AN ORDINANCE OF'THE CITY OF RENTON, WASHINGTON
CHANGING THE ZONING CLASSIFICATION OF CERTAIN
PROPERTIES WITHIN THE CITY OF RENTON FROM
GENERAL CLASSIFICATION DISTRICT (G) TO RESIDENCE
DISTRICT (R-3) (R-165-78)
WHEREAS under Chapter 7, Title IV (Building Regulations)
of Ordinance No. 1628 known as the "Code of General Ordinances
of the City of Renton", as amended, and the maps and reports
adopted in conjunction therewith, the property hereinbelow described
has •her.etofore been zoned as GEneral Classification District (G);
and
WHEREAS a proper petition for change of zone classification
of said property has been filed with the Planning Department
on or about April 17, 1978, which petition was duly referred
to the Hearing Examiner for investigation, study and public hearing,
and a, pubiic,hearing having been held thereon on or about May 30,
1978, and said matter having been ddly considered by the Hearing

Land Use Plan COMPREHENSIVE PLAN THAT WOULD ALLOW LOW-DENSITY INDICATION FOR
CP 903-78 ! MOBILE HOME PARKS. Councilman Stredicke further noted need for
Dean W. Bitney E change in Comprehensive Land Use Plan allowing mobile home use with

along Union Ave. SE and the widening of Union to full 60 ft. width.
Planning and' Development Comittee Chairman Perry noted. that 2.4
acre parcel was referred to the Hearing Examiner and then returned
to Council and back to the committee and both parcels are being
recommended. : MOVED BY PERRY, SECOND SHANE, SUBSTITUTE MOTION, THAT
Two Parcels BOTH ITEMS REQUESTED BY BITNEY FOR CHANGE IN LAND USE DESIGNATION
2.4 and 10 Acres BE APPROVED AND LAND USE DESIGNATOR BE SHOWN ON COMPREHENSIVE PLAN FOR
MOBILE HOMES. Councilwoman Thorpe noted need for change in the
Comprehensive Plan. Ordinance and noted for the record Mrs. Bitney
had made phone contact and had been advised she could not discuss
the matter with her. Councilman Stredicke called attention that
matter before the 'Council was land use designation and not zoning.
City Attorney Warren noted need to modify Comprehensive Plan desig-
nations and establish new designation, then apply that to the matter
before the Council . Following further discussion, ROLL CALL ON
SUBSTITUTE MOTION: 6-AYE: CLYMER, TRIMM, SHANE, SHINPOCH, STREDICKE,
PERRY; ONE NO: THORPE. SUBSTITUTE MOTION CARRIED. MOVED BY
STREDICKE, SECOND SHINPOCH, REFER`MATTER AND ANY CHANGES THAT
NEED TO BE MADE TO THE WAYS AND MEANS COMMITTEE. CARRIED. Thorpe noted
for the record her objection not to change but to granting change that
doesn't exist'. Public Works Director Gonnason explained delay in
Heather Downs sewers, contract awarded and signed, easements not
obtained to .cross Edwards property and Attorney proceeding with
condemnation, contractor has been advised that he can proceed' with
the installation within Heather Downs. Gonnason further noted that
Union Ave. SE is designated as arterial but not included in the
6-year street plan, that signal at NE 4th scheduled for expansion
providing left turn both east and: west bound; streets within the
Heather Downs area will be repaired following installation of the
sewer. City Attorney Warren explained condemnation proceedings.
David:Millard noted willingness to submit restrictive covenants
which would prohibit building of multiple-family and also intent to
participate in sewer trunk line costs. 10:25. p.m.

Ordinance #3247 the Stone rezone approving change from General Classification

Greenwood Cemetery MOVED BY STREDICKE, SECOND SHINPOCH, ADOPT THE ORDINANCE AS READ.
ROLL CALL: ALL AYES: CARRIED. (First Reading July- 17, 1978)
Wehrman Rezone Councilman Stredicke noted for the record that the Ways and Means
(R-166-78) Committee is still holding the Wehrman Rezone Ordinance awaiting
signing of documents by the applicant, that the delay is due to
applicant- and not City.
Ordinance #3248 An ordinance was read appropriating $325,559 from excess funds
Appropriation I establishing 1978 Housing and Community Development Block Grant
Block Grants Funds. MOVED BY STREDICKE, SECOND SHINPOCH, ADOPT ORDINANCE AS
READ. ROLL: CALL: ALL AYES. CARRIED.

WAYS AND MEANS COMMITTEE. CARRIED. •
LID #307 The Ways and Means Committee recommended the subject of Consultants
Street Improvement for LID #307 be referred to the Administration for appropriate
Raymond Ave. SW action and further recommended monitoring by the Utilities Committee.
MOVED BY STREDICKE, SECOND CLYMER, CONCUR IN COMMITTEE REPORT.

