A. SUMMARY OF REQUEST:
Applicant requests the approval of a rezone from R-1, Single Family
Residence District, to L-1, Light Industrial District, to permit devel-
opment of the site for a multi-tenant masonry warehouse.
B. GENERAL INFORMATION:
1. Owner of Record: Mary L. Carpine and John C. Edwards,
guardian
2. Applicant: Cascadia Properties Corporation
3. Location: On Lake Avenue South between South
Victoria Street and South Second Street.
4. Legal Description: A detailed legal description is available
on file in the Renton Planning Department.
5. Size of Property: ±0.48 acre
7. Existing Zoning: R-1, Single Family Residence District
8. Existing Zoning in Area: R-1, Single Family Residence District;
B-1, Business Use; P-1, Public Use.
9. Comprehensive Land Use Plan: Light Industrial
10. Notification: The applicant was notified in writing of
the hearing date. Notice was properly
published in the Record Chronicle and
posted in three places on or near the
site as required by City Ordinance.
C. PURPOSE OF -REQUEST:
The purpose of the request is to establish zoning consistent with a pro-
posed warehouse use and the City's Comprehensive Plan.
D. HISTORY/BACKGROUND:
The subject site was part of the original plat of the City at the time of
incorporation. This area was included in the last major Comprehensive
Plan revision in 1971.
E. PHYSICAL BACKGROUND:
1. Topography: The site is level .
2. Soils: Urban land (Ur); soil that has been modified by disturbance
of the natural layers with additions of fill material several feet
thick to accommodate large industrial and housing installations. The
erosion hazard is slight to moderate.

3. Vegetation: Scrub grass is the dominant feature of the site with
some small shrubs scattered throughout. •
4. Wildlife: Existing vegetation on the site may provide suitable
habitat for birds and small mammals.
• 5. Water: . There is no surface water evident on the site.
6. Land Use: Surrounding properties include reidential , commercial ,
and public uses. To the south and east is the Renton Senior High
School and related open space activity. To the north along Tobin
Avenue South are single family residences, and to the west are re-
tail businesses with some warehousing. .
F. NEIGHBORHOOD CHARACTERISTICS:
The area consists of a varied pattern of residential , commercial , and
public uses. .
G. PUBLIC SERVICES:
1. Water and Sewer: An existing 8-inch watermain is located along Lake
Avenue South and also on South Second Street. In addition, a 12-inch
main exists along South Tobin Street. Approximately 200 feet west of
the intersection of Lake Avenue and Second Street a 6-inch sanitary
sewer extends northerly, and an 8-inch sewer exists along Tobin and
Second Streets.
2. Fire Protection: Provided by the Renton Fire Department as per ordi-
nance requirements.
,3. Transit: METRO Transit Route 107 operates along Rainier Avenue South
within 500 feet to the west of the subject stie and Route 145 runs
along South Second Street within 600 feet to the south.
4. Schools: The subject site is located slightly over 2 mile east of
the Earlington Elementary School , approximately one mile southeast
of the Dimmit Middle School , and adjacent to the Renton Senior High
School .
5. Parks: Jones Park is located within z mile to the east of the subject
site with the Cedar River and Liberty Parks just east of Jones. Mothers'
Park is within 2 mile to the northeast. .

J. IMPACT ON THE NATURAL SYSTEMS:
Rezoning of the site will not have a direct effect on the natural systems. '
However, development of the site for warehousing use will disturb soil and
vegetation, increase storm water runoff, and have an effect on traffic and
noise levels in the area. Much of this impact can be mitigated through
proper development procedures.

L. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION:
Pursuant to the City of Renton's Environmental Ordinance and the State
Environmental Policy Act of 1971, as amended, RCW 43-21C, a declaration
of non-significance has been issued for the subject proposal .
M. ADDITIONAL INFORMATION:
A vicinity map and a site map are attached.
N. AGENCIES/DEPARTMENTS CONTACTED:
1. City of Renton Building Division.
2. City of Renton Engineering Division.
3. City of Renton Traffic Engineering Division.
4. City of Renton Utilities Division.
5. City of Renton Fire Department.
0. PLANNING DEPARTMENT ANALYSIS:
1. The poposed rezone is consistent with the Comprehensive Plan map
element which designates the site and area as light industrial .
2. The proposed rezone to L-1 is consistent with other L-1 zoning and
uses in the general area and existing business zoning west of the
subject site. However, existing R-1 zoning and uses north of the
site should be protected from potential detrimental effects of devel-
opment of the subject site. This will require possible additional
setbacks and landscape buffers on portions of the site adjacent to
such uses and zoning. Comprehensive Plan, Land Use Report, 1965,
Objectives 1 and 4.
3. Comprehensive Plan Land Use Report, 1965, Objectives 3 and 6, address
"opportunities for employment" and "encourage utilization of land to
its highest and best use." The subject site will provide an employ-
ment opportunity in close proximity to residential areas. It is also
located in an area designated as light industry on the Comprehensive
Plan land use element, with existing commercial/warehouse use located
to the west and a transitional area from residential to commercial
and light industry uses located to the north. Therefore, the loca-
tion of the site and surrounding uses have an influence on the appro-
priate present land use for the subject site.
4. Adequate utilities are available in the area. However, certain up-
grading of these utilities may be necessary. (See Utility Division
comments. )
5. A conceptual site plan has been prepared. Although it is not neces-
sary to review specific site plans with a rezone application, several
elements of such plans should be noted:
A. Typical of this type of facility is the need for a front office
in each warehouse unit (five proposed). This will require parking
space at one space per 200 square feet plus the warehouse space
requirement. A reasonable figure for office space is approximately
. 400 square feet or two parking spaces for an office or salesperson
and secretary. More or less may be necessary depending on actual

space provided for each use activity. Such additional parking
may require revisions to the parking layout (possibly one-way
double bank of 45 stalls) and building size and location.
B. A minimum 10-foot landscaped setback should be provided along
the north property line adjacent to the South Victoria alley
(16 feet) .suitable for screening and buffering of existing sin-
gle family residence uses.
C. A minimum 5-foot driveway setback is required by ordinance along
the south property line.
D. Landscaping should be provided in certain areas adjacent to the
building front (west side).
E. Drainage plans per ordinance requirements and utilities plans will
be required at time of building permit application.
F. Additional improvements to Victoria Street alley may be necessary
at time of construction subject to Public Works Department review
and approval .
G. School District open field area is located south and east of the
site and the proposed use will not have a significant effect on
this use. Therefore, it does not appear to be necessary to pro-
vide additional setbacks and landscaping along these boundaries.
H. A detailed landscape plan should be required as part of site de-
velopment review and potential environmental impact mitigation,
subject to Planning Department approval .
P. PLANNING DEPARTMENT RECOMMENDATION:
Recommend approval of the proposed rezone subject to the conditions as
noted in no. 5 above in order to mitigate the impact of the development
of said site on the adjacent single family zoned areas and uses.

C. PURPOSE OF -REQUEST:
The purpose of the request is to establish zoning consistent with a pro-
posed warehouse use and the City's Comprehensive Plan.
D. HISTORY/BACKGROUND:
The subject site was part of the original plat of the City at the time of
incorporation. This area was included in the last major Comprehensive
Plan 'revision in 1971.
E. PHYSICAL BACKGROUND:
1. Topography: The site is level .
2. Soils: Urban land (Ur); soil that has been modified by disturbance
of the natural layers with additions of fill material several feet
thick to accommodate large industrial and housing installations. The
erosion hazard is slight to moderate.

