right-of-way in the vicinity of SE 192nd St. to fulfill a requirement of the Gurdev Singh Short

d. Finance and Information Services Department recommends approval of Addendum #46 to CAG-
06-097, Eastside Fiber Consortium agreement to add the City of Auburn as a consortium partner.

e. Utility Systems Division requests authorization to establish the Earlington Sanitary Sewer
Interceptor Special Assessment District in the estimated amount of $767,783.60 to ensure that

SUMMARY OF ACTION:
Approval of this contract and scope of work from the Petrizzo Strategic Group allows them to
represent the City of Renton in intergovernmental relations at the federal level. Issues on which the
firm will particularly focus include government efficiency and opposition to unfunded mandates,
economic stimulus funding, transportation funding, emergency management, economic and community

STAFF RECOMMENDATION:
Approve a contract with the Petrizzo Strategic Group not to exceed $62,500 for federal lobbyist
services and authorize the Mayor and City Clerk to sign the agreement.

SUBJECT: Consultant Contract with Petrizzo Strategic Group for
Federal Lobbying Services
ISSUE:
Should the City of Renton contract with the Petrizzo Strategic Group for federal lobbying
services?
RECOMMENDATION:
Staff recommends approval of the contract with the Petrizzo Strategic Group.
BACKGROUND SUMMARY:
Approval of this contract and scope of work from the Petrizzo Strategic Group allows them to
represent the City of Renton in intergovernmental relations at the federal level. Issues on which
the firm will particularly focus include government efficiency and opposition to unfunded
mandates, economic stimulus funding, transportation funding, emergency management,
economic and community development, and community services funding. Attached is a draft
2009 Federal Agenda, which includes potential requests and projects for the City's federal
relations efforts. Funding for this contract is already established in the Adopted 2009 non -
departmental budget.
CONCLUSION:
There are many potentially valuable opportunities for the City if it engages in intergovernmental
relations at the federal level. The assistance of a federal lobbyist will help maximize these
efforts.