Rezone R-065-77 The Ways and Means Committee reported that an inquiry has been made
Grand Prix re property contained in Rezone request R-065-77 and Special Permit
SP-067-77 of Malibu Grand Prix Corp. The report noted matter
originally referred to Ways and Means Committee, however, it was
abandoned by the applicant when the Special Permit was not approved;
and that the committee recommends that any new application for
rezone must follow the appropriate zoning application procedures.
MOVED BY THORPE, SECOND SHINPOCH, COUNCIL CONCUR IN COMMITTEE
REPORT. CARRIED.

1977-78 priorities for work to be undertaken in the near future. Councilman

We have coordinated review. of the legal description for the
proposed rezone ordinance with the Public Works Department.
The exception of the north 30 feet has been noted in red
on the attached copy of the ordinance . The original should
be amended accordingly.
The status of the Ball rezone ( R-082-77 ) and Boehme rezone
(R-088-77 ) is that they have -not completed or filed the
required covenants and/or deeds required as part of the
rezones . It may be necessary to inform each party that
we are assuming the rezones are to be withdrawn unless
further action on the requirements is taken immediately .

WHEREAS under Chapter. 7 , Title IV (Building Regulations )
of Ordinance No. 1628 known as the "Code of General Ordinances
of the City of Renton", ,as amended, and the maps and reports
adopted in conjunction therewith, the. property .hereinbelow described

WHEREAS a proper petition for change of zone classification
of said property has been filed with the Planning Department
on or about April 17 , 1978 , which petition as duly referred

Attached are copies of the analysis and recommendations
sections of the staff reports submitted to the Hearing
Exarhiner on th.e .above.-mentioned items. The staff
recommended that ri'gh.trof..way be dedicated for a future
east/west public street from Union Avenue N . E . to the
easterly boundary of the cemetery adjacent to the
northerly boundary of the City property, and for a
future street to extend south from N . E . 4th Street along
the easterly edge of Greenwood Cemetery. The proposed
rezones , together with the existing zoning and proposed
apartment complexes in the area , will create significant
development intensity to justify an adequate public cir-
culation: system into the area.. There will also be a
need for controlled intersections at existing streets
(N . E . 4th Street and Union Avenue N . E . ) for traffic
safety and optimal traffic movement purposes . See
attached map for proposed street right-of-way locations .

L. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION:
Pursuantito the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended, RSV. 43.21C, a Declaration of non-significance has
been issued for the subject proposal. This declaration is based on provision of
suitable development procedures and standards.

0. STAFF ANALYSIS:
1. The proposed rezone to R-3 is consistent with the Comprehensive Plan map
element which designates the site and area south of the site as medium density
multiple family residential .
2. The proposal is generally consistent with existing zoning and land uses to the
north (i .e. , B-1 zone, proposed apartment complex, and existing business uses).
3. Although the proposal is consistent with the Comprehensive Plan Map Element, the
Comprehensive Plan Land Use Report, Residential , page 11, states that "convenient
access to major arterials and highways is important". The purposes and objectives
of the comprehensive plan, streets and arterials also states that "street patterns
compatible with and complimentary to ,the general land use plan. . " should be
considered. The subject site appears to be land locked without proper public
access: No consideration of access has been addressed in the application.
4. It is possible with the development of an access street to the east to connect
to Union Avenue N.E. that sufficient. access will be provided to the site. However,
from the information that has been provided, no access is provided to the east,
north, west, or south.
5. It is not clear how utilities will be provided to the site. If they are to be
provided from N.E. 4th Street, they will need to be extended the entire distance
across the proposed apartment complex property north and adjacent to the subject
site. If they are to be provided from Union Avenue N.E. ; they will need to be
extended across City of Renton property or the Wehrman property.
P. STAFF RECOMMENDATION:
Based on the apparent access problem that exists, R-3 zoning may be approved only if
suitable public access is assured. This could be accomplished by dedication of northerly
30 feet of the subject site together with similar dedication on the adjacent properties
to the north (proposed apartment complex), east (City of Renton property), and north-
east (Wehrman property). Such rezone is further subject to the following conditions
in the form-of restrictive covenants running with the land:
1. Site development approval. Specific site development plans including site plan,
landscape plan, building elevation design, and parking and circulation shall be
reviewed and approved by the Hearing Examiner.
. 2. Existiflg evergreen trees shall be preserved as much as possible and incorporated
into site design, development, and landscape plans. No such trees shall be cut
or removed without approval of the Planning Department. Detailed landscape and
open space plans shall be approved by the Planning Department at the time of site
devleopment review.
3. All utilities shall be provided per Public Works Department approval comprehensive
utility plan at the time of site development.

