NOWTHEREFORE,theAPPLICANTherebyagreesandbindsitselfanditslegalrepresentatives,successors,andassignsasfollows:1.TheAPPLICANTguaranteesthatconstruction,maintenanceandrestorationofroadway,site,drainage,retention/detention,water,andsanitarysewerfacilitieswilloccurinfullcompliancewiththeapprovedconstructionplansandprofiles,includinganyapprovedamendmentsthereto,andinfullconformancewithapplicableCITYordinances,standardsandspecifications,tothesatisfactionoftheCITY.2.lithesubdivision,shortsubdivision,orsiteplanisnotrecorded,orthebuildingdoesnotreceiveanycertificateofoccupancyorfinalbuildingpermit,theAPPLICANTagreestorestoretherightofwaytoitsoriginalconditionorbetterANDstabilizethesiteorcomplywiththeconditionsofanypermitorapproval,including,butnotlimitedto,correctiveworknecessarytoprovidedrainageconsistentwithapprovedplansandconditions,andtoprotectthepublichealth,safety,andwelfare,includingeffectsonwaterquality.3.TheCITYmustapprove(inwriting)anyproposedchangesfromtheapprovedplanspriortotheAPPLICANTbeginningsuchwork.4.Priortobeginningconstruction,apreconstructionmeetingshallbeheldwiththeCITY,theAPPLICANTandtheAPPLICANT’Scontractor(s).5.TheAPPLICANTshallberesponsibleforthecostofanycorrectiveworkonoroffthesiteorwithintherightofwaytotheextentthatsuchcorrectivemeasuresareassociatedwithworkperformedand/ornotcompleted.6.TheAPPLICANTshallpayanyfeesrequiredinconjunctionwiththeprojectpursuanttotheCityofRentonFeeSchedule.7.IftheAPPLICANTfailstoproceedwithduediligenceandingoodfaithintheworkprovidedherein,theAPPLICANTshallremoveallorpartofconstructedfacilitiesandrestorealldisturbedareasofthesitetoitsoriginalorbetterconditionattheAPPLICANT’Ssoleexpense.TheAPPLICANTshallnotstop,delayorabandontheprojectwithoutfirstrectifyinganydamage,stabilizingandrestorihgthetightofwayand/orsitebygrading,hydroseeding,and/orlandscapingasmayberequiredbytheCITY.8.TheAPPLICANTshallfurnishtotheCITYasetof“finalcorrectedplans”(photoMylarquality)ofallrequiredpublicandprivatefacilitieswhenapplicable.PublicAgencyAgreementforPerformancePage2of5 9.TheAPPLICANTshallberesponsiblefortheproperperformance,safeconductandadequatepolicingandsupervisionoftheproject.ThisresponsibilityshallnotbelessenedorotherwiseaffectedbytheCITY’Sapprovalofplans,specifications,orwork,orbythepresenceattheworksiteoftheCITY’Srepresentative(s),orbythecompliancebytheAPPLICANTwithanyrequestsmadebysaidrepresentative(s).13.TheAPPLICANTshallindemnifyandholdtheCITYanditsagents,employeesand/orofficersharmlessfromandshallprocessanddefendatitsownexpenseallclaims,damages,suitsatlaworequity,actions,penalties,losses,orcostsofwhatsoeverkindornature,broughtagainsttheCITYarisingoutof,inconnectionwith,orincidenttotheexecutionofthisAGREEMENTand/ortheAPPLICANT’SperformanceorfailuretoperformanyaspectoftheAGREEMENT.Provided,however,thatnothinghereinshallrequiretheAPPLICANTholdharmlessordefendtheCITYfromanyclaimarisingfromthesolenegligenceoftheCITY’Sagents,employeesand/orofficers.14.IntheeventthatanypartydeemstnecessarytoinstitutelegalactionorproceedingstoenforceanyrightorobligationunderthisAGREEMENT,thepartiesheretoagreethatanysuchactionorproceedingshallbebroughtinacourtofcompetentjurisdictionsituatedinKingCounty,Washington.ReleaseRequirements:ThisAGREEMENTshallremaininforceandeffectandshallnotbereleaseduntilalltermsofthisAGREEMENThavebeencompletedtothesatisfactionoftheCityofRenton.INWITNESSWHEREOF,thePARTIESheretohaveexecutedthisAGREEMENTonthedateandyearfirstabovesetforth.PublicAgencyAgreementforPerformancePage3of5
