
hearing, but it was determined that the hearing should proceed as scheduled.
Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following
additional exhibits into the record:
Exhibit #2: King County Assessor's Map
Mr. Smith indicated that a conceptual plan had been submitted by the applicant, but the
plan was lacking in detail and designated non-conformance to city requirements for
setbacks. The Examiner accepted the exhibit as a possible guide for placement of either
two duplex units or a four-plex structure on the site with the agreement that the
Planning Department had not reviewed or approved the plan:

The representative for the applicant identified himself to the Examiner and reported
his attendance at the hearing for the purpose of clarifying the intent of the request.

Mr. Retchless reviewed the purpose of the request for rezone to construct a four-plex
in an R-3 zone. He noted that construction of two duplex units within the existing

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must
be filed in writing on or before May 18, 1978. Any aggrieved person feeling that the
decision of the Examiner is based on erroneous procedure, errors of law or fact, error
in judgment, or the discovery of new evidence which could not be reasonably available
at the prior hearing may make a written request for review by the Examiner within
fourteen (14) days from the date of the Examiner's decision. This request shall set
forth the specific errors relied upon by such appellant, and the Examiner may, after
review of the record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires
that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and
meeting other specified requirements. Copies of this ordinance are available for
inspection in the City Clerk's office, first floor of City Hall, or same may be
purchased at cost in said office.

3. A fourplex on the site would appear to present more potential for site planning in
such a small area. However, both Section 4-708. (4) . (f) (R-2) and Section 4-709A.F
(R-3) require 65% of the site to be ". . .open and free from structures." In other
words, the building area on the site would be 2800 square feet.
The. parking requirements of eight cars would be the same for two duplexes or one
fourplex.
4. Because of the small site, care must be exercised in site planning for the
development. The Planning Department should very carefully review the development
plans for provision of adequate landscaping, building coverage of 35% of the site,
and duplex appearance of the four-plea to be compatible with the neighborhood.
5. Since the abutting alley will be used for access to the proposal, the Public Works
Department should review improvements therein.
6. This recommendation should not be considered a precedent for future land use
decisions in the area. The circumstances of this proposal are relatively unique
in that the two permitted duplexes on,a small site can only be combined into a
single four-plex configuration via a rezone to at least R-3. The development
will be almost the same as in the R-2 zone.
Perhaps the P.U.D. Ordinance should be amended to allow this type of development
in the R-2 zone, thereby precluding the need to rezone the property to accomplish
merely combining structures.
RECOMMENDATION:
Based upon the record, testimony, findings and conclusions, it is the Examiner's ,
recommendation that the City Council approve the requested reclassification from R-2
to R-3 subject to the following conditions being attested to in restrictive covenants:
1. Maximum density of four dwelling' units.
2. Maximum building height of 35 feet.
3. Submittal of site development plans and building elevations for approval by the
Planning Department for provision of adequate landscaping, 35% building coverage
of the site, and duplex appearance that is compatible with the neighborhood.

4. Development of the existing alley abutting the site and extending to the northerly
boundary of the site as required and approved by the Public Works Department.
5. Compliance with all other applicable provisions of Section 4-709A (R-3) and
ordinances of the City of Renton.

Declaration of non-significance has been issued for the subject
proposal .

0. PLANNING DEPARTMENT ANALYSIS :
1 . The proposed rezone is consistent with the Comprehensive Plan
designation of high density multiple family residential for the
site and general area .
2 . Although the subject site and the three lots north of it are
zdned R-2 , the property further north along Factory Avenue North
ix zoned R-4 , high density multiple family. The property
directly west of the subject site and the exisiting 16 foot
alley is also zoned R-4, The area south of the subject site and
south of North 3rd Street is presently zoned R-2 .
3. There is an existing single family residence located north of
the subject site . Single family residence structures also
exist west of the site and alley. Existing apartments are
located north of the site along Factory Avenue North and south
off the site along the south side of North 3rd Street . Existing
apartments of similar density to that requested are intermixed
throughout this north Renton area .
4. Thle subject site consists of two 40 .x 103 foot lots (4 , 120 square
feet each ) . Section 4-708 (4) (e ) will allow the construction
of one duplex unit on each of the two previously platted sub-
standard lots ( less than 7 ,200 square feet ) , provided it is con-
sistent with all other city requirements . Therefore , four
dwelling units could be constructed under the existing R-2
zoning . However , an attached four-plex on the two combined lots
1 (8240 square feet ) can only be constructed by special permit
to l a maximum density of 11 units per acre . Utilizing this
formula only permits construction of a duplex .

Recommend approval of R. 3 zoning based on the above analysis and
the Comprehensive Plan subject to the following conditions to be
establiished as restrictive covenants ;
1 . Any development shall be subject -to site plan approval by the
Planning Department including but not limited to building and
parking location , landscaping , setbacks , building elevation ,
design , and exterior construction .
2 . Setbacks for structures ; Minimum twenty feet adjacent to
Factory Avenue North and North 3rd Street , minimum 25 feet
adjacent to alley , and minimum ten feet adjacent to north
property line .
3. All areas not utilized for parking , access , or structures shall
be ' suitably landscaped. A detailed landscape plan for the site
development shall be approved by the Planning Department .
4. Maximum density shall not exceed four dwelling units ,
5 . Maximum height shall not exceed thirty five feet.
