drainage facilities shal! be maintained in cornpliance with the aperatian and maintenance
schedule included and attached herein as Exhibit B--Qperatians and Mairrtenance, Drainage
fatiiities inckude pipes, channels, flow controi facilities, water quality facilities, on-site best
management practices (BMPs) and other engineered structures designed ta manage and/or

bioretention, permeable pavements, rainwater harvesting systerns, tree retention credit,
reduced impervious surface iootp�int, vegetaterf roofs and other measures designed to mimic
p�e-developed hydralogy and rninimize stnrmwater runoff on the Property.
2. City of Renton shall have the right ta ingress and egress over those portions of the Praperty
necessar�e ta perforrn inspections of the storrnwater facilities and BMPs and co�duct
maintenance activities specified in this Declaration of Covena�t and in accardance with the
Renton Municipal Code. City af Rentan shall provide at Jeast thirty(30} days' written notice to
the Owners that entry on the Rroperty is planned for the inspection of dra�nage facilities. Aher
the thiriy (30) days,the Owners shall allow the�ity af Renton to enter for the sole purpt�se c►f
inspectsng drainage facilities. In lieu of inspection by the City, the Owners may elect to engage
a licensed civiJ engineer registered in the state of Washington who has expertise in drainage to
inspect the drainage facilities and ptavide a wntten report descr�bing their condEtion. !f the
e�gineer option is chosen,the Owners shall provide written natice to the City of Rentan within
fifteen (15)days of receiving the Cit�s notice of inspection.Within thirty(30}days of giving this
notice,the C?wners,o�engineer on behalf of the Qwners,shafl provide the engineer's repart ta
the City of Renton. If the report is r�ot pravided in a timely manner as specified above, the City
of Renton may inspect the drainage facilities without further notice.
3. tf City of Rentan determines frarn its inspection, ar from an engineer's repart provided in
accordance with Paragraph 2,that maintenance, repair, restaration, and/or mitigatian work is
requi�ed to be dane to any of the drainage facilities,City af Rentvn shall not�fy the Qwners of
the specific maintenance, repair, resto�atian, anr}/or mitigatian wark ("Work"} required
pursuant to the Rentan Municipal Code.The City shall aiso set a reasonable deadline for the
Owners co complete the Work, or to pravide an engineer's report that verifies cornpletian af
the Work. After the deadline has passed,the C3wners shall allaw the City access ta re-inspect
the d�ainage faciEities unless an engineer's report has been provided verifying completion of
the Work, �f the Wark is not cornpleted within the tirne frame set by the City, the City may
inftiate an enforcement action and/or perform the Work and hereby is given access to tF�e
Property for such purposes, Written notice will be sent to the Owners stating the City"s
interstian ta perform such Wbrk.7�his Work wil!not carnrnence until at least se�en(7)days after
such notice is mailed. If, within the sole discretion af the City, there exists an imrninent csr
present danger, the sev�n (7} day notice period wilE be waiued and Work will begin
immediately.
4. The Owners shall assume all respansibitity fc,r the east af any Work,or any measures takeri by
the City ta address conditions as descri�aed in Paragraph 3. Such responsibility shall include
reimbursernent tv the City within t�irty(3p)days of the receipt of the invoice for any such Work
performed. Overdue payments wifl require payrne�t of interest at the maxirnum legal �ate
allowed by RCW 19.52.020(currently twelve percent(12%)). If the Gity initiates {egal actian to
enforee this agreement, the prevailing party in such action is entitled to reco�er reasonable
litigation costs and attomey's fees.
5. Tt�e C)wners are required ta obtain written appraval fram City of Renton prior to fiUing, piping,
cutting, or rernoving vegetation (excepf in routine landscape maintenance) in open vegetate�5
stormwater facilities (such as swales, channels, ditches, ponds, etc.y, or p��orrning any
alteratlons or mocfificatiens to the drainage facilities referenced in this Declaration of Cuvenant.

6. Any notice o�cansent required to be given or otherwise provided far by�the provisions of ihis
Agreeme�t shall be effective upan persanal delivery,or threQ(3)days after mailing by Certified
Mail, return reteipt requested.
7• With�egard ta the matters addressed herein,this agreement constitutes the entire agreemer�t
between the parties, and supersedes al! prior discussions, negotiations, and al! agreements
whatsoever whether oral or written.
8. This Declaration of Cavenant is intended ta protect the value and desirabiliiy and promote
efficient and effettive management of surface water drainage of the real property described
above, and shall inure ta the benefit of aU the cit'tzens of the City of Renton and ics successors
anci assigns. This Declaratian af Covenant shall run uvith the land and be binding upon
Grantor(s}, end Grantor's�s'j successars in interest,and assigns.
9. This [}eclaration of Covenant may he terminated by execution of a written agreement by ihe
Owners and the City that is recarcfed by King County in its real property recards.

MAINTENANCE INSTRUCTIONS FOR FULL INFILTRATION
Your property contains a stormwater management flow control BMP (best management practice) called
'full infiltratioiT,"which was installed to mitigate the stormwater quantity and quality impacts of some or
all of the impervious surfaces on your property.
Full infiltration is a method of soaking runoff from impervious area (such as paved areas and roofs) into the
ground. If properly installed and maintained, full infiltration can manage n.inoff so that a majority of
precipitation events are absorbed. In�ltration devices, such as gravel filled trenches, diywells, and ground
surface depressions, facilitate this process by putting runoff in direct contact with the soil and holding the
runoff long enough to soak most of it into the ground. To be successful, the soil condition around the
in�ltration device must be reliably able to soak water into the ground for a reasonable number of years.
In�ltration Devices
The infiltration devices used on your property include the following as indicated on the flow
control BMP site plan (CHECK THE BOX(ES)THAT APPLY):
❑ gravel filled trenches, Odrywells, ❑ground surface depressions.
MAINTENANCE RESTRICTIONS
The size,placement, and composition of these devices as depicted by the flow conhol BMP site plan and
design details must be maintained and may not be changed without written approval either from the King
County Water and Land Resources Division or through a future development permit from King County.
INSPECTION FREQUENCY AND MAINTENANCE GUIDELINES
To be successful,the soil condition around the infiltration device must be reliably able to soak water into
the ground for a reasonable number of years.
• Infiltration devices must be inspected annually and after major storm events to identify and repair
any physical defects.
• Maintenance and operation of the system should focus on ensuring the system's viability by
preventing sediment-laden flows from entering the device. Excessive sedimentation will result in a
plugged or non-functioning facility.
• If the infiltration device has a catch basin, sediment accumulation must be removed on a yearly
basis or more frequently if necessary.
• Prolonged ponding around or atop a device may indicate a phigged facility. If the device becomes
plugged, it must be replaced.
• Keeping the areas that drain to infiltration devices well swept and clean will enhance the longevity
of these devices.
• For roofs, frequent cleaning of gutters will reduce sediment loads to these devices.
RECORDING REQUIREMENT
These fiill in�ltration flow control BMP maintenance and operation instructions must be recorded as an
attachment to the required declaration of covenant and grant of easement per Requirement 3 of Section
C.13.4 of the King County Surface Water Design Manual. The intent of these instructions is to explain to
fiiture property owners, the purpose of the BMP and how it must be maintained and operated. These
insh�uctions are intended to be a minimum; the King County Department of Pennitting and Environmental
Services (DPER)may require additional instructions based on site-specific conditions. See King County's
Surface Water Design Manual website for additional information and updates.
