INABILITY OF THE CITY COUNCIL TO TAKE TESTIMONY ON APPEALS DURING THE CITY
COUNCIL MEETING
State law requires that the City establish a process to handle appeals from application of environmental and
developmental rules and regulations. The Renton City Council, feeling it was best for the elected
representatives to handle the appeals rather than require citizens to go to court, has retained appellate
jurisdiction to itself.
The courts have held that the City Council, while sitting as an appellate body, is acting as a quasi-judicial
body and must obey rules of procedure of a court more than that of a political body.
By City Code, and by State law, the City Council may not consider new evidence in this appeal. The parties
to the appeal have had an opportunity to address their arguments to the Planning & Development
Committee of the City Council at a meeting previously held. Because of the court requirements prohibiting
the City Council from considering new evidence, and because all parties have had an opportunity to address
their concerns to the Planning & Development Committee, the City Council may not consider oral or written
testimony at the City Council meeting. The Council understands that this is frustrating to citizens and is
outside the normal process of open discourse provided to citizenry during the audience comment portion of
the City Council meeting. However, this burden of not allowing the Council to be addressed concerning
pending appeals is outweighed by the quick, easy, inexpensive and local appeal process provided by the
Renton City Council.

Airport lease with Pro -Flight Aviation, Inc. for a rent increase from $9,342.41 to $11,700.08
annually, and to change the purpose of use to allow construction of a fuel storage facility and fuel

e. Transportation Systems Division submits CAG-04-076, 2004 Street Overlay; and requests
approval of the project, authorization for final pay estimate in the amount of $138,108,
commencement of 60-day lien period, and release of retained amount of $33,271.61 to ICON
Materials, contractor, if all required releases are obtained. Council concur.
f. Utility Systems Division submits CAG-04-037, Talbot Hill Water Main Replacement Phase 1;
and requests approval of the project, authorization for final pay estimate in the amount of
$49,424.16, commencement of 60-day lien period, and release of retainage bond in the amount of
$22,628.53 to Buno Construction, LLC, contractor, if all required releases are obtained. Council
concur.
g. Utility Systems Division submits CAG-03-063, East Valley Lift Station Replacement; and
requests approval of the project, authorization for final pay estimate in the amount of $2,169.42,
commencement of 60-day lien period, and release of retained amount of $39,408.75 to Stouder
General Construction, LLC, contractor, if all required releases are obtained. Council concur.

SPECIAL PRESENTATION Recreation Director Sylvia Allen presented a report on the programs and events
Community Services: Summer the Recreation Division offered during the summer. Noting the growing
Recreation Program Report number of participants and staff s efforts to increase the number of classes,
camps, and activities offered, Ms. Allen detailed the many programs that were
made available to people of all ages. She highlighted continuing events such as
the Kid's Klassic Fishing Derby, the Summer Lunch Program, the Kidd Valley
Family Concert Series, and the Senior Day Picnic. Additionally, she pointed
out new programs such as the birthday party packages, the Best Effort
Basketball Camp, the outdoor adventure activities for special populations, and
the opening of the Henry Moses Aquatic Center.
PUBLIC HEARINGS This being the date set and proper notices having been posted and published in
Vacation: Alley, Burnett Ave accordance with local and State laws, Mayor Keolker-Wheeler opened the
S & S 2nd St, McLendon public hearing to consider the street vacation petition submitted by Steven
Hardware, VAC-04-004 Friedman, on behalf of McLendon Hardware and the Tennessee Group, for a
portion of alley right-of-way located east of Burnett Ave. S., west of Williams
Ave. S., south of S. Tobin St., and north of S. 2nd St. (VAC-04-004). The alley
is ten feet in width, and approximately 50 feet in length for portion running
north and south, and 115 feet in length for portion running east and west.
Karen McFarland, Engineering Specialist, reported that the subject right-of-way
was obtained through quitclaim deeds, was not acquired with City funds, and
does not contain any City facilities. She explained that the petitioner plans to
use the vacation area in the proposed Merrill Gardens Senior Housing Project,
and plans on dedicating 20 feet of right-of-way to access the remaining alley.