CONSULTANT AGREEMENT
THIS AGREEMENT is made as of the day of , 20 , between the CITY OF RENTON,
a municipal corporation of the State of Washington, hereinafter referred to as "CITY" and
Petrizzo Strategic Group, hereinafter referred to as "CONSULTANT", for their services related
federal policy and legislation. Information shall be made available for use by the City of Renton
Staff and City Council.
The CITY and CONSULTANT agree as set forth below:
Scope of Services. The Consultant will provide all labor necessary to perform all work,
which is described in the attached Scope of Services (Exhibit A). This Agreement and
Exhibit hereto contain the entire agreement of the parties and supersedes all prior oral
or written representation or understandings. This Agreement may only be amended by
written agreement of the parties. The scope of work may be amended as provided
herein.
2. Changes in Scope of Services. The City, without invalidating the Consultant
Agreement, may order changes in the services consisting of additions, deletions or
modifications, and adjust the fee accordingly. Such changes in the work shall be
authorized by written agreement signed by the City and Consultant. If the project scope
requires less time, a lower fee will be charged. If additional work is required, the
consultant will not proceed without a written change order from the City. If any provision
of this Agreement is held to be invalid, the remainder of the Agreement shall remain in
full force and effect to serve the purposes and objectives of this Agreement.
3. Time of Performance. The Consultant shall complete performance of the Consultant
Agreement for the items under Consultant's control in accordance with Exhibit A. If
items not under the Consultant's control impact the time of performance, the Consultant
will notify the City.
4. Term of Consultant Agreement. The term of this Agreement shall end at completion
of the scope of work identified in Exhibit A, but no later than December 31, 2009. This
Agreement may be extended to accomplish change orders, if required, upon mutual
written agreement of the City and the Consultant.
5. Consultant Agreement Sum. The total amount of this Agreement is not to exceed the
sum of $5,834 for the first three months of services, and then $5,000 per month.
Washington State Sales Tax is not required. The Cost Estimate provided by the
Consultant to the City specifies total cost.
6. Method of Payment. Payment by the City for services rendered will be made after a
voucher or invoice is submitted in the form specified by the City. Payment will be made
within thirty (30) days after receipt of such voucher or invoice. The City shall have the
right to withhold payment to the Consultant for any work not completed in a satisfactory
manner until such time as the Consultant modifies such work so that the same is
satisfactory.
7. Record Maintenance and Work Product. The Consultant shall maintain accounts and
records, which properly reflect all direct and indirect costs expended and services
provided in the performance of this Agreement. The Consultant agrees to provide
access to any records required by the City. All originals and copies of work product,
exclusive of Consultant's proprietary items protected by copyright such as computer
programs, methodology, methods, materials, and forms, shall belong to the City,
including records, files, computer disks, magnetic media or material which may be
produced by Consultant while performing the services. Consultant will grant the City the
right to use and copy Consultant copyright materials as an inseparable part of the work
product provided.
8. Assignment Agreement. The Consultant shall not assign any portion of this consultant
Agreement without express written consent of the City of Renton.
9. Hold Harmless. The Consultant shall indemnify, defend and hold harmless the City, its
officers, agents, employees and volunteers, from and against any and all claims, losses
or liability, or any portion thereof, including attorneys fees and costs, arising from injury
or death to persons, including injuries, sickness, disease or death of Consultant's own
employees, or damage to property caused by a negligent act or omission of the
Consultant, except for those acts caused by or resulting from a negligent act or
omission by the City and its officers, agents, employees and volunteers. Should a court
of competent jurisdiction determine that this agreement is subject to RCW 4.24.115,
then, in the event of liability for damages arising out of bodily injury to persons or
damages to property caused by or resulting from the concurrent negligence of the
contractor and the city, its officers, officials, employees and volunteers, the contractor's
liability hereunder shall be only to the extent of the contractor's negligence. It is further
specifically and expressly understood that the indemnification provided herein constitute
the contractor's waiver of immunity under the Industrial Insurance Act, Title 51 RCW,
solely for the purposes of this indemnification. This waiver has been mutually
negotiated by the parties. The provisions of this section shall survive the expiration or
termination of this agreement.
10. Insurance. The Consultant shall secure and maintain commercial liability insurance in
the amount of $1,000,000 in full force throughout the duration of this Consultant
Agreement. It is agreed that on the CONTRACTOR's policy, the City of Renton will be
named as Additional Insured(s) on a non-contributory primary basis. A certificate of
insurance and the Primary & Non -Contributory Additional Insurance Endorsement page,
properly endorsed, shall be delivered to the City before executing the work of this
agreement. Please note: The cancellation language should read "Should any of the
above described policies be cancelled before the expiration date thereof, the issuing
company will mail 45 days written notice to the certificate holder named to the left."
11. Independent Contractor. Any and all employees of the Consultant, while engaged in
the performance of any work or services required by the Consultant under this
agreement, shall be considered employees of the Consultant only and not of the City.
The Consultant's relation to the City shall be at all times as an independent contractor.
Any and all claims that may or might arise under the Workman's Compensation Act on
behalf of said employees, while so engaged, and any and all claims made by a third
party as a consequence of any negligent act or omission on the part of the Consultant's
employees, while so engaged on any of the work or services provided to be rendered

herein, shall be the sole obligation and responsibility of the Consultant.
12. Compliance with Laws. The Consultant and all of the Consultant's employees shall
perform the services in accordance with all applicable federal, state, county and city
laws, codes and ordinances. Discrimination Prohibited: Consultant, with regard to work
performed under this agreement, will not discriminate on the grounds of race, color,
national origin, religion, creed, age, sex, the presence of any physical or sensory
handicap, or sexual orientation, in the selection and/or retention of employees, or
procurement of materials or supplies.
This agreement is entered into as of the day and year written above.

General:
Petrizzo Strategic Group, Inc. agrees to provide government relations services to City of Renton
for the purpose of maximizing the City's interests during the preparation, consideration, enactment and
implementation of Federal appropriations. Our fundamental goal is to provide a comprehensive
representation of your interests before the United States Congress.
Specifics:
Petrizzo Strategic Group, Inc. works with each individual client to accurately identify the
government relations services necessary to meet every need. In this case, we agree to represent the
City of Renton and provide counsel to assist in the following manner:
• Assist the City in the development and management of a federal legislative agenda.
• Manage day to day relationships in Washington, D.C. with the Washington State
Congressional Delegation and staff. This includes office visits, phone calls and various
meetings as may be required.
• Assist the City with advancing the federal legislative agenda with the Administration and
federal agencies, as needed.
• Assist the City in drafting letters and other communications documents to execute its federal
funding strategy.
• Coordinate City material submissions and relevant Congressional letters.
• Attend Congressional Committee hearing and markups. Follow all relevant Congressional
proceedings important to the City's federal agenda.
• Coordinate visits to Washington, D.C. by City officials for meetings with Congressional
Delegation and staff.
• Advise and assist with events in Renton targeted at the Congressional Delegation including
staff and Member visits, speeches and media events, etc.
• Consult with City officials on a regular basis, provide written reports on a regular schedule
and as warranted by new developments.
Petrizzo Strategic is enthusiastic at the prospect of working with the City of Renton. We pride
ourselves on our ability to offer a personal level of service to our clients. Petrizzo Strategic is a full -
service firm with the goal of attaining results for our clients. The City will have access to the
principles assigned to your account 24 hours a day/7 days a week. We believe constant communication
and accountability with our clients is important to our success on your behalf. We propose that this
engagement commence on March 1, 2009 and continue through December 31, 2009. For services
rendered, we propose that the monthly retainer be $5,834 for March, April and May and $5,000 a
month for the remainder of 2009, which includes all expenses associated with representation.