ACCESS
Vehicular access shall be provided according to the requirements of
applicable ordinances and regulations of the City of Renton and as approved by
the Public Works Department, City of Renton.
VEGETATION
As much of the existing vegetation as possible shall be retained.
SETBACKS
Along the southerly and westerly property,lines, the building setbacks
shall be thirty (30) feet from these property lines.
BUILDING HEIGHT
Buildings shall be limited to a height of thirty-five (35) feet.
SITE PLAN REVIEW
The development site plan shall be reviewed by the Hearing Examiner prior
to issuance of a building permit to establish compliance with these restrictive
covenants.
DURATION
These covenants shall run with the land and expire on December 31, 2025.
If at any time improvements are installed pursuant to these covenants, the portion

Proper legal procedures in the Superior Court of King County may be

SUBJECT: Rezone Applications: Stone (R-165-78) , Wehrman (R-166-78) , and
Swanson (R-167-78)

In response to your referral of July 24, 1978 and the July 26, 1978 memorandum from
Councilman Stredicke (attached) , I have reviewed the record on these three
applications.
Access to these properties is only a problem for the Stone property. The Swanson
property has rights' of access to N.E. 4th'Street, and the rezone required dedication
of the westerly approximate six feet for part of the right-of-way for the road,
adjacent to the'cemetery. With the dedication of the south 30 feet. of the Wehrman
property and the city's committed north 30 feet of the abutting property, sufficient
access exists for that property to the easterly border of the Stone property. Mr.
Stone's property is the only one of the three applications without sufficient access.
The comprehensive .view of access for properties in the area was not entered into the
record by the Public Works Department Traffic Division.' However, the Planning
Department provided a recommendation that the 60-foot roadway from the Wehrman
property extend ,across the entire Stone property.- This indicated that some
comprehensive review had' occurred by that department Of the traffic circulation in
the area. However, nothing formal with support or participation by the Traffic
Division was provided the Examiner in the hearing on the Stone rezone application or
in the subsequent responses requested by the Examiner. 'Therefore, the Examiner
considered the recommendation for dedication of the north 30 feet of the Stone
property as .not 'completely researched, reviewed or coordinated with the Traffic
Division (based upon the record) to make a specific requirement for that dedication.
The condition the Examiner recommended in the Stone application was for acceptable
access to be provided, thereby putting the burden upon the applicant to submit a
means of access 'acceptable ,to staff. This access could take the form of dedication
of the north 30 feet of Mr. Stone's property or dedication of another alignment in
cooperation with the, northerly abutting property (the site of the' proposed large' ,
apartment complex) . Either alternative could meet the east-west access recommendation
of staff.

It appeared at the time that; 1) the applicant would be more able to select one of
the alternatives with the assistance of staff, in coordination with the abutting
northern.,property 'owner, and 2) the Traffic Division should have another opportunity
for a comprehensive view of the access for the area. Whatever access staff reached
a consensus on was acceptable to the Examiner; however, the Examiner did not wish to
hinder this cooperative decision by dictating the location of the access without more
1 complete information entered into the record.

Per the memorandum Of July 26, 1978, from Councilman Stredicke, another area of concern
was the status of the right-of-way abutting the cemetery property and the Swanson
property. The record in the public hearing was that a 30-foot public right-of-way
exists abutting the easterly boundary of the cemetery property, although this is being
contested in litigation. Staff supported making this a 60-foot dedicated public street
for access serving the properties from N.E. 4th Street to the Leisure Estates Mobile
Home Park. This appeared reasonable, logical and warranted.

But upon examination of the 60 feet of property between the cemetery and Mr. Swanson!s
property, it was discovered in the public hearing that Mr. Swanson did not own all of
. .what would be the easterly 30 feet of the needed 60-foot right-of-way. Another person
owned approximately 24 feet of this easterly 30 feet of right-of-way. Mr. Swanson
could only dedicate six feet. (westerly approximate six feet of his property) . Therefore,
this was required of Mr. Swanson with full knowledge that the city would probably have
to condemn the intervening 24 feet of property in order to develop a full 60-foot public
street.