Ms. McFarland stated that the petition was circulated to various City
departments. No objections were raised; however, the following conditions
were recommended:
• Transportation Systems Division: 1) Amend the vacation area to exclude
the north 20 feet of the alley running north and south; and 2) Maintain
access to the remaining alley though the proposed right-of-way dedication.
• Development Services Division: 1) Provide access to the remaining alley
through the dedication of an alley 20 feet in width across the northern
portion of the petitioner's lot; 2) Design the alley to accommodate the
minimum turning radius for emergency vehicles; and 3) Pave the alley to 20
feet in width with asphalt and crushed rock.
• Fire Department: The proposed right-of-way dedication be a minimum of
20 feet in width, and have a turning radius for emergency vehicles.
Ms. McFarland stated that upon circulation of the petition to outside agencies,
Puget Sound Energy reported the existence of facilities in the alley, and
requested that the vacation not be finalized until it has received any necessary
easements. In conclusion, Ms. McFarland stated that staff recommends
approval of the vacation request, subject to five conditions pertaining to
amending the vacation area, protecting the existing facilities, maintaining
access to the remaining alley, paving the new alley section, and accommodating
a minimum turning radius.'
Public comment was invited.
Steven Friedman, 7426 SE 27th St., #200, Mercer Island, 98040, representing
the petitioner, clarified that five feet of the west side of the existing north/south
alley will be dedicated, which allows for the turning radius requested by the
Fire Department.
An e-mail was read from Bob and Margaret Schmidt, 95 Williams Ave. S.,
Renton, 98055, stating their opposition to the vacation request if access to the
alley is limited or restricted to anyone.
There being no further public comment, it was MOVED BY LAW,
SECONDED BY NELSON, COUNCIL CLOSE THE PUBLIC HEARING.

MOVED BY BRIERE, SECONDED BY LAW, COUNCIL APPROVE A
PORTION OF THE REQUEST TO VACATE THE RIGHT-OF-WAY .
SUBJECT TO THE FOLLOWING CONDITIONS: THE VACATION AREA
BE AMENDED TO EXCLUDE THE NORTH 20 FEET OF THE ALLEY
RUNNING NORTH AND SOUTH; THE PETITIONER PROVIDE

Planning: Urban Center This being the date set and proper notices having been posted and published in
Design Overlay Regulations, accordance with local and State laws, Mayor Keolker-Wheeler opened the
2004 Revisions public hearing to consider the 2004 revisions to the Urban Center Design
Overlay Regulations.
Elizabeth Higgins, Senior Planner, explained that the overlay district guidelines
were originally adopted in 1999, and applied to the Downtown Core (District
A) and South Renton (District B). In December, 2003, the guidelines were
expanded to include the rezoned Boeing property, or South Lake Washington
redevelopment area (District Q. These guidelines have been revised again to
improve their effectiveness, as they did not include all the anticipated uses for
this area.
Ms. Higgins pointed out that the intent statements have changed since the
guidelines were originally adopted to encourage flexibility and creativity. As
long as the project can demonstrate that it meets the intent of each design
element, there is an opportunity to modify both the minimum standards and the
guidelines. She noted that the standards and guidelines vary from district to
district. Ms. Higgins stated that the primary purposes of the regulations are to
maintain and protect property values, enhance the general appearance of the
City, encourage creativity, achieve predictability balanced with flexibility, and
consider the individual merits of each proposal.
Continuing, Ms. Higgins reported that the elements of the design guidelines are
divided into the following categories:
• Site Design and Building Location
• Parking and Vehicular Circulation
• Pedestrian Environment
• Landscaping, Recreation and Common Space
• Building Architectural Design
• Signage
• Lighting
Ms. Higgins reviewed the goals of each category, such as making sure
businesses are visible from the street, creating pedestrian activity areas along
streets, avoiding dictating architectural design or styles, and enhancing the
development areas with lighting without creating a negative environment for
area residents.

Chief Administrative Officer Jay Covington reviewed a written administrative

report summarizing the City's recent progress towards goals and work
programs adopted as part of its business plan for 2004 and beyond. Items noted
included:
* The Renton Senior Activity Center's Annual Craft Bazaar, featuring
handmade crafts by Renton area senior citizens, is on October 30th, from
9:00 a.m. to 2:00 p.m.
* The Washington State Department of Transportation cameras along the I-
405 corridor have now been linked to the City so that the images of traffic
on I-405 can be viewed in the Traffic Control Center at City Hall.

UNFINISHED BUSINESS
Transportation (Aviation) Committee Chair Palmer presented a report on the

the purpose of slowing down traffic. These measures include, but are not
limited to: speed limit pavement marks to reinforce signing; additional speed
limit signs; permanent radar speed signs (requires budget evaluation); and
police emphasis during the times the speed studies indicated there was

Transportation: Smithers Ave Transportation (Aviation) Committee Chair Palmer presented a report regarding
S Traffic Concerns Smithers Ave. S. speed pillow installation. The Committee met on 11/20/2003
and recommended implementation of traffic delineators; removal of turning
restrictions; and the addition of a sidewalk, street overlay, and speed pillow on
Stnithers Ave. S. All of the improvements have been installed with the
exception of the speed pillow. Due to the narrow width of the street, a speed
pillow cannot be properly installed without creating a safety hazard.
The Committee recommended concurrence in the staff recommendation to
instead construct a speed hump using King County's specifications, and install
it in place of the speed pillow as a demonstration project. MOVED BY

