Dear Mr. McCue:
On November 11, 2017 you requested the Comprehensive Plan Land Use Map Amendment and
Concurrent Rezone application for the Kennydale Market be granted a continuance. The City
granted that continuance in order to provide time for the property owner to have a traffic study
completed. As stated in your email,
“Traffic analysis would concentrate in determining impact of proposed rebuilding of the Market
from approximately 2,500 sq. ft. to approximately 4,500 sq. ft., remaining in the original
location, retaining the 8-unit apartment building as it exists behind the Market, and with the
possible addition of 4 units above the Market, according to the new design that was submitted
to the city in October. It is the hope of the owner to address the primary concerns expressed by
the Kennydale Homeowner’s Association of a possible increase in traffic that would be
detrimental. Traffic analysis is also desired in that it will establish more realistic information
about the impact of the desired improvements.”
The City has received a final traffic study from you in which the study analyzed only a
replacement of the existing market within the existing footprint. The project that was analyzed
can be completed with the existing zoning. The Comprehensive Plan Land Use Map Amendment
and Concurrent Rezone applied for is not needed for the development that is analyzed in the
traffic study you submitted.
I have left you a voice mail message enquiring as to what Emanuel IV, LLC intends to do
regarding the application for the Comprehensive Plan Land Use Map Amendment and
Concurrent Rezone. Its current status is that it is held in continuance. If the application is taken
off continuance and brought forward for consideration to the Planning Commission and
Council, staff will recommend denial of the application. The decision on the matter would be
made by the City Council.
Given that the traffic study submitted analyzes a project that does need a rezone, staff believes
that your intent is to withdraw the Comprehensive Plan Land Use Map Amendment and
Concurrent Rezone application.
I sent a letter July 27, 2018 informing you that if we did not receive a request to take the
application off continuance and be advanced for consideration we will consider the application
withdrawn. This letter is the final attempt to contact you in this matter. Unless you email or
send the City a letter requesting the application be taken off continuance and be advanced for
consideration by the Planning Commission, staff will consider the application withdrawn. We
must receive such an email or letter by August 24, 2018.
