AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON,
CHANGING THE ZONING CLASSIFICATION OF CERTAIN
PROPERTIES WITHIN THE CITY OF RENTON FROM
RESIDENCE DISTRICT (R-1) TO RESIDENCE DISTRICT
(R-2)
WHEREAS under Chapter 7, Title IV (Building Regulations)
of Ordinance No. 1628 known as the "Code of General Ordinances
of the City of Renton", as amended, and the maps and reports adopted
in 'conjunction therewith, the property hereinbelow described has
heretofore been zoned as Residence District (R-1) ; and
WHEREAS a .proper petition for change of zone classification
of said property has been filed with the Planning Department on
or about April 24, 1978' which petition was duly referred to the
Hearing Examiner for investigation, study and public hearing, and
a public hearing having been held thereon on or about May 23, 1978,
and said matter having been duly considered by the Hearing Examiner
and said zoning request being in conformity with the City's Comprehensive
Plan, as amended, and the City Council having duly considered all
• matters relevant thereto, and all parties having been heard appearing
in' support thereof or in opposition thereto, NOW THEREFORE
THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO

3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance
has been issued for the subject proposal by Gordon Y. Ericksen, responsible official.
•
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development and no adverse comment was expressed.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The proposal is compatible with the required setbacks, lot coverage and height
requirements of Section 4-712 (L-1) and 4-708 (R-2) of Title IV, Ordinance No. 1628,
Code of General Ordinances. Exhibit #3 indicated that the existing garage may or
may not be nonconforming to the R-2 sideyard setback requirement.
8. Testimony. was not submitted as to whether or not the specific proposal was considered
during any previous area land use or zoning analysis (Section 4-3014 (A) ) .
9. The Comprehensive Plan Land Use Map indicates the site to potentially be Light
Industry (L-1) (Section 4-3014. (B) ) . Duplex use (R-2) is a less intensive land use
than L-1. Adjacent to and surrounding the site is the Renton Senior High School
property and uses.
10. Testimony was not submitted regarding the completion of public and/or private
improvements relative to the area land use or zoning analysis (Section 4-3014. (C) ) .
11. Parking lots for the Renton High School have encompassed the west; south and east
boundaries of the subject site. •
12. On the south side Of Tobin Street South between Lake Avenue South and the high
school, light industry uses do not exist. This portion of the block is predominantly
single family residential interrupted by only the school parking lots.
13. Improvements within the applicant's house have been made per guidance of the Building
Division for conversion to a duplex.
CONCLUSIONS:
1. The proposal conforms to the Comprehensive Plan (Section 4-3014. (B) ) . At this time
light industrial uses are premature for the properties abutting Tobin Street South.
Sufficient land use pressure exists from adjacent school use to justify a
reclassification to duplex (R-2) . This school development may have occurred since
any previous area land use and/or zoning analysis (Section 4-3014. (C) ) .
2. Impacts from conversion of the existing residence to a duplex will be minimal upon
adjacent properties. The impact will probably be less than that of the school
parking lots upon the duplex. Exterior modifications have been slight, if any, to
the house and only additional parking spaces and/or garage structures can be added.
3. A reclassification to R-2 appears to be an appropriate and reasonable response to
the specific circumstances affecting this property.
•
4. The Planning Department should review the garage location relative to the western
property line. Conformance to the R-2 zone setback requirements should then be
resolved by the department.
•
RECOMMENDATION:
Based upon the record, testimony, findings and conclusions, it is the recommendation of
the Examiner that the City Council approve reclassification of the property to, R-2,
subject to resolution of the sideyard setback for the existing garage. •

Examiner conducted a public hearing on the subject as
follows:
The hearing was opened on May 23, 1978 at 10:50 a.m. in the Council Chambers of the
• Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following

R-2 zoning. She reviewed the background of the request for rezone to L-1 which had
conformed. to the zoning designation on the Comprehensive Plan, and advised that the
existing house contains ample square footage and the lot contains adequate parking area
to lend itself successfully to duplex use. She advised that she had coordinated
improvements to the structure with the city's Building Division to conform to
requirements of the Building, Fire, Zoning and other applicable codes of the city.
The Examiner asked for testimony in support of or opposition to the request. There was
no response. , The Examiner asked Mr. Smith for a final recommendation on the matter: Mr.
Smith indicated that the preliminary staff report, Exhibit #1, would remain as submitted.
The Examiner asked for further comments. Since there were none, the hearing on File No.
R-169-78 was closed by the Examiner at 11:05 a.m.