Police: Reporting Speeding Councilwoman Palmer stated that citizens can report speeding vehicles to the

Councilman Clawson stated that future requests for connection to Renton's
sanitary sewer service will be placed on the Council meeting consent agenda.
Public Works: Cedar River
Utilities Committee Chair Clawson presented a report regarding the Seattle
Broodstock Collection Facility

a sockeye broodstock collection facility on the Cedar River as a mitigation

condition of their Habitat Conservation Plan. SPU's preferred location for the
collection facility is at the I-405 overpass in the City of Renton. The
conceptual design of the broodstock facility has been significantly scaled back
and simplified to minimize impacts and concerns.
Even with the proposed improvements to the broodstock facility there are many
questions about potential impacts and mitigation that need to be discussed and
worked out before the Committee can recommend that this facility be sited at
the proposed I-405 location. The Committee recommended concurrence with
the Planning/Building/Public Works Department recommendation that Council
direct staff to engage in discussions with SPU to resolve potential impacts and
concerns regarding construction and operation of a broodstock facility at the I-
405 site. Furthermore, the Committee recommended that this matter be brought
back to Committee following these discussions to determine whether the final
design proposal fully satisfies Renton's concerns and adequately mitigates

Finance Committee Chair Corman presented a report recommending approval

DESCRIPTION:
The City Council will hear a proposal requesting the vacation of an alley right-of-way north of S 2nd
Street between Burnett and Williams Avenues South that is approximately 165' in length and 10' in
width. The requested vacation area is shown on the accompanying map exhibit.
RECOMMENDATION:
The Planning/Building/Public Works Department recommends that Council conditionally approve the
request to vacate the alley right-of-way.
SUMMARY:
A vacation petition was received August 5, 2004 from Steven Friedman on behalf of McLendon
Hardware, Inc. and the Tennessee Group, LLC. City Code requires that more than two-thirds (2/3) of
the owners whose property abuts the alley to be vacated must sign the petition. One -hundred percent
(100%) of the abutting property owners have signed this petition.
The portion of right-of-way included in this petition was obtained through quitclaim deeds. The west
five feet of the vacation request for the alley running north/south were dedicated to the City on July
31, 1925 by John and Josephine Laramie through a quitclaim deed. The east five feet of the vacation
request for the alley running north/south were dedicated to the City on July 31, 1925 by John and
Elizabeth Comb through a quitclaim deed. The ten feet of the vacation request for the alley running
east/west were quitclaimed to the City on November 16, 1978 by McLendon Hardware in partial
exchange for the alley vacated in City of Renton Ordinance 3272.
No public facilities exist within the requested area.
None of the City Departments surveyed have objections to the vacation. However, the Fire
Prevention Bureau (Fire Department) and the Development Services and Transportation Systems
Divisions (PBPW Department) have no objection provided certain conditions are met.
The petitioner plans to use the requested vacation area in the proposed Merrill Gardens Senior
Housing Project. As part of this redevelopment, the petitioner plans on dedicating right-of-way across
the north 20' of Lot 18. According to petitioner, the public benefit provided by the proposed vacation
would be to create a unified site for this redevelopment and create "more usable access through the
block" than currently exists.
As established by RCW 35.79.030, the street vacation petition, if granted, must be approved by the
City Council through ordinance after a public hearing is held. The City shall receive compensation in
accordance with RCW 35.79.030 for the vacated alley. The ordinance shall be recorded with King
County once it is in effect.

RENTON MUNICIPAL CODE 4-3-100

In 2003, as part of the Boeing Renton Plant Site Comprehensive Plan Amendments, the Urban
Center Design Overlay District Guidelines, adopted in December 1999 and previously applicable
to the Center Downtown and South Renton (Districts `A' and `B' respectively), were expanded
to include the rezoned Boeing property (District `C'). The revised Guidelines were adopted in
December 2003. Those Guidelines have now been revised to improve their effectiveness. The
revision includes reorganization and the addition of details, definitions, and graphic illustrations
to improve clarity of intent.
The Guidelines are codified in the Renton Municipal Code, Title IV Development Standards,
therefore are enforceable regulations. They will also be available as a "stand-alone" document to
assist potential developers in understanding the City's Vision for redevelopment of Renton's
Urban Center. As regulations, the Guidelines implement the objectives and policies of the Urban
Center Comprehensive Plan designations. As a development tool, the Guidelines will provide
predictability to the review process by clearly outlining in advance of design, what will be
necessary to achieve project approval.
If the Council decides to adopt these proposed revisions, the following will occur:
1. Renton Municipal Code, Title IV Development Standards, will be revised; and,
2. Future projects within the Urban Center — North and Urban Center - Downtown, unless
vested to previously adopted regulations, must adhere to the revised Guidelines.
The recommendation to Council is that the 2004 Revised Urban Center Design Overlay
Regulations ("Design Guidelines") be adopted.