3. Vegetation: Scrub grass is the dominant feature of the site with
some small shrubs scattered throughout.
4. Wildlife: Existing vegetation on the site may provide suitable
habitat for birds and small mammals.
5. Water:. There is no surface water evident on the site.
6. Lard Use: Surrounding properties include reidential , commercial ,
and public uses. To the south and east is the Renton Senior High
School and related open space activity. To the north along Tobin
Avenue South are single family residences, and to the west are re-
tel businesses with some warehousing.
F. NEIGHBORHOOD CHARACTERISTICS:
The area consists of a varied pattern of residential , commercial , and
public uses.
G. PUBLIC SERVICES:
1. Water and Sewer: An existing 8-inch watermain is located along Lake
Avenue South and also on South Second Street. In addition, a 12-inch
main exists along South Tobin Street. Approximately 200 feet west of
the intersection of Lake Avenue and Second Street a 6-inch sanitary
sever extends northerly, and an 8-inch sewer exists along Tobin and
Second Streets.
2. Fire Protection: Provided by the Renton Fire Department as per ordi-
nance requirements.
,3. Transit: METRO Transit Route 107 operates along Rainier Avenue South
within 500 feet to the west of the subject stie and Route 145 runs
along South Second Street within 600 feet to the south.
4. Schools: The subject site is located slightly over 2 mile east of
the Earlington Elementary School , approximately one mile southeast
of the Dimmit Middle School , and adjacent to the Renton Senior High
School .
5. Parks: Jones Park is located within 2 mile to the east of the subject
site with the Cedar River and Liberty Parks just east of Jones. Mothers'
Pak is within 2 mile to the northeast.

0. PLANNING DEPARTMENT ANALYSIS:
1. The poposed rezone is consistent with the Comprehensive Plan map
element which designates the site and area as light industrial .
2. The proposed rezone to L-1 is consistent with other L-1 zoning and
uses in the general area and existing business zoning west of the
subject site. However, existing R-1 zoning and uses north of the
site should be protected from potential detrimental effects of devel-
opment of the subject site. This will require possible additional
setbacks and landscape buffers on portions of the site adjacent to
such uses and zoning. Comprehensive Plan, Land Use Report, 1965,
Objectives 1 and 4.
3. Comprehensive Plan Land Use Report, 1965, Objectives 3 and 6, address
"opportunities for employment" and "encourage utilization of land to
its highest and best use." The subject site will provide an employ-
ment opportunity in close proximity to residential areas. It is also
located in an area designated as light industry on the Comprehensive
Plan land use element, with existing commercial/warehouse use located
tothe west and a transitional area from residential to commercial
and light industry uses located to the north. Therefore, the loca-
tion of the site and surrounding uses have an influence on the appro-
priate present land use for the subject site.
4. Adequate utilities are available in the area. However, certain up-
grading of these utilities may be necessary. (See Utility Division
comments. )
5. A conceptual site plan has been prepared. Although it is not neces-
sary to review specific site plans with a rezone application, several
eleMents of such plans should be noted:
A. Typical of this type of facility is the need for a front office
in each warehouse unit (five proposed). This will require parking
space at one space per 200 square feet plus the warehouse space
requirement. A reasonable figure for office space is approximately
400 square feet or two parking spaces for an office or salesperson
and secretary. More or less may be necessary depending on actual

space provided for each use activity. Such additional parking
may require revisions to the parking layout (possibly one-way
double bank of 45 stalls) and building size and location.
B. A minimum 10-foot landscaped setback should be provided along
the north property line adjacent to the South Victoria alley
(16 feet)..suitable for screening and buffering of existing sin-
gle family residence uses.
C. A minimum 5-foot driveway setback is required by ordinance along
the south property line.
D. Landscaping should be provided in certain areas adjacent to the
building front (west side).
E. Drainage plans per ordinance requirements and utilities plans will
be required at time of building permit application.
F. Additional improvements to Victoria Street alley may be necessary
at time of construction subject to Public Works Department review
and approval .
G. School District open field area is located south and east of the
site and the proposed use will not have a significant effect on
this use. Therefore, it does not appear to be necessary to pro-
vide additional setbacks and landscaping along these boundaries.
H. ' A detailed landscape plan should be required as part of site de-
velopment review and potential environmental impact mitigation,
subject to Planning Department approval .
P. PLANNING DEPARTMENT RECOMMENDATION: .
Recommend approval of the proposed rezone subject to the conditions as
noted in no. 5 above in order to mitigate the impact of the development
of said site on the adjacent single family zoned areas and uses.