The Ways and Means Committee has reviewed your reports and proposed
proposed ordinances rezoning properties in East Renton in accordance .
• . with recommendations from your office.
•
• However, the committee has not reported the ordinances out for final
reading because of discussion regarding the dedication of right-of-way
and establishment of roadways to properly serve the area between the
cemetary and Union Avenue N.E . The committee has been, concerned about
granting a zoning on properties which appear to, be "land locked" to
• .higher density multiple, even though there are no building permits . ,
involved.
The proposed 'concentration of vehicles in that area would dictate
establishment of roadways BEFORE anything is done in the area and
that either roadway right-of-way is dedicated by property owners
or the city proceed to condemn that area which would be required.
There was also some concern about "dumping" a high volume of inter-
ior traffic onto either Union Avenue N.E. or N.E. Fourth St.
The interior property , in fact , lists, the dedication of 30 ' of the
south property line, when 30 ' of the NORTH property would line up
with. that proposed in the eastern rezone request.
Because of, this concern, the committee had askerr. the Planning Depart-
ment to make a• report this' past Monday. It appears that the depart-
ment 's recommendations did cover this problem, but the examiner's
report failed to consider or include them. Were they omitted in
error or could we have some explanation?
Otherwise, the committee will be remanding all three parcels back
to your office for further consideration.

It is also my personal concern when a six foot strip is talked about
for' roadway purposes on the piece abutting N.E . 4th, when no other .

0. STAFF ANALYSIS: •
1. The proposed rezone to R-3 is consistent with the Comprehensive Plan map
element which designates the site and area south of the site as medium density
multiple family residential .

2. The proposal is generally consistent with existing zoning and land uses to the
north (i.e. , B-1 zone, proposed apartment complex, and existing business uses) .
' 3. Although the proposal is consistent with the Comprehensive Plan Map Element, the
Comprehensive Plan Land Use Report, Residential , page 11, states that "convenient
access to major arterials and highways is important". The purposes and objectives
of the comprehensive plan, streets and arterials also states that "street patterns
• compatible with and complimentary to .the general land use plan. . " should be
considered. The subject site appears to be land locked without proper public
access. ! No consideration of access has been addressed in the application.
4. It is possible with the development of an access street' to the east to connect
' to Union Avenue N.E. that sufficient access will be provided to the site. However,
from the information that has been provided, no access is provided to the east,
north, west, or south.
5. It is not clear how utilities will be provided to the site. If they are to be .
provided from N.E. 4th Street, they will need to be extended the entire distance
across the proposed apartment complex property north and adjacent to the subject
site. .If they are to be provided .from Union Avenue N.E. ; they will need to be
extended across City of Renton property or the Wehrman property.
P. STAFF RECOMMENDATION:
Based on the apparent access problem that exists, R-3 zoning may be approved only if
suitable public access is assured. This could be accomplished by dedication of northerly
• 30 feet of the subject site together with similar dedication on the adjacent properties
to the north (proposed apartment complex), east (City of Renton property), and north-
east (Wehrman property). Such rezone is further subject to the following conditions
in the form-of restrictive covenants running with the land:
1. Site development approval. Specific site development plans including site plan,
landscape plan, building elevation design, and parking and circulation shall be
reviewed and approved by the Hearing Examiner.

. 2. Existing evergreen trees shall be preserved as much as possible and incorporated
into site design, development, and landscape plans. No such trees shall be cut
or removed without approval of the Planning Department. Detailed landscape and
open space plans shall be approved by the Planning Department at the time of site

This department concurs with the Public Works Department
in the need for public access into the general area of the
subject rezones . One parcel, the subject of R-165-78, is
totally landlocked at the present time.
Also from a land use intensity standpoint, the existing
extensive amount of B-1 zoning together with the proposed
rezones and 222 unit apartment complex establish a critical
need for suitable public access and circulation into the
area, if proper growth and development of the area is to
proceed. We also point to the Streets and Arterials plan,
purposes and objectives , pages 2 and 3, which clearly
indicate a need for suitable public streets consistent with
land use trends .
Regarding the location of a Street extending south from
NE 4th Street, we are not adverse to an alternate location
being provided. However, it` appears that the existing
platted 30 foot right of way along the cemetery boundary,
together with an additional dedication of 30 feet adjacent
to the east of it, is the most appropriate and significantly
established alternative to date . Further dedications will
take place through rezones , site development, and possible
condemnations . We would not object to a street along the
power transmission line easement provided it was dedicated
and developed to suitable city standards .
The matter of access to Union Ave. NE is also important,
particularly with regard to the Wehrman and Stone properties .
However, such access will also provide an important link to
the overall circulation pattern of the area as it will
eventually connect to the proposed north/south street. It
appears , given the validity of the 10/30/68 letter from the

city clerk to Mr. Wehrman, that a full 60 feet of right of
way (south 30 feet of Wehrman property and north 30 feet of
city property) is possible from Union Ave. to the Stone
property, with the possibility of the north 30 feet of the
Stone property and the south 30 feet of the property to the
north being dedicated and developed as part of rezone and
development of these properties .

