.ORDINANCE NO. 3250
AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON
CHANGING THE ZONING QLASSIFICATION OF CERTAIN
PROPERTIES WITHIN THE CITY. OF RENTON FROM
GENERAL CLASSIFICATION DISTRICT (G) TO BUSINESS
DISTRICT (B-1) (R-166,-'78)
WHEREAS under Chapter 7', Title IV (Building Regulations)
of Ordinance No. 1628 ' known as the "Code of General Ordinances
of the City of 'Renton", as amended, and the maps and reports
adopted in conjunction therewith, the property hereinbelow described
has heretofore been zoned, as General Classification District (G) ;
and
WHEREAS a proper petition for change of zone classification
of said property has- been filed with the Planning Department
on or about April 17, 1978 , which petition was duly referred
to the Hearing Examiner for investigation, 'Study and public hearing,
and a public hearing having been held thereon on or about May 30 ,
1978 , and said matter having been duly considered by the Hearing
Examiner and said zoning request being in conformity with the
City' s Comprehensive Plan, as amended, and the City Council having
duly considered all matters relevant thereto, and all parties
having been heard appearing in support thereof or in opposition
thereto, NOW THEREFORE ,
THE CITY COUNCIL OF THE CITY OF RENTON; WASHINGTON, DO
ORDAIN AS FOLLOWS :
SECTION I : The following described property in the City
of Renton is hereby rezoned to Business District (B-1) as hereinbelow
specified; subject to the findings , conclusions and decision dated
June 15 , 1978 of the City' s Hearing Examiner;the Planning Director
is hereby authorized and directed to change the maps of the Zoning
Ordinance, as amended, to evidence said rezoning, to-wit:

The West 220 feet of the South 4 of the NE 4 of the
NE 4 of the NE 4 of Section 16 , Township 23 North ,
Range 5 East, W . M. ; together with the South 30 feet
of the South 4 of the NE 4 'of the NE 4 of the NE 4
of said Section 16 , less ' the 'West 220 feet , and less
East 30 feet , in .King County Washington .
( Said property located South of Northeast 4th Street
between Greenwood Cemetery and Union Avenue Northeast)
AND SUBJECT FURTHER to that certain Declaration of Restrictive
Covenants executed by Petitioner-owner on or about July 13, 1978,
and recorded in the office of the Director of Records and Elections ,
Receiving No . 7807210771 and which said covenants are hereby
incorporated and made a part hereof as if fully set forth .
SECTION II : - This Ordinance shall be effective upon its
passage , approval and five ( 5 ) days after its publication .

insurance without street vacation or obtaining quiet title through
the court, which may take a year. McBeth further explained the
history of street and developer's intent to build. Upon inquiry
-Planning Director Ericksen noted the area owned by Lakeview
Towers was zoned R-4 and R-3. R. Little, 264 Maple Ave. NW,
area resident, explained traffic problems and steepness of terrain.
Mr. Little noted in reply to Councilman Shane's suggestion for
vacating all non-opened streets in area, that as streets did revert
back to original owner and as Maple Ave. was opened by his father
in-law 1952 without power to do so, it could also be included.
Barbara Little, 264 Maple Ave. NW, area resident, objected to
Council vacating the street making building of apartment complex
easier, expressing belief that streets in the area are prohibitive
to such development due to steepness, questioning access of emer-
gency vehicles. Following further discussion, it was MOVED BY
STREDICKE, SECOND SHANE, CLOSE THE PUBLIC HEARING. CARRIED.
Following further questions re servicing of area by Fire and Police
vehicles; automatic vacation, etc. , it was MOVED BY STREDICKE,
SECOND SHANE, RECONSIDER PREVIOUS MOTION. CARRIED. MOVED BY
STREDICKE, SECOND SHANE, CONTINUE PUBLIC HEARING FOR ONE WEEK.

Zoning Maps Councilman Stredicke requested updated zoning map for each
Council Members' desk in the Council Chambers. Planning Director
Ericksen agreed to furnish maps.
Streets Councilman Stredicke called attention to numerous specific street
locations that repairs are needed and asked that no street cuts
be made unless the contractor or City will return street to
original condition. Councilman Shane noted several areas in
need of repair.
NE 30th Overpass Councilman Stredicke submitted letter for reading from the 11th
Legislative District ReOresentative Avery Garrett thanking him
for letter re I-405 overpass at NE 3.0th and hearing held at
Kennydale School in May 1978. Garrett's letter complimented the
Kennydale residents for presenting a strong case and for their
participation. .
Recurring Water Councilwoman Thorpe for the record expressed gratitude for Water
Problem on Talbot Department crew and work done on water problem on Talbot Hill .
Utilities • Utilities Committee Chairman Shane submitted report recommending
Committee Report approval of the Latecomer's Agreement between the City and Loveless-
Loveless/Powell Powell and that the Mayor and City Clerk be authorized to exe-