Economic Stimulus Requests
Renton will support passage of a federal economic recovery package that will provide critically needed
infrastructure improvements and create family wage jobs during these extremely challenging economic
times. Renton has submitted to its Congressional delegation and Governor Gregoire the following list
of "ready to go" infrastructure projects that have either completed or are far along in their environmental
and design phases. All of these projects would help move the Renton community forward, brighten the
region's employment picture, and allow taxpayers to see projects implemented quickly:
• Rainier Avenue (SR 167) Improvements Project — Shattuck Avenue Stormwater Bypass - $2 million
• SW 271h Street/Strander Boulevard Connection Project - completion of rail realignment phase:
$4.2 million; completion of rail realignment phase and bridge over tracks: $34 million
• Earlington Water and Sewer Replacement Project - $3.7 million (sewer: $1.7 million; water: $2
million)
• Barrier Free Sidewalk Project - $1 million
• Street Overlay and Rehabilitation Project - $4 million
• Downtown Renton Wayfinding Initiative - $775,000 Option: $400,000 for Phase II only
• "SCORE" Regional Jail Facility - $80 million
• Facilities and Parks Maintenance & Operations Center - $12 million
• Interstate 405/Highway 167 HOV to HOV Connector Lead Agency: WSDOT - $400 million
Transportation Funding for Strander Boulevard/SW 27th Street*
The City of Renton, in partnership with the City of Tukwila, is creating a connection between the
existing Strander Boulevard in Tukwila and SW 27th Street in Renton. This project is creating an
important east -west connection across the Green River Valley between Renton and Tukwila that has
multiple benefits for relieving congestion, improving freight mobility and creating new access to
commuter rail and surrounding commercial development. Renton has constructed the first segment of
the project to provide access for the new Federal Reserve Bank of San Francisco, which supports this
project. This federal funding appropriations request of $2 million would help fund the next segment,
relocating the Union Pacific tracks to fit one overpass rather than two, saving $8 million on the project.
A future request is expected for the upcoming reauthorization of the Transportation Equity Act Legacy
of Users (TEALU) legislation.
Protection of the City's Cable Franchise Authority*
Renton has strong concerns with pending telecommunications legislation to federalize cable franchises
and eliminate local control of Right of Way. One of municipal government's most important roles is to
manage the use and access to public Right of Way for the benefit of all users -- it is a public asset that
should not be tilted to meet the needs of just one user. Renton has cable based police and fire data and
communication systems that were created and maintained by franchise agreements that may be taken
over and lost if the City's franchise agreement is abrogated. Renton welcomes competition in
telecommunications services, which improves services for our residents.
Government Efficiency, Opposition to Unfunded Mandates and Tax Erosion*
Renton will support legislative initiatives to promote greater efficiency and cost -savings in providing
local government services. Renton opposes efforts to impose new unfunded or "under -funded"
mandates without corresponding funding. Renton also opposes tax -policy legislation that infringes on,
undermines, or eliminates local tax authority without corresponding new authority to offset revenue
losses.

Rebanding of the 800 MHz radio system -- potential treaty with Canada

SUMMARY OF ACTION:
The area to be dedicated for street improvements is approximately 1,790 sq. ft. to widen SE 192nd
Street and was granted by King County. This dedication complies with the code requirements for
this short plat. As the successor jurisdiction through the Benson Hill Annexation, Council
acceptance of said right-of-way should be completed prior to recording the deed with the short
plat.
STAFF RECOMMENDATION:
Accept the additional right-of-way and authorize the Mayor and City Clerk to sign and record the
Deed of Dedication.

DESCRIPTION OF THE PROPOSED SHORT SUBDIVISION:
This is�a short subdivision of a .55 acre -parcel into four lots for detached single-family

HISTORY and BACKGROUND
The Subdivision Technical Committee (STC) of King County has conducted an on -site
examination of the subject property. The STC has discussed the proposed
development with the applicant to clarify technical details of the application, and to
determine the. compatibility of this project with applicable King County plans, codes; and
other official documents regulating this development.

