CityofRentonDepartmentofCommunity&EconomicDevelopmentCertificateofExemptionfromShorelineSubstantialDevelopment4267WilliomsShorelineExemption—ReplantingofVegetationConsrvationBufferLUA1S-000528,SMEDATEOFPERMIT:July28,2015Page2of3WATERBODY/WETLAND:LakeWashington,ReachCWorkwithinavegetationconservationbufferalongLakeWashingtonrequiresreviewoftheShorelineMasterProgram(SMP)andthatproposedprojectsareincompliancewithRMC4-3-090F.1“VegetationConservation”.TheexistingvegetationconservationbufferwasestablishedforBarbeeMillsubdivisionasa35-footshorelineplantedbuffetwithina50-footmanagedbuffetasidentifiedonthesubdivision’splantingplan(Exhibit4).Bufferenhancement,perRMC4-3-090F.1.g,asaseparateactionmaybeproposedonanypropertyandmaybeimplementedwithoutfullcomplianceoftheSMP“VegetationConservation”subsection;provided,thattheprojectincludesabufferenhancementplanusingnativevegetationandprovidesdocumentationthattheenhancedbufferareawillmaintainorimprovethefunctionalattributesofthebuffer.Anychangetoexistingnonconformingfacilitiesoruseonasiteshallmeettheprovisionsfornonconformingsites.StaffResponse:Theproposalisareplantingandmaintenanceofthe35-footvegetationconservationbufferonthesubjectpropertywherepreviouslyplantedvegetationhasdiedorisdecaying.Theproposalisanticipatedtoimprovethefuncitonalattributesofthebufferareastheplantstobeplantedinthebufferareaarefromthepreviouslyapprovedvegetationandplatplantingplans.Therearenononconformingfacilitiesintheproposedworkarea.AnexemptionfromaShorelineManagementSubstantialDevelopmentPermitisherebygrantedontheproposedprojectinaccordancewithRMC4-9-190C.3ExemptionsfromPermitSystemgrantedforthefollowingreason(s):Subsection3:MaintenanceandRepair:Normalmaintenanceorrepairofexistingstructuresordevelopments,includingdamagebyaccident,fireorelements:a.‘‘Normalmaintenance”includesthoseusualactstopreventadecline,lapse,orcessationfromalawfullyestablishedcondition.b.“Normalrepair”meanstorestoreadevelopmenttoastatecomparabletoitsoriginalcondition,includingbutnotlimitedtoitssize,shape,configuration,locationandexternalappearance,withinareasonableperiodafterdecayorpartialdestruction,exceptwhererepaircausessubstantialadverseeffectstotheshorelineresourceorenvironment.c.Replacementofastructureordevelopmentmaybeauthorizedasrepairwheresuchreplacementisthecommonmethodofrepairforthetypeofstructureordevelopmentandthereplacementstructureordevelopmentiscomparabletotheoriginalstructureordevelopmentincluding,butnotlimitedto,itssize,shape,configuration,locationand