Land Use Development
The above-referenced land development has come to our attention on an individual
basis, but requires a comprehensive analysis of all four combined properties in
regard to access.
The portion of the property of Mike Mastro's which is proposed for apartments
or condominiums with a possible restaurant has a projected traffic volume of
1 ,366 vehicles per dby if fully developed. This would generate between two
and three vehicles per minute during peak hour entering and exiting to NE 4th
Street.
Limited site distance due to a vertical curve and heavy peak hour traffic
volumes on NE 4th Street will cause all .left-turning movement to the property's
proposed access unsafe.
Possible corrective solutions to this unsafe condition are as listed:
I . Restrict all left turning movements by installing 'C' curbing
on the centerline of NE 4th Street.
2. Property owners fronting on NE 4th Street could pay for the
installation of a center lane, two-way left turn. It would be
desirable if property owners would dedicate 5 feet of property
to facilitate the most desirable design width.
3. Regardless of corrective actions on NE 4th Street, an additional
east/west roadway access for the two southerly properties must
be required and provide access to Union Ave. NE as proposed on
the attached drawing. As you are aware, a portion of the
properties shown in the proposed right-a-way (60 ft.) would have
to be dedicated as a public street by each property owner.
In addition to the east/west roadway access, we also confirm the need for a
north/south roadway access to NE 4th Street to release properties to the south
of the above-referenced property from being landlocked and improve traffic
circulation throughout the area as developments occur.
Please make the contents of this memo a part of the permanent records and any

and assigns, as follows:
ACCESS AND OFF-SITE IMPROVEMENTS
The south 30 feet of the property is to be dedicated for public right-of-way.
Upon dedication of the north 30 feet of the southerly abutting property, owned by
the City of Renton, for public right-of-way, the aforesaid owners will construct a
public street within the combined public right-of-way of 60 feet to applicable
standards of the City of Renton as required by the Public Works Department, City
of Renton.
LANDSCAPED BUFFER
The easterly 30 feet of the property shall be utilized exclusively for
landscaping which shall include existing vegetation and shall constitute an
effective visual screen as required by the Planning Department, City of Renton;
EXCEPT, in the event that the abutting easterly property is reclassified to a use
more intensive than single family, the Planning Department,, City of Rentoh, may
reduce the 30-foot landscaped area to a lesser dimension commensurate, in its
jud gnent, with the approved reclassification.

DURATION
These covenants shall run with the land and expire on December 31, 2025.
If at any time improvements are installed pursuant to these covenants, the portion,
of the covenants pertaining to the specific installed improvements as required by
the Ordinances of the City of_Benton shall terminate without necessity of further
— documentation.

O Any violation or breach of these restrictive covenants may be enforced by

affected by said breach. Reasonable attorneys' fees incurred during an enforcement

Land Use Plan , COMPREHENSIVE PLAN THAT WOULD ALLOW LOW-DENSITY INDICATION FOR
CP 903-78 MOBILE HOME PARKS. Councilman Stredicke further noted need for
Dean W. Bitney ' change in Comprehensive Land Use Plan allowing mobile home use with
Area of I filing of restrictive covenants prohibiting multi-family (apart-
Union Ave. SE ' ment) therein and requiring applicant to provide green belt area
along Union Ave. SE and the widening of Union to full 60 ft. width.
' Planning and Development Committee Chairman Perry noted that 2.4
' acre parcel was referred to the Hearing Examiner and then returned
to Council and back to the committee and both parcels are being
recommended. MOVED BY PERRY, SECOND SHANE, SUBSTITUTE MOTION, THAT
Two Parcels BOTH ITEMS REQUESTED BY BITNEY FOR CHANGE IN LAND USE DESIGNATION
2.4 and 10 Acres BE APPROVED AND LAND USE DESIGNATOR BE SHOWN ON COMPREHENSIVE PLAN FOR
MOBILE HOMES. Councilwoman Thorpe noted need for change in the
Comprehensive Plan Ordinance and noted for the record Mrs. Bitney
" had made phone contact and had been advised she could not discuss
the matter with her. Councilman Stredicke called attention that
matter before the Council was land use designation and not zoning.
City Attorney Warren noted need to modify Comprehensive Plan desig-
nations and establish new designation, then apply that to the matter
before the Council . Following further discussion, ROLL CALL ON
SUBSTITUTE MOTION: 6-AYE: CLYMER, TRIMM, SHANE, SHINPOCH, STREDICKE,
PERRY; ONE NO: THORPE. SUBSTITUTE MOTION CARRIED. MOVED BY
STREDICKE, SECOND SHINPOCH, REFER MATTER AND ANY CHANGES THAT
NEED TO BE MADE TO THE WAYS AND MEANS COMMITTEE. CARRIED. Thorpe noted
for the record her objection not to change but to granting change that
doesr?t exist. Public Works Director Gonnason explained delay in
Heather Downs sewers, contract awarded and signed, easements not
obtained to cross Edwards property and Attorney proceeding with
condemnation, contractor has been advised that he can proceed with
the installation within Heather Downs. Gonnason further noted that
Union Ave. SE is designated as arterial but not included in the
6-year street plan, that signal at NE 4th scheduled for expansion
providing left turn both east and west bound; streets within the
Heather Downs area will be repaired following installation of the
sewer. City Attorney Warren explained condemnation, proceedings.
David Millard noted willingness to submit restrictive' covenants
which would prohibit building of multiple-family and:also intent to
participate in sewer trunk line costs. 10:25. p.m.

