CityofRentonDepartmentofCommunity&EconomicDevelopmentAdministrativeVarianceReport&DecisionGRAMMERCYAPARTMENTSSIGNVARIANCELUA15-000281,V-AReportof:July1,2015Page2of8B.PROJECTDESCRIPTION/BACKGROUND:Theapplicantproposesnewwall,freestanding,andway-findingsignsaspartofrebrandingandnewownershipattheGrammercyApartments.Theapplicantisalsoproposingtoremove4non-conformingpermanentfreestandingsignsinthepublicright-of-wayalongPetrovistkyRdSW(Exhibit10).TheapartmentcomplexsiteisboundedbySEPetrovitskyRdtothesouthandCascadeShoppingcentertothenorthandislocatedintheResidentialMulti-FamilyZoneandtheDesignDistrict‘B’overlay(Exhibit3).Theapproximate20-acresiteisacombinationoftwoproperties:PID2823059024andPID2823059026(Exhibit2andExhibit11).Multiplepublicandprivatestreetsprovideaccesstothe27buildingcomplexwith378apartmentunits,accesstoparking,theleasingoffice,andtheresidentcenter.ThetwopublicstreetsthatprovideaccesstothesiteareSEPetrovitskyRdandSE175thSt.Thethreeprivatestreetsthatprovideaccessthroughoutthesiteare119thP1SE,120thLnSE,and120thTerSE.Overheadhigh-voltageelectrictowersdividethesiteeasttowest.Theapplicantisrequestingthat:a)morethan2on-premisesidentifyingsignsbeallowed,andb)thatproposedfreestandingsignsbeallowedcloserthan5feetfromlotlines.BothrequestsrequireavariancefromRMC4-4-100E.4.a.Forapartmentcomplexes,theRentonMunicipalCode(RMC)allowsupto2on-premisesidentifyingsignsofnotover32squarefeetinareaononeface,andthatanyfreestandingsignsshallnothaveaheightgreaterthan6feetaboveanyestablishedgrade,andafreestandingsignshallbenocloserthan5feettoanylotlineperRMC4-4-100E.4.a.Theapplicanthasidentified199signsinthevariancesubmittal.With2permanentfreestandingsignsthatwerealreadyinstalledwithoutapermitalongSE175thSt,thisisatotalof201permanentsigns.Theseare$freestandingsignsalongstreets(Exhibits4and7),2waIlsignsfortheleasingofficeandresidentcenter(Exhibits5),27buildingnumberwallsignsforthemulti-familybuildings(Exhibits6),and164parkingstallnumbers(Exhibit6).Theparkingstallnumbersarelessthan2squarefeetinsizeandareexemptfromsignregulations,perRMC4-4-100B.6.r“SmallParkingandTrafficControlSigns,”asanyparkingandtrafficcontrolsigns2squarefeetorlessonprivatepropertyarenotregulated.Theindividualbuildingnumberwallsignsareneededforaddressingofthebuildingsandidenfiticationforemergencyservices.Forthe2permanentsignsalreadyinstalledalongSE175thSt(Exhibit7),these2signswerenotpartofthewrittenvariancerequestbutwillbeconsideredbystaffaspartoftherequest(Exhibit7).ThereisaseparatesignpermitapplicationattheGrammacyApartmentcomplexfor8permanentdecorativeflagsignsapproximately15feetinheightinthesouthwestcornerofthesitealongPetrovitskyRdSW(Exhibit10).Withouttheindividualbuildingwallsignsandparkingstallnumbers,thereare1$permanentsignsrequestingapprovalsatthesitebetweenthevariancerequest(10)anddecorativeflagsignpermit(8).Intotal,thevariancerequestisapplicableto8on-premisesidentificationsigns(8freestandingsignsand2wallsignsontheresidentcenterandleasingoffice).The8permanentdecorativeflagsarebeingreviewedthroughaseparatesignpermit(Exhibit9).Theapplicantisrequestingavariancetoallow10on-premisesfreestandingidentifyingsignswhichismorethantheallowed2perRMC4-4-100E.4.a.,including2signsalreadyinstalledonscreeningfencesalongSE175thSt(Exhibit7).Allofthesignsare32squarefeetorless.ThreeofthefreestandingsignsarelocatedalongPetrovitskyRdSWandsetbackapproximately25feetfromthebacksideofthesidewalk(Exhibit4).FivefreestandingsignsareproposedalongthenorthsideoftheSE175thStrightof-wayneartheintersectionsof120thLnSEand120thTerSE.AllfreestandingsignsarerequestedatVarianceReportl5-00028.2GrammercyApartments