The Highlands Community Association Board is seeking your help resolving two
pedestrian safety issues at the 800 block of Harrington Avenue Northeast.
The first is approximately 100 feet of sidewalk damaged by the roots of four evergreen
trees resulting in an unsafe pedestrian situation. Broken concrete and asphalt patch have
made the sidewalk very uneven. A resident who is blind, brought this to our attention.
He regularly uses the sidewalk on his route to purchase groceries at the local grocery
store. The sidewalk is also used daily by Highlands Elementary students. The location is
in front of the following property.

The second pedestrian safety issue is a storm drain located on the corner of Harrington
Avenue NE and NE 8th Street. The drain is approximately six inches below grade and a

ISSUE:
An appraisal has been submitted by John Skochdopole of Connor Homes on behalf of Jean W.
Lucas for acceptance and determination of compensation due the City for the area to be vacated
in Street Vacation VAC-04-001. The appraisal provides a fair market value estimate of this
area.
RECOMMENDATION:
The Planning/Building/Public Works Department recommends that Council accept the
appraisal and set compensation for Street Vacation VAC-04-001 at $16,500.00 for the right-of-
way 20 feet in width and approximately 308 feet in length.
BACKGROUND SUMMARY:
Street Vacation Request VAC-04-001 was approved on June 14, 2004, for the western 20 feet
of 140th Ave SE south of SE 132"d Street. The right-of-way is approximately 308 feet in length.
On September 13, 2004, an appraisal was submitted by John Skochdopole of Connor Homes on
behalf of Jean W. Lucas for the area to be vacated. Staff has reviewed the appraisal and
concludes that the appraisal meets industry standards. The appraisal report provides a fair
market value of $16,500.00 for the right-of-way 20 feet in width and approximately 308 feet in
length to be vacated in Street Vacation VAC-04-001. Staff believes the estimate determined in
the appraisal represents a reasonable and fair market value.

State Law and City Code allow for compensation in the amount of the full -appraised value if a
street or alley has been a dedicated public right-of-way for twenty-five years or more. The
vacation area was acquired from N.H. Martin through a quitclaim deed dated November 7,
1966. Thus, the right-of-way included in these vacations has been dedicated public right-of--
way for more than twenty-five years and State Law and City Code, therefore, allow for
compensation amounts to be set at the full -appraised values.
CONCLUSION:
Staff has reviewed the appraisal submitted by John Skochdopole of Connor Homes on behalf of
Jean W. Lucas and concludes that the appraisal meets industry standards. The
Planning/Building/Public Works Department recommends that Council accept the appraisal
and set compensation for Street Vacation VAC-04-001 at $16,500.00 for the right-of-way 20
feet in width and approximately 308 feet in length.

GENERAL:
The report contained the necessary analysis for the appraiser to form an opinion of the fair market value of
that portion of right-of-way to be vacated. The report indicated that the right-of-way being vacated has a
highest and best use of assemblage with the surrounding properties and redevelopment as part of a single
family residential subdivision.
QUALIFIED APPRAISER
The appraiser is experienced and a well -qualified state certified appraiser.
PROPERTY VALUATION
Since the subject property is Right -of -Way, it is not assessed for taxes by the King County Assessor. The
sales comparison approach was the only applicable method for valuation and, thus, was the method used for
this valuation. The fair market value was based upon direct comparison with recent sales of similar
properties.
FIELD INSPECTION
An inspection of the subject property and all comparables was made by the appraiser.
COMPARABLE SALES
The fair market value was determined based upon direct comparison with recent sales of similar properties
within a reasonable distance of the subject site. The adjustments to the comparable sales were found to be
within a reasonable range of the subject site valuation.
CONCLUSION
The Planning/Building/Public Works Department recommends that the Council accept the appraised value
of the subject land of $16,500.00 for the right-of-way 20 feet in width and approximately 308 feet in length.

BACKGROUND:
Pro -Flight Aviation, Inc. (Pro -Flight) is an airport tenant with a long-term ground lease with the
City to operate a maintenance shop at 522 West Perimeter Road. Pro -Flight also sells aircraft
fuel to the public from another area on the Airport that is subleased from another tenant. At
this other location Pro -Flight provides fuel to the public dispensed from an above ground
100LL fuel tank.