Attached are copies of the analysis and recommendations
sections of the staff reports submitted to the Hearing
Examiner .on th.e above.mentioned items , The staff
recommended that right-of—way be dedicated for a future
east/west public street from Union Avenue N . E . to the
easterly boundary of the cemetery adjacent to the
northerly boundary of the City property, and for a
future street to extend south from N , E . 4th Street along
the easterly edge of Greenwood Cemetery. The proposed
rezones , together with the existing zoning and proposed
apartment complexes in the area , will create significant
development intensity to justify an adequate public cir-
culation system into the area.. There will also be a
need for controlled intersections at existing streets
(N . E . 4th Street and Union Avenue N , E . ) for traffic
safety and optimal traffic movement purposes . See

State Highway Glen Garrett, 1006 So. 30th Ct. , inquired when comments from State
Dept. Report Highway Dept. would be available, being advised they should be
'ready .within 'a week.
Dennis Stremick, 2532 Smithers Ave. So. , inquired .as to city' s
response to State Highway report. Councilwoman Shinpoch advised
of those corrections-improvements to be made within the city limits
in the area of Victoria Park.

Acquisition of MOVED BY CLYMER, SECOND PERRY TO REFER MATTERS OF PETERMEYER PROPERTY
Property on ON MILL AVE. SO. TO WAYS AND MEANS COMMITTEE. Councilwoman Thorpe
Mill Ave. So. inquired re public hearing 'for 'acquisition of this property for
public use. Councilman Shane noted previous council action to acquire
civic` center property. Councilwoman Thorpe requested Administration
to research and verify that the proper procedures have been followed
to acquire property and report to the Ways and Means Committee. CARRIED.

0. STAFF ANALYSIS:
1. The proposed rezone is compatible with the Comprehensive. Plan, land use map
element, which designates the site and general area north of the site as
commercial .
2. However, the subject site has only 30 feet of frontage along a public street
(Union Avenue N.E. ). Access to the site, is provided by what appears to be a
strip of land 30 feet wide and 425 feet in length. Sufficient access in the .
form of a dedicated and improved public street should be provided to the site
to provide proper access and circulation to the site and surrounding area,
which has the potential for intense multiple and commercial development (arterials
and streets, purposes and objectives, page 2 and 3).
3. The utilities division has indicated that sewer and water line extensions will
be necessary as part of site development.
4. Although the adjacent property to the north and west is zoned B-1, the pattern
of zoning south of Union Avenue N.E. indicates that R-3 zoning has been established
to provide a more suitable land use transition from commercial to single family
residential uses. (See zoning pattern directly east of the site along the east
site of Union Avenue N.E. . ) The pattern of development in this area has been
established as multiple family residential (i.e. , proposed 222 unit apartment
complex west.of the site and Leisure Estates Mobile Home Park south of the site) .
Therefore, it seems that R-3 zoning may be more appropriate than B-1 for the
subject site.
5. An existing food market is located north of the site. An existing single family
residence is located on the property between the subject site and Union Avenue
N.E. A 222 unit apartment complex is proposed on the property directly west of
the site. A building permit application for the apartment complex has been sub-
mitted. and is being reviewed by the various municipal departments.
6. Property owned by the City of Renton and used as a gravel stockpile area is
located south of the subject site.
7. Improvements to the intersection of Union Avenue N.E. and N.E. 4th Street for
more improved turning movement is proposed to be undertaken by the city within
the next one to two years.
8. Although the site is near an arterial intersection and existing B-1 zoning and
uses, access to the site will need to be improved through dedication and develop-
ment of a half street along the southerly property line.
9. The site contains a certain number of evergreen trees. These should be retained
as part of site development.
10. The Comprehensive Plan Land Use Report Objectives 2, 4, and 6 provide for encour-
aging development to its highest and best use while at the same time providing for
"open space, attractiveness, and desirability" in development through "effective
control of land use". The applicant has indicated that apartments may be con-
structed on the site. R-4 densities may be allowed under the B-1 zone. Develop-
ment of such density should be closely reviewed with respect to open space,
access, circulation, landscaping, and building location and design. Site plan
approval of specific development should be required as part of approval .