and does not apply to any specific development plan . The proposed
request is in accordance with the Comprehensive Plan.

The plan was labeled Exhibit #4 by the Examiner. The Examiner requested testimony in
support or opposition to the request. There was no response. He then requested
clarification from Mr. Smith regarding the status of Victoria Avenue, a 16-foot alley.
Mr. Smith designated the location of Victoria Street, a 16-foot alley located north of
the site and the location of Victoria Avenue South, a vacated street located south of
the subject property. The Examiner inquired regarding the timing of the proposed rezone
in relationship to surrounding uses and zoning in the area. Mr. Smith reported the
department's determination that the request was not premature in the area due to the
location of the site on the periphery of single family residential areas and proximity
to compatible uses along the west side of Lake Avenue South near Tobin Street as well
as along Lake Avenue South and Tobin Street near the southeast corner.
The Examiner requested final comments from the Planning Department. Mr. Smith indicated
that the preliminary report, Exhibit #1, would remain as submitted with additions
previously discussed during testimony.
The Examiner requested further comments. Since there were none, the hearing on File
No. R-208-78 was closed by the Examiner at 9:35 a.m.
FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter,
the Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of a reclassification of approximately one-half acre
from R-1 to L-1.
2. The Planning Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter,
is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report
by reference as set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance
has been issued for the subject proposal by Gordon Y. Ericksen, responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development and no adverse comment was expressed.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available in the area.
7. A conceptual site plan, Exhibit #4, indicated that the proposal is not compatible
with the setback requirements of Section 4-712. (c) . (L-1) of Title IV, Ordinance
No. 1628, Code of General Ordinances. Detailed review of the site plan normally
occurs during the review of the building permit for development, not in this rezone
consideration.
8. The Comprehensive Plan Land Use Map indicates the property to potentially be Light
Industry (Section 4-3014, (B) ) ,
9. In the immediate area the predominant zoning is B-1 west, northwest and southwest
of the site. South of the site is P-1, the secondmost dominant zoning category.
The only nearest I,-1 zoning is at the northwest corner of S. Tobin Street and
Shattuck Avenue S. , approximately 1-1/2 blocks from the subject site. The
orientation of the subject site is to the west, the developed B-1 zoned property,
and, to a lesser degree, the southerly adjacent undeveloped P-1 property owned by
the school district.
CONCLUSIONS:
1. The proposed reclassification to L-1 conforms to the Light Industrial category
shown in the Comprehensive Plan Map. However, the Comprehensive Plan goals and
objectives, which are more detailed than the map, indicate that B-1 would probably
be the most appropriate zoning for the property (Section 4-3014. (B) ) .
A small but established single family area exists along approximately one-half of
the north and south sides of S. Tobin Street between Lake Avenue S. and Logan
Avenue S. These single family residences (R-1 zoning) are experiencing pressure
from all sides by commercial and some multifamily development. The residential
structures are older, and no new home construction is evident.

the Planning Department report, and the report was entered into the record as Exhibit #1.
Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following
additional exhibits into the record:

Exhibit #3: Vicinity Map
Mr. Smith referenced departmental comments received from the Fire Department and
Engineering Division attached to. Exhibit #1 and indicated they would be incorporated in
the Planning Department recommendation. He advised that because of the proximity of
existing single family 'residences in an R-1 zone to the north and east of the subject
site, requirements of the Zoning- Ordinance, Section 4-711.B and C pertaining to height
limit and front and side yard setbacks would apply to the subject application. Mr.
Smith read the referenced sections of the ordinance into the record. He referred to
a conceptual site plan submitted by the applicant, and noted that setbacks required in
site development would include a 20-foot front yard setback along Lake Avenue South,
five-foot side yard along the west, five-foot setback along the south, and no less than
10 feet along the east property lines.
The Examiner indicated that the plan would not be entered into the record until the
applicant had addressed and reviewed it in subsequent testimony. Mr. Smith noted that
all site development and setbacks would be reviewed during building permit processes,
and he subsequently amended the Planning Department Recommendation, Section P. to
include occurrence of actual site plan review and approval upon building permit
application.
The Examiner asked the applicant if he concurred in Exhibit #1. Responding was:

Mr. Wescott indicated his concurrence in Exhibit 41 and reported that the .site plan was
' conceptual in intent and had been submitted with the rezone. request in response to a
Planning Department request. The Examiner indicated that the conceptual site plan would .
be entered into the record with the stipulation that it was subject to subsequent revision.

4. The abutting easterly properties are zoned R-1, requiring much the same buffering
from the recommended B-1 zone. However, these properties are undeveloped; thereby
necessitating less buffer. Under these circumstances it seems appropriate to
require a 20-foot landscape buffer along the eastern property line. This would
adequately protect the R-1 properties (page 17, Objective No. 1, Comprehensive
Plan, Renton Urban Area, July, 1965) and their property values (Ibid, Objective
No. 4) . As recommended in Conclusion No. 2 this buffer should constitute an
effective sight screen which can be approved per the requirements of the Planning
Department. If at some future date the easterly abutting property is reclassified
to a more intensive use, this landscape buffer requirement may be removed.
RECOMMENDATION:
Based upon the record, testimony, findings and conclusions, it is the recommendation of
the Hearing Examiner that the City Council reclassify the subject property to B-1,
subject to attestation in restrictive covenants that the northerly and easterly 20
feet of the property will be used exclusively for a landscape buffer which shall
constitute an effective sight screen per the requirements and approval of the Planning
Department. However, at such time as the easterly abutting property is reclassified
to a more intense use, the landscape buffer requirement along the easterly portion of
the subject property shall become null and void.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must
be filed in writing on or before September 15, 1978. Any aggrieved person feeling that
the decision of the Examiner is based on erroneous procedure, errors of law or fact,
error in judgment, or the discovery of new evidence which could not be reasonably
available at the prior hearing may make a written request for review by the Examiner
within fourteen (14) days from the date of the Examiner's decision. This request shall
set forth the specific errors relied upon by such appellant, and the Examiner may, after

An appeal to the City Council is governed by Title IV, Section 3016, which requires