CityofRentonDepartmentofCommunity&EconomicDevelopmentAdministrativeVarianceReport&DecisionGRAMMERCYAPARTMENTSSIGNVARIANCELUAI5-000281,V-AReportof:July1,2015Page4of85.Topography:ThesiteslopesfromnorthtosouthdownwardtowardsSEPetrovitskyRd.6.LotsandBuildingSize:Thesubjectsiteisamulti-familyapartmentcomplexwithapproximately27multi-storyapartmentbuildingswith380unitsonanapproximate20-acrecampuswithmultipleprivatedriveways,aresidentcenter,andaleasingserviceoffice.Combinedtotalbuildingareais352,315squarefeetaccordingtoKingCountyAssessorData(Exhibit11).tE.CONSISTENCYWITHVARIANCECRITERIA:Section4-9-250B.5lists4criteriathatthePlanningDirectorisaskedtoconsider,alongwithallotherrelevantinformation,inmakingadecisiononanAdministrativeVarianceapplication.Theseincludethefollowing:ThePlanningDirectorshallhaveauthoritytograntanadministrativevarianceuponmakingadetermination,inwriting,thattheconditionsspecifiedbelowhavebeenfoundtoexist:a.Thattheapplicantsufferspracticaldifficultiesandunnecessaryhardshipandthevarianceisnecessarybecauseofspecialcircumstancesapplicabletosubjectproperty,includingsize,shape,topography,locationorsurroundingsofthesubjectproperty,andthestrictapplicationoftheZoningCodeisfoundtodeprivesubjectpropertyownerofrightsandprivilegesenjoyedbyotherpropertyownersinthevicinityandunderidenticalzoneclassification:Theapplicantcontendsthatpracticaldifficultiesexistandthatthestrictinterpretationofthesignregulationsfortheapproximate20-acresitecausesconfusionforthepublicandemergencyvehiclesthatenterthepropertyfromthemultipleentrancepointsandhalfdozenpublicandprivatestreetsthatrunthroughtheproperty(Exhibit6).Aspartofsignageimprovements,theapplicantisproposingtoremoveexistingnon-conformingsignslocatedinthepublicright-of-wayalongSEPetrovitskyRd(Exhibit10).Thecodeallowsforupto2on-premisespermanentsignsperRMC4-4-100E.4.aatanapartmentcomplexinaresidentialzone.Thesubjectsiteisnotasmallapartmentcomplexwithoneortwobuildingsbutisalarge20-acrecampuswith27multi-storybuildingsandawideoverheadhighvoltageutilityeasementthatdividesthepropertyeasttowest.Staffhasreviewedtheproposedvariancerequestandconcurswiththeapplicant’sanalysis.Thesizeoftheproposedsignsmeetthestandardof32squarefeetinareaorlessperRMC4-4-100E.4.a.Additionally,allproposedfreestandingsignsare6feetorlessinheightasrequiredperRMC4-4-100E.4.a.ThefreestandingsignsarelocatedascloseaszerosetbackalongPetrovitskyratherthan5feetminimumdistancebecausethereisapproximately25feetofundevelopedright-of-waybetweenthebackofsidewalkandpropertyline,lithestrictcodewereapplied,only2on-premisessignswouldbeallowedonthe20-acresitethathasapproximately6publicandprivatestreets.At2on-premisesidentificationsigns,thismaximumoftwosignswouldnotprovideneededwayfindingforthepublicandemergencyneeds.Allsignswouldhelpprovideclarityandwayfindingincloseproximityofsidewalksandvehiclestravelingthroughthelargesite.Itisanticipatedthattheproposedsignswouldreduceconfusioninthelargeapartmentcomplexsiteandclaritybetweenboundarieswithothermulti-familyresidentialdevelopmentsborderingthesiteoneitherside.b.Thatthegrantingofthevariancewillnotbemateriallydetrimentaltothepublicwelfareorinjurioustothepropertyorimprovementsinthevicinityandzoneinwhichsubjectpropertyissituated:VarianceReportl5-00D281GrammercyApartments