SUBJECT: Rezone Applications: Stone (R-165-78) , Wehrman (R-166-78) , and
Swanson (R-167-78)
In response to your referral of July '24, 1978 and the July 26, 1978 memorandum from
Councilman Stredicke (attached) , I have reviewed the record on these three
applications.
Access to these'properties is only a problem for the Stone property. The Swanson
property has rights of access to N.E. 4th Street, and the rezone required dedication
of the. westerly approximate six feet for part of the right-of-way, for the road
adjacent to the cemetery. With the dedication of the south 30 feet of the Wehrman
property and the city's committed north 30 feet of the abutting property, sufficient
,access exists for that property to the easterly border of the Stone property. Mr.
Stone's property is the only one of the three applications without sufficient access.
•
The comprehensive view of access for properties in the area was not entered into the
record by the Public Works Department Traffic Division. However, the Planning
Department provided a recommendation that the 60-foot roadway from the Wehrman
'property extend across the entire Stone property. This indicated that some
comprehensive review had occurred by that department of the traffic circulation in
. the area. However, nothing formal with support or participation by the Traffic
Division was provided the Examiner in the hearing on the Stone rezone application or
in the subsequent responses requested by the Examiner. Therefore, the Examiner
considered the recommendation for dedication of the north 30 feet of the Stone
property as not, completely researched, reviewed or coordinated with the Traffic
Division (based upon the record) to make a specific requirement for that dedication.
The condition the Examiner recommended in the Stone application was for acceptable
access to be provided, thereby putting the burden upon the applicant to submit a
means 'of access acceptable to staff. This access could take the form of dedication
of the north 30 feet of .Mr. Stone's property or dedication of another alignment in
cooperation with the northerly abutting property (the site of the proposed large
apartment complex) . Either alternative could meet the east-west access recommendation
of staff.
It appeared at the time that, 1) the applicant would 'be more able to. select one of
the alternatives with the assistance of staff in coordination with the abutting
northern property owner, and '2) the Traffic Division should have another opportunity .
for a comprehensive view of the access for the area. Whatever access staff reached
a consensus on was acceptable to the Examiner; however, the Examiner did not wish to
hinder this cooperative decision by dictating the location of the access without more
complete information entered into the record. •

Per the memorandum of July 26, 1978, from Councilman Stredicke, another area of concern
was the status of the right-of-way abutting the cemetery property and the Swanson
property. The record in the public hearing was that a 30-foot public right-of-way
exists abutting the easterly boundary of the cemetery property, although this is being
contested in litigation. Staff supported making this a 60-foot dedicated public street
for access serving the properties from N.E. 4th Street to the Leisure Estates Mobile .
Home Park. This appeared reasonable, logical and warranted.
' But upon examination of the 60 feet of property between the cemetery and Mr. Swanson's
property, it was, discovered in the public hearing, that Mr. Swanson did not own all of
.what would be the easterly 30 feet of the needed 60-foot right-of-way. . Another person
owned approximately 24 feet of this easterly 30 feet of right-of-way. Mr. Swanson
• could only dedicate six feet (westerly approximate six feet of his property) . Therefore,
this was required of Mr. Swanson with full knowledge that the city would probably have
to condemn the intervening 24 feet of property in order to develop a full 60-foot public
street.

• The Ways and Means Committee has reviewed your reports and proposed
proposed ordinances rezoning properties in East Renton in accordance
with recommendations from your office.
However, the committee has not reported the ordinances out for final
• reading because of discussion regarding the dedication of right-of-way.
• and establishment of roadways to properly serve the area between the
cemetary and .Union Avenue N.E . The committee has been concerned about
• granting a zoning on properties which appear to,be "land locked" to
higher density multiple, even though there are no building permits
• involved.
The proposed concentration of vehicles in that area would dictate
establishment of roadways BEFORE anything is done in the area and
that either roadway right-of-way is dedicated' by property owners
or the city proceed to condemn that area which would be required.