Per the discussion during today's. public hearings on the above, the
hearings were closed subject to completion of your analysis of the
traffic circulation in the area of properties. Please provide your
recommendation on:

1. The need for a public right-of-way.
2. The use of the transmission line easement. •
3. The use .of the right-of-way adjacent to the cemetery property.
•
4. The access to,Union Avenue N.E. •
Since the existing right-of-way adjacent to the cemetery is in .
litigation, I would suggest discussing with the City Attorney any
recommendations pertinent thereto.
Since my recommendation to the City Council is due June 13, 1978,
please provide me your written analysis and recommendation by
June 8, 1978.

This department concurs with the Public Works Department
in the need for public access into the general area of the
subject rezones . One parcel, the subject of R-165-78,' is
totally landlocked at the present time.
Also from a land use intensity standpoint, the existing
extensive amount of B-1 zoning together with the proposed
rezones and 222 unit apartment complex establish a critical
need for suitable public access and circulation into the
area, if proper growth and development of the area is to
proceed. We also point to the Streets and Arterials plan,
purposes and objectives , pages 2 and 3, which clearly
indicate a need for suitable public streets consistent with
land use trends .
Regarding the location of a Street extending south. from
NE 4th Street, we are not adverse to an alternate location
being provided. However, it appears that the existing
platted 30 foot right of way along the cemetery boundary,
together with an additional dedication of 30 feet adjacent
to the east of it, .is the most appropriate and significantly
established alternative to date. Further dedications will
take place through rezones , site development, and possible
condemnations . We would not object to a street along the
power transmission line easement provided it was dedicated
and developed to suitable city standards .
The matter of access to Union Ave. NE is also important,
particularly with regard to the Wehrman and Stone properties .
However, such access will also provide an important link to
the overall circulation pattern of the area as it .iaill
eventually connect to the proposed north/south street. It
appears , given the validity of the 10/30/68 letter from the

city clerk to Mr. Wehrman, that a full 60 feet of right of
way (south 30 feet of Wehrman property and north 30 feet of
city property) is possible from Union Ave. to the Stone
property, with the possibility of the north 30 feet of the
Stone property and the south 30 feet of the property to the
north being dedicated and developed as part of rezone and
development of these properties .

There is no doubt that the Stone property does need public access. The use of
the power line is not recommended.
The cemetery right-of-way as you know is i.n question and if it were to be used
an additional 30 feet would be required from the people in the east. This
would provide access to NE 4th St.
It would be best to acquire the 30' adjacent on theseast next to the cemetery.
Thereby providing access to NE 4th St. (SEE ATTACHED MAP) Stone would still
have problems. Perhaps he can acquire the property to the west therby giving
him access to the road along the cemetery.

• The Examiner asked for tesitmony in support or opposition'to the request. There was
no response. The Examiner asked Mr. Smith for a final recommendation. Mr. Smith
indicated that. Exhibit #1 would remain as submitted. •
The.Examiner asked for further comments. ' Since there were none, the hearing on File No.
R-165-78 was closed by the Examiner at 11:10 a.m.

FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now' makes,.and enters the,following: ,
FINDINGS: ' •
1. The request is for approval of a.rezone of approximately 1.25 acres from G to R-3.
2. The Planning Department report accurately sets forth the issues, applicable policies
and provisions, .findings of fact, and departmental recommendations in this matter,
' and is hereby attached as Exhibit #1 and incorporated in this; report,by reference
as set forth in full therein.
3. Pursuant to the City of Renton's. Environmental Ordinance and the State, Environmental
• Policy Act 'of 1971, as amended by R.C.W. 43.21:C. , a Declaration.of Non-
Significance
has been issued for the subject proposal by Gordon. Y. Ericksen, responsible official. •
4. Plans for the proposal 'have been reviewed by all city.departments affected by the
impact of this development. . ' .
5. There was no opposition to the proposal expressed.
6. All existing utilities'are available through extensions of facilities in N.E. 4th
Street and/or Union Avenue N:E. ' r
7. Testimony was not presented regarding previous area land use or zoning analysis
(Section 4-3014. (A) ) or' the impact of significant improvements since those analyses •
• (Section 4-3014, (C) ) . . . •
8. The Comprehensive•Plan Land Use Nap indicates the property to potentially be Medium
Density Multiple Family (Section 4-3014, (B) ) .
9. Storm drainage problems exist adjacent to the site (Exhibit. #6) .
' 10. Access to the site was not apparent; however, development of the' Site and adjoining
properties is to be coordinated. ' A study by the Planning and Public Works Departments
of traffic circulation in the area Of the property '(See attached memoranda of
June 6, 1978 and June 12, 1978) indicated that a 60-foot 'right-of-way and public
street should be provided 'along the .southerly border of Mr. Wehrman's property
(File No. R-166-78) . Due to the property line configurations, ,this would provide
only 30 feet or a half-street to.Mr.. Stone's property, unless the northerly abutting
• property granted him an, easeinent. or dedicated 30 feet. for the needed' right-of-way.
Otherwise; the property is without access except for the transmission line easement.
CONCLUSIONS: •
A1. The proposal. general,ly conforms to the. Comprehensive Plan (Section 4-3014.,(B)) .
except for access. Adequate `access, should .be provided to the site prior to
development of the site. Perhaps ,the most appropriate and ;expeditious'solution
• would.be to' incorporate this needed access into the development of adjacent
properties. However, access becomes, critical relative to actual development, not
the reclassification. Adequate access to the site per applicable city requirements
must be provided. This can be reviewed during review :by the Examiner of the .
development site plan.: • .. '

