November13,2015Page3of7FINDINGSOFFACT(FOF):ThePlanningDivisionoftheCityofRentonacceptedtheabovemasterapplicationforreviewonOctober13,20ThanddeterminedtheapplicationcompleteonOctober14,2015.Theprojectcomplieswiththe120-dayreviewperiod.2.Theprojectislocatedat737LoganAve.N,attheBoeingRentonManufacturingPlan.MorespecificallyApronDwithintheManufacturingPlanCampus.3.Theprojectsiteiscurrentlydevelopedwith10737Aircraftspaces,includingutilityinfrastructureandblastfences.4.ThepropertyislocatedwithintheCommercialMixedUseComprehensivePlanlandusedesignation;howevertheprojectisvestedtoEmploymentAreaIndustrial.5.ThesiteislocatedwithintheUrbanCenter(UC)zoningclassification;howevertheprojectisvestedtoHeavyIndustrialzoning.6.Thereiscurrentlynovegetationontheprojectsite,ApronDisdevelopedwith100%impervioussurface.7.ThesiteislocatedeastoftheCedarRiver,aShorelineoftheState,locatedinCedarRiverReachA,designatedShorelineHighIntensity.TheapplicanthasrequestedaShorelineExemptionformaintenanceandrepairofthereplacedutilitiesandtherelocationoftheblastfence.8.Theproposedblastfencewouldberelocated17feetsouth,tobeplaced5feetfromthesouthpropertyline.Theblastfenceis70feetlongby10feetinheight,witha1,130SFfoundation.9.TheapplicantisproposingtobeginconstructioninDecemberof2015andendinNovemberof2016.10.Staffreceivedonecommentletter(Exhibit8),fromtheRentonSchoolDistrict.ThecommentletterstatedthattheSchoolDistricthadnoobjectionstotheproposedvariance.11.Representativesfromvariouscitydepartmentshavereviewedtheapplicationmaterialstoidentifyandaddressissuesraisedbytheproposeddevelopment.Thesecommentsarecontainedintheofficialfile,andtheessencesofthecommentshavebeenincorporatedintotheappropriatesectionsofthisreport,andtheDepartmentalRecommendationattheendofthisreport.12.ConsistencyWithVarianceCriteria:Section4-9-2505.5“DecisionCriteria”lists4criteriathatthePlanningDirectorisaskedtoconsider,alongwithallotherrelevantinformation,inmakingadecisiononanAdministrativeVarianceapplication.TheapplicanthasrequestedasideyardsetbackvariancefromRMC4-2-130Atoallowa5footsetbackforablastfenceinsteadoftherequired20footsetback.Staffrecommendsapprovalofthesetbackvariance.ComplianceThePlanningDirectorshallhaveauthoritytograntanadministrativevarianceuponmakingadetermination,inwriting,thattheconditionsspecifiedbelowhavebeenfoundtoexist:a.Thattheapplicantsuffersunduehardshipandthevarianceisnecessarybecauseofspecialcircumstancesapplicabletosubjectproperty,includingsize,shape,topography,locationorsurroundingsofthesubjectproperty,andthestrictapplicationoftheZoningCodeisfoundtodeprivesubjectpropertyownerof“rightsandprivilegesenjoyedbyotherpropertyownersinthevicinityandunderidenticalzoneclassification;TheapplicantcontendsthatthestrictapplicationoftheZoningCodewoulddeprivethepropertyownersubstantialuseofthesouthwestcornerofthemanufacturingfacility.ThisisprimarilyduetotheorientationoftheadjacentCedarRiverandthelocationandCityofRentonDepartmentofCommunity&EconomicDevelopmentRENTONAPRONDUTILITIESDAdministrativeVarianceReport&DecisionLUAIS-000749ApronDVariance15-000749
CityofRentonDepartmentofCommunity&EconomicDevelopmentAdministrativeVarianceReport&DecisionRENTONAPRONDUTILITIES0LUAIS-000749November13,2015Page4of7orientationoftheexistingaccessbridgeconnectingApronDtotheRentonMunicipalAirport.ThesoutheasterlycornerofApronDdoesnotprovidethespaceneededinitscurrentconfigurationtoperformthenecessarymanufacturingactivitiestoaccommodatea737-900aircraft.IfthesoutheasterlycornercannotbeusedthepropertyownerwouldberequiredtofullyrelocatetheApron0activitiestoanotherpieceofpropertyresultinginsubstantialchangestotheexistingmanufacturingplant.StaffConcurswiththeapplicant,thestrictapplicationofthe20footsetbackwoulddeprivethepropertyownerofsubstantialuseofthesouthwestcornerofthemanufacturingfacility.Completeredesignofthemanufacturingplanttoaccommodateoneaircraftpositionwouldresultinanunduehardshipfortheapplicant.Thesespecialcircumstances,thatareapplicabletothesubjectproperty,createdbytheexistingconfigurationofbridge,alongwithminimalnecessaryspacingforaircraftmovementsresultintheneedforasetbackreductionto5feet.Thestrictapplicationofthe20footsetbackwoulddeprivethepropertyownerofrightsandprivilegesenjoyedbyother__