As a result of preliminary discussions, the applicant presented the Technical Committee
with a revised site plan on July 14, 2005. The primary modification includes a revision
to the private access tract to meet the King County Road Standards.
D. NATURAL ENVIRONMENT
Topography: The site is relatively flat. The west half slopes down gently from
northeast to southwest.
Soils: One soil type is found on this site per King County Soil Survey, 1973.
The entire site is classified AgB. The following are AgB characteristics:
AgB - Alderwood gravely, sandy loam; 0-6% slopes. Runoff is slow and the
erosion hazard is slight. This soil type has a moderate limitation for low building
foundations due to a seasonally high water table, and severe limitations for
septic tank filter fields due to very slow permeability in the substratum.
3. Wetland/streams: According to the King County Sensitive Areas Folio, no
mapped hydrographic features exist on this site. Panther Creek runs
approximately half a mile west of the site. The site lies within the Black River
drainage basin.
4. Vegetation: This site is overgrown by lawn and there a few fruit trees scattered
throughout the site.
5. Wildlife: Small birds and animals may inhabit this site however their population
and species are limited due to nearby development. No threatened or
endangered species are known to exist on or near the property.
6. Mapped Sensitive Areas: The Sensitive Areas Folio does not identify any
mapped sensitive areas as being present on this site.
E. NEIGHBORHOOD CHARACTERISTICS:
The property lies within the designated Urban Area east of the city of Renton. The site
and the surrounding properties are zoned Residential with 8 dwelling unit per acre. The
neighboring properties. are developed with residential structures. The site contains a
house which will be removed.
F. DESIGN FEATURES
Density, Lot Pattern, Comprehensive Plan: The site's assigned density is eight
dwelling units per acre. The proposed density is in compliance with the density of
the zone. The site is located in the "urban " area as designated by the King
County Comprehensive Plan.
Access and Roadway Section: The applicant proposes to access the lots via a
Private Access Tract (PAT) extending north from SE 192"d Street into the site.
All .lots will have direct access to the PAT. A road variance (KC File L05V0045)
from the intersection spacing requirements was approved by King County
Department of Transportation (see -Attachment 2).
3. Drainage: The site's drainage generally sheet flows from the north to the south.
A "Targeted Drainage Review, Category 2" is required because the existing
drainage system must be modified to collect and convey drainage along.the
property frontage. ,The proposed on -site improvements appear to qualify for
small -site Best Management Practices (BMP's).

G. PUBLIC SERVICES
Sewage Disposal: The applicant proposes to serve the subject subdivision by
means of a public sewer system managed by Soos Creek Water and Sewer
District. A Certificate Sewer Availability, dated February 1, 2005, indicates this
sewer district's capability to serve the proposed development.
Water Supply: The applicant proposes to serve the subject subdivision with a
public water supply and distribution system managed by Soos Creek Water and
Sewer District. A certificate of Water Availability, dated February 1, 2005,
indicates this sewer district's capability to serve the proposed development.
School facilities: The subject subdivision will be served by Benson Hill
Elementary, Nelson Junior High, and Lindberg Senior High Schools, all located
within the Renton School District. The District has indicated that the future
students from this subdivision will walk to the elementary school. The students
will be bussed to both Junior and Senior High schools.
The walkway to the elementary school consist of pedestrian path along SE 192"d
Street and sidewalks along 113d' way SE all the way to the Elementary school
site. The Junior High school students will be picked up at the intersection of SE
192"d and 113 h Way SE. The High School students will be picked up at the
intersection of SE 192"d Street and 116th Avenue SE. There are pedestrian path
along SE 192"d to. both intersections. Additionally, there will be sidewalks
constructed along the frontage of the site which will provide additional safe
walking conditions for all pedestrians.
H. SEPA THRESHOLD DETERMINATION:
Pursuant to the State Environmental Policy Act (SEPA), RCW 43.21 C, the responsible
official of the Land Use Services Division (LUSD) issued a threshold determination of
non -significance (DNS) for the proposed development on October 28, 2005. This
determination was based on the review of the environmental checklist and supporting
documentation filed with the application, resulting in the conclusion that the proposal
would not cause probable significant adverse impacts on the environment.
FINDINGS/CONCLUSIONS:
The subject subdivision will comply with the goals and objectives of the King County
Comprehensive Plan and will comply with the requirements of the Subdivision and
Zoning Codes and other official land use controls of King County (i.e. 1993 King County
Road Standards, 2005 Surface Water Design Manual, etc.), based upon the conditions
for final short plat approval.
DECISION:
Proposed Short Plat revised and received July 14, 2005 as described by Attachment 1
of this report is granted preliminary approval subject to the following conditions of final
approval:
1. The proposal shall Compliance with all platting provisions of Title 19A. of.the
King County Code,
2. All persons having an ownership interest in the subject property shall sign on the
face of the final short subdivision.
3. All utilities within proposed rights -of -way must be included within a franchise
approved by the King County Council prior to final shortplat recording
2005 King County Surface Water Design Manual (SWDM- The following are
drainage conditions applied to this proposal:

A. TARGETED DRAINAGE REVIEW
The proposed short subdivision requires a Category #2 Targeted
Drainage Review as outlined in Chapter 1.1.2.2 in the Surface Water
Design Manual. The existing drainage system must be modified to colle
and, convey drainage along the property frontage.
B. ON -SITE BMP's
The proposed on -site improvements appear to qualify for small site
drainage BMP's as outlined in Appendix C of the Surface Water Design
Manual.
1993 King County Road Standards -Final short plat approval shall require full
compliance with the provisions set forth in the 1993 KCRS, including engineering
plans for all road improvements. The engineering plans shall be prepared by a
professional civil engineer licensed in the state of Washington. DDES strongly
recommends that the enoineerino plans be submitted at least two years prior to
the expiration date .of the project. The following conditions apply to this short plat
unless a variance pursuant to the variance procedures in KCRS 1.08 is obtained
or otherwise approved by DDES:
A. Frontage improvements along SE 192nd Street shall be designed to
Urban Principal Arterial Standards per KCRS Section 2.02. These
.improvements shall extend along the entire frontage of the site and make
standard connections to adjacent improvements.
B. Forty-two feet of Right -of -Way (ROW) width shall be dedicated north of
the.SE 192nd Street R/W centerline, along the frontage of the site.
Appropriate pavement tapers and pavement striping shall extend east and
west of the project's frontage.
D. A Road Variance (KC File Number L05V0049) was granted for
intersection spacing with the condition that the private access tract be
located at the center of the property frontage. Additionally, approval was
granted for a reduced stopping -sight -distance.
E. Rockeries, luminaires and utilities located along the frontage of the site
shall be relocated; redesigned or removed to match the ultimate roadway
design of SE 192nd Street without creating roadside obstacles per KCRS
Section 5.11.
F. The proposed Private Access Tract (PAT) shall be revised to allow
adequate access width (20 feet minimum, measured from the point of
curve) to lots 1 and 4. This will requires shortening the length of the
panhandle portion Lots 2 and 3.
G. The PAT shall be constructed per KCRS Section 2.09.6.
H. There shall be no direct vehicular access to or from SE 192"d Street from
those lots which abut it. A note to this effect shall appear on the
engineering plans and final short plat.
I. The following Notes shall be shown of the final recorded short subdivision
(1) Warning: King County has no responsibility to build, improve, maintain
or otherwise service the private access road contained within or provide
service to the property described in this subdivision.
(2) All private easements and or tracts to be maintained, repaired and/or
rebuilt by the owners of the parcels having legal access there from and
their heirs, assigns or successors, unless and until such roads are
improved to King County Road standards and are dedicated and accepted
by King County for maintenance.