REPORT AND RECOMMENDATION TO THE RENTON CITY COUNCIL.
APPLICANT: Stanley E. Stone FILE NO. R-165-78
LOCATION: Approximately 650 feet north of Northeast 4th Street west
of Union Avenue Northeast, between existing Greenwood
Cemetery and existing City of Renton property.
SUMMARY OF REQUEST: Applicant requests approval of a rezone from G to R-3 to
• permit construction of multiple family housing.
SUMMARY OF Planning Department: Approval subject to restrictive covenants.
RECOMMENDATION:
Hearing Examiner: Approval with conditions.

PLANNING DEPARTMENT The Planning Department staff report was received by the
REPORT: Examiner on May 25, 1978. .
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on.file with the application, and
field checking the property and surrounding area, the
• Examiner conducted a public hearing on the subject as
follows:
The hearing was opened on May 30, 1978 at 10:55 a.m. in the Council Chambers of the
Renton Municipal Building. The Examiner disclosed being acquainted with the applicant;
. however, discussion regarding the pending application had not occurred prior to the
hearing and he would provide an objective decision on the request. He asked if parties
oi' record in attendance objected to proceeding with the hearing upon receipt of the
disclosure. There was no objection.
' Parties wishing to testify were affirmed by the Examiner. •
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following
additional exhibits into the record:
Exhibit #2: King County Assessor's Map
Exhibit #3: Plot Plan, 1-40 scale
Exhibit #4: Vicinity Map .
Mr. Smith revised Section P.3 of Exhibit #1 to contain recommendation for Public Works
Department approval of storm drainage plans at the time of site development. He also
indicated that Exhibit #5 submitted during public hearing of File No. R-166-78, Marvin
Wehrman request for rezone, would also apply to the subject application. The Examiner
entered the letter into the record as Exhibit #5 by 'reference. The letter to Mr. Wehrman
from the City Clerk, City of Renton, dated October 30, 1968, indicated that the city '
would dedicate the northern 30 feet of City of Renton reservoir property for street access
purposes to the applicant upon development of the site. Mr. Smith noted the city's
cooperation in the matter to provide a total 60-foot right-of-way as access to the site
and other properties in the area. He also submitted and read a letter addressed to the
• Planning Department from Wyman K. Dobson, representing Greenwood Cemetery, dated May 26,
1978, which indicated concerns for provision and installation of adequate storm drainage
system to alleviate existing flood conditions of the cemetery due to elevations of property
' to the east. The Examiner labeled the letter as Exhibit #6.
The Examiner asked the applicant if he concurred in Exhibit #1. Responding was:

Mr: Stone indicated his concurrence in the report based' upon testimony and discussion '
:, 'field during hearing of File No. 's R-166-78 and.R-167-78, properties located in the same
:,.,.`general area. ' The Examiner advised that receipt and review of information from the
'`" '' '.. Planninq'.and Public Works Departments regarding access provisions would occur.prior to ,

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must
be filed in writing on or before June 29, 1978. Any aggrieved person feeling that the
decision of the Examiner is based on erroneous procedure, errors of law or fact, error
in judgment, or the discovery of new evidence which could not be reasonably available
at the prior hearing may make a written request .for review by the Examiner within •
• fourteen (14) days from the date of the Examiner's decision. This request shall set
forth the specific errors relied upon by such appellant, and the Examiner may, after
review of the record, take further action as he deems proper.
.
• An' appeal to the City .Council is governed by Title IV, Section 3016, which requires
that such appeal' be filed with the City Clerk accompanying a filing fee of $25.00 and
meeting other specified requirements:• Copies of this ordinance are available for
inspection in the City Clerk's office, first floor of City Hall, or same may be
purchased at cost in said office.

