The Grantor Patrick Blodgett, for and in consideration of mutual benefits,the receipt of which is hereby acknowledged, does by these presents,grants, bargains, sells, conveys and warrants unto the Grantee, City of Renton, a Washington municipal corporation ("Grantee"), its successors, assigns and permitees, an easement for public road and public utilities purposes,including but not limited to water, sewer,storm water, electric,gas and telecommunications,together with all necessary incidental appurtenances thereto in,over, under, across and upon the parcel of land herein described (the "Easement Area") including but not limited to the right to enter upon the property herein described for construction, maintenance and repair of such public road or public utilities. The public road shall be maintained by the grantee and kept as safe as possible for public travel, grantee shall also maintain the storm water drainage system and catch basins within this easement agreement. � Page 1 of4 t.�, Grantor shall retain the right to use the surface of the "Easement Area" as long as such use does not interfere with the easement rights granted to the Grantee. Grantor shall not, however, have the right to: i. Erect or maintain any buildings or structures within the Easement Area;or ii. Plant trees, shrubs or vegetation having deep root patterns which may cause damage to or interfere with the public road or public utilities to be placed within the Easement Area by the Grantee; or iii. Dig,tunnel or perform other forms of construction activities on the property which would disturb the compaction or unearth Grantee's public road or public utilities, or endanger the lateral support facilities;or v. Blast within fifteen (15)feet of the Easement Area;or vi. Erect fences in such a way as to prevent access by the Grantee's vehicles to the Grantee's public road or public utilities. The rights contained within this easement shall run with the land and inure to, and be for the benefit of, Grantor and Grantee, their successors and assigns. Grantor covenants that it is the lawful owner of the property and that it has a good and lawful right to execute this easement.