There was also some concern about "dumping" a high volume of inter-
ior traffic onto either Union Avenue N.E. or N.E. Fourth St.
• The interior property, in fact , lists the dedication of 30 ' of the
south property line, when 30 ' of the NORTH property would line up
with that proposed in the eastern rezone request,
•
Because of this concern, the committee had asked the Planning Depart-
ment to make a report this past Monday. It appears that the depart-
• ment's recommendations did cover this problem, but the examiner' s
report failed to consider or include them. Were they omitted in •
error or could we have some explanation? •
Otherwise, the committee will• be remanding all three parcels back
to your office for further consideration.

The Examiner asked for testimony in support or opposition to the request. There was no
response. The Examiner asked Mr. Smith if provisions contained in Exhibit #5, letter from
City Clerk, would satisfy Planning Department concerns for adequate access. Mr. Smith
responded affirmatively.
The Examiner reported that review and response regarding access provisions from the
Planning and Public Works Departments for the subject application as well as previously
heard applications, R-165-78 and R-167-78, would be necessary prior to providing a final
recommendation on the request, and asked if parties of record were amenable to such
procedure. There was no objection. Mr. Clint Morgan, Traffic Engineering Division,
indicated that traffic revisions are scheduled sometime in 1979 in the location of
N.E. 4th Street and Union Avenue N.E. if funding remained available.
The Examiner asked for further comments. Since there were none, the hearing on File No.
R-166-78 was closed by the Examiner at 10:55 a.m.
FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of a reclassification of approximately 1.12 acres from
G to B-1 to permit multi-family development and small retain outlets.
2. The Planning Department report sets forth the issues, applicable policies and
provisions, findings of fact, and departmental recommendations in this matter, and
is hereby attached as Exhibit #1 and incorporated in this report by reference as
set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance
has been issued for the subject proposal by Gordon Y. Ericksen, responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available through extensions of facilities in N.E. 4th
Street and/or Union Avenue N.E.
7. Testimony was not presented regarding previous area land use or zoning analysis
(Section 4-3014. (A) ) or the impact of significant improvements since those analyses
(Section 4-3014. (C) ) .
8. The Comprehensive Plan Land Use Map indicates the property to potentially be
Commercial (Section 4-3014. (B) ) .
9. Access to the site is via an existing 30-foot strip of property (pipestem) to Union
Avenue N.E. The City has agreed to making available an additional 30-foot strip
adjacent to and southerly of the site to form a total of 60 feet of right-of-way for
a public street.
10. Some substantial trees exist on the site.
11. The Planning and Public Works Departments have studied vehicular circulation in the
area (attached memoranda of June 6, 1978 and June 12, 1978) . • Their recommendation is
to dedicate a 60-foot right-of-way on the east side of the cemetery, 30 feet of which
is existing right-of-way. It was also recommended that a 60-foot right-of-way be
dedicated in combination of Mr. Wehrman's and the City properties.

12. In 1979, the intersection of N.E. 4th Street and Union Avenue N.E. is scheduled for
improvement to increase vehicular capability.
13. Immediately west and north of the site is existing B-1 zoning. South and east of the
site is existing G zoning. West of the site is proposed multiple family development
of about 222 units. South of the site lies City-owned property currently being used
for storage of gravel which may eventually be used for a water reservoir facility.

LOCATION: South of Northeast 4th Street between Greenwood Cemetery and
Union Avenue Northeast.
SUMMARY OF REQUEST: Applicant requests approval of a rezone from G to B-1 to
permit the construction of multiple family housing units and/
or condominiums along with compatible retail outlets.
SUMMARY OF Planning Department: Approval to R-3 with restrictive covenants.
RECOMMENDATION:
Hearing Examiner: Approval to B-1 with conditions.
PLANNING DEPARTMENT The Planning Department staff report was received by the
REPORT: Examiner on May 25, 1978.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and
field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as
follows:
The hearing was opened on May 30, 1978 at 10:30 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following
additional exhibits into the record:

Mr. Smith revised Section P.4 of Exhibit #1 to include a recommendation for Public Works
Department approval of storm drainage plans at the time of site development.
The Examiner asked the applicant if he concurred in Exhibit #1. Responding was:

Mr. Wehrman indicated his nonconcurrence in the report. He submitted a letter addressed
to him from City Clerk, Helmie Nelson, dated October 30, 1968, which he read into the
record. The letter, labeled Exhibit #5 by the Examiner, contained authorization for
acceptance of Mr. Wehrman's offer by the City Council to develop a street in connection
with development of the subject site and advised dedication of the north 30 feet of the
City of Renton reservoir site for provision of a 60-foot right-of-way.
Mr. Wehrman objected to the Planning Department recommendation for R-3 zoning in lieu
of the requested B-1 zoning designation. He advised that the Comprehensive Plan designates
the subject area for commercial use and B-1 zoning exists to the north and east of the
site. He felt that because the subject property is located 403 feet west of Union Avenue
N.E. the existing R-3 zoning and development on the east side of that street would not
have a relationship to the subject request and the existence of Union Avenue N.E. provides
a natural divider for zoning designations. He noted that the property directly south of
the subject site is owned by the City of Renton for a potential reservoir site. Mr.
Wehrman advised that the city's highest elevation exists on the subject site and future
plans could include construction of a rooftop restaurant to utilize a 360 degree view.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must
be filed in writing on or before June 28, 1978. Any aggrieved person feeling that the
decision of the Examiner is based on erroneous procedure, errors of law or fact, error
in judgment, or the discovery of new evidence which could not be reasonably available
at the prior hearing may make a written request for review by the Examiner within
fourteen (14) days from the date of_ the Examiner's decision. This request shall set
forth the specific errors relied upon by such appellant, and the Examiner may, after
review of the record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires
that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and
meeting other specified requirements. Copies of this ordinance are available for
inspection in the City Clerk's office, first floor of City Hall, or same may be
purchased at cost in said office.

CONCLUSIONS:
1. The proposal generally conforms to the Comprehensive Plan (Section 4-3014. (B) ) , except
for access. It can be reasonably assumed that the adjacent City property will be
retained by the City for uses of utility nature such as the existing gravel storage
or the indicated water reservoir. Another reasonable assumption is that the adjacent
and easterly single lot will eventually be reclassified in response to the northern
B-1 zone (supermarket) , but until such time, some buffer between the two uses is needed.
Other than these two abutting properties, the site is bordered by existing B-1 zoning,
of which the westerly parcel is apparently scheduled for multi-family development.
Therefore, it seems reasonable for the site to be reclassified to B-1 due to its
predominant orientation to existing B-1 property.
This would be the appropriate use of ". . .land use principles. . ." and the ". . .
coordinated development of undeveloped areas. " (Summary, page 9, Comprehensive Plan,
Renton Urban Area, July, 1965) . The rezone would not constitute ". . .unwarranted
infiltration of incompatible uses which would contribute to premature decay and
obsolescence, and prevent the development of orderly growth patterns. " (Objective No.
1, page 17, Comprehensive Plan, Land Use Report, July, 1965) . The ". . .effective
control of land use. . . " is accomplished (Objective No. 4, Page 17, Comprehensive Plan,
Land Use Report, July, 1965) . B-1 will be the ". . .highest and best use. . ." While
contributing to the community's ". . .overall attractiveness and desirability as a
place in which to work, shop, live and play. " (Objective No. 6, Comprehensive Plan,
Land Use Report, July, 1965) .
2. A vegetation buffer seems appropriate for separation of the subject site and the
easterly abutting single family property containing a single family residence
(Summary, page 9, Comprehensive Plan, Renton Urban Area, July, 1965; Objectives No.
1 and 4, page 17, Comprehensive Plan, Land Use Report, July, 1965) . The normal
B-1 zone setback would be five feet in this case (Section 4-711.D) which is
inadequate for a buffer.
A landscape buffer of 30 feet should be reserved along the easterly property line of
the subject site. This buffer strip should constitute an effective visual buffer.
The buffer should be decreased if the adjacent single family property is reclassified
to a use more compatible with B-1. A reclassification to multi-family would require
some buffer, but a rezone to B-1 would necessitate landscaping of only the normal
setback area. The Planning Department should use their judgment in specifying the
amount of decrease of the buffer strip.
3. Existing access to the property is inadequate but can be brought up to city
requirements (Section 9-1108.7.H, Subdivision Ordinance) by the City dedicating
30 feet of property adjacent to the applicant's 30-foot pipestem. However, it is
apparent that this access may also eventually serve the westerly properties as well
when development occurs in that area.
The Planning and Public Works Departments have studied the access for this general
area. A 60-foot public street appears reasonable along the south portion of the
property (30 feet from both properties) . Such a street would serve Mr. Wehrman's
property as well as the westerly properties, thereby providing needed circulation
from and to the interior of the "block. "
4. Storm drainage plans may require careful review by the Public Works Department for
conformance to Ordinance No. 3174 and minimizing impact upon adjacent properties.
5. Utilities must be provided to the site by extension of existing facilities in Union
Avenue N.E. or N.E. 4th Street.

RECOMMENDATION:
Based upon the record, testimony, findings and conclusions, it is the Examiner's
recommendation that the City Council approve the rezone to B-1 subject to:
1. Dedication of the south 30 feet and the north 30 feet of the abutting southerly City-
owned property for public right-of-way and construction to city street standards, a
public street thereon.
2. The easterly 30 feet being a landscape buffer of sufficient vegetation so as to
constitute an effective visual screen per approval of the Planning Department. If
the abutting easterly property is reclassified to a use more intensive than single
family, the Planning Department may reduce the dimension of the landscape buffer
commensurate with the intensity of uses contained in the approved reclassification.