___manufacturingpropertyownersinthevicinityandunderthelHzoningclassification.b.Thatthegrantingofthevariancewillnotbemateriallydetrimentaltothepublicwelfareorinjurioustothepropertyorimprovementsinthevicinityandzoneinwhichsubjectpropertyissituated;Theapplicantcontendsthatthegrantingofthevariancewouldnotchangetheuseoractivitiesatthesiteandthereforethesetbackreductionwouldnotbedetrimentaltothepublicwelfareorinjurioustotheadjacentproperty.Additionally,theblastfenceand737aircraftstallisanexistingcondition,assuchtherewouldbenooperationalchanges,simplyarelocationoftheblastfencesetbacktoaccommodatea737-900aircraft.Currently,theBoeingCompanycoordinatesenginerunupoperationsuchthattheoperationsdonottakeplaceduringtheuseofthefield.Thisprotocolwouldnotchangeasaresultofthevariance.Staffconcurswiththeapplicantthatthegrantingofthevariancewouldnotbemateriallydetrimentaltothepublicwelfareorinjurioustothepropertyinthevicinity.ThesoutheasterlycornerofApronDabutstheRentonMemorialStadium.ThisstadiumisusedbytheRentonSchoolDistrictforathleticeventssuchasfootball,trackandfield,andspecialevents.Theprimaryuseofthestadiumislocatedwithinthestadiumitselfapproximately180feetfromthepropertylineandbufferedfromApron0bystadiumseating.TheRentonSchoolDistricthasindicatedinaresponsethattheyhavenoobjectionstotheproposedsetbackreduction(Exhibit7).TheprimaryeventthattakesplaceoutsidethestadiumalongthesubjectpropertylineistheJavelincompetition.However,basedonBoeingscoordinationwithschooleventsandenginerunupscoupledwiththeSchoolDistrictsresponse,staffbelievesthatthesetbackvariancewouldnotresultindetrimentalimpactstothepublicwelfare.c.Thatapprovalshallnotconstituteagrantofspecialprivilegeinconsistentwiththelimitationuponusesofotherpropertiesinthevicinityandzoneinwhichthesubjectpropertyissituated;andTheapplicantcontendsthatthelocationoftheblastfenceat5feetwouldnotVconstituteagrantofspecialprivilegebecausethefenceisascreeningandprotectionfencingfortheadjacentpropertyownersfromtheenginerunmanufacturingactivatesthatareongoingattheplatsite.StaffConcurswiththeapplicantthatthereductionofthesetbackto5feetwouldnotconstituteagrantofspecialprivilegeinconsistentwithlimitationplaceduponother___

CityofRentonDepartmentofCommunity&EconomicDevelopmentAdministrativeVarianceReport&DecisionRENTONAPRONDUTILITIESDLUA5-000749November13,2015Page5of7anduniquesafetystandardsbasedupontheiroperations.ItisnecessaryfortheBoeingmanufacturingfacilitytoprovideforpublicsafetybytheinstallationoftheblastfencebehindanaircrafttestingstall.U.Thattheapprovalisaminimumvariancethatwillaccomplishthedesiredpurpose.TheapplicantcontendsthatthelocationoftheexistingbridgecrossingtheCedarRiverreducestheuseofthesoutheasterlycornerofthepropertyresultinginthelossofthiscornerfor737-900aircraftparking.StaffConcurswiththeapplicantthatthereductionofthesideyardsetbackto5feetistheminimumnecessarytoaccommodatethe737-900aircraftpositionandnecessarymovementstoaccessthesouthBoeingbridgecrossingtotheRentonMunicipalAirport.Seeadditionalanalysisaboveundercriteriona.13.ConsistencyWithVarianceCriteria:Section4-9-250B.5“DecisionCriteria”lists4criteriathatthePlanningDirectorisaskedtoconsider,alongwithallotherrelevantinformation,inmakingadecisiononanAdministrativeVarianceapplication.TheapplicanthasrequestedalandscapebuffervariancefromRMC4-2-130Atonotinstalllandscapingalongthesouthpropertyline.Staffrecommendsapprovalofthelandscapebuffervariance.ComplianceThePlanningDirectorshallhaveauthoritytograntanadministrativevarianceuponmakingadetermination,inwriting,thattheconditionsspecifiedbelowhavebeenfoundtoexist:e.Thattheapplicantsuffersunduehardshipandthevarianceisnecessarybecauseofspecialcircumstancesapplicabletosubjectproperty,includingsize,shape,topography,locationorsurroundingsofthesubjectproperty,andthestrictapplicationoftheZoningCodeisfoundtodeprivesubjectpropertyownerofrightsandprivilegesenjoyedbyotherpropertyownersinthevicinityandunderidenticalzoneclassification;TheapplicantcontendsthattheysufferunduehardshipandthevarianceisnecessarybecauseofFederalAviationAdministration(FAA)regulationsandexistingoperationsatthesite.Thecurrentconditionalongthesouthpropertylineispavedandwithoutscreeningvegetation.BecausetheoperationsinthisareaofApronDarewithinanAirOperationArea(AOA)BoeingfollowstheFAAcriteriaforminimizingForeignObjectDebris(FOD).SpecificallyintheapronareasforBoeingpropertiesthatconductaircraftoperations,theAdvisoryCircularAC150/5210-24AirportForeignObjectDebris(FOD)Managementisfollowed.Thisdocumentprovidesdirectiononprevention,detection,removal,andevaluation.TheapplicationofFODinareaswereaircraftoperationsareconductedisconstantwithotheradjacentaircraftfacilitiesandisincompliancewithfederalguidelinesadheredtonationwideforsimilarfacilities.StaffconcursthattheapplicantsuffersunduehardshipasthestrictapplicationofthezoningcodewouldbeinconflictwiththefederalFODregulations.Furthermore,AC150/5210-24states“thepresenceofFODonanairport’sairoperationsarea(AOA)posesasignificantthreattothesafetyofairtravel.FODhasthepotentialtodamageaircraftduringcriticalphasesofliftoffwhichcanleadtocatastrophiclossoflifeandairframe,andattheveryleastincreasemaintenanceandoperationscosts.Vf.ThatthegrantingofthevariancewillnotbemateriallydetrimentaltothepublicwelfareorinjurioustothepropertyorimprovementsinthevicinityandzoneinApron0Variance15-000749