At the southwestern corner of this area is located the subject property which
apparently has lain undeveloped for some time and is proposed for industrial use.
It appears that industrial use may be an inappropriate land use influence or
encroachment upon the single family residents at this time in the development
of the area (page 4, paragraph 1, The Neighborhood, Comprehensive Plan, Renton
Urban Area, July, 1965, and page 17, Objective No. 1, Comprehensive Plan, Land
Use Report, July, 1965) . Industrial use directly abutting R-1 appears to be
unreasonably close without adequate buffering and transition via less intense
uses. The present development, especially on the south side of S. Tobin Street,
indicates that redevelopment of this neighborhood to commercial or industrial
uses is some years away, and that additional land use pressure from L-1 zoning
may not be appropriate at this time.
Timing of development, although not a consideration specifically contained in
the Comprehensive Plan, is a fundamental land use principle applicable in this
instance (page 9, Summary, Comprehensive Plan, Renton Urban Area, July, 1965,
and page 17, Objective No. 4, Comprehensive Plan, Land Use Report, July, 1965) .
The subject site, the adjacent easterly property and the southerly abutting
school property has remained undeveloped as has the predominant westerly side
of Lake Avenue S. Directly opposite the subject site is a parking lot apparently
serving the northerly retail/warehouse use. Until development of these vacant
properties occurs to more clearly establish the land use pattern and timing
surrounding the subject site, L-1 zoning appears relatively premature.
However, the zoning pattern westerly, southwesterly, and northwesterly of the
property is exclusively B-1. Although the B-1 property southwesterly of the
subject site is not completely developed, it can be reasonably concluded that
the timing of a rezone to B-1 would be more appropriate. With some buffering
along the north side of the property, any negative impacts from development per
B-1 zoning could be mitigated (page 17, Objective No. 1, Comprehensive Plan,
Land Use Report, July, 1965) . Employment opportunities would be close at hand
(Ibid, Objective No. 3) . Effective use of land use principles and protection of
property values of the single family residences would occur (Ibid, Objective No.
4) . This would represent the "highest and best use" of the property while making
a positive contribution to the community (Ibid, page 18, Objective No. 6) .
Another alternative would be multifamily zoning. Multifamily use would be an
appropriate zone abutting the single family residences to accomplish the
traditional graduation of intensity of uses. However, in this instance it is.
clear that the area is gradually over time changing from single family to
commercial uses. In view of this trend it appears most appropriate to avoid
multifamily zoning in favor of commercial (B-1) zoning. Continuing the trend
would be favorable to the interests of the neighborhood and surrounding commercial
properties (Ibid, page 18, Objective No. 6) until such time that L-1 is more timely.
2. Along the northern border of the property is located the 16-foot alley of S.
Victoria Street separating it from the adjacent R-1 zoned property. Both the
L-1 and B-1 zone require a 10-foot building setback along this property line
(Sections 4-711.D and 4-712. (c) ) . The cumulative 26 feet (16-foot alley plus
10-foot setback) would in effect be a buffer between the existing R-1 and
recommended B-1 zone.
The alley, unless it is vacated in order to be used for landscape screening
purposesA:A combination with the 10-foot setback,cannot constitute an effective
buffer/transition between the two zones. Ordinarily these two zones are not
compatible without more extensive transition via at least a landscape buffer.
A reasonable amount of the northerly portion of the property to be dedicated to
a landscape buffer would be 20 feet. The cumulative 36 feet (16-foot alley and
20-foot buffer) would adequately protect the R-1 properties (page 17, Objective
No. 1, Comprehensive Plan, Renton Urban Area, July, 1965) and their property
values (Ibid, Objective No. 4) . This buffer should be an effective sight screen
which can be approved per the requirements of the Planning Department.
3. Development of adjacent property has not significantly impacted the property
sufficiently to facilitate a rezone from R-1 to L-1 (Section 4-3014. (C) ) . As
mentioned in Conclusion No. 1, on the other hand, existing development on B-1
property has impacted the property. But testimony was not provided relative
to the time of the last land use or area zoning analysis or the time of this
B-1 development. . Therefore, the finding of Section 4-3014. (C) cannot be found
in support of B-1 either. However, it is pertinent that immediately southwest
of the property and across Lake Avenue S. recently occurred a rezone from P-1
to B-1 (R-152-78) . , ,