Pro -Flight also sells Jet A fuel to the public, however, they do not own a Jet A storage tank at
this time. Currently, Pro -Flight uses a temporary truck -to -truck transfer process permitted by
the Renton Fire Department to obtain Jet A fuel on the Airport. Then Pro -Flight dispenses Jet
A fuel from their truck and sells directly to the public. This is only a temporary solution and
Pro -Flight has taken steps to secure a permanent solution to on -airport fuel storage.
Pro -Flight has submitted and received permit approval by the City to install an above ground
fuel storage facility. The fuel storage facility will have an integrated spill containment pad for
the tank(s) and aircraft refueling trucks. The design of the facility should result in zero
discharge of fuel and/or oils to the Airport storm drainage system, which drains to the lake.
In order to complete this project, an Addendum to the Pro -Flight lease was needed. The
Addendum needed to recognize an increase to the Pro -Flight leased area, modify the purpose of
use of the lease to recognize fuel sales to the public, and increase Pro-Flight's ground lease rate
(per the CPI increase requirements of Pro-Flight's ground lease with the City).
Approximately 5,000 square feet of Airport property formerly leased by The Boeing Company
had to be added to the Pro -Flight leased area in order to provide room for the new fuel facility.
In addition, an old air compressor station abandoned by The Boeing Company had to be
demolished and the Airport perimeter fence had to be modified. The demolition work on the
old air compressor station and relocating the perimeter fence were completed by Airport
Maintenance staff with some assistance from Pro -Flight.
The Boeing Company and the City of Renton still have active utilities on the Pro -Flight leased
area. Hence, a provision has been inserted into the Pro -Flight lease Addendum 01-04 to allow
for The Boeing Company and the City to access those utilities when maintenance work is
needed.
There is a strong public interest in ensuring competition in fuel sales on the Airport. The
proposal by Pro -Flight to install a permanent fuel facility on the Airport will help ensure that
fuel is available to the public over the long term. In addition, the safety features designed into
the fueling facility establishes a new higher standard for protecting the lake from fuel spills and
oil contamination.
The Pro -Flight lease, LAG-99-002, provides for a periodic increase in rent using the Consumer
Price Index for Urban Seattle. Lease Addendum 01-04 includes an adjustment to the ground
lease rate. The old lease rate was $0.3066 per square foot. The new ground lease rate is
$0.3287 per square foot. This rate increase was effective July 31, 2004, and resulted in an
annual increase of $2,357.67, for a total annual rent of $11,700.08. This increased the annual
ground lease payment to the City from $9,342.41 to $11,700.08, plus the State leasehold excise
tax. Approval is requested of a lease addendum documenting this rate increase.

ADDENDUM TO LEASE AGREEMENT
(City of Renton to Pro -Flight Aviation)
. THIS ADDENDUM to Lease Agreement LAG 99-002 is effective as of the date
of execution by the City of Renton, as indicated on the last page of this addendum.
RECITALS:
WHEREAS, Pro -Flight Aviation has a Lease Agreement with the City of Renton,
LAG 99-002; and
WHEREAS, The Boeing Company has a Lease Agreement with the City of
Renton, LAG 877-65, that included a portion of the north end of Apron B; and
WHEREAS, on March 16, 2004, The Boeing Company terminated approximately
6,181 square feet at the north end of Apron B, including an oil -water separator and
compressed air station, see Exhibits A-1 and A-2; and
WHEREAS, Pro -Flight Aviation desires to amend its Lease to add 5,124 square
feet of the portion of Apron B terminated by The Boeing Company, see Exhibit A-3; and
WHEREAS, The City of Renton and Pro -Flight Aviation removed all above-
ground structures pertaining to The Boeing Company's abandoned compressed air
station, and The Boeing Company will need periodic access to the Pro -Flight leased area
to maintain the underground air line; and
WHEREAS, The Boeing Company will retain an electrical sub -station within this
same area, and will need periodic access to the Pro -Flight Aviation leased area for service
and maintenance; and
WHEREAS, The Boeing Company will retain a fire water line within this same
area, and will need periodic access to the Pro -Flight Aviation leased area for service and
maintenance; and
WHEREAS, The City of Renton will need access to the Pro -Flight Aviation leased
area to periodically maintain the oil -water separator; and
WHEREAS, the Lease Agreement LAG-99-002 establishes the Purpose for the
leased area identified in Exhibit A-3; and
WHEREAS, the Purpose identifies the Use of Premises for the leased area; and
WHEREAS, the Use of Premises established that the leased area shall be used for
the purpose of maintenance of aircraft; and