It was stated that the B-1 property north of and adjacent to the site is proposed
for development of 220+ multiple family dwelling units. These development plans
were not submitted or required, but Section 4-711 (B-1) and 4-709.B (R-4) allow a
building height of six stories or 95 feet. If such height is not in fact proposed,
even the density above requires transition to the low density single family G
property.
Medium density multi-family (R-3) can provide this transition if appropriate
restrictions are placed upon the rezone. The R-3 conforms to the Comprehensive
Plan Land Use Map designation for the subject site. The property south of and
abutting the site is also designated to possibly be R-3; however, until it is
developed beyond the existing single family use, it should be considered as single
family (G) property.
3. The adjacent and easterly city-owned property (undeveloped) is compatible with
R-3 zoning. Buffering is not required along this portion of the subject site.
Normally the R-3 zone rear yard setback is 20 feet and side yard setback is five
feet (Sections 4-709.A. , B. , and D.) . This appears insufficient when the abutting
property is G. The setback along the south and west portions of the site should
therefore be enlarged to 30 feet.
Furthermore, the building height should be reduced from 60 feet to 35 feet, that
height for single family development, in order to complete the transition and
buffering. Review of the site plan by the Examiner in a public hearing is
appropriate for final review of compliance with this and other conditions.
4. Existing vegetation, particularly the substantial trees, should be retained as much
as possible to contribute towards resolution of storm drainage problems. Drainage
and vegetation retention can be reviewed with specific development plans.
RECOMMENDATION:.
Based upon the record, testimony, findings and conclusions, it is the recommendation of
the Examiner that the City Council approve the reclassification from G to R-3 subject
to:
1. Provision of adequate access to and from the property per applicable city ordinances
and regulations.
2. Retention of existing vegetation as much as possible.
3. Building setbacks of 30 feet along the southerly and westerly boundaries of the
property.
4. Building height of 35 feet.
5. Review of the development site plan by the Examiner in a public hearing for
compliance with the aforementioned conditions.

This department concurs with the Public Works Department
in the need for public access into 'the general area of the
• subject rezones . One parcel, the subject of R-165-78, is
totally landlocked at the present time.
• Also from a land use intensity standpoint, the existing
extensive amount of B-1 zoning together with the proposed
• rezones and 222 unit apartment complex establish a critical
need for suitable public access and circulation into the
area, if proper growth and development of the area is, to
proceed. We also point to' the Streets and. Arterials plan,
purposes and objectives , pages 2 and 3, which clearly
indicate a need for suitable public streets consistent with
land use trends .
Regarding the location of a Street extending south from
NE 4th Street, we are not adverse to an alternate location
being provided. However, it appears that the existing
platted 30 foot right of way along the cemetery boundary,
together with an additional dedication of 30 feet adjacent
to. the east of it, is the most appropriate and significantly
established alternative to date. Further dedications will
take place through rezones , site development, and possible
condemnations . We Could not object to a street along the
• power transmission line easement provided it was dedicated
and developed to suitable city standards .
The matter of access to Union Ave. NE is also important,
particularly with regard to the Wehrman and Stone properties .
However, such access will also provide an important link to
the overall circulation pattern of the area as it will
• eventually connect to the proposed north/south street. It
appears , given the validity of the 10/30/68 letter from the

• city clerk to Mr. Wehrman, that a full 60 feet of right of
way (south 30 feet of Wehrman property and north 30 feet of
city property) is possible from Union Ave. to the Stone
property, with the possibility' of the north 30 feet of the
Stone property and the south 30 feet of the property to the
north being dedicated and developed as part of rezone and
development of these properties .

on their behalf concerning the above rezone application.
On any rezone and development of the property, we would
ask that a condition be attached thereto requiring the
owner/developer to provide and install an adequate
storm drainage system. The subject property slopes in
a downward direction toward the shop and the cemetery.
This past year the cemetery experienced severe flood-
ing as a result of a development on the southeast
corner which had inadequate storm drainage.

To permit rezone of the subject site into an area suitable for future
development of multiple family housing and/or condominiums .,
D. HISTORY/BACKGROUND:
The subject site was annexed into the City by Ordinance Number 2249
dated June 22 , 1976 .
E. PHYSICAL BACKGROUND:
1 . Topography: The terrain rises slightly from west to east at approxi-
mately a 6% slope.
2 . Soils : Alderwood gravelly sandy loam (AgC) , runoff is slow to
medium and the erosion hazard is' moderate. This soil is used for
timber, pasture, berries , and row crops , and for urban development.