CityofRentonDeportmentofCommunity&EconomicDevelopmentAdministrotiveVorionceReport&DecisionGRAMMERCYAPARTMENTSSIGNVARIANCELUAI5-000281,V-AReportof:July1,2015Page5of8Theapplicantcontendsthatthevariancerequestandapprovalwouldallowforwayfindingandeaseoflocationonthesite.Theapplicantalsostatesthatthesignsareofhighqualityandwillbebeneficialtothepublicinbothconvenienceandimprovedpropertyvalues.Staffhasreviewedtheproposedvariancerequestandconcurswiththeapplicant’sanalysis.Thegrantingofthevariancewillnotbemateriallydetrimentaltothepublicwelfareorinjurioustothepropertyorimprovementsinthevicinityandzoneinwhichthesubjectpropertyissituated.Theproposalwouldremovenon-conformingsignsthatarecurrentlyinthepublicright-of-wayalongSEPetrovitskyRd.Thesubjectproposalwouldallowtheremovaloftheexistingsignswithinthepublicright-of-wayandimprovewayfinding.Grantingofthevarianceformorethan2signsonthesitewouldallowforimproveddirectionalsignagewithinthesitealongthepublicandprivatestreetsanddrives.Thegrantingofthevariancetoallowsignsalonglotlinestobecloserthanthe5-footsetback(zerofootsetbacks)isnotanticipatedtocauseanynegativeimpactstoneighboringpropertyownersand/orthepublic.Theproposedreplacementsingswouldbeoutsideofthevisionclearanceareasatentrances(Exhibit4)andwouldbemovedoutsideofthepublicright-of-way.Thereducedsetbackfrom5feetto0feetallowsthesignstobebetween24and27feetfromthebackofthesidewalk.Theproposedlocationofthesignsata0-footsetbackincreasesvisibilityfromthepublicright-of-waywithoutbeinglocatedintheright-of-way.Theresultoftheproposedsignpackagewouldimprovethenon-conformingsituationandmovethecomplex’sfreestandingsignsclosertoconformance.Therefore,staffrecommendsthattherequestsfor$on-premisesfreestandingidentifyingsignsbeallowedandthatthesignsbealloweduptozerosetbackalonglotlinesandpublicrights-of-way.c.Thatapprovalshallnotconstituteagrantofspecialprivilegeinconsistentwiththelimitationuponusesofotherpropertiesinthevicinityandzoneinwhichthesubjectpropertyissituated:Theapplicantcontendsthattheapprovalofthevariancerequestswouldimprovedirectionsthroughoutthelargesiteforboththepublicandemergencyservices.Duetothelargesitehavingmultipleentrypoints,andhavingmultiplepublicandprivatestreetsbisectingthecampus,thereisaneedforimprovedsignagethroughoutthesite.Thesiteneedsmorethanthe2permanentsignsallowedthroughCitycode.AllproposedsignsareidentifiedinExhibits4-9.Thesignswouldbeforlocatingtheleasingandresidentcenters,apartmentbuildings,parkingstalls,andidentificationofthecomplexwithcontactinformation.Staffhasreviewedtheapplicant’sjustificationsandconcursthattheapprovalofthevarianceformorethan2permanentsignsandoneofthepermanentsignstobelessthan5-feetfromthepropertylineswouldimprovewayfindingthroughthesiteforresidents,thepublic,andemergencyservices.Inaddition,thegrantingofthisvariancewouldnotconstituteagrantofspecialprivilege,asthesignpackagewouldbringthesiteclosertoconformancewithRentonMunicipalCodethanitistoday.d.ThattheapprovalasdeterminedbythePlanningDirectorisaminimumvariancethatwillaccomplishthedesiredpurpose:TheapplicantisproposingtoreducethesignsonPetrovitskybyone,toultimatelyhave3onpremisesfreestandingidentifyingsignsalongPetrovitskyand5alongtheinternalpublicroadSE175thSt.TherearetwoprivatestreetsconnectingtoPetrovitsky,wheretherearetwofreestandingsignsneareachentryandoneprimarysitesigninthemiddleofthetwostreets.Furtherintothesite,wheretherearemultipleintersectionsnearon-streetparkingareas,andwherewayfindingisVorionceReportl5-000281GrommercyAportments