HomeMy WebLinkAboutORD 6061CITY OF RENTON, WASHINGTON ORDINANCE NO. 6061 AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, DECLARING A MORATORIUM ON LAND USE, BUILDING PERMIT, AND BUSINESS LICENSE APPLICATIONS FOR BATTERY ENERGY STORAGE SYSTEMS; SETTING FORTH FINDINGS OF FACT IN SUPPORT OF SAID MORATORIUM; PROVIDING FOR SEVERABILITY; DECLARING AN EMERGENCY; AND ESTABLISHING AN IMMEDIATE EFFECTIVE DATE. WHEREAS, the City of Renton has adopted a Comprehensive Plan and zoning regulations pursuant to the Growth Management Act that authorize land uses and activities within the City; and WHEREAS, a Battery Energy Storage System ("BESS") is not an authorized or permitted use pursuant to the City's Comprehensive Plan and zoning regulations; and WHEREAS, the City Council seeks to understand any impacts and determine appropriate zoning and development standards for such systems; and WHEREAS, City's Community and Economic Development Department (CED) regularly undertakes work programs to propose amendments to Title IV of the Renton Municipal Code (RMQ and WHEREAS, the City seeks adequate time to complete said work program; and WHEREAS, the City Council has determined that there is a need for a moratorium on accepting any land use application, building permit application, or business license application for BESS; and WHEREAS, the City Council will hold a public hearing within sixty (60) days of the passage of this ordinance; 1 ORDINANCE NO. 6061 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION I. The above recitals are adopted as findings of fact in support of the moratoriums adopted herein pursuant to RCW 35A.63.220 and RCW 36.70A.390, and are found to be true and correct in all respects. SECTION II. The City Council hereby declares a moratorium upon the submission or acceptance of any land use application, building permit application, or business license application for BESS; and SECTION III. This moratorium shall not apply to any complete and accepted land use applications, building permit applications, or business license applications for BESS; and SECTION IV. The moratorium imposed herein shall be in effect until October 18, 2022, unless ended earlier by subsequent City Council action, or unless subsequently extended by the City Council pursuant to state law. SECTION V. A public hearing shall be scheduled and held within sixty (60) days of the passage of this ordinance. SECTION VI. If any section, subsection, sentence, clause, phrase, or work of this ordinance should be held to be invalid or unconstitutional by a court or competent jurisdiction, such invalidity or unconstitutionality thereof shall not affect the constitutionality of any other section, subsection, sentence, clause, phrase or word of this ordinance. SECTION VII. The City Council declares an emergency for the protection of the public welfare and to enable the purpose and intent of this ordinance to be accomplished. This ordinance shall take effect immediately when passed by the City Council.