3. Vegetation: The majority of the site is covered by grass with
some scattered deciduous trees located in the northeast section .
4 . Wildlife: The existing vegetation of the site provides suitable
habitat for birds and small mammals .
5 . Water: There is no surface water evident on the site.
6 . Land Use: The site is basically undeveloped. The surrounding
area is primarily single family residential in nature with commercial
uses located to the northeast.
F . NEIGHBORHOOD CHARACTERISTICS :
The area is predominantly single family residential in nature .
G. PUBLIC SERVICES:
1. Water and Sewer: An existing 12" water main is located along
Northeast 4th Street and a 16" main extends south on Union Avenue
Southeast for approximately 750 feet. An 8" sanitary sewer is
situated on Northeast 4th Street and a similar pipe is located on
Union Avenue Southeast extending south for approximately 450 feet.
2 . Fire Protection: Provided by the Renton Fire Department as per
Ordinance requirements .
3. Transit: Metro Transit Route 107 operates along Union Avenue
Southeast within 1/4 mile of the subject site.
4 . Schools: The subject site is located approximately 1/2 mile south
of the Honey Dew Elementary School; approximately 1 1/4 miles south-
east of McKnight Junior High School; and 1 mile southwest of Hazen
High School .
5 . Parks: Kiwanis Park is approximately 1/2 mile north of the site
and Windsor Hills Park is within 1 mile to the west.

The rezone process will not have any direct, impacts. However, resulting development
from such rezone may disturb existing soil and vegetation, increase storm water run-
off and have an effect on traffic and noise levels in the area. However, these can
be mitigated by proper development controls, and procedures.

Future development subsequent to a rezone will increase population levels and the
related social impacts.

L. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION:
Pursuant to the City of Renton°s Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended, RCW9. 43.21C, a Declaration of non-significance has
been issued for the subject proposal. This declaration is based on provision of
suitable development procedures and standards.

0. STAFF ANALYSIS:
1. The proposed rezone to R-3 is consistent with the Comprehensive Plan map
element which designates the site and area south of the site as medium density
multiple family residential .
2. The proposal is generally consistent with existing zoning and land uses to the
north (i .e. , B-1 zone, proposed apartment complex, and existing business uses) .
3. Although the proposal is consistent with the Comprehensive Plan Map Element, the
Comprehensive Plan Land Use Report, Residential , page 11, states that "convenient
access to major arterials and highways is important" . The purposes and objectives
of the comprehensive plan, streets and arterials also states that "street patterns
compatible with and complimentary to the general land use plan. . " should be
considered. The subject site appears to be land locked without proper public
access. No consideration of access has been addressed in the application.
4. It is possible with the development of an access street to the east. . to connect
to Union Avenue N.E. that sufficient access will be provided to the site. However,
from the information that has been provided, no access is provided to the east,
north, west, or south.
5. It is not clear how utilities will be provided to the site. If they are to be
provided from N.E. 4th Street, they will need to be extended the entire distance
across the proposed apartment complex property north and adjacent to the subject
site. If they are to be provided from Union Avenue N.E. , they will need to be
extended across City of Renton property or the Wehrman property.
P. STAFF RECOMMENDATION:
Based on the apparent access problem that exists, R-3 zoning may be approved only if
suitable public access is assured. This could be accomplished by dedication of northerly
30 feet of the subject site together with similar dedication on the adjacent properties
to the north (proposed apartment complex) , east (City of Renton property) , and north- •
east (Wehrman property). Such rezone is further subject to the following conditions
in the form of restrictive covenants running with the land:
1. Site development approval. Specific site development plans including site plan,
landscape plan, building elevation design, and parking and circulation shall be
reviewed and approved by the Hearing Examiner.
2. Existing evergreen trees shall be preserved as much as possible and incorporated
into site design, development, and landscape plans. No such trees shall be cut
or removed without approval of the Planning Department. Detailed landscape and
open space plans shall be approved by the Planning Department at the time of site
devleopment review.
3. All utilities shall be provided per Public Works Department approval comprehensive
utility plan at the time of site development.

Per the discussion during today's public hearings on the above, the
hearings were closed subject to completion of your analysis of the
traffic circulation in the area of properties. Please provide your
recommendation on:
1. The need for a public right-of-way. ,
2. The use of the transmission line easement.
3. The use of the right-of-way adjacent to the cemetery property.
4. The access to Union Avenue N.E.
Since the existing right-of-way adjacent to the cemetery is in
litigation, i would suggest discussing with the City Attorney any
recommendations pertinent thereto.
Since my recommendation to the City Council is due June 13, 1978,
please provide me your written analysis and recommendation by
June 8, 1978.