WHEREAS, the Use of Premises established that the leased area shall be used for
storage of aircraft at outdoor tiedown locations; and
WHEREAS, the Use of Premises established that the leased area shall be used for
commercial aircraft services including flight training and aircraft leasing; and
WHEREAS, the Use of Premises established that the leased area shall be used for
maintaining a business office during normal business hours, five days per week; and
WHEREAS, the Parties desire to expand the Use of Premises identified in Lease
Agreement LAG-99-002 to add retail sale of aircraft fuel to the public; and
WHEREAS, the Lessee desires to install above ground fuel tanks with a spill
containment pad and an oil/water separator; and
WHEREAS, in 1998, the starting date of the Lease Agreement LAG-99-002, the
land rental rate for the approximately 30,471 square feet was established at $0.28 per
square foot per year and continued until July 31, 2001; and
WHEREAS, on July 31, 2001, and for the ensuing three (3) year period, the land
rental rate was adjusted, using the Consumer Price Index -Urban, to a rate of $0.3066 per
square foot per year, resulting in an annual rental amount of $9,342.41, and continuing
until July 31, 2004; and
WHEREAS, the land rental rate has been adjusted by and between both parties,
effective July 31, 2004, and for the ensuing three (3) year period using the Consumer
Price Index -Urban.
NOW, THEREFORE, IT IS HEREBY AGREED AND COVENANTED BY AND
BETWEEN THE CITY OF RENTON AND THE ASSOCIATION AS FOLLOWS:
WITNESSETH:
1. The Lessor and Lessee do hereby agree to amend Paragraph 1 a. of Pro -Flight
Aviation's lease, LAG 99-002, to add to its leased premises 5,124 square feet of
the portion of Apron B identified in Exhibit A-3, for a total leased area of 35,595
square feet; and
2. The Lessor and Lessee do hereby agree that Exhibit A-3, Legal Description,
attached hereto, of the northern most portion of Apron B, is made a part hereof;
and
3. The Lessor and Lessee agree that the Lessor may periodically access the leased
area to maintain the oil water separator;

4. The Lessor and Lessee agree that The Boeing Company may periodically access
the leased area to maintain Boeing owned utilities;
5. The Lessor and Lessee agree to amend the original Lease Agreement LAG-99-002
in the following manner; Paragraph 7 of LAG-99-002 is amended to read as
follows:
7. PURPOSE:
7a. Use of Premises: The Premises are leased to the Lessee for the following
describes purposes:
7a(1) The maintenance of aircraft within the privately -owned hangar building
identified as 540 West Perimeter Road, available as a service to the public
7a(2) The storage of aircraft at outdoor tie -down locations, available as a
service to the public.
7a(3) The conduct of Lessee's commercial aircraft services including flight
training and aircraft leasing, available as a service to the public.
7a(4) Lessee must maintain a business office during normal business hours,
five days per week, with the building identified as 540 West Perimeter Road.
7a(5) The sale of Avgas and Jet A to the public in accordance with the Airport
Rules and Regulations and Minimum Standards for Commercial Service
Providers at Renton Municipal Airport.
6. Lessor and Lessee agree that the Lessee shall retain ownership of the above
ground fuel tank(s) installed on the leased area at the normal expiration of the
term of this Lease (LAG-99-002), to wit, July 31, 2018, or at the end of executed
extensions thereof, if any, as provided with the Lease LAG-99-002, but in no case
later than July 31, 2028. Lessor and Lessee agree that the spill containment pad,
oil water separator and associated piping and electrical connections shall be
considered to be improvements and subject to Section 10 IlAPROVEMENTS of
LAG-99-002.
7. Lessor and Lessee do further agree that the difference between the CPI-U of
August 1, 2001 to July 31, 2004, is 7.2% (193.4-180.4=13/180.4=.072 or 7.2%).
This results in an annual rate increase from $0.3066 to $0.3287 per square foot
(.3066 x 1.072 = $0.3287); and

8. The Lessor and Lessee do hereby agree to an annual land rent of $11,700.08 for
the 35,595 square feet (35,595 x $0.3287 = $11,700.08) identified in Exhibit A-3;
and
9. Lessor and Lessee do hereby agree that the annual land rent rate in Paragraph 4
shall remain in effect until August 1, 2007, and, effective as of that date the rental
rate shall automatically be readjusted by and between the parties as specified in
Paragraph 3 of the Lease Agreement, using the increase of the Consumer Price
Index, and for each three (3) year period thereafter. Minimum base rental for any
extended period shall not be less than the current annual rental of $11,700.08; and
10. Lessor and Lessee do hereby further agree that the Consumer Price Index
information to be used for rental adjustments shall be the Consumer Price Index -
Urban (CPI-U) then in effect for all urban consumers, as published by the US
Department of Labor for the Seattle -Tacoma Metropolitan Area; and
11. Lessor and Lessee do hereby further agree that at least thirty (30) days prior to the
Rental Adjustment Date either party shall, if they desire to adjust the base land
rental rate for the ensuing three (3) year period by a means other than the
Consumer Price Index -Urban, provide to the other party a written request for
readjustment of the rental rate pursuant to RCW 14.08.120(5).
12. All other terms and conditions of the original Lease Agreement shall remain in
full force and effect.

