Hi Phil,
I don’t know because of Covid and shortage of staff, mails are from City always sent a week late. It
gave me shorter time to respond. However, I always managed to send my response before the due
date.
On the first Finding of Violation on March 01, 2022, I mailed out my appeal letter on the 12th. I didn’t
see any response to that letter. About 2 weeks later, I received a second Finding of Violation with
higher fine and including the appeal letter. Again, I sent out the appeal letter on the 24th. Because
there is no contact on the appeal to check for process so couple days later, I called Jason Churchill
and left messages twice but I didn’t receive a call back.
I don’t think my appeal untimely. Please understand that and help me resolve this issue.

I serve as the hearing examiner assigned to adjudicate your appeal of Finding of Violation CODE21-
000580. Per the email from Ms. Locher below, the City is seeking dismissal of your appeal on the
basis that it is untimely. If you would like to file a response to the City's argument, please do so by
email by 5 pm, April 8, 2022 to all the parties to this email. The City will have a right to email a
response to all parties by 5 pm, April 13, 2022. Please be advised that your response should be
limited to the issue of whether your appeal was untimely. The merits of your appeal at this time are
not relevant to the City's motion to dismiss and will not be addressed in the consideration of the
motion.