6. . Health (KCC 13)- This project is exempt from further King County Heath
Department review. However, if improvements are required from the Sewer
and/or the Water District, then verification shall be required from said District(s)
that the improvements have been bonded and/or installed, prior to final recording
of the short plat.
7. Buildinq and Construction Standards (Title 16)- The applicant shall comply with
all applicable provisions of KCC 16.82.
8. Fire Code (KCC 17) -Section 902 of the 1997 Edition of Uniform Fire Code- The
Fire Engineering. approval is granted as proposed.
9. Density and Dimensions (KCC 21 A.12) - All lots shall meet the density and.
dimensions requirements of the R-8 zone classification or shall be as shown on
the face of the approved preliminary short subdivision, whichever is larger. Minor
revisions to the short subdivision, which do not result in substantial. changes
and/or do not create additional lots may be approved at the discretion of the
Department of Development and Environmental Services.
10. The existing house on the site shall be removed prior to the final approval and
recording.
11 Street Trees (KCC 21A.16) - Street trees shall be provided as follows (per KCRS
5.03 and KCC 21A.16.050):
A. Trees shall bedplanted at a rate of one tree for every 40 feet of frontage
along SE 192" Street and the private tract where it can be
accommodated. Spacing may be modified to accommodate sight
distance requirements for driveways and intersections.
B. Trees shall be located within the street right-of-way and planted in
accordance with Drawing No: 57009 of the 1993 King County Road
Standards, unless King County Department of Transportation determines
that trees should not be located in the street right-of-way.
C. If King County determines that the required street trees should not be
located within the. right-of-way, they shall be located no more than 20 feet
from the street right-of-way line.
D. The trees shall be owned and maintained by the abutting lot owners or the
homeowners association or other workable organization unless the
County has adopted a maintenance program. Ownership and
maintenance shall be noted on the face of_the final recorded plat.
E. The species of trees shall be approved by DDES if located within the
right-of-way, and shall not include poplar, cottonwood, soft maples, gum,
any fruit -bearing trees, or any other tree or shrub whose roots are likely to
obstruct sanitary or storm sewers, or that is not compatible with overhead
utility lines.
F. The applicant shall submit a street tree plan and bond quantity sheet for
review and approval by DDES prior to engineering plan approval.
G. The applicant shall contact Metro Service Planning at 684-1622 to
determine if SE 192"d Street is on a bus route. If it is a bus route, the
street tree plan shall also be reviewed by Metro.
H. The street trees must be installed and inspected, or a performance bond
posted prior to recording,of the plat. If a performance bond is posted, the
street trees must be installed and inspected within one year of recording
of the plat. At the time of inspection, if the trees are found to be installed
per the approved plan, a maintenance bond must be submitted or the

performance bond replaced with a maintenance bond, and held for one
year. After one year, the maintenance bond may be released after DDES
has completed a second inspection and determined that the frees have
been kept healthy and thriving.
12. Road Mitigation Payment System - The applicant or subsequent owner shall
comply with Road Mitigation Payment System (MPS), King County Code 14.75,
by paying the required MPS fee and administration fee as determined by King.
County Department of Transportation. The applicant has an option to either:
A. Pay the MPS fee at final short plat recording. If this option is chosen, the
fee paid shall be the fee in effect at the time of short plat application and a
note shall be placed on the face of the short plat that reads, "All fees
required by King County code 14.75, Mitigation Payment System (MPS)
have been paid.". Or
B. Pay the MPS fee at the time of building permit issuance. If this option is
chosen, the fee paid shall be the amount in effect as of the date of the
building permit application.
Other Considerations
A. Preliminary approval of this application does not limit the applicant's
responsibility to obtain any required permit or license from the State or other
regulatory body. This may include, but not be limited to, obtaining a forest
practice permit, an HPA permit, building permits, and other types of entitlements
as necessitated by circumstances.
B. The short subdivision shall conform to KCC 16.82 relating to grading on private
property.
C. Development of the subject property may require registration with the
Washington State Department of Licensing, Real .Estate Division

ISSUE
Should the City execute an Interlocal Agreement adding the City of Auburn as a partner
to the Fiber Consortium?
RECOMMENDATION
Staff recommends approval of the Interlocal Agreement.
BACKGROUND
Several years ago the City joined the Fiber Consortium, a group of local government
agencies comprised of local cities, hospitals, schools and utilities. The attached Fiber
Optic Project Agreement (FOPA) supplements the original agreement by adding the City
of Auburn to the Fiber Consortium as a partner. By adding valley cities to the
consortium, the number of partners is increased, spreading future potential costs of
getting fiber to the other valley cities and Valley Communications. There are no costs to
the City for this project.

GENERAL TERMS and CONDITIONS
For Sharing of Fiber Optic Installation Projects
WHEREAS, the City of Bellevue, the City of Kirkland, the City of Renton, the Lake
Washington School District, the Renton School District, the Bellevue School District, the
University of Washington, Bellevue Community College, Evergreen Hospital, and Seattle Public
Utilities, (the Participating Agencies) have entered into the General Terms and Conditions for
Sharing of Fiber Optic Installation Projects, and;
WHEREAS, the City of Auburn, desires to participate in the planned and future Fiber
Optic Projects but cannot because it is not a Participating Agency subject to the General Terms
and Conditions for Sharing of Fiber Optic Installation Projects, and;
WHEREAS, the current Participating Agencies desire to amend the General Terms and
Conditions for Sharing of Fiber Optic Installation Projects to add the City of Auburn as a
Participating Agency for participation in the planned and future Fiber Optic Projects;
NOW THEREFORE, the parties hereby agree as follows:
1) All terms in this Addendum shall have the same meaning as the defined terms in
the General Terms and Conditions for Sharing of Fiber Optic Installation Projects.
2) City of Auburn hereby acknowledges that it has read, understands and accepts
the General Terms and Conditions for Sharing of Fiber Optic Installation Projects, hereby
incorporated by reference as if fully set forth, and agrees to be bound by them.
3) As provided in Section IX, paragraph N, the current Participating Agencies
hereby amend the General Terms and Conditions for Sharing of Fiber Optic Installation Projects
to add City of Auburn as a Participating Agency, and City of Auburn, by executing this
agreement, consents to becoming a Participating Agency.
IN WITNESS WHEREOF, the parties hereto have executed this Addendum to the
General Terms and Conditions For Sharing of Fiber Optic Installation Projects on the respective