Per the discussion during today's public hearings on the above, the
hearings were closed subject to completion of your analysis of the
traffic circulation in the area of properties. Please provide your
recommendation on:

3. The use of the right-of-way adjacent to the cemetery property.
4. The access to Union Avenue N.E.
Since the existing right-of-way adjacent to the cemetery is. in
litigation, I would suggest discussing with the City Attorney any
recommendations pertinent thereto.
Since myy recommendation to the City Council is due June 13, 1978,
please provide me your written analysis and recommendation by
June 8, 1978.

This department concurs with the Public Works Department
in the need for public access into the general area of the
subject rezones . One parcel, the subject of R-165-78, is
totally landlocked at the present time.
Also from a land use intensity standpoint, the existing
extensive amount of B-1 zoning together with the proposed
rezones and 222 unit apartment complex establish a critical
need for suitable public access and circulation into the
area, if proper growth and development of the area is to
proceed. We also point to the Streets.. and Arterials plan,
purposes and obJectives , pages 2 and 3, which clearly
indicate a need for suitable public streets consistent with
land use trends .
Regarding the location of a Street extending south from
NE 4th Street, we are not adverse to an alternate location
being provided. However, it appears that the existing
platted 30 foot right of way along the cemetery boundary,
together with an additional dedication of 30 feet adjacent
to the east of it, is the most appropriate and significantly
established alternative to date. Further dedications will
take place through rezones , site development, and possible
condemnations . We would not object to a street along the
power transmission line easement provided it was dedicated
and developed to suitable city standards .
The matter of access to Union Ave. NE is also important,
particularly with regard to the Wehrman and Stone properties .
However, such access will also provide an important link to
the' overall circulation pattern of the area as it will
eventually connect to the proposed north/south street. It
appears , given the validity of the 10/30/68 letter from the

city clerk to Mr. Wehrman, that a full 60 feet of right of
way (south 30 feet of Wehrman property and north 30 feet of
city property) is possible from Union Ave. to the Stone
property, with the possibility of the north 30 feet of the
Stone property and the south 30 feet of the property to the
north being dedicated and developed as part of rezone and
development of these properties .

There is no doubt that the Stone property does need public access. The use of
the power line is not recommended.
The cemetery right-of-way as you know is in question and if it were to be used
an additional 30 feet would be required from the people in the east. This
would provide access to NE 4th St.
It would be best to acquire the 30' adjacent on the east next to the cemetery.
Thereby providing access to NE 4th St. (SEE ATTACHED MAP) Stone would still
have problems. Perhaps he can acquire the property to the west therby giving
him access to the road along the cemetery.
Proposed 60-foot right-of-way for access from Union Avenue N.E. per letter from
City Clerk, dated October 30, 1968, is acceptable if proper cul-de-sac is

C. PURPOSE OF REQUEST:
To permit rezone of the subject site into an area suitable for future
development of multiple family housing and/or condominiums.
D. HISTORY/BACKGROUND:
The subject site was annexed into the City by Ordinance Number 2249
dated June 22 , 1976 .
E. PHYSICAL BACKGROUND:
1 . Topography: The site is basically level with a very gradual rise
from east to west off Union Avenue Northeast.
2 . Soils: Alderwood gravelly sandy loam (AgC) , runoff is slow to
medium and the erosion hazard is moderate. This soil is used for
timber, pasture, berries , and row crops , and for urban development.

3. Vegetation: The eastern edge of the property is dominated by low
grass and the western portion includes an abundant variety of
evergreens .
4 . Wildlife: The existing vegetation of the site provides suitable
habitat for birds and small mammals .
5 . Water: There is no surface water evident on the site.
6 . Land Use : The site is undeveloped.
F. NEIGHBORHOOD CHARACTERISTICS :
The area is predominantly single family residential in nature.
G. PUBLIC SERVICES :
Water and Sewer: An existing 12" water main is located along Northeast
4th Street and a 16" main extends south on Union Avenue Southeast for
approximately 750 feet. An 8" sanitary sewer is situated on Northeast
4th Street and a similar pipe is located on Union Avenue Southeast
extending south for approximately 450 feet.
Fire Protection: Provided by the Renton Fire Department as per Ordinance
requirements .
Transit: Metro Transit Route 107 operates along Union Avenue Southeast
within 1/4 mile of the subject site .
Schools : The subject site is located .approximately 1/2 mile south of
the Honey Dew Elementary School; approximately 1 1/4 miles southeast of
McKnight Junior High School and 1 mile southwest of Hazen High School .
Parks : Kiwanis Park is approximately 1/2 mile north of the site and
Windsor Hills Park is within 1 mile to the west.