D. HISTORY/BACKGROUND:
The site is one of the older areas of the city. This area was included in the
last major Comprehensive Plan revision in 1971 .

E. PHYSICAL BACKGROUND:
1 . Topography: The site is level .
2. Soils: Urban Land (Ur), erosion hazard is slight to moderate. This soil is
used for urban development.
3. Vegetation: The majority of the site is covered by grass. On the western and
southern portions of the property are found several large alder trees.
4. Wildlife: The existing vegetation of the site provides suitable habitat for
birds and small mammals.
5. Water: There is no surface water evident on the site.
6. Land Use: The land use of the site consists of a single family dwelling.
The site is directly adjacent to the school district `parking lots on the
east and west. The area east of the site is primarily utilized as part
of the high school . There is an existing apartment across from the site
together with existing commercial industrial uses north of Tobin Avenue
South. It is predominantly single family residential .
F. NEIGHBORHOOD CHARACTERISTICS:
The area is primarily single family residential in nature.
G. PUBLIC SERVICES:
1 . Water and Sewer: A twelve inch water main exists along Tobin Street South with a
three inch extending north-south of Shattuck Avenue (north of Tobin) and a six
inch main located on Shattuck (south of Tobin). A twenty four inch sanitary
sewer is situated north-south on Shattuck and an eight inch sanitary sewer extends
along Tobin and west of Shattuck (north-south) on property approximately 70 feet
east of the subject site.
2. Fire Protection: Provided by the Renton Fire Department as per Ordinance requirements.
3. Transit: Metro transit route 142 operates along South 2nd Street within 1/4 mile
south of the subject site and routes 107 and 240 are within one half mile to the
east and west.
4. Schools: The site is located approximately one mile east of the Earlington
Elementary School and immediately north of the Renton Senior High School and
Junior High School .
5. Parks: Jones Park is approximately 1/4 mile east of the subject site and Mothers
Park is 1/2 mile to the northeast. Liberty and Cedar River Parks are slightly
over 1/2 mile to the east.

L. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION:
Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971 , as amended, RCW 43-21C, a Declaration of Non-significance has
been used for the subject proposal .
M. ADDITIONAL INFORMATION:
A vicinity map and site map are attached.

4. City of Renton Utilities Division.

0. STAFF ANALYSIS:
1 . The subject proposal is compatible with the Comprehensive Plan which designates
the site and general area as light industiral .
2. The existing zoning both east and west of the subject site is R-1 single family
residence. However, the property directly adjacent to the site on the east and
is the west is presently being used as a parking lot for the high school . The
property further east is utilized as part of the high school facilities.
Existing single family uses are located further west of the site to Lake Avenue
South. The property along the north side of Tobin Avenue South is a mixture of
single family, apartments and industrial/commercial uses. The zoning pattern
is a mixture of R-1 and L-1 .
3. The applicant proposes to convert the existing house to a duplex. Given the
existing R-1 zoning and mixture of uses in the area, an alternative R-2,
duplex residential zone, may be more appropriate at this time. This has been
previously discussed with the applicant, and she is in agreement. Although
the Comprehensive Plan for the area indicates light industrial uses and the
L-1 zone would correspond, the R-2 zone may be more compatible at this time
with existing uses and the proposed duplex use.
4. Suitable utilities are available to the subject site. Standard charges and
installation requirements will be necessary at the time of any construction.
5. The conversion of the existing single family residence to a duplex will be
subject to Building Code, Fire Code, and Zoning Code requirements.
P. STAFF RECOMMENDATI.ON:
Recommend approval of the R-2 zone based on the above analysis subject to the
requirements of the Building, Fire, Zoning and other applicable codes for any
proposed addition or conversion of the subject site.

Introduction The State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires
_all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals . The Act also requires that an EIS be
prepared for all major.actions significantly affecting the, quality of the environment.
The purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.