CityofRentonDepartmentofCommunity&EconomicDevelopmentAdministrativeVarianceReport&DecisionGRAMMERCYAPARTMENTSSIGNVARIANCELUAI5-000281,V-AReportof:July1,2015Page6018needed,thefreestandingsignsontheproposed6-foothighfencesectionsincludingwayfindingsignsandasitemap,areneededtoprovideakeypointnearthemiddleofthesitewherethepublicandothersitevisitorscandeterminehowtogettothemanagementandleasingoffice,theresidentcenter,internalstreets,andtheother27apartmentbuildingsonthesite.Staffhasreviewedtheproposedvariancerequestandconcurswiththeapplicant’sanalysis,thattherequestfor$newsignsandassociatedreducedsetbacksistheminimumvariancenecessarytoeffectivelyfacilitatewayfindingonthesiteforbothresidences,visitors,andemergencyservices.Althoughnotpartofthevariancerequest,theapartmentcomplexownershiphasappliedfordecorativeflagsinthesouthwestportionofthesite.ThedecorativeflagswouldbeallowedbyRMC4-4-100E.4.a.i“DecorativeFlags”.Therearepreviouslyinstalledcementfootingsneatthedecorativeflagproposalwithintheright-of-way.Therefore,toremovethenon-conformingflagfootingsintheright-of-way,staffrecommendsthatallsignfootingsintheright-of-wayalongtheborderofthecomplexberemovedbytheapplicant,priortoinstallationofanysignapprovedthroughthisapplication.Atminimum,grassshallbeaddedwhereremovalofthefootingsoccurs.F.CONCLUSIONS:1.ThesubjectsiteislocatedonthenorthsideofSEPetrovitskyRd,at3750EValleyRoad,withintheResidentialMulti-Family(RMF)ZoneandDesignDistrictB.2.ThesignregulationsofRMC4-4-100E.4.alimitpermanentsignsto2on-premisesidentifyingsignsnotover32squarefeetinareaontheface,wherefreestandingsignsshallnothaveaheightgreaterthan6feetandshallnotbelocatedcloserthan5feettoanylotline.Theapplicantrequeststhatatotalof$permanentfreestandingidentifyingsignsbeallowed,beascloseaszerosetbackfrompropertylines,andallowthree6-foottallfencesectionswithsignsneartheintersectionofSEl75120thLnSE.Allareproposedon-premisesidentifyingsignsarelessthan32squarefeetinsizeand6-feetorlessinheight.3.TherequestedvariancemeetsthefourcriteriatobeconsideredinmakingadecisiononavariancerequestasspecifiedinRMC4-9-250B.5.TheanalysisoftheproposalaccordingtovariancecriteriaisfoundinthebodyoftheStaffReportaslongastheexistingfourfreestandingsignsinthePetrovitskyright-of-wayareremovedandaslongasthepipeandconcretefootingsforpolesignsinthePetrovitskyright-of-wayareremovedpriortoinstallationofanynewsignsapprovedthroughthisvariance.G.DECISION:TheAdministrativeVariancefortheGrammacyApartmentsSignVariance,FileNo.LUA15-0002$1,isapprovedsubjecttothefollowingconditions:1.TheapplicantshallremovethefourexistingpermanentfreestandingsignswithintheSEPetrovitskyRdright-of-wayandaddlandscapingtoreplacethelocationoftheexistingsignswithlandscapingsimilartowhatexists.AlandscapeplanshowinglandscapingforthenewsignsandtherestorationlandscapingfortheremovedsitesshallbesubmittedtotheCurrentPlanningProjectManagerforreviewandapprovalpriortosignpermitissuance.VarianceReportl5-000281GrommercyApartments