SUMMARY OF ACTION:
The Wastewater Utility has completed construction of the Earlington Sanitary Sewer Interceptor.
At the regular Council meeting on October 8, 2007, Council approved the preliminary Special
Assessment District. The final costs and assessments have been determined and the property
owners will be notified, as directed by City Ordinance #4444 (draft copy of notice attached).
There is a potential for 53 single-family units within the Special Assessment District.
The per -unit assessment for the district is $6,512.40 for the lots that granted easements to
construct the sewer and $7,366.22 for the lots that did not. Interest will accrue on the assessments
at a rate of 5.30 percent for a period of 10 years (per City Ordinance #4505) 30 days after final
approval of the ordinance.
STAFF RECOMMENDATION:
Approve the final Earlington Sanitary Sewer Interceptor Special Assessment District No. 0038 and
present the ordinance for first reading.

Does the City wish to establish a Special Assessment District for the Earlington Sanitary
Sewer Interceptor, in order to ensure that the cost of the project is equitably distributed to
those who benefit?
RECOMMENDATION:
Approve the final Earlington Sanitary Sewer Interceptor Special Assessment District
No. 0038 and present the ordinance for first reading.
BACKGROUND SUMMARY:
The Earlington Sanitary Sewer Interceptor project will provide sanitary sewer service to
the properties adjacent to the new sewer main (see attached map).
Previously this area did not have sewer service available. Since the City has eliminated
the need to replace the existing Earlington lift station as a result of the construction of the
Earlington Sewer Interceptor, the Wastewater Utility proposes that the City contribute
$400,000 (the revised estimated cost to replace the lift station) toward the new gravity
main.
For this area we chose to calculate the benefited area utilizing a per -connection method.
This method takes the size of the lot and anticipates how many single-family residences
could be constructed in accordance with the City's proposed zoning for the area. There is
a potential for the existing properties to subdivide into 53 lots. Properties that have
granted utility easements to the City of Renton for this project should be compensated for
their loss of property use. The properties that granted utility easements have the potential

to subdivide into 41 of the possible 53 lots. We have calculated that the total value of all
granted easements is $17,503.45.
The final cost for the new sewer is $767,783.60. This equates to a per -connection charge
of $6,512.40 for the 41 potential single-family lots that will come from the original lots
that granted easements and a per -connection charge of $7,366.22 for the remaining 12
potential lots that will come from original lots that did not grant easements.

It has been the policy of the City that when sanitary sewer facilities have been installed
that the City hold a Special Assessment District in order to ensure that each property that
benefits from the new facility pays their fair share of the costs. This policy helps to
ensure that the existing ratepayers do not pay a disproportionate share of the costs for
these City -installed facilities. Therefore, we recommend that Council approve the
establishment of the Earlington Sanitary Sewer Interceptor Special Assessment District
No. 0038.

EARLINGTON SANITARY SEWER INTERCEPTOR AND
ESTABLISHING THE AMOUNT OF THE CHARGE UPON
CONNECTION TO THE FACILITIES
THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES ORDAIN
AS FOLLOWS:
SECTION I. There is hereby created a Sanitary Sewer Service Special
Assessment District for the area served by the Earlington Sanitary Sewer Interceptor project in
the northwest quadrant of the City of Renton and within King County, which area is more
particularly described in Exhibit "A" attached hereto. A map of the service area is attached as
Exhibit "B". The recording of this document is to provide notification of potential connection
and interest charges. While this connection charge may be paid at any time, the City does not
require payment until such time as the parcel is connected to and, thus, benefiting from the sewer
facilities. The property may be sold or in any other way change hands without triggering the
requirement, by the City, of payment of the charges associated with this district.
SECTION II. Persons connecting to the sanitary sewer facilities in this Special
Assessment District, and which properties have not been charged or assessed with all costs of the
Earlington Sanitary Sewer Interceptor as detailed in this ordinance, shall pay, in addition to the
payment of the connection permit fee and in addition to the system development charge, the
following additional fees:

A. Per Unit Charl4e. New connections of residential units as shown in Zone "A" on
the Earlington Sanitary Sewer Interceptor Special Assessment District Map shall
pay a fee of $6,512.40 per dwelling unit. New connections of residential units as
shown in Zone "B" on the Earlington Sanitary Sewer Interceptor Special
Assessment District Map shall pay a fee of $7,366.22 per dwelling unit.
SECTION III. In addition to the aforestated charges, there shall be a charge of
5.30% per annum added to the Special Assessment District charge. The interest charge shall
accrue for no more than ten (10) years from the date this ordinance becomes effective. Interest
charges will be simple interest and not compound interest.
SECTION IV. This ordinance is effective upon its passage, approval and thirty
(30) days after publication.

On April 22, 2008, I, Bonnie I. Walton, the City Clerk of Renton, Washington, mailed you a notice of
potential assessment for sanitary sewer improvements associated with the Earlington Sanitary Sewer
Interceptor Project. We have now completed construction of these sewer facilities. The facilities, as
shown on the attached map, are eligible for cost recovery under City Special Assessment District
Ordinance No. 4444.
For those properties that could receive benefit directly by the sewers, future use would trigger
payment of a 'fair share' cost of the sewer. This assessment is calculated, as a unit charge, by dividing
the cost of the conveyance portion of the sewers by the number of units projected for the basin served
by these sewers. This rate has been established at $XXX per unit.
The purpose of the assessment district is to allow the City the ability to collect the costs of the
construction of the sewer facilities from all those who benefit from its construction. To accomplish
this, we are required to record an ordinance which will serve as a notice of potential assessment. This
ordinance will establish a boundary that includes any parcel that may benefit in the future. It is our
goal to ensure, in fairness to all, that any property owner that connects at a later date pays their share
just ',like those who will connect right away. The benefit area is defined as the 'ultimate service area
that the facility may be able to serve. This boundary is shown on the attached map.
This assessment district does not create a lien against real estate and is not a charge against
your property until your property is connected to, or benefitting from, the Earlington Sanitary
Sewer Interceptor. You will only be required to pay this assessment when the property gains
benefit from these sewer facilities. Until that time, the property can be sold or change hands
without triggering the assessment. Benefit from these sewer facilities can be described as
follows:
A property not currently connected to a City sewer facility (i.e., currently utilizing an on -site
system or a vacant parcel), that connects to the sewer system associated with this district will
trigger the assessment. Until then, the assessment will not be triggered.
For those properties that are already connected to City sewer, this assessment will only be
triggered if the property increases its density either by change of use (i.e., single family to multi-
family housing) or through increased density within the same use (i.e., further subdivision of
land for single family housing).
You will not be required to pay the assessment unless one of the above situations occurs. However,
the assessment district will accrue simple interest at a rate of 5.30% per annum for a period of ten
years. The accrual of interest will begin thirty (30) days after the notice of potential assessment is
recorded with King County Records. To avoid interest charges at a future date, you may pay the

amount of assessment during the thirty -day period after recording, interest free. This option is totally
at the discretion of the property owner.
Some properties within the boundary of this special assessment district are currently within other city
held special assessment districts. Each property will only be responsible to pay the charges for the
special assessment districts that they derive benefit from.
Per City Ordinance No. 4444 you may request an appeal hearing by writing to the Renton City
Council, c/o City Clerk, 105.5 S. Grady Way, Renton, WA 98057, within twenty (20) days of this
mailing (by APr l XX, 2009, 5:00 P.M.).
Grounds for protest:
An appeal shall include a statement of claimed errors that concern the proposed
assessment and must be accompanied by a $75.00 non-refundable fee. Errors which are
not set forth in writing will not be considered. Pursuant to City Ordinance No. 4444,
Sections 9-16-9.0 and D, the only items of appeal that will be considered are the cost of
the facilities, the costs distribution methodology, and the issue of benefit to the
properties to be assessed
Appeal Fee and Appeal Process:
A non-refundable appeal fee in the amount of $75.00 shall be submitted with each
appeal. If a protest is received and deemed timely and establishes a proper ground for
protest according to City Ordinance, a public hearing will be held. If no protests are
received, the above -quoted notice of potential assessment will be recorded against your
property. The charge(y) will not be collected until you subsequently tap onto or use the
facilities covered by the Special Assessment District notice.