SUMMARY OF ACTION:
The project started on July 20, 2004, and was completed on October 15, 2004. The original
contract amount was $640,739.38. Following contract award, Change Order #1 added extruded
curb work on Cedar Avenue South for $1,276.50 and Change Order #2 added paving of the
Springbrook Trail for $70,000 (trail work was requested and entirely funded by the Community
Services Department), bringing the contract total to $712,015.88. However, due primarily to
under -runs in asphalt overlay and removal quantities (mostly attributable to Powell Avenue South
work, which the City elected not to proceed with), the final contract amount was considerably less
at $677,246.62. The Street Overlay Program's total payment will be $337,262.42, the Arterial
Rehabilitation Program paid $193,915.98, Water Engineering paid $65,396.94, Wastewater
Engineering paid $10,671.28 and Community Services budgeted $70,000. There are sufficient
budget remaining to fund the final pay estimate from the Street Overlay Program (account number
317.012108).
STAFF RECOMMENDATION:
The Transportation Division recommends Council accept completion of the project, approve
payment of the Final Pay Estimate, and approve release of retainage for the full project in the total
amount of $33,271.61 after sixty (60) days, subject to the required authorization.

SUMMARY OF ACTION:
The project was awarded to Buno Construction, LLC., on April 26, 2004, for the amount of
$500,855.36. Construction started on June 1, 2004, and was completed on September 28, 2004,
with a final contract amount of $492,396.78. The decrease in the total project construction cost in
the amount of $8,458.58 (1.7%) is mainly due to the use of less import trench backfill materials
than estimated. There are sufficient funds in the Water Utility project budget to cover the final
pay estimate.
STAFF RECOMMENDATION:
The Utility Systems Division of the Planning/Building/Public Works Department recommends
that the project be accepted, the final pay estimate in the amount of $49,424.16 be approved, and
the retainage bond in the amount of $22,628.53 be released after 60 days, subject to receipt of all
required authorizations.

The project was awarded on July 7, 2003. Construction was started on August 18, 2003, and
was completed on September 1, 2004. The original contract amount was $607,321.60 and the
final contract amount is $857,534.55. The increase of the final contract amount is due to
relocation and redesign of the station because of conflicts discovered when construction began.
The increased cost of the project was discussed in January 2004, when the issue was brought to
Council as a `Request for Additional Budget Authority'. On January 26, 2004, Council
approved the additional budget authority.
The total Wastewater funds budgeted for this project were $1,357,000 of which $460,000 was from
the 2004 Wastewater Budget. Expenditures as of the end of September are $378,342.28 leaving a
balance of approximately $81,000 to cover the final pay estimate and the small amount of staff time

Smithers Avenue South Speed Pillow Installation

On November. 20, 2003, the Transportation Committee met and recommended implementation of
traffic delineators; removing turning restrictions, addition of a sidewalk, street overlay, and a
speed pillow on Smithers Avenue South: All of the improvements have been installed with the
exception of the speed pillow: Due to the narrow width of the street, a speed pillow cannot be
properly installed without creating a safety hazard ,
The Transportation/Aviation Comttee recommends concurrence in the staff recommendation
to instead construct a. speed hump using King County's speeificatigns, and install it in place of
the speed pillow as a demonstration ptoject. .

Seattle Public Utilities Broodstock Collection Facility
(October 14, 2002)
Seattle Public Utilities (SPU) is proposing to.build a sockeye broodstock collection facility on the
Cedar.River as a mitigation condition of their Habitat Conservation Plan. SPU's preferred location for
the collection facility is at the 1;-405 overpass in the City of Renton. The conceptual design of the
broodstock collection facility has been significantly scaled back and simplified to minimize impacts
and concerns.
Even with the proposed improvements to the broodstock facility there aremany questions about
potential impacts'and mitigation that -need to be discussed and ,wo2rked out before. the Committee can
recommend that -this facility be sited at the proposed 1 405 location 'The Utilities Committee
recommends concurrence with;the.PI' 4 nin.g/Building/Public;Wotks Department recommendation that
Council direct staff to engage"in Pdiscussions with SPU to resolve potential impacts and concerns