J. IMPACTS ON NATURAL SYSTEMS:
The rezone process will not have any direct impacts. However, resulting development
fran such rezone may disturb existing soil and vegetation, increase storm water run-
off and have an effect on traffic and noise levels in the area. However, these can
be mitigated by proper development controls and procedures.
K. SOCIAL IMPACTS:
Future development subsequent to a rezone will increase population levels and the
related social impacts.
L. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION:
Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended, RCW. 43.21C, a Declaration of non-significance has
been issued for the subject proposal. This declaration is based on provision of
suitable development procedures and standards.

. 0. STAFF ANALYSIS:
1. The proposed rezone is compatible with the Comprehensive Plan, land use map
element, which designates the site and general area •north of the site as
commercial .
2. However, the subject site has only 30 feet of frontage along a public street
(Union Avenue N.E. ) . Access to the site is provided by what appears to be a
strip of land 30 feet wide and 425 feet in length. Sufficient access in the
form of a dedicated and improved public street should be provided to the site
to provide proper access and circulation to the site and surrounding area,
which has the potential for intense multiple and commercial development (arterials
and streets, purposes and objectives, page 2 and 3).
3. The utilities division has indicated that sewer and water line extensions will
be necessary as part of site development.
4. Although the adjacent property to the north and west is zoned B-1, the pattern
of zoning south of Union Avenue N.E. indicates that R-3 zoning has been established
to provide a more suitable land use. transition from commercial to single family
residential uses. (See zoning pattern directly east of the site along the east
site Of Union Avenue N.E. . ) The pattern of development in this area has been
established as multiple family residential (i.e. , proposed 222 unit apartment
complex west of the site and Leisure Estates Mobile Home Park south of the site) .
Therefore, it seems that R-3 zoning may be more appropriate than B-1 for the
subject site.
5. An existing food market is located north of the site. An existing single family
residence is located on the property between the subject site and Union Avenue
N.E. A 222 unit apartment complex is proposed on the property directly west of
the site. A building permit application for the apartment complex has been sub-
mitted and is being reviewed by the various municipal departments.
6. Property owned by the City of Renton and used as a gravel stockpile area is
located south of the subject site.
7. Improvements to the intersection of Union Avenue N.E. and N.E. 4th Street for
more improved turning movement is proposed to be undertaken by the city within
the next one to two years.
8. Although the site is near an arterial intersection and existing B-1 zoning and
uses, access to the site will need to be improved through dedication and develop-
ment of a half street along the southerly property line.
9. The site contains a certain number of evergreen trees. These should be retained
as part of site development.
10. The Comprehensive Plan Land Use Report Objectives 2, 4, and 6 provide for encour-
aging development to its highest and best use while at the same time providing for
"open space, attractiveness, and desirability" in development.through "effective
control of land use". The applicant has indicated that apartments may be con-
structed on the site. R-4 densities may be allowed under the B-1 zone. Develop-
ment of such density should be closely reviewed with respect to open space,
access, circulation, landscaping, and building location and design. Site plan
approval of specific development should be required as part of approval .

P. STAFF RECOMMENDATION:
Recommend approval 'of rezone to R-3 based on the above analysis subject to the .
following conditions to be established as restrictive covenants running with the land:
1. Dedication of the southerly 30 feet of the entire site and improvement of a half
street to city standards as part of future site development.
2. Site development approval. Specific site development plans including site plan,
landscape plan, building elevation design, and parking and circulation shall be
reviewed and approved by the Hearing Examiner.
3. Existing evergreen trees shall be preserved as much as possible and incorporated
into site design, development, and landscape plans. No such trees shall be cut
or removed without approval of the Planning Department. Detailed landscape and
open space plans shall be approved by the Planning Department at the time of site
development review.
4. All utilities shall be provided per Public Works Department approval comprehen-
sive utility plan at the time of site development.

Per the discussion during today's public hearings on the above, the
hearings were closed subject to completion of your analysis of the
traffic circulation in the area of properties. Please provide your
recommendation on:
1. The need for a public right-of-way.
2. The use of the transmission line easement.
3. The use of the right-of-way adjacent to the cemetery property.
4. The access to Union Avenue N.E.
Since the existing right-of-way adjacent to the cemetery is in
litigation, I .would suggest discussing with the City Attorney any
recommendations pertinent thereto.
Since my recommendation to the City Council is due June 13, 1978,
please provide me your written analysis and recommendation by
June 8, 1978.