Dear Mr. Beeler:
We are writing in regard to our application for the rezone of the Lake
Street property as contained in your reference file. Your recommendation
is that the site be zoned B-1 with certain restrictive covenants. We
generally agree with your conclusions, but request your reconsideration
of the dedication of the North and East 20 feet of the site "exclusively
fora landscape buffer which will constitute an effective site screen':
The amount of green belt proposed will amount to approximately 25% of
the total land area, not counting the normal front and side yard set-backs.
We agree that the residential properties to the North should be screened,
but if the area continues it's transition to commercial and industrial uses
as the comprehensive plan anticipates, perhaps a well done but narrower
landscape area would suffice.
Our most serious concern, however, is the 20 foot site screen proposed
for the rear property line. While we have no objections to landscaping
requirements for the rear of the site, we are hopefull that they can be
held to 5 feet. In that way, parking and driveways could utilize some
portion of that area. The adjacent property, as you are aware, is used
by the Renton High School as a baseball field. It seems unlikely to us
that it will ever be used for other than school related use. If it were,
it would probably be for commercial or industrial purposes, rather
than for residential use. In consideration of the above, we feel that a
20 foot buffer from the baseball field now, or a commercial, industrial
facility in the future, to be more than needed.
We have included some pictures of the area, suitably labeled, for
your reference.
We respectfully request that you reconsider these 20 foot greenbelt
requirements.

Dear Mr. Wescott:
Upon receipt of your request for reconsideration, dated September 14, 1978,
I have reviewed the record of this application. My conclusion and
recommendation to the City Council is that my previous recommendation, dated
September 1, 1978, should be amended to require only the normal 10-foot
building setback along the easterly property line per Section 4-711.D (B-1) .
The initial recommendation was predicated upon the fact that the abutting
easterly p-operty was zoned R-1. However, further research (Exhibit #2)
confirmed that the School District owns this property and has developed it
for athletic purposes. Therefore, this property should be considered non-
residential and should not require the previously recommended landscape
buffering beyond the normal landscaping required by city ordinances.
Until the northerly abutting properties change zoning or land use, the
previously, recommended landscaping buffer should be maintained. When and
if these changes occur, this requirement for development on your B-1
property could be re-evaluated.
This reconsideration is hereby attached to and amends the recommendation of
September 1, 1978, although restrictive covenants will be required for the
northerly landscape buffer. A fourteen day appeal and/or reconsideration
period, the same as specified in the aforementioned recommendation relative
to Title IV, Sections 3015 and 3016, will conclude on September 29, 1978.

Any violation or breach of these restrictive covenants may result in enforcement
by proper legal procedures in the Superior Court of King County by either the

adversely affected by said breach. Reasonable attorneys' fees incurred during

Please find enclosed original of Ordinance rezoning the above
captioned property. I note in the file that one of the
signaturies to the Restrictive Covenants is Mrs . Mary Carpine .
Mrs . Carpine died sometime ago and if her guardian' s signature
was obtained after her death, then it is invalid and the City
cannot accept that signature on the Restrictive Covenants .
I think the City should make an investigation into the dates
and times of this entire matter to ensure ourselves that the
Restrictive Covenants are legally binding.
If you have any questions in this matter, please feel free to

use of the land hereinabove described with respect to the use by the
undersigned; their successors, heirs and assigns, as follows:

/ The northerly 20 feet of the property will be used exclusively for a
landscape buffer which shall constitute an effective sight screen per the
requirements and approval of the Planning Department.
DURATION
These covenants shall run with the land and expire on December 31, 2025:
If at any time improvements are installed pursuant to these covenants, the
portion of the covenants pertaining to the specific installed improvements
as requiredlby the Ordinances of the City of Renton shall terminate without
necessity of further documentation.
Any violation or breach of these restrictive covenants may result in enforcement
by proper legal .procedures in the Superior Court of King County by either the
City of Renton or any property owners adjoining subject property who are
adversely affected by said ,breach. Reasonable attorneys' fees incurred during
an enforcement proceeding will be borne by the parties whom the court determines
are in errors and shall be entered as a judgment in such action.