PROPERTY, KNOWN AS THE "MROCZEK PROPERTY," WITHIN THE
CITY OF RENTON FROM RESIDENTIAL 8 TO COMMERCIAL
NEIGHBORHOOD.
WHEREAS, under Chapter 2, Zoning Districts - Uses and Standards, of Title IV
(Development Regulations) of Ordinance No. 4260 known as the "Code of General Ordinances
of the City of Renton, Washington" as amended, and the maps and reports adopted in
conjunction therewith, the property herein below described has previously been zoned as
Residential 8; and
WHEREAS, the City of Renton initiated a proceeding for change of zone classification
of property adjacent to said property, and the owners asked that their property be included in the
rezone; and
WHEREAS, the matter of the Sunset Boulevard SW rezone was duly referred to the
Planning Commission for investigation, study, and public hearing, and a public hearing having
been held thereon on September 21 and September 28, 2004, and that matter having been duly
considered by the Planning Commission, and said zoning request being in conformity with the
City's Comprehensive Plan, as amended, and the City Council having duly considered all matters
relevant thereto on October 11, 2004, and all parties having been heard appearing in support
thereof or in opposition thereto;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON,
WASHINGTON, DO ORDAIN AS FOLLOWS:

SECTION I. The following described property in the City of Renton is hereby
rezoned to Commercial Neighborhood (CN), as hereinbelow specified. The Economic
Development, Neighborhoods, and Strategic Planning Department is hereby authorized and
directed to change the maps of the Zoning Ordinance, as amended, to evidence said rezoning, to

SECTION II. This ordinance shall be effective upon its passage, approval, and

AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON
ANNEXING CERTAIN TERRITORY OF THE CITY OF RENTON
(JOHNSON ANNEXATION; FILE NO. A-03-08)
WHEREAS, under the provisions of RCW 35A.14.120 as amended, a petition in writing
requesting that certain territory contiguous to the City of Renton, as described below, be annexed
to the City of Renton, was presented and filed with the City Clerk on or about December 19,
2003; and
WHEREAS, prior to the filing and circulation of said petition for annexation to the City
of Renton, the petitioning owners notified the City Council of their intention to commence such
proceedings as provided by law, as more particularly specified in RCW 35A.14.120, and upon
public hearing thereon, it having been determined and the petitioning owners having agreed to
assume their fair share of the pre-existing outstanding indebtedness of the City of Renton as it
pertains to the territory petitioned to be annexed; and to accept that portion of the City's
Comprehensive Plan as it pertains to the territory including the applicable Zoning Code relating
thereto; and
WHEREAS, the King County Department of Assessments has examined and verified the
signatures on the petition for annexation and determined signatures represent at least sixty
percent (60%) of the assessed value (excluding streets) of the area to be annexed, as provided by
law; and

WHEREAS, the Economic Development, Neighborhoods and Strategic Planning
Department of the City of Renton having considered and recommended the annexing of said
property to the City of Renton; and
WHEREAS, the City Council fixed April 19, 2004, as the time and place for public
hearing in the City Council Chambers, City Hall, Renton, Washington, upon the petition and
notice thereof having been given as provided by law; and
WHEREAS, pursuant to said notices, public hearings have been held at the time and
place specified in the notices, and the Council having considered all matters in connection with
the petition and further determined that all legal requirements and procedures of the law
applicable to the petition method for annexation have been met; and
WHEREAS, the King County Boundary Review Board having deemed the "Notice of
Intention" approved as of August 20, 2004; and
WHEREAS, the City of Renton is concurrently zoning the annexation site R-8, eight
units per net acre;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON,
WASHINGTON, DO ORDAIN AS FOLLOWS:
SECTION L The findings, recitals, and determinations are hereby found to be
true and correct in all respects. All requirements of the law in regard to the annexation by
petition method, including the provisions of RCW 35A.14.120, 130, 140 and 150, have been
met. It is further determined that the petition for annexation to the City of Renton of the property
and territory described below is hereby approved and granted; the following described property
being contiguous to the City limits of the City of Renton is hereby annexed to the City of

Renton, and such annexation to be effective on and after the approval, passage, and publication
of this Ordinance; and on and after said date the property shall constitute a part of the City of
Renton and shall be subject to all its laws and ordinances then and thereafter in force and effect,
the property being described as follows:

forth herein
[Said property, approximately 18.24 acres in area, is generally located south of
the centerline of SE 118t' Street, if extended, and east of the western edge of the
14fd Avenue SE right-of-way]
and the owners of the property within the annexation shall assume their fair share of the
outstanding indebtedness of the City of Renton as prescribed in RCW 35A.14.120 as it pertains
to the property, and the property shall be subject to the City's Comprehensive Plan and Zoning
Code.
SECTION H. This Ordinance shall be effective upon its passage, approval, and
five days after its publication.
A certified copy of this Ordinance shall be filed with the King County Council, State of
Washington, and as otherwise provided by law.
