Project Summary: The applicant is requesting Environmental (SEPA) Review to review for the following
non-project item:
#D-207 Code Interpretations: Administrative Code Interpretations are binding
interpretations concerning land use codes administered by the City. Draft
interpretations are posted online and public comments may be provided during a 14
day comment period following the posting. Interpretations are then issued at the end
of the comment period, subject to comments received. The interpretation may be
appealed. As Code Interpretations are codified, they are removed from the online list.
This docket item is to codify a group of those code interpretations. The interpretations
being advanced for codification are: CI-149 Downtown Window Transparency, CI‐150:
Preschools and Permissibility, CI-151: Slotted Drain Requirement, CI‐153:
Administrative Fees for School Impact Fees, CI -159: Open Space Measurement, CI-162:
Setbacks Required from Alley, CI-166: Design Requirement Applicability for Non -
Conforming Structures, CI‐167: Secondary Front Yards for Residential Accessory
Structures, and CI‐169: Townhome Development in the RMF Zone.

RECOMMENDATION:
Staff Recommends that the Environmental Review Committee issue a
Determination of Non-Significance (DNS).
PART ONE: PROJECT DESCRIPTION / BACKGROUND
CI-149: Downtown Window Transparency amended the design standards for Downtown Renton to ensure the
intended more restrictive standard applied regarding window transparency. The code interpretation amended the
requirement to add the word “no”.
CI‐150: Preschools and Permissibility clarified that when daycare centers are built as an accessory use to public or
community facilities, it is a permitted use which does not require a Hearing Examiner Conditional Use Permit (CUP).
CI-151: Slotted Drain Requirement specified when a slotted drain is required to be installed for new construction of
driveways that exceed 8% slope. The code stated that they are required when surface water crossed a public sidewalk.
It was not the intent that slotted drains only be installed when a public sidewalk is present. The intent is to protect
future homeowners from water intrusion into their home and or garage.

CI‐153: Administrative Fees for School Impact Fees aligned the Renton Municipal Code (RMC) and the City of Renton
Fee Schedule to reflect that a five percent administrative fee shall be applied to cover administrative costs associated
with collecting, processing, and handling school impact fees.
CI-159: Open Space Measurement clarified the minimum measurements required for open space. New development
in the R-10 and R-14 zone is required to provide open space within their development. The code was intended to work
to create open space that is usable, not simply 30 or 40 feet in one direction and only 5 feet in another creating a long
linear strip.
CI-162: Setbacks Required from Alley clarified that development that includes alleys must meet both the stated
setback for garages and the rear yard setback requirements. The lesser setback o f the setback for the garage may not
be used as an alternative to the rear yard setback.
CI-166: Design Requirement Applicability for Non-Conforming Structures amended code to better articulate when a
non-conforming structure would be required to comply with design regulations. The code section for the design
regulations simply made a cross reference to the code section regarding non -conforming structures. The non-
conforming structures code was amended to specify how long a building can be vacant before it would be required to
meet code requirements. Legally established nonconforming structure may remain, even if it does not conform to
current code requirements. However, if the structure is abandoned or left vacant for one year it would need to comply
with code.
CI‐167: Secondary Front Yards for Residential Accessory Structures clarified that the same minimum front yard
setback requirements for accessory buildings shall also be applied to accessory buildings when a secondary front yard
is present.
CI‐169: Townhome Development in the RMF Zone clarified that one townhome per lot is allowed in the Residential
Multi-Family Zone, resulting in required applicability of RMC 4-2-115, Residential Design and Open Space Standards,
for proposed townhome development in the RMF zone.
PART TWO: ENVIRONMENTAL REVIEW
In compliance with RCW 43.21C.240, the following environmental (SEPA) review addresses only those project impacts
that are not adequately addressed under existing development standards and environmental regulations.
A.Environmental Threshold Recommendation
Based on analysis of probable impacts from the proposal, staff recommends that the Responsible Officials:
Issue a DNS with a 14-day Appeal Period.

There are no environmental impacts that are anticipated to occur in conjunction with the proposal.

The Environmental Determination decision will become final if the decision is not appealed within the 14 -day
appeal period (RCW 43.21.C.075(3); WAC 197-11-680).
Environmental Determination Appeal Process: Appeals of the environmental determination must be filed in writing
on or before 5:00 p.m. on April 4, 2022. Due to the ongoing state of emergency enacted by Governor’s Proclamation
20-05, the City Clerk’s Office is working remotely. For that reason, appeals m ust be submitted electronically to the
City Clerk at cityclerk@rentonwa.gov or delivered to City Hall 1st floor Lobby Hub only on Tuesdays and/or
Wednesdays. The appeal fee, normally due at the time an appeal i s submitted, will be collected at a future date if your
appeal is submitted electronically. Appeals to the Hearing Examiner are governed by RMC 4 -8-110 and additional
information regarding the appeal process may be obtained from the City Clerk’s Office, cityclerk@rentonwa.gov.