CORRESPONDENCE Letter from Albert Talley, Chairperson, Human Rights and Affairs
I Commission, advised research of the Council referral re issue of
Adults Only adult only restrictions for mobile home parks and other rental
living units. The letter reported findings that adult only
restriction is acceptable legally and ethically, there being no
state law prohibiting the restriction and litigation at the Federal
level from other areas has upheld the owner's right to establish
age requirements. The letter further stated the Commissions belief
that it is not ethically wrong to determine occupancy on the basis
of age. MOVED BY STREDICKE, SECOND THORPE, COUNCIL ACCEPT THE
REPORT AND COPY OF THE REPORT BE PROVIDED TO THE LEISURE ESTATES
MOBILE HOME. PARK RESIDENTS WHO HAD EXPRESSED CONCERN OVER REFERRAL.
Councilman Perry requested the City Clerk also provide copy of the

Annexation Councilman Stredicke requested additional information be provided
regarding Cascadia Annexation prior to public meeting scheduled
10/23/78. Councilman Shane called attention to need for fiscal
impact statement as previously used by the city with the Boundary
Review Board which estimated cost to City from various departments
as pertained to. police and fire services, streets, utilities, etc.

Restaurant of Airport restaurant builder and submission of plans for sign at

Damages Claim A claim for damages was filed by Martin J. Rauma, 528 Williams
Ave. S. , for cost of broken windows allegedly caused by Mid
Mountain gas line contractor. Refer to City Attorney and the
Insurance Carrier.
Proclamation Mayor Delaurenti proclaimed Hire a Disabled Veteran Week November
Hire a Disabled 6 through 13, 1978 and recognized the federal program entitled
Veteran Week Disabled Veterans Outreach Program. Council concur.
Revision to Letter from City Clerk Mead requested amendment:to the City Code
Plat Recording for revision of Plat Requirements for Short Subdivisions (9-1105)
Procedure and (9-1106) Tentative, Preliminary and Final Plat Requirements.
The letter explained meeting of various City Department representa-
tives with Mr. Torohoff, King County Records Division, regarding
procedure for filing plat mylars for record and securinqmylar
copies. The amendment would increase the initial plat application
fee by $25.00 to eliminate the time-consuming collection process
when the City pre-pays the recording fee. Refer to Ways and Means
Committee.

Jurisdiction re Letter from Rick Beeler, Hearing Examiner, requested modification
Variances of the City' s existing ordinances to permit the Examiner to hear
and decide upon land use related variances in order to meet the
objectives of the present Hearing Examiner ordinance to provide
"a single, efficient, integrated land use regulator hearing system. "
Hearing Examiner Beeler called attention to City Attorney Warren' s
legal opinion of 10/12/78 regarding this subject. The letter
explained current procedure requires applicants to appear before
both the Examiner and the Board of Adjustment regarding certain
variances, noting the duplicity may cause delay and additional
staff time when hearings could be combined. The letter expressed
the belief that a variance decision could adversely affect a decision
of the Examiner and requested early attention to the matter. MOVED

based on cost of living, failed for lack of a second. Motion by
Shane to place 2% tax on gambling at Longacres, failed for lack

Utilities , Utilities Committee Chairman Shane presented committee report
Committee Report recommending concurrence in Public Works Department report
Ripley Lane accepting the bid of Frank Coluccio Construction Co. for the
Sewer Replacement Ripley Lane replacement sanitary sewer project (S-189) in amount

Development and Letter from Del Bennett, President, Belterra Development Corp. ,
Subdivision Bellevue, explained that since terminating employment with the City
Regulations he has been involved with various governmental jurisdictions in
the development of single-family subdivisions. Mr. Bennett noted

Appreciation Letter from Service Laundry and Dry Cleaners expressed appreciation
of Fire Dept. of the fast action by the Renton Fire Department at the occasion
of a fire at their plant. Mayor Delaurenti asked that copy of the
letter be furnished the Fire Department.
NEW BUSINESS MOVED BY SHANE, SECOND PERRY, FISCAL IMPACT STATEMENTS BE PROVIDED
BY THE ADMINISTRATION FOR EACH PROPOSED ANNEXATION. CARRIED. Coun-
cilwoman Shinpoch noted her similar request a year ago